    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="display:none"&gt;&amp;nbsp;&lt;/span&gt;&lt;span style="line-height:114%"&gt;El apartado&amp;nbsp;8.4. de la Resolución del&amp;nbsp;Presidente del Fondo de&amp;nbsp;Garantía Agraria&amp;nbsp;y Pesquera de&amp;nbsp;las&amp;nbsp;Islas Baleares&amp;nbsp;(FOGAIBA) de 26 de febrero de 2016 por la&amp;nbsp;que se aprueba la convocatoria&amp;nbsp;para el Fomento de la Producción Integrada, para el año 2016&amp;nbsp;(Prórroga 2021),&amp;nbsp;especifica&amp;nbsp;que la resolución&amp;nbsp;expresa&amp;nbsp;se notificará&amp;nbsp;a&amp;nbsp;los interesados mediante&amp;nbsp;su publicación en el&amp;nbsp;&lt;em&gt;Boletín Oficial de las&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;Islas Baleares&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;de acuerdo con los&amp;nbsp;términos&amp;nbsp;previstos en el artículo&amp;nbsp;45.2&amp;nbsp;de la Ley&amp;nbsp;39/2015, de 1&amp;nbsp;de octubre, procedimiento administrativo común de&amp;nbsp;las&amp;nbsp;administraciones públicas.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:114%"&gt;Los expedientes&amp;nbsp;han sido&amp;nbsp;tramitados&amp;nbsp;por el Fondo&amp;nbsp;de Garantía Agraria&amp;nbsp;y Pesquera de&amp;nbsp;las&amp;nbsp;Islas Baleares&amp;nbsp;(FOGAIBA) en cumplimiento de lo&amp;nbsp;dispuesto en el artículo&amp;nbsp;43&amp;nbsp;de&amp;nbsp;la Ley&amp;nbsp;39/2015, de 1 de octubre, procedimiento administrativo común de las&amp;nbsp;administraciones públicas.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:114%"&gt;El vicepresidente&amp;nbsp;en Materia Agraria del FOGAIBA, con fecha 13&amp;nbsp;de octubre&amp;nbsp;de 2022, firmó la siguiente resolución, &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;3.Resolución de la presidenta del Fondo de Garantía Agraria y Pesquera de las Illes Balears (FOGAIBA) de 30 de enero de 2021, por la que se aprueba la convocatoria, para el año 2021, de las ayudas para prorrogar los compromisos asumidos para el fomento de la producción integrada. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;4.Los órganos gestores del Servicio de Ayudas al Desarrollo Rural han realizado el control administrativo de las solicitudes y de la documentación aportada de acuerdo con las normas reguladoras de esta ayuda. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;5.Con fecha 7 de octubre de 2022 se notifica, mediante publicación en la página web http://www.caib.es, el informe propuesta provisional de concesión de la ayuda, emitida por el Servicio de Ayudas al Desarrollo Rural&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;.&lt;/em&gt;&amp;nbsp;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;6.Dentro del plazo establecido los interesados indicados en el Anexo 1 adjunto no se han presentado o no presentarán alegaciones, o bien si las han presentadas se han desestimado por seguir incumpliendo los requisitos.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;7. Teniendo en cuenta que el crédito existente cubre la totalidad de las peticiones de esta convocatoria, no deben aplicarse el apartado séptimo de la convocatoria.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;16.Orden del consejero de Agricultura, Medio Ambiente y Territorio de 19 de febrero de 2015, por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco del Programa de Desarrollo Rural de las Islas Baleares 2014-2020 . &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;17.Ley 3&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;/201&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;9&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;, de &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;3&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;1 de e&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;nero, agraria de las Islas Baleares. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;18.Decreto 65/2007, de 25 de mayo, de constitución, organización y funcionamiento del Organismo Pagador de los gastos del Fondo Europeo Agrícola de Garantía (FEAGA) y del Fondo Europeo Agrícola de Desarrollo Rural (FEADER), a la comunidad autónoma de las Islas Baleares BOIB núm. 082 de 2007; en virtud de la Orden de la consejera de Agricultura y pesca de 23 de diciembre de 2005, por la que se dispone la asunción de la ejecución de la política de mejora y fomento de los sectores agrario y pesquero por parte del Fondo de Garantía Agraria y Pesquera de las Illes Balears, establece en el artículo 1 que el FOGAIBA asume la ejecución de la política de la Consejería de Agricultura y Pesca en lo referente a la aplicación de las medidas de fomento y&lt;/em&gt;&amp;nbsp;&lt;em&gt;mejora de los sectores agrario y pesquero, a partir del 1 de enero de 2006. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;19.Ley 39/2015, de 1 de octubre del procedimiento administrativo común de las administraciones públicas.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;Propuesta de Resolución de concesión&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;Por todo ello, se informa &amp;nbsp;y se &lt;/em&gt;&lt;em&gt;propon&lt;/em&gt;&lt;em&gt;e&amp;nbsp;al vicepresidente del FOGAIBA que dicte una Resolución en los siguientes términos:&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;1.Conceder la ayuda solicitada a los beneficiarios por los importes y con los plazos detallados en el anexo 1, que son un total de &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;1&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;expediente y que comienza &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;y temina &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;con &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;JUAN FORTEZA PASCUAL&amp;nbsp;que suma un importe total de CUATRO MIL DOSCIENTOS SESENTA Y SEIS EUROS (4.266,00 euros), relativa a la línea de ayudas “Fomento de la producción integrada 2021 convocatoria 2016”. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2.Autorizar y disponer el gasto señalado en cada una de las personas beneficiarias con los porcentajes de cofinanciación detallados en el anexo 1. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;3.Determinar la superficie comprometida por persona beneficiaria y grupo de cultivo detallados en el anexo 1. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;4.Informar a los beneficiarios de que sus expedientes se encuentran a su disposición y consulta en el Servicio de Ayudas al Desarrollo Rural del FOGAIBA (calle de Reina Constança, nº 4 de Palma). &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;5.Publicar la resolución en el BOIB.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;Interposición de recursos&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;
