    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El apartado 9.3 de la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 26 de febrero de 2016 &amp;nbsp;por la cual se convocan subvenciones para el Fomento de la Producció Integrada, para el año 2016&amp;nbsp;(Prórroga 2021), especifica que la resolución expresa se notificará a las personas interesadas mediante su publicación en el &lt;em&gt;Boletín Oficial de las Islas Baleares&lt;/em&gt;&amp;nbsp;de acuerdo con los términos que prevee el artículo 45.2 de la Ley 39/2015, d'1 d'octubre, del Procedimiento Administrativo Común de las Administraciones Públicas.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los expedientes han sido tramitados por el Fondo de Garantia Agraria y Pesquera de las Islas Baleares (FOGAIBA), en cumplimiento del que dispone el artículo 43 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El vicepresidente en Materia Agraria del FOGAIBA, con fecha de 26&amp;nbsp;de octubre&amp;nbsp;de 2022, dicta lo siguiente:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;1.Con fecha 26 de febrero de 2015, se publicó en el BOIB núm. 29 la Orden del consejero de Agricultura, Medio Ambiente y Territorio de 19 de febrero de 2015, por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco del Programa de Desarrollo Rural de las Illes Balears 2014- 2020.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;2.Con fecha 1 de marzo de 2016 se publicó, en el BOIB núm. 28, la Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) por la que se aprueba la convocatoria para el año 2016 de las ayudas destinadas al fomento de la producción integrada. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;3.Con fecha 30 de enero de 2021 se publicó, en el BOIB núm. 13, la Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) por la que se aprueba la convocatoria para el año 2021 de las ayudas para prorrogar los compromisos asumidos para el fomento de la producción integrada en la convocatoria del año 2016.&lt;/em&gt;&amp;nbsp;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;4.Una vez analizada toda la documentación, el vicepresidente en materia agraria del FOGAIBA resolvió desfavorablemente la concesión de la ayuda a SON MARRANO SL con CIF B077728181, entre otros, que figuran en el Anexo de la resolución de denegación, Rd2 de fecha 21 de julio de 2022 (BOIB núm. 116 de fecha 3 de septiembre de 2022). Se comprobó que el interesado no cumplía con el compromiso de la convocatoria contemplado en el apartado noveno, punto 1, letra d) de participar durante el período comprometido (2016-2021) en actividades de formación relacionadas con la producción integrada con una duración mínima de 25 horas. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;5.Los órganos gestores han detectado un error en la denegación de la ayuda a SON MARRANO SL, por tanto, procede su revisión, y se estima oportuno promover de oficio la revocación parcial de la resolución de denegación antes mencionada, ya que, y según consta en las bases de datos del FOGAIBA, en fecha 20 de junio de 2022 el jefe de Servicio de Agricultura de la Dirección General de Agricultura, Ganadería y Desarrollo Rural de la Conselleria de Agricultura, Pesca y Alimentación del Gobierno de las Islas Baleares certificó que la Dirección General, dentro de sus competencias, gestiona, coordina y tutela todos los tratamientos que se realizan en la finca de SON MARRANO SL, quedando suficientemente acreditada la formación técnica de 25 horas relacionada con la materia, y de esta forma cumpliendo con el compromiso por el que se denegó la ayuda. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;6.El artículo 109.1 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, determina que las administraciones públicas podrán revocar, mientras no haya transcurrido el plazo de prescripción, sus actos de gravamen o desfavorables, siempre que tal revocación no constituya dispensa o excepción no permitida por las leyes, ni sea contraria al principio de igualdad, al interés público o al ordenamiento jurídico. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;7.Dado todo esto, se revoca parcialmente la resolución de denegación a los beneficiarios de las ayudas, Rd2 de fecha 21 de julio de 2022 para que las 25 horas de formación de SON MARRANO SL relacionadas con la producción integrada contemplada en el apartado noveno, punto 1, letra d), han quedado suficientemente acreditadas con el certificado emitido por el jefe de Servicio de Agricultura de la Dirección General de Agricultura, Ganadería y Desarrollo Rural de la Conselleria de Agricultura, Pesca y Alimentación del Gobierno de las Islas Baleares.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;3.Orden del consejero de Agricultura, Medio Ambiente y Territorio de 19 de febrero de 2015, por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco del Programa de Desarrollo Rural de las Islas Baleares 2014-2020.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;4.Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Propuesta de Resolución de Revocación&amp;nbsp;parcial&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Por todo ello, se informa favorablemente y se propone al vicepresidente en materia agraria del FOGAIBA que dicte resolución en los siguientes términos:&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;1.Revocar parcialmente la Resolución del vicepresidente en materia agraria del FOGAIBA de 22 de julio de 2022 relativo a la línea de ayuda destinadas al fomento de la producción integrada mediante la cual se deniega la ayuda a la entidad SON MARRANO SL con CIF B07728181, ya que se ha producido un error por parte de la Administración en relación con el cumplimiento del compromiso de participar durante el año comprometido (2016-2021) en actividades de formación relacionadas con la producción integrada de una duración mínima de 25 horas.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;2.Notificar esta resolución al beneficiario mediante la publicación en el Boletín Oficial de las Islas Baleares.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Interposición de recursos&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;Contra esta resolución -que no agota la vía administrativa- se puede interponer recurso de alzada ante la consellera de Agricultura, Pesca y Alimentación, en el plazo de un mes, a contar desde el día siguiente de la notificación de la resolución, de acuerdo con el artículo 58.4 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la comunidad autónoma de las Illes Balears, y los artículos 121 y 122 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
