    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;El apartado&amp;nbsp;8.4. de la Resolución del&amp;nbsp;Presidente del Fondo de&amp;nbsp;Garantía Agraria&amp;nbsp;y Pesquera de&amp;nbsp;las&amp;nbsp;Islas Baleares&amp;nbsp;(FOGAIBA) de 19 de febrero de 2015 por la&amp;nbsp;que se aprueba la convocatoria&amp;nbsp;para el Fomento de la Producción Integrada, para el año 2015&amp;nbsp;(Prórroga 2021), especifica&amp;nbsp;que la resolución&amp;nbsp;expresa&amp;nbsp;se notificará&amp;nbsp;a&amp;nbsp;los interesados mediante&amp;nbsp;su publicación en el&amp;nbsp;&lt;em&gt;Boletín Oficial de las&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;Islas Baleares&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;de acuerdo con los&amp;nbsp;términos&amp;nbsp;previstos en el artículo&amp;nbsp;45.2&amp;nbsp;de la Ley&amp;nbsp;39/2015, de 1&amp;nbsp;de octubre, procedimiento administrativo común de&amp;nbsp;las&amp;nbsp;administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;Los expedientes&amp;nbsp;han sido&amp;nbsp;tramitados&amp;nbsp;por el Fondo&amp;nbsp;de Garantía Agraria&amp;nbsp;y Pesquera de&amp;nbsp;las&amp;nbsp;Islas Baleares&amp;nbsp;(FOGAIBA) en cumplimiento de lo&amp;nbsp;dispuesto en el artículo&amp;nbsp;43&amp;nbsp;de&amp;nbsp;la Ley&amp;nbsp;39/2015, de 1 de octubre, procedimiento administrativo común de las&amp;nbsp;administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;El vicepresidente&amp;nbsp;en Materia Agraria&amp;nbsp;del FOGAIBA, con fecha 4&amp;nbsp;de noviembre&amp;nbsp;de 2022, firmó la siguiente resolución, &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;1.Con fecha 26 de febrero de 2015, se publicó en el BOIB núm. 29 la Orden del Conse&lt;/em&gt;&lt;em&gt;ller de Agricultura, Medio Ambiente y Territorio de 19 de febrero de 2015, por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco del Programa de Desarrollo Rural de las Islas Baleares 2014- 2020. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;2.Co&lt;/em&gt;&lt;em&gt;n fecha de 28 de febrero de 2015 se publicó en el BOIB núm. 30, la Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) por la que se aprueba la convocatoria para el año 2015 de las ayudas destinadas al &lt;/em&gt;&lt;em&gt;Fomento de la producción integrada.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;3.Con fecha 11 de junio de 2015, se publicó el BOIB núm. 87, la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) por la que se modifica la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares por la que se aprueba la convocatoria por el 2015 de las ayudas destinadas al fomento de la producción integrada. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;4.Co&lt;/em&gt;&lt;em&gt;n fecha de 7 de mayo de 2016, se publicó en el BOIB núm. 57,la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIB&lt;/em&gt;&lt;em&gt;A) por la que se modifica la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA), de 27 de febrero de 2015 , por la que se aprueba la convocatoria para el año 2015 de las ayudas destinadas al fomento de la producción integrada. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;5.Co&lt;/em&gt;&lt;em&gt;n fecha de 30 de enero de 2021, se publicó en el BOIB n&lt;/em&gt;&lt;em&gt;úm.13 la Resolución de la presidenta del Fondo de Garantía Agraria y Pesquera de las Illes Balears (FOGAIBA) por la que se aprueba la convocatoria, por la año 2021, de las ayudas para prorrogar por segundo año los compromisos asumidos para el fomento de la producción integrada en la convocatoria de 2015. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;6.Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA), de 22 de julio de 2016 (BOIB núm 95 de 28 de julio) por la que se modifican los créditos y las cofinanciaciones de diversas convocatorias de subvenciones del FOGAIBA, correspondientes a las medidas contempladas en el Programa de Desarrollo Rural de las Islas Baleares 2014-2020. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;7.Resolución de la presidenta del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA), de 12 de febrero de 2022 (BOIB núm 23 de 12 de febrero) por la que se modifican los créditos y las cofinanciaciones de diversas convocatorias de subvenciones del FOGAIBA, correspondientes a las medidas contempladas en el Programa de Desarrollo Rural de las Islas Baleares 2014-2020 &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;8.Con fecha 30 de enero de 2021 se publicó, en el BOIB núm. 13, la Resolución de la presidenta del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) por la que se aprueba la convocatoria, para el año 2021, de las ayudas para prorrogar los compromisos asumidos para el fomento de la producción integrada. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;9.Los órganos gestores del Servicio de Ayudas al Desarrollo Rural han realizado el control administrativo de las solicitudes y de la documentación aportada de acuerdo con las normas reguladoras de esta ayuda. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;10.Una vez evaluadas las solicitudes de ayuda por los órganos gestores y de acuerdo con los criterios de elegibilidad establecidos, los interesados que figuran en el Anexo I no cumplen con los requisitos establecidos en la convocatoria. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;11.Con fecha 14 de enero de 2022 se notifica, mediante publicación en la página web http://www.caib.es, el informe desfavorable y la propuesta provisional de denegación de la ayuda, emitida por Servía de Ayudas al Desarrollo Rural a los interesados, concediéndoles un plazo de 10 días para presentar las alegaciones oportunas. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;12.Dentro del plazo establecido, los interesados indicados en el Anexo I adjunto no han presentado alegaciones, o si las han presentadas se han desestimado por seguir incumpliendo los requisitos.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;Fundamentos de derecho&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;6.Reglamento de ejecución (UE) núm. 808/2014 de la Comisión, de 17 de julio de 2014, por el que se establecen disposiciones de aplicación del Reglamento (UE) núm. 1305/2013 del Parlamento Europeo y del Consejo, relativo a la ayuda al desarrollo rural a través del Fondo Europeo Agrícola de Desarrollo Rural (FEADER). &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;7.Reglamento de ejecución (UE) núm. 809/2014 de la Comisión, de 17 de julio de 2014, por el que se establecen disposiciones de aplicación del Reglamento (UE) núm. 1306/2013 del Parlamento Europeo y del Consejo, en lo que respecta al sistema integrado de gestión y control, las medidas de desarrollo rural y la condicionalidad. &lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;8.Real decreto 1075/2014, de 19 de diciembre, sobre la aplicación a partir de 2015 de los pagos directos a la agricultura y la ganadería y otros regímenes de ayuda, así como sobre la gestión y control de los pagos directos y de los pagos al desarrollo rural. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;9.Real decreto 1078/2014, de 19 de diciembre, por el que se establecen las normas de condicionalidad que deben cumplir los beneficiarios que reciban pagos directos o determinadas primas anuales de desarrollo rural, o pagos en virtud de los programas de apoyo a la reestructuración y reconversión o de apoyo a la cosecha en verde, en el sector vitivinícola. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;14.Orden del conseller de Agricultura, Medio Ambiente y Territorio de 19 de febrero de 2015, por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco del Programa de Desarrollo Rural de las Islas Baleares 2014-2020. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;15.Ley 3/2019, de 31 de enero, agraria de las Islas Baleares. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;16.Decreto 65/2007, de 25 de mayo, de constitución, organización y funcionamiento del Organismo Pagador de los gastos del Fondo Europeo Agrícola de Garantía (FEAGA) y del Fondo Europeo Agrícola de Desarrollo Rural (FEADER), a la comunidad autónoma de las Islas Baleares BOIB núm. 082 de 2007; en virtud de la Orden de la consell&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;era de Agricultura y pesca de 23 de diciembre de 2005, por la que se dispone la asunción de la ejecución de la política de mejora y fomento de los sectores agrario y pesquero por parte del Fondo de Garantía Agraria y Pesquera de las Islas Baleares, establece en el artículo 1 que el FOGAIBA asume la ejecución de la política de la Conse&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;llería de Agricultura y Pesca referente a la aplicación de las medidas de fomento y mejora de los sectores agrario y pesquero, a partir del 1 de enero de 2006. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;17.Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;Propuesta de Resolución de denegación&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;Por todo ello, &lt;em&gt;se informa desfavorablemente y se propone al vicepresidente en Materia Agraria del FOGAIBA que dicte resolución en los siguientes términos: &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;1.Denegar la solicitud de ayuda a las personas beneficiarias detalladas en el anexo I. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2.Declarar concluido el procedimiento y proceder al archivo de los expedientes detallados en el Anexo 1 &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;3.Notificar la resolución a los interesados del Anexo 1.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;Interposición de recursos&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
