La citada Resolución se modificó en fecha 26 de abril de 2016 (BOIB núm. 54, de 30 de abril de 2016), modificada por la Resolución del presidente del FOGAIBA de 26 de junio de 2018 (BOIB núm. 80, de 28 de junio de 2018). </em></em></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em><em>2.El 16 de septiembre de 2022, con registro de entrada núm. 525134, DANIEL ANTONIO JUAN JUAN ha presentado la solicitud del primer pago de ayuda correspondiente al expediente núm. CEJA2021_1/007. En el Plan Empresarial que adjunta, manifiesta que no practicará la agricultura ecológica como había especificado en la solicitud de ayuda y por la que se le concedió un importe de 2.500,00 €. </em></em></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em><em>3. El 1 de septiembre de 2022, el vicepresidente en materia agraria del FOGAIBA dictó la Resolución de concesión de ayudas para la creación de empresas de jóvenes agricultores (RES1), publicada en el BOIB núm. 118, de 8 de diciembre de 2022, en la que se incluye una concesión a favor de DANIEL ANTONIO JUAN JUAN, con NIF ***5801**, con un importe de ayuda por concurrencia de 27.500,00 €, con núm . de expediente CEJA2021_1/007. </em></em></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em><em>4. Dentro de la subvención concedida se incluyeron 2.500,00 € por incorporación a una explotación dedicada a la agricultura ecológica. </em></em></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em><em>5.El artículo 43 del Texto refundido de la Ley de Subvenciones, aprobado por Decreto Legislativo 2/2005, de 28 de diciembre, dispone que “Pertoca la revocación de la subvención cuando, posteriormente a la resolución de concesión válida y ajustada a derecho , el beneficiario incumple total o parcialmente las obligaciones o compromisos contraídos a los que está condicionada la eficacia del acto de concesión de la subvención. Como consecuencia de la revocación de la subvención, queda sin efecto, total o parcialmente, el acto de concesión y procede el reintegro de las cantidades indebidamente percibidas”. </em></em></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em><em>6.
