    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;En &lt;em&gt;Boletín Oficial de las Illes Balears&lt;/em&gt; núm.&amp;nbsp;125, de 11 de septiembre&amp;nbsp; de 2021, se publicó la Resolución de consejero de Transición Energética, Sectores Productivos y Memoria Democrática de 6 de septiembre de 2021 por la cual se aprueba la convocatoria pública de subvenciones para la realización de instalaciones de autoconsumo con fuentes de energía renovable, con o sin almacenamiento, y la incorporación de almacenamiento en instalaciones de autoconsumo con fuentes de energía ya existentes, en el sector residencial, las administraciones públicas y el tercer sector en el marco del Plan de Recuperación, Transformación y Resiliencia europeo ‑NextGenerationEU.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Esta convocatoria se enmarca en el Real decreto 477/2021, de 29 de junio, por el cual se aprueba la concesión directa a las comunidades autónomas y en las ciudades de Ceuta y Melilla de ayudas para la ejecución de varios programas de incentivos ligados al autoconsumo y al almacenamiento, con fuentes de energía renovable, así como a la implantación de sistemas térmicos renovables en el sector residencial, en el marco del Plan de Recuperación, Transformación y Resiliencia.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;En el BOE núm. 118, de 18 de mayo de 2022, se publicó el Real decreto 377/2022, de 17 de mayo, por el cual se amplía la tipología de beneficiarios del Real decreto 477/2021, de 29 de junio, por el cual se aprueba la concesión directa a las comunidades autónomas y en las ciudades de Ceuta y Melilla de ayudas para la ejecución de varios programas de incentivos ligados al autoconsumo y al almacenamiento, con fuentes de energía renovable, así como a la implantación de sistemas térmicos renovables en el sector residencial, en el marco del Plan de Recuperación, Transformación y Resiliencia, y del Real decreto 1124/2021, de 21 de diciembre, por el cual se aprueba la concesión directa a las comunidades autónomas y en las ciudades Ceuta y Melilla de ayudas para la ejecución de los programas de incentivos para la implantación de instalaciones de energías renovables térmicas en diferentes sectores de la economía, en el marco del Plan de Recuperación, Transformación y Resiliencia.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Esta modificación del Real decreto&amp;nbsp; 477/2021 afecta varias disposiciones de la mencionada Resolución de 11 de septiembre de 2021, por lo cual es necesario modificar-la .En concreto, se debe que modificar lo siguiente: &amp;nbsp;el punto 2 del apartado segundo sobre la presentación de las solicitudes por parte de las entidades públicas establecidas en este punto&amp;nbsp; 2;&amp;nbsp; el punto 7 del apartado tercero sobre el ratio de la capacidad instalada de almacenamiento frente a &amp;nbsp;la potencia de generación; la letra &lt;em&gt;j)&lt;/em&gt; del apartado diecisieteavo sobre el plazo en el cual se debe que contar la permanencia de la propiedad de las inversiones subvencionadas, y el punto 4 del apartado decimosexto sobre la publicidad que introduce obligaciones adicionales sobre la contribución al objetivo de autonomía estratégica y digital de la Unión Europea. También se modifica la letra &lt;em&gt;a)&lt;/em&gt; del punto 4 del apartado quinto sobre gastos elegibles en el cual de acuerdo con el establecido en el punto 4 del apartado AI.2 del anexo I del Real decreto 477/2021 en el cual establece que el IVA se subvencionable en el supuesto de que no puedan ser susceptibles de recuperación o compensación total o parcial.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Por otro lado, el 10 de junio de 2022, la presidenta de la EPE Instituto para la Diversificación y Ahorro de la Energía (IDAE), MP, dicta una resolución por la cual se amplía el presupuesto para la ejecución de varios programas de incentivos ligados al autoconsumo y almacenamiento, con fuentes de energía renovable, así como la implantación de sistemas térmicos renovables en el sector residencial, en el marco del Plan de Recuperación, Transformación y Resiliencia,&lt;strong&gt;&lt;em&gt; &lt;/em&gt;&lt;/strong&gt;aprobado por el Real decreto&amp;nbsp;477/2021, de 29 de junio, en la cual se asigna un crédito adicional en la comunidad autónoma de las Islas Baleares de 9.407.106,59&amp;nbsp;euros con el desglose por componentes establecidos en la resolución mencionada.