460 es es 668540 47247 2022-11-17 666588 text/html 47246 CAIB ![CDATA[Resolución de la Presidencia del Institut Mallorquí d'Afers Socials de fecha 24 de octubre de 2022 de bajas de ayudas económicas a familias acogedoras correspondiente al mes de octubre de 2022]] 2022-11-17 ![CDATA[<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>Antecedentes:</strong></span></span></span></p> <p><span style="color:#000000; font-family:&quot;Times New Roman&quot;,Times,serif">1. El artículo 70.8 del texto consolidado del Estatuto de Autonomía de las Islas Baleares, aprobado por la Ley Orgánica 1/2007, de 28 de febrero, de reforma del Estatuto de Autonomía de las Islas Baleares (BOE núm. 52 de 1 de marzo de 2007), otorga al Consell de Mallorca como propia la competencia en tutela, acogimiento y adopción de menores.</span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">2. La Ley 8/1997, de 18 de diciembre, de atribución de competencias en materia de tutela, acogida y adopción de menores (BOCAIB núm. 157 ext. de 20/12/1997), con el artículo 2 de los Estatutos del Institut Mallorquí d'Afers Socials aprobados en el Pleno del 1/04/2019 (BOIB núm. 67 de 18/05/2019), la Ley 9/2019, de 19 de febrero, de la atención y los derechos de la infancia i la adolescencia de las Islas baleares (BOIB núm. 26 de 28/02/2019), la Ley Orgánica 1/1996, de 15 de enero, de protección jurídica del menor y modificación parcial del Código Civil i de la LEC.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">3. Vista la resolución de la Presidencia del Institut Mallorquí d'Afers Socials (IMAS) de fecha 16 de marzo de 2018 relativa a las prestaciones económicas por acogimientos permanentes con familia extensa o aliena, temporales con familia extensa y temporales con familia aliena y por acogimientos preadoptivos (BOIB núm. 36, de 22 de marzo de 2018).</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">4. Vista la resolución de la Presidencia del Institut Mallorquí d'Afers Socials (IMAS) de fecha 28 de enero de 2022 relativa a la modificación de la resolución de 16 de marzo de 2018, de prestaciones económicas por acogimiento familiar permanente con familia extensa o aliena, temporales con familia extensa y temporales con familia aliena y por acogimientos preadoptivos, por la cual se actualizan los importes a percibir (BOIB núm. 18, de 3 de febrero de 2022).</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">5. El artículo 1.2 i) de la Ley 62/2003, de 30 de diciembre, de medidas fiscales, administrativas y de orden social, establece que están exentos de declaración del Impuesto sobre la Renta de las Personas Físicas las prestaciones económicas recibidas de instituciones públicas con motivo de la acogida de menores.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">6. Los ingresos que perciben las familias acogedoras en concepto de acogida de menores con medida de protección son renta exentas de acuerdo con lo que dispone el art. 7.i) de la Ley 35/2006, de 28 de diciembre, del IRPF.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">7. Según los dictámenes aprobados en las Comisiones Técnicas Económicas (CTE) que se llevan a cabo semanalmente donde se determinan los motivos por los cuales se conceden ayudas económicas a las familias acogedoras de menores, así como los motivos para dejar sin efecto las citadas ayudas.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">8. Y vista la propuesta anterior de la directora insular de Infancia y Familia de fecha 20 de octubre<span style="color:#000000"> </span>de 2022.</span></span></span></p> <p><strong>F</strong><span style="color:#000000; font-family:&quot;Times New Roman&quot;,Times,serif"><strong>undamentos de derecho</strong></span></p> <p><span style="color:#000000; font-family:&quot;Times New Roman&quot;,Times,serif">El art. 7.2.7 de los Estatutos otorgan a la Presidencia del IMAS la competencia para resolver el procedimiento de ayudas y prestaciones.</span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Por todo lo expuesto anteriormente,</span></span></span></p> <p style="text-align:center"><strong>RESUELVO</strong></p> <p><span style="color:#000000; font-family:&quot;Times New Roman&quot;,Times,serif"><strong>Primero. -</strong> Dar de baja a las personas detalladas en la lista adjunta como perceptoras de las ayudas económicas por acogimiento familiar, de acuerdo con la motivación que consta en la relación contable </span><span style="color:#000000; font-family:&quot;Times New Roman&quot;,Times,serif"><strong>Q/2022/1229</strong></span><span style="color:#000000; font-family:&quot;Times New Roman&quot;,Times,serif">, por un importe total de </span><span style="color:#000000; font-family:&quot;Times New Roman&quot;,Times,serif"><strong>30.120,00 €, </strong></span><span style="color:#000000; font-family:&quot;Times New Roman&quot;,Times,serif">distribuidos de la siguiente manera: </span><span style="color:#000000; font-family:&quot;Times New Roman&quot;,Times,serif"><strong>11.295,00 € </strong></span><span style="color:#000000; font-family:&quot;Times New Roman&quot;,Times,serif">con cargo a la partida presupuestaria </span><span style="color:#000000; font-family:&quot;Times New Roman&quot;,Times,serif"><strong>20.23135.48000, 11.580,00 € </strong></span><span style="color:#000000; font-family:&quot;Times New Roman&quot;,Times,serif">con cargo a la partida presupuestaria</span><span style="color:#000000; font-family:&quot;Times New Roman&quot;,Times,serif"><strong> 20.23135.48001 </strong></span><span style="color:#000000; font-family:&quot;Times New Roman&quot;,Times,serif">y </span><span style="color:#000000; font-family:&quot;Times New Roman&quot;,Times,serif"><strong>7.245,00 € </strong></span><span style="color:#000000; font-family:&quot;Times New Roman&quot;,Times,serif">con cargo a la partida presupuestaria </span><span style="color:#000000; font-family:&quot;Times New Roman&quot;,Times,serif"><strong>20.23135.48002 </strong>del presupuesto de gastos del IMAS de 2022.</span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000000"><strong>Segundo.-</strong> Publicar esta resolución en el BOIB.</span></span></span></span></p> <p><span style="color:#000000; font-family:&quot;Times New Roman&quot;,Times,serif">Esta resolución no pone fin a la vía administrativa y contra ella se puede interponer, de acuerdo con el artículo 28.1 de los Estatutos del Institut Mallorquí d'Afers Socials (BOIB núm. 67, de 18 de mayo de 2019) aprobados por acuerdo del Pleno del Consell de Mallorca de 11 de abril de 2019, recurso de alzada ante el Consejo Ejecutivo del Consell de Mallorca, en el plazo de un mes, contado a partir del día siguiente al de la notificación de la presente resolución, de acuerdo con los artículos 121 y 122 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas, sobre el objeto y plazo de este recurso.</span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Contra la desestimación expresa del recurso de alzada podrá interponerse recurso contencioso administrativo ante el Juzgado Contencioso Administrativo, en el plazo de dos meses, contados a partir del día siguiente al de la notificación de la desestimación del mencionado recurso.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Contra la desestimación por silencio del recurso de alzada podrá interponerse recurso contencioso administrativo ante el Juzgado Contencioso Administrativo, en cualquier momento a partir del día siguiente a la desestimación presunta (tres meses desde la interposición del recurso sin que se haya notificado la resolución).</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">No obstante lo anterior, se puede ejercitar, en su caso, cualquier otro recurso que se estime pertinente.
