&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;1. El 3 de julio de 2021, se publicó la convocatoria pública de subvenciones para actuaciones de apoyo a la movilidad eléctrica (Programa MOVES&amp;nbsp;III)&lt;strong&gt;&lt;em&gt; &lt;/em&gt;&lt;/strong&gt;mediante la Resolución del consejero de Transición Energética, Sectores Productivos y Memoria Democrática de 28 de junio de 2021&lt;/span&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;2. La Dirección General de Energía y Cambio Climático concedió una subvención a las personas o entidades que figuran en el anexo de esta Resolución en el marco de la convocatoria &lt;span style="color:black"&gt;para actuaciones de apoyo a la movilidad eléctrica.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;3. Las personas o entidades que figuran en el anexo aportaron la documentación requerida para la justificación de la realización de las actuaciones subvencionadas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;4. El técnico de la Dirección General de Energía y Cambio Climático examinó la documentación aportada y emitió un informe desfavorable a la justificación de los expedientes descritos en el anexo con la motivación que figura en este anexo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;5. El 1 de agosto de 2022, se emitió una propuesta de revocación de la subvención del director general de Energía y Cambio Climático (BOIB nº 103, de 6 de agosto de 2022).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;6. El 23 de agosto de 2022, la entidad Knife Mecanic SL, titular del expediente MOVESIII-285/2021, presentó alegaciones a la propuesta de revocación de la subvención. Una vez valorada la documentación presentada se emitió un informe técnico desestimando las alegaciones, dado que la documentación aportada incumple el punto 4.1. &lt;em&gt;a) i c) &lt;/em&gt;de la convocatoria pública de referencia.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Las letras &lt;em&gt;a)&lt;/em&gt; y c) del punto 4.1 de la convocatoria establecen que:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;a)&lt;/em&gt; Las inversiones objeto de la solicitud se tienen que llevar a cabo en el ámbito territorial de las Illes Balears y se deben realizar dentro del periodo siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li style="margin: 0px 0px 0px 40px;"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Los beneficiarios indicados en el apartado 2.1 de esta convocatoria con las letras &lt;em&gt;a),&lt;/em&gt; &lt;em&gt;b), c)&lt;/em&gt; y &lt;em&gt;f)&lt;/em&gt;: desde el 10 de abril de 2021 hasta el plazo que fije la resolución de otorgamiento, que como máximo será de doce meses a contar desde la fecha de la notificación de la resolución de concesión.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li style="margin: 0px 0px 0px 40px;"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Los beneficiarios indicados en el apartado 2.1 de esta convocatoria de las letras &lt;em&gt;d)&lt;/em&gt;, &lt;em&gt;e)&lt;/em&gt; y &lt;em&gt;g)&lt;/em&gt;: desde el día de la presentación de la solicitud hasta el plazo que fije la resolución de otorgamiento, que como máximo será de doce meses a contar desde la fecha de la notificación de la resolución de concesión.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Computa como fecha de solicitud la de entrada en el Registro electrónico del trámite específico de acuerdo con lo que establece el apartado decimoséptimo de esta convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;c)&lt;/em&gt; Las facturas y el pago de la inversión, incluyendo el abono de posibles cantidades por anticipado o bajo cualquier otro concepto, deben ser desde el 10 de abril de 2021, para los beneficiarios indicados en el apartado 2.1 de esta convocatoria con las letras &lt;em&gt;a)&lt;/em&gt;, &lt;em&gt;b)&lt;/em&gt;, &lt;em&gt;c)&lt;/em&gt; y &lt;em&gt;f)&lt;/em&gt; , o posteriores a la fecha del registro de la solicitud, para los beneficiarios indicados en el apartado 2.1 de esta convocatoria con las letras &lt;em&gt;d)&lt;/em&gt;, &lt;em&gt;e)&lt;/em&gt; y &lt;em&gt;g)&lt;/em&gt; .&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;7. El 23 de agosto de 2022, el señor Damián Carlos de Luque Comas, titular del expediente MOVESIII-896/2021, presentó alegaciones a la propuesta de revocación de la subvención. Una vez valorada la documentación presentada se emitió un informe técnico desestimando las alegaciones, dado que la documentación aportada incumple el punto 4.2g&lt;em&gt;) y 11.3.1c)&lt;/em&gt; de la convocatoria pública de referencia. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;La letra &lt;em&gt;g) &lt;/em&gt;del punto 4.2 de la convocatoria establece que:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Los vehículos M1 y N1, que se acojan en el programa de incentivos, tienen que contar con un descuento de al menos 1.000 euros en la factura de venta por parte del fabricante/importador o punto de venta del vehículo adquirido, que se tiene que trasladar al beneficiario de la ayuda. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;La letra&lt;em&gt; f) &lt;/em&gt;del punto 11.3.1 de la convocatoria establece que:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;En la factura debe constar la matrícula o el número de bastidor, la marca, el modelo y la versión del vehículo adquirido, y un descuento por parte del fabricante/importador o punto de venta de al menos 1.000 euros para la adquisición de vehículos de categorías M1 y N1, que tendrá que reflejarse antes de la aplicación del IVA. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;En la facturada modificada que el interesado aporta en las alegaciones, se aplica un descuento de 1.000€ ficticio, puesto que también se encarece en 1.000€ el precio inicial del vehículo antes de aplicar los impuestos. Tanto en la factura aportada inicialmente como en la modificada el precio final del vehículo después de aplicar los impuestos es el mismo, y por tanto no hay ningún descuento. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;8. En fecha 22 de agosto de 2022 el señor Manuel Iglesias March, en calidad de administrador de la entidad ARC Sistemes Electrics, SL presentó alegaciones contra la revocación de la subvención. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;No obstante, no fue hasta el día 9 de septiembre de 2022 que este escrito tuvo entrada en la Consejería de Transición Energética, Sectores Productivos y Memoria Democrática (GOIBE 507172/2022).