&amp;nbsp; &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Atendido esto, se hace necesario modificar el punto sexto de la convocatoria de subvenciones para aumentar la cuantía inicialmente prevista y adaptarla a las anualidades establecidas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Así mismo, la convocatoria en cuestión resulta afectada por la Orden&amp;nbsp;HFP/1030/2021, de 29 de septiembre, por la cual se configura el sistema de gestión del Plan de Recuperación, Transformación y Resiliencia; así como por la Orden&amp;nbsp;HFP/1031/2021, de 29 de septiembre, por la cual se establecen el procedimiento y el &amp;nbsp;formato de la información a proporcionar por las entidades del sector público para el seguimiento del cumplimiento de los hitos y los &amp;nbsp;objetivos, y de ejecución presupuestaria y contable de las medidas de los componentes del Plan de Recuperación, Transformación y Resiliencia.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Esto obliga esta Consejería a modificarla convocatoria pública de subvenciones para la realización de instalaciones de autoconsumo con fuentes de energía renovable, con o sin almacenamiento, y la incorporación de almacenamiento en instalaciones de autoconsumo con fuentes de energía ya existentes, en el sector residencial, las administraciones públicas y el tercer sector, en el marco del Plan de Recuperación, Transformación y Resiliencia europeo «NextGenerationEU», con el fin de ajustarla al marco jurídico vigente que el amparo en cuanto al cumplimiento de las obligaciones inherentes al Plan de Recuperación, Transformación y Resiliencia, así como a la aprobación de los anexos a rellenar requeridos para solicitar las subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Por todo esto, y en cumplimiento de la normativa estatal específica sobre la materia, dicto la siguiente&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Resolución&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;1. Modificar la letra &lt;em&gt;d)&lt;/em&gt; del punto&amp;nbsp;1 del apartado segundo de la convocatoria, que queda redactada de la manera siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;d) Las personas físicas que realicen alguna actividad económica en las Islas Baleares, por la cual ofrezcan bienes y/o servicios en el mercado, y en este caso tienen que estar dados de alta en el Censo de empresarios, profesionales y retenedores de la Agencia Estatal de Administración Tributaria, y tienen que estar sometidos a los requisitos y límites establecidos en el Reglamento (UE) núm. 1407/2013 de la Comisión, de 18 de diciembre de 2013, relativo a la aplicación de los artículos 107 y 108 del Tratado de Funcionamiento de la Unión Europea a las ayudas &lt;/em&gt;de minimis&lt;em&gt;. Los otros beneficiarios indicados en el punto 1 del apartado segundo quedan fuera de las ayudas de Estado y, por lo tanto, exentos de la aplicación del Reglamento 651/2014.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;2. Modificar el punto&amp;nbsp;2 del apartado segundo de la convocatoria, que queda redactado de la manera siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;2. En todos los programas de incentivos, los ayuntamientos, las diputaciones provinciales o las entidades equivalentes y las mancomunidades o agrupaciones de municipios españoles, cabildos y consejos insulares, y cualesquiera organismos públicos y entidades de derecho público vinculados o dependientes tanto de la administración local como autonómica correspondiente, podrán acceder a la condición de destinatarios últimos de las ayudas como representantes de agrupaciones de personas físicas o jurídicas, públicas o privadas, propietarios de instalaciones del sector servicios u otros sectores productivos que, aun careciendo de personalidad jurídica, puedan llevar a cabo la ejecución de las correspondientes actuaciones de autoconsumo con fuentes de energía renovable, debiendo cumplirse, en todo caso, lo previsto por el párrafo segundo del artículo 11.3 de la Ley 38/2003, de 17 de noviembre. En estos casos, el beneficiario que actúe en representación de tales agrupaciones deberá presentar la solicitud o solicitudes de ayuda a los programas que le corresponderían a cada representado.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;3. Modificar el punto&amp;nbsp;7 del apartado tercero de la convocatoria, que queda redactado de la manera siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;7. Excepto para instalaciones aisladas de la red, sólo son consideradas elegibles las instalaciones de almacenamiento que no superen una ratio de capacidad nominal instalada de almacenamiento frente a la potencia de generación de 5 kWh/kW. Además, tienen que contar con una garantía mínima de cinco años. Las tecnologías plomo-ácido para almacenamiento no son elegibles.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;4. Modificar la letra &lt;em&gt;a)&lt;/em&gt; del punto&amp;nbsp;4 del apartado quinto de la convocatoria, que queda redactada de la manera siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;a) El impuesto sobre el valor añadido (IVA) siempre que puedan ser susceptibles de recuperación o compensación total o parcial.