Estimar las alegaciones formuladas en fecha 18 de julio de 2022 por el sr. Estimar las alegaciones formuladas en fecha 17 de agosto de 2022 por el sr. José Sevilla Solera, en representación de Dª. Desestimar la solicitud de suspensión del inicio del procedimiento expropiatorio en beneficio del Ajuntament de Calvià, solicitada por la entidad ABAQUA.</em></span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><em>5. Entender definitivamente aprobado el «Proyecto renovación derivación Guixera 3-Son Ferrer-Fase II» y la relación concreta e individualizada de bienes y derechos afectados.</em></span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><em>6. Consignar en la Caja General de Depósitos el importe de TRESCIENTOS VEINTINUEVE EUROS CON NUEVE CÉNTIMOS (329,09 €), a repartir entre todos los afectados, tanto en lo que se refiere a la constitución de las servidumbres como por la ocupación temporal para la ejecución de las obras.</em></span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><em>7. Remitir el expediente al Consejo de Gobierno de les Illes Balears para la declaración de urgencia de la ocupación de los bienes y derechos a expropiar.</em></span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><em>8. Notificar la presente resolución a las personas interesadas.</em></span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><em>9. Dar cuenta de la presente resolución al Pleno de la Corporación para su ratificación, previo dictamen de la Comisión Informativa de Asuntos Generales, en la primera sesión que se celebre y en Secretaría para su debida constancia en el Libro de Decretos y Resoluciones”.</em></span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Contra este acuerdo, se puede interponer, con carácter potestativo, recurso de reposición ante el Pleno de la Corporación, de acuerdo con lo que dispone el art. 123 de la Ley 39/2015, de 1 de octubre, de procedimiento administrativo común de las administraciones públicas. El plazo para interponerlo es de un mes a contar desde el día siguiente a la recepción de la presente notificación, en cuyo caso no se puede interponer recurso contencioso administrativo hasta que se haya resuelto expresamente el de reposición o se haya producido la desestimación presunta del mismo.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">El recurso de reposición deberá presentarse en el Registro General de este Ayuntamiento o en las dependencias y medios a que se refiere el art. 16.4 de la Ley 39/2015 antes mencionada, y se entenderá desestimado cuando no se resuelva y notifique en el plazo de un mes, a contar desde el día siguiente de su interposición, en cuyo caso queda expedita la vía contenciosa administrativa.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">De no utilizar el recurso potestativo de reposición, es necesario interponer directamente recurso contencioso administrativo, de acuerdo con lo que establece el artículo 123 anteriormente mencionado, y los artículos 45 y siguientes de la Ley 29/1998, de 13 de julio, reguladora de la Jurisdicción contencioso-administrativa, ante los Juzgados de lo Contencioso-Administrativo de Palma de Mallorca en el plazo de dos meses, a contar desde el día siguiente de la recepción de la presente notificación.
