&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. El 8 de marzo de 2019 (GOIBE33591/2021), la señora Catalina Maria Crespí Isern, en representación de Escoleta de Pa amb Oli, CB, presentó una solicitud de autorización de apertura y funcionamiento de un centro singular incompleto de educación infantil de primer ciclo con 1 unidad (1 unidad de 1 a 3 años), y adjuntó una modificación del proyecto.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;2. El 26 de marzo de 2021, el arquitecto del Instituto para la Educación de la Primera Infancia (IEPI) emitió un informe favorable condicionado del proyecto presentado.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. El 26 de abril de 2021, se comunicó a la titular del centro el informe emitido por el arquitecto del IEPI el 26 de marzo de 2021.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. El 7 de mayo de 2021, la titular del centro presentó nueva documentación, para enmendar las deficiencias detectadas en el informe de 26 de marzo de 2021.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. El 26 de julio de 2021, la jefa de la Sección de Autorizaciones y Registro de Centros comunicó al centro el informe favorable del arquitecto del IEPI sobre la solicitud y le requirió para que al finalizar las obras de adaptación del baño solicitara la visita de obras para que el técnico pudiera comprobar que las instalaciones se habían adecuado a los planos aprobados.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6. El 3 de junio de 2022, la Comisión de Valoración de las Calificaciones del Profesorado de Educación Infantil de Primer Ciclo emitió un informe favorable sobre las calificaciones del profesorado.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;7. En fecha 3 de septiembre de 2022, la representante del centro solicitó la visita de los técnicos para comprobar que las instalaciones se habían adecuado a los planos aprobados.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;8. En fecha 22 de septiembre de 2022, el arquitecto del IEPI informó favorablemente sobre la visita realizada al centro.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;9. El 14 de octubre de 2022, el jefe del Servicio de Planificación educativa emitió un informe favorable sobre el expediente de apertura y funcionamiento del Centro singular de Educación Infantil &lt;span style="color:black"&gt;incompleto de primer ciclo Pa amb Oli, del municipio de Sóller.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;10. El 18 de octubre de 2022, el director general de Planificación, Ordenación y Centros emitió una propuesta de resolución por la cual se autoriza la apertura y el funcionamiento del Centro de Educación Infantil &lt;span style="color:black"&gt;de primer ciclo&lt;/span&gt; (CEI) Pa amb Oli&lt;span style="color:black"&gt;, del municipio de Sóller.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;Fundamentos de derecho&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. La Ley Orgánica 8/1985, de 3 de julio, Reguladora del Derecho a la Educación (BOE núm. 159, de 4 de julio).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. La Ley Orgánica 2/2006, de 3 de mayo, de Educación (BOE núm. 106, de 4 de mayo), modificada por la Ley Orgánica 3/2020, de 29 de diciembre, por la cual se modifica la Ley Orgánica 2/2006, de 3 de mayo, de Educación (BOE núm. 340, de 30 de diciembre).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. La Ley 3/2003, de 26 de marzo, de Régimen Jurídico de la Administración de la Comunidad Autónoma de las Illes Balears (BOIB núm. 44, de 3 de abril).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. La Ley 1/2022, de 8 de marzo, de Educación de las Islas Baleares, la cual establece en el artículo 102 de Creación de centros, que la creación, la supresión y la transformación de centros privados se tienen que someter a la autorización administrativa correspondiente (BOIB núm. 38, de 17 de marzo).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. El Decreto 23/2020, de 31 de julio, por el cual se aprueba el Texto consolidado del Decreto por el cual se establecen los requisitos mínimos de los centros de primer ciclo de educación infantil (BOIB núm. 135, de 1 de agosto).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6. El Estatuto de Autonomía de las Illes Balears, aprobado por la Ley Orgánica 1/2007, de 28 de febrero (BOE núm. 52, de 1 de marzo), el cual establece, en el artículo 36.2, que, en materia de enseñanza, corresponde en la comunidad autónoma de las Illes Balears la competencia de desarrollo legislativo y de ejecución de la enseñanza en toda su extensión, niveles y grados, modalidades y especialidades.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;7. El Decreto 11/2021, de 15 de febrero, de la presidenta de las Illes Balears, por el cual se establecen las competencias y la estructura orgánica básica de las consejerías de la Administración de la Comunidad Autónoma de las Illes Balears (BOIB núm. 21, de 15 de febrero), modificado por el Decreto 25/2021, de 8 de marzo, de la presidenta de las Illes Balears (BOIB núm. 33, de 9 de marzo).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Por todo esto, y de acuerdo con la propuesta formulada por la Dirección General de Planificación, Ordenación y Centros en fecha 18 de octubre de 2022, dicto la siguiente&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;RESOLUCIÓN&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Autorizar, con efectos del inicio del curso 2022/2023, la autorización de la apertura y el funcionamiento del Centro singular de Educación Infantil &lt;span style="color:black"&gt;incompleto de primer ciclo&lt;/span&gt; Pa amb Oli con el código 07016487.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Autorizar la implantación de 1 unidad de 1 a 3 años, distribuida de la manera siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4.&amp;nbsp;Inscribir esta autorización en el Registro autonómico de centros docentes (Repositorio de centros) y en el Registro estatal de centros docentes no universitarios (RCD) del Ministerio de Educación y Formación Profesional.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. Recordar al centro mencionado que queda obligado a cumplir la legislación vigente y que tiene que solicitar la revisión oportuna de su configuración cuando se tenga que modificar cualquiera de los datos que figuran en esta Resolución.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;6. Publicar esta Resolución en &lt;/span&gt;&lt;em&gt;Boletín Oficial de las Illes Balears&lt;/em&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;Interposición de recursos&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Contra esta Resolución, que agota la vía administrativa, se puede interponer un recurso potestativo de reposición ante el consejero de Educación y Formación Profesional en el plazo de un mes contador desde el día siguiente de la publicación, de acuerdo con los artículos 123 y 124 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, y el artículo 57 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/p&gt;