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;5. Modificar el punto 1 del apartado&amp;nbsp;sexto de la convocatoria, que queda redactado de la manera siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;1. El importe económico máximo de esta convocatoria es de 13.598.486,56 euros, financiados con los fondos procedentes del Plan de Recuperación, Transformación y Resiliencia. Las subvenciones se conceden con cargo en el presupuesto de la Comunitat Autónoma para los ejercicios de 2022, 2023, 2024 y 2025, concretamente, del centro de coste, subprograma 731A01, capítulo 7* FF MR021, con la distribución 19701 de anualidades siguiente:&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;&lt;em&gt;- Programa de incentivos 4. Categoría autoconsumo renovable en sector residencial, administraciones públicas y tercer sector (componente 7)&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;Año 2022:&amp;nbsp;&amp;nbsp; 3.269.599,00&amp;nbsp;€&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;Año 2023:&amp;nbsp;&amp;nbsp; 7.271.989,00&amp;nbsp;€&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;Año 2024: 1.069.599,00&amp;nbsp;€&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;Año 2025:&amp;nbsp;&amp;nbsp;&amp;nbsp; 494.972,59&amp;nbsp;€ &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;El importe total de este programa y categoría es de 12.106.159,59&amp;nbsp;€&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;&lt;em&gt;- Programa de incentivos 4. Categoría almacenamiento en sector residencial, administraciones públicas y tercer sector (componente 8):&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;Año 2022: 272.798,00&amp;nbsp;€&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;Año 2023: 682.386,00&amp;nbsp;€&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;Año 2024: 76.399,00&amp;nbsp;€&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;Año 2025: 42.163,29&amp;nbsp;€&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;El importe total de este programa y categoría es de 1.073.746,29 €&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

Incorporación de almacenamiento en instalaciones existentes en sector residencial, administraciones públicas y tercer sector (componente 8):&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;Año 2022: 85.333,00&amp;nbsp;€&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;Año 2023: 221.996,00&amp;nbsp;€&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;Año 2024: 75.665,00&amp;nbsp;€&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;Año 2025: 35.586,68&amp;nbsp;€&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;El importe total de este programa y categoría es de 418.580,68 €&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;6. Añadir en el punto 2 del apartado noveno de la convocatoria las letras&lt;em&gt;, n) y o)&lt;/em&gt;, con la redacción siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;n) Declaración responsable del cumplimiento de los principios transversales establecidos en PRTR y de acuerdo con el establecido en el artículo 8.1&lt;/em&gt;.&lt;em&gt;i&lt;/em&gt;)&lt;em&gt; de la Orden HFP/1030/2021. Adopción de medidas eficaces y proporcionadas para evitar el fraude, la corrupción el conflicto de intereses y la doble financiación en el ámbito de gestión de estas ayudas, según lo dispuesto en los acuerdos y reglamentos de la UE y en la Orden HFP/1030/2021&lt;/em&gt;. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;o) Declaración de aceptación de la cesión y el tratamiento de datos entre administraciones públicas en relación con la ejecución y las actuaciones del PRTR, en conformidad con la Ley orgánica 3/2018, de 5 de diciembre, de protección de datos personales y garantía de los derechos digitales, y con la Orden HFP/1030/2021.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;7. Añadir un punto 11 al apartado undécimo de la convocatoria con la redacción siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;11. En cuanto a la remisión de la información sobre perceptores finales de los fondos (beneficiarios de las ayudas, contratistas y subcontratistas), la Consejería de Transición Energética, Sectores Productivos y Memoria Democrática debe aportar la información sobre la identificación del perceptor de los fondos (nombre del destinatario de los fondos, si procede, fecha de nacimiento), en concepto de ayudas o por la condición de contratista y subcontratista, en los términos que determine el Ministerio de Hacienda y Función Pública, para dar cumplimiento a la exigencia del artículo 22.d) del Reglamento (UE) 2021/241.