El 30 de diciembre de 2021 se publicó la convocatoria pública de subvenciones para el año 2022 para el fomento de instalaciones de energía solar fotovoltaica y microeólica dirigida a particulares y comunidades de propietarios dentro del Programa Operativo FEDER 2021-2027 mediante la Resolución del consejero de Transición Energética, Sectores Productivos y Memoria Democrática de 21 de diciembre de 2021.</span></span></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm"><span style="line-height:1"><span style="color:black">2. Las personas o entidades que figuran en el anexo de esta Resolución presentaron a la Consejería de Transición Energética, Sectores Productivos y Memoria Democrática una solicitud de subvención en el marco de la convocatoria.</span></span></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm"><span style="line-height:1"><span style="color:black">3. A los titulares de los expedientes que aparecen en el anexo se les concedió una subvención en el marco de la convocatoria por los importes que también se indican, todo de acuerdo con las respectivas resoluciones estimatorias del consejero de Transición Energética, Sectores Productivos y Memoria Democrática, con fecha y número de BOIB indicados en el anexo.</span></span></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm"><span style="line-height:1"><span style="color:black">4. Al mismo tiempo, se resolvió autorizar y disponer un gasto a favor de los beneficiarios por los importes concedidos, ambos indicados en el anexo, con cargo a la partida presupuestaría</span> <span style="color:black">2022/G/731A01/78000/00/19701/31111</span> <span style="color:black">del ejercicio presupuestario 2022.</span></span></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm"><span style="line-height:1"><span style="color:black">5. Los titulares de los expedientes que aparecen en el anexo han presentado un escrito en el que indican que renuncian a la subvención mencionada.</span></span></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm"><span style="line-height:1"><strong>Fundamentos de derecho</strong></span></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm"><span style="line-height:1"><span style="color:black">1. El consejero de Transición Energética, Sectores Productivos y Memoria Democrática es el órgano competente para resolver este procedimiento, dada la estructura orgánica del Gobierno de las Illes Balears y de acuerdo con la Orden de la consejera de Comercio, Industria y Energía de 15 de mayo de 2008 por la que se establecen las bases reguladoras para la concesión de subvenciones en materia de energía.</span></span></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm"><span style="line-height:1"><span style="color:black">2. La Ley&nbsp;38/2003, de 17 de noviembre, General de Subvenciones.</span></span></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm"><span style="line-height:1"><span style="color:black">3. El Decreto Legislativo&nbsp;2/2005, de 28 de diciembre, por el que se aprueba el texto refundido de la Ley de Subvenciones (BOIB n.º&nbsp;196, de 31 de diciembre de 2005).</span></span></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm"><span style="line-height:1"><span style="color:black">4. El artículo&nbsp;94 de la Ley&nbsp;39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas, prevé que la Administración, en el supuesto de renuncia de la persona interesada a sus derechos, aceptará la renuncia completamente y resolverá el procedimiento declarando esta circunstancia, con indicación de los hechos producidos y las normas aplicables.</span></span></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm"><span style="line-height:1"><span style="color:black">5. La Resolución del consejero de Transición Energética, Sectores Productivos y Memoria Democrática de 21 de diciembre de 2021 por la que se aprueba, mediante el procedimiento de gasto anticipado, la convocatoria pública de subvenciones para el año 2022 para el fomento de instalaciones de energía solar fotovoltaica y microeólica dirigida a particulares y comunidades de propietarios dentro del Programa Operativo FEDER 2021-2027 (BOIB n.º&nbsp;180, de 30 de diciembre de 2021).</span></span></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm"><span style="line-height:1"><span style="color:black">Por todo ello, dicto la siguiente</span></span></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm; text-align:center"><span style="line-height:1"><strong>Resolución</strong></span></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm"><span style="line-height:1"><span style="color:black">1. Aceptar la renuncia a las subvenciones presentadas por los beneficiarios de los expedientes que aparecen en el anexo.</span></span></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm"><span style="line-height:1"><span style="color:black">2. Revocar la concesión de las subvenciones detalladas en el anexo y por los importes que en él se indican.</span></span></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm"><span style="line-height:1"><span style="color:black">3. Autorizar y disponer negativamente el gasto a favor de los beneficiarios por los importes detallados en el anexo con cargo a la partida presupuestaria 2022/G/731A01/78000/00/19701/31111.</span></span></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm"><span style="line-height:1"><span style="color:black">4. Declarar concluido el procedimiento y por tanto, archivar el expediente.</span></span></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm"><span style="line-height:1"><span style="color:black">5. Publicar esta Resolución en el <em>Boletín Oficial de las Illes Balears</em>.</span></span></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm"><span style="line-height:1"><strong>Interposición de recursos</strong></span></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm"><span style="line-height:1"><span style="color:black">Contra esta Resolución, que agota la vía administrativa, se puede interponer un recurso de reposición ante el consejero de Transición Energética, Sectores Productivos y Memoria Democrática, en el plazo de un mes a contar desde el día siguiente de haber recibido la notificación, de acuerdo con el artículo&nbsp;124 de la Ley&nbsp;39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas, y el artículo&nbsp;57 de la Ley&nbsp;3/2003, de 26 de marzo, de Régimen Jurídico de la Administración de la Comunidad Autónoma de las Illes Balears.</span></span></p> <p style="margin-bottom:10pt;