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;9. En fecha 30 de agosto de 2022 se publicó en el BOIB n.º&amp;nbsp;114 la Resolución del consejero de Transición Energética, Sectores Productivos y Memoria Democrática por la que se revocan las subvenciones en el marco de la convocatoria pública de subvenciones para actuaciones de apoyo a la movilidad eléctrica (Programa MOVES III) en el marco del Plan de Recuperación, Transformación y Resiliencia europeo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;10. Como que en la fecha en la que se dictó y publicó la Resolución no se tenía conocimiento de las alegaciones del solicitante, en la Resolución de revocación de 25 de agosto de 2022 (BOIB n.º&amp;nbsp;114, de 30 de agosto de 2022), no se tuvieron en cuenta y, por tanto, estas no fueron resueltas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;11. Por el motivo descrito en el antecedente anterior, en fecha 25 de octubre de 2022 se dictó la Resolución de revocación de la Resolución del consejero de Transición Energética, Sectores Productivos y Memoria Democrática de 25 de agosto de 2022 por la cual se revocan las subvenciones en el marco de la convocatoria pública de subvenciones para actuaciones de apoyo a la movilidad eléctrica (Programa MOVES III) en el marco del Plan de Recuperación, Transformación y Resiliencia europeo (BOIB n.º 141, de 1 de noviembre de 2022). &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;12. En fecha 26 de octubre de 2022, una vez valorada la documentación presentada por la entidad ARC Sistemes Electrics, SL (MOVESIII-317/2021), se emitió un informe técnico desestimando las alegaciones , dado que la documentación aportada incumple el punto 4.1.a) y c) de la convocatoria pública de referencia. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Las letras &lt;em&gt;a)&lt;/em&gt; y c) del punto 4.1 de la convocatoria establecen que:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;a)&lt;/em&gt; Las inversiones objeto de la solicitud se tienen que llevar a cabo en el ámbito territorial de las Illes Balears y se deben realizar dentro del periodo siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;li style="margin: 0px 0px 0px 40px;"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Los beneficiarios indicados en el apartado 2.1 de esta convocatoria de las letras &lt;em&gt;d)&lt;/em&gt;, &lt;em&gt;e)&lt;/em&gt; y &lt;em&gt;g)&lt;/em&gt;: desde el día de la presentación de la solicitud hasta el plazo que fije la resolución de otorgamiento, que como máximo será de doce meses a contar desde la fecha de la notificación de la resolución de concesión.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Computa como fecha de solicitud la de entrada en el Registro electrónico del trámite específico de acuerdo con lo que establece el apartado decimoséptimo de esta convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Fundamentos de derecho&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;1. El consejero de Transición Energética, Sectores Productivos y Memoria Democrática es el órgano competente para resolver este procedimiento, dada la estructura orgánica del Gobierno de las Illes Balears y de acuerdo con la Orden de la consejera de Comercio, Industria y Energía de 15 de mayo de 2008 por la que se establecen las bases reguladoras para la concesión de subvenciones en materia de energía.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;2. El Decreto Legislativo&amp;nbsp;2/2005, de 28 de diciembre, por el que se aprueba el Texto refundido de la Ley de Subvenciones (BOIB núm.&amp;nbsp;196, de 31 de diciembre de 2005).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;3. La Orden de la consejera de Comercio, Industria y Energía de 15 de mayo de 2008 por la que se establecen las bases reguladoras para la concesión de subvenciones en materia de energía (BOIB núm.&amp;nbsp;72, de 24 de mayo de 2008).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;4. La Resolución de consejero de Transición Energética, Sectores Productivos y Memoria Democrática de 28 de junio de 2021 por la que se aprueba la convocatoria pública de subvenciones para actuaciones de apoyo a la movilidad eléctrica (Programa MOVES&amp;nbsp;III) en el marco del Plan de Recuperación, Transformación y Resiliencia europeo (BOIB núm.&amp;nbsp;88, de 3 de julio de 2021).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Por todo ello, dicto la siguiente&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Resolución&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;1. Revocar la subvención concedida a los beneficiarios que figuran en el anexo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;2. Autorizar y disponer negativamente el gasto a favor de los beneficiarios por los importes detallados en el anexo con cargo a la partida presupuestaria que también figura en él.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;3. Declarar concluido el procedimiento y, por lo tanto, archivar los expedientes indicados en el anexo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;4. Publicar esta Resolución en el &lt;em&gt;Boletín Oficial de las Illes Balears&lt;/em&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;div style="page-break-after:always"&gt;&lt;span style="display:none"&gt;&amp;nbsp;&lt;/span&gt;&lt;/div&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Interposición de recursos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Contra esta resolución, que agota la vía administrativa, se puede interponer un recurso potestativo de reposición ante el consejero de Transición Energética, Sectores Productivos y Memoria Democrática en el plazo de un mes a contar desde el día siguiente de su publicación, de acuerdo con los artículos&amp;nbsp;123 y 124 de la Ley&amp;nbsp;39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas, y el artículo&amp;nbsp;57 de la Ley&amp;nbsp;3/2003, de 26 de marzo, de Régimen Jurídico de la Administración de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;También se puede interponer directamente un recurso contencioso‑administrativo ante la Sala de lo Contencioso-administrativo del Tribunal Superior de Justicia de las Illes Balears en el plazo de dos meses a contar desde el día siguiente de la publicación de la resolución, de acuerdo con el artículo&amp;nbsp;46 de la Ley&amp;nbsp;29/1998, de 13 de julio, reguladora de la Jurisdicción Contencioso-administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;/p&gt;