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;8. Modificar el punto&amp;nbsp;4 del apartado decimosexto de la convocatoria, que queda redactado de la manera siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;4. Adicionalmente, en el caso de instalaciones superiores a 100 kW de potencia nominal de generación, se deberá aportar un plan estratégico que indique el origen o lugar de fabricación (nacional, europeo o internacional) de los componentes de la instalación y su impacto medioambiental, incluyendo el almacenamiento, los criterios de calidad o durabilidad utilizados para seleccionar los diferentes componentes, la interoperabilidad de la instalación o su potencial para ofrecer servicios al sistema, así como el efecto motor sobre pymes y autónomos que se espera que tenga el proyecto. En particular, incluirá la contribución en el objetivo de autonomía estratégica y digital de la Unión Europea, así como a la garantía de la seguridad de la cadena de suministro teniendo en cuenta el contexto internacional y la disponibilidad de cualquier componente o subsistema tecnológico sensible que pueda formar parte de la solución, mediante la adquisición de equipos, componentes, integraciones de sistemas y software asociado a proveedores situados a la Unión Europea.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;Puede incluir, además, estimaciones de su impacto sobre la ocupación local y sobre la cadena de valor industrial local, regional y nacional. Este documento tiene que ser publicado por la autoridad convocante de las ayudas y tiene que ser accesible desde las publicaciones o páginas web del destinatario último referidas en el apartado 1 de este artículo.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;9. Modificar en el apartado diecisieteavo la letra &lt;em&gt;j)&lt;/em&gt;, con la redacción siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;j)&lt;em&gt; Garantizar la propiedad de la inversión durante el periodo mínimo de los cinco años siguientes al pago de la ayuda.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;10. Añadir en el apartado diecisieteavo las letras &lt;em&gt;q)&lt;/em&gt;, &lt;em&gt;r), s)&lt;/em&gt; y t), con la redacción siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;q)&lt;em&gt; En el supuesto de que sean entidades del sector público, a adoptar las medidas relacionadas con la prevención de los conflictos de intereses, de acuerdo con el que&amp;nbsp; se prevé en el anexo III.C de la Orden HFP/1030/2021, de 29 de septiembre, por la cual se configura el sistema de gestión del Plan de Recuperación, Transformación y Resiliencia, lo cual incluye la cumplimentación de una declaración de ausencia de conflicto de intereses (DACI) a los intervinientes en el procedimiento.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;r)&lt;em&gt; Permitir el acceso en la Comisión Europea, a la OLAF y al Tribunal de Cuentas de la Unión Europea y, si procede, en la Fiscalía Europea, en los términos previstos en el artículo&amp;nbsp;22.2 del Reglamento (UE)&amp;nbsp;2021/241.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;s)&lt;em&gt; Cumplir las obligaciones relativas a la conservación de los documentos previstas en el artículo&amp;nbsp;132 del Reglamento (UE)&amp;nbsp;2018/1046, del Parlamento Europeo y del Consejo, de 18 de julio de 2018.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;t)&lt;em&gt; Las personas o entidades beneficiarias tienen que garantizar el pleno cumplimiento del principio de no causar un perjuicio significativo al medio ambiente (DNSH por sus siglas en inglés, &lt;/em&gt;Do No Significant Harm&lt;em&gt;) y el etiquetado climático y digital, de acuerdo con el que se prevé en el Plan de Recuperación, Transformación y Resiliencia, aprobado por el Consejo de Ministros el 27 de abril de 2021 y por el Reglamento (UE) núm.&amp;nbsp;2021/241 del Parlamento Europeo y del Consejo, de 12 de febrero de 2021, por el cual se establece el Mecanismo de recuperación y resiliencia; &amp;nbsp;cómo también de aquello requerido en la Decisión de ejecución del Consejo relativa a la aprobación de la evaluación del Plan de Recuperación y Resiliencia de España.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;u) Proporcionar y permitir el intercambio de información necesaria para configurar la Base de datos de los beneficiarios de las ayudas, de contratistas y subcontratistas, de acuerdo con el artículo 8 de la Orden HFP 1030/2021.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;11. Añadir en el apartado veintiunavo, relativo a los modelos normalizados, el siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;- Documento 10. Declaración responsable del cumplimiento de los principios transversales establecidos en PRTR y de acuerdo con el que establece el artículo 8.1.i&lt;/em&gt;)&lt;em&gt; de la Orden HFP/1030/2021. Adopción de medidas eficaces y proporcionadas para evitar el fraude, la corrupción, el conflicto de intereses y la doble financiación en el ámbito de gestión de estas ayudas, según el que disponen los acuerdos y reglamentos de la UE y la Orden HFP/1030/2021&lt;/em&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;- Documento 11. Declaración de aceptación de la cesión y el tratamiento de datos entre administraciones públicas en relación con la ejecución y actuaciones del PRTR, en conformidad con la Ley orgánica 3/2018, de 5 de diciembre, de protección de datos personales y garantía de los derechos digitales, y con la Orden HFP/1030/2021.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;12. Cumplir las obligaciones de comunicación, publicidad y difusión inherentes al Plan de Recuperación, Transformación y Resiliencia.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;13. Añadir un tercer párrafo al apartado veintidosavo, relativo a la normativa aplicable, que queda redactado de la manera siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;- A la convocatoria siguiente será aplicable la Orden HFP/1030/2021, de 29 de septiembre, por la cual se configura el sistema de gestión del Plan de Recuperación, Transformación y Resiliencia, así como la Orden HFP/1031/2021, de 29 de septiembre, por la cual se establecen el procedimiento y el &amp;nbsp;formato de la información a proporcionar por las entidades del sector público estatal, autonómico y local para el seguimiento del cumplimiento de hitos y objetivos y de ejecución presupuestaria y contable de las medidas de los componentes del Plan de Recuperación, Transformación y Resiliencia.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;14. Añadir la frase &lt;em&gt;«—financiado por la Unión Europea—NextGenerationEU»&lt;/em&gt; en el título de la Resolución de la convocatoria, que queda redactado de la manera siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;Resolución de consejero de Transición Energética, Sectores Productivos y Memoria Democrática de 6 de septiembre de 2021 por la cual se aprueba la convocatoria pública de subvenciones para la realización de instalaciones de autoconsumo con fuentes de energía renovable, con o sin almacenamiento, y la incorporación de almacenamiento en instalaciones de autoconsumo con fuentes de energía ya existentes, en el sector residencial, las administraciones públicas y el tercer sector, en el marco del Plan de Recuperación, Transformación y Resiliencia europeo —financiado por la Unión Europea— NextGenerationEU.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;15. Declarar que esta convocatoria se ajusta a los principios transversales del Mecanismo de Recuperación y Resiliencia, así como a los principios de gestión previstos en el artículo&amp;nbsp;2 de la Orden&amp;nbsp;HFP/1030/2021.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;16. Insertar en la cabecera de la Resolución de la convocatoria el logotipo del Plan de Recuperación, Transformación y Resiliencia; el logotipo del Ministerio para la Transición Ecológica y el Reto Demográfico; el logotipo de autoconsumo y el emblema de la Unión Europea.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;17. Establecer que esta modificación es aplicable en los expedientes que ya se hayan presentado, a partir de la entrada en vigor del Real decreto 377/2022, de 17 de mayo, por el cual se amplía la tipología de beneficiarios del Real decreto 477/2021, de 29 de junio, por el cual se aprueba la concesión directa a las comunidades autónomas y en las ciudades Ceuta y Melilla de ayudas para la ejecución de varios programas de incentivos ligados al autoconsumo y al almacenamiento, con fuentes de energía renovable, así como a la implantación de sistemas térmicos renovables en el sector residencial, en el marco del Plan de Recuperación, Transformación y Resiliencia, y del Real decreto 1124/2021, de 21 de diciembre, por el cual se aprueba la concesión directa a las comunidades autónomas y en las ciudades Ceuta y Melilla de ayudas para la ejecución de los programas de incentivos para la implantación de instalaciones de energías renovables térmicas en diferentes sectores de la economía, en el marco del Plan de Recuperación, Transformación y Resiliencia. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;18. No obstante el punto anterior, la modificación de la convocatoria establecida en los puntos 1, 4, 5, 6, 7, 8 ,9, 10, 1, 12 y 13 de esta Resolución es aplicable a todos los expedientes que se hayan presentado desde la fecha de publicación de la convocatoria pública de subvenciones para la realización de instalaciones de autoconsumo con fuentes de energía renovable, con o sin almacenamiento, en el sector de servicios y otros sectores productivos de la economía, y para la incorporación de almacenamiento en instalaciones de autoconsumo, con fuentes de energía renovable, ya existentes en el sector de servicios y otros sectores productivos, en el marco del Plan de Recuperación, Transformación y Resiliencia europeo ‑NextGenerationEU.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;19. Publicar esta Resolución en &lt;em&gt;Boletín Oficial de las Illes Balears&lt;/em&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Interposición de recursos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Contra esta Resolución, que agota la vía administrativa, se puede interponer un recurso potestativo de reposición ante consejero de Transición Energética, Sectores Productivos y Memoria Democrática en el plazo de un mes contador desde el día siguiente de la publicación, de acuerdo con el artículo&amp;nbsp;124 de la Ley&amp;nbsp;39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, y el artículo&amp;nbsp;57 de la Ley&amp;nbsp;3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunitat Autónoma de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;También se puede interponer directamente un recurso contencioso administrativo ante la Sala de lo contencioso administrativo del Tribunal Superior de Justicia de las Islas Baleares en el plazo de dos meses contadores desde el día siguiente de la publicación, de acuerdo con el artículo&amp;nbsp;46 de la Ley&amp;nbsp;29/1998, de 13 de julio, reguladora de la Jurisdicción Contenciosa Administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;DECLARACIÓN&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;DECLARO conocer la normativa aplicable, en particular los apartados siguientes del artículo&amp;nbsp;22, del Reglamento (UE)&amp;nbsp;2021/241 del Parlamento Europeo y del Consejo, de 12 de febrero de 2021, por el cual se establece el Mecanismo de Recuperación y Resiliencia:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;1. La letra &lt;em&gt;d)&lt;/em&gt; del apartado 2: «recaudar, a efectos de auditoría y control del uso de fondo en relación con las medidas destinadas a la ejecución de reformas y proyectos de inversión en el marco del Plan de Recuperación y Resiliencia, en un formato electrónico que permita realizar búsquedas y en una base de datos única, las categorías armonizadas de datos siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;i)&lt;/em&gt; el nombre del perceptor final de los fondos;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;ii)&lt;/em&gt; el nombre del contratista y del subcontratista, cuando el perceptor final de los fondos sea uno poder adjudicador en conformidad con el Derecho de la Unión Europea o nacional, en materia de contratación pública;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;iii)&lt;/em&gt; los nombres, los linajes y los datos de nacimiento de los titulares reales del perceptor de los fondos o del contratista, según se define en el artículo&amp;nbsp;3, punto&amp;nbsp;6, de la Directiva (UE) 2015/849 del Parlamento Europeo y del Consejo (26);&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;iv)&lt;/em&gt; una lista de medidas para la ejecución de reformas y proyectos de inversión en el marco del Plan de Recuperación y Resiliencia, junto con el importe total de la financiación pública de estas medidas y que indique la cuantía de los fondos desembolsados en el marco del Mecanismo y otros fondos de la Unión».&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;2. Apartado 3: «Los datos personales mencionados en el apartado 2, letra &lt;em&gt;d)&lt;/em&gt;, de este artículo sólo serán tratadas por los Estados miembros y por la Comisión al efecto y duración de la correspondiente auditoría de la aprobación de la gestión presupuestaria y de los procedimientos de control relacionados con la utilización de los fondos relacionados con la aplicación de los acuerdos al hecho a que se refieren los artículos&amp;nbsp;15, apartado 2, y 23, apartado&amp;nbsp;1. En el marco del procedimiento de aprobación de la gestión de la Comisión, en conformidad con el artículo&amp;nbsp;319 del TFUE, el Mecanismo estará sujeto a la presentación de informes en el marco de la información financiera y de rendición de cuentas integrada al hecho a que refiere el artículo 247 del Reglamento financiero y, en particular, por separado, en el informe anual de gestión y rendimiento».&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Conforme con el marco jurídico expuesto, manifiesto acceder a la cesión y el tratamiento de los datos con las finalidades expresamente indicadas en los artículos mencionados.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp; &amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;,&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp; &amp;nbsp;de&amp;nbsp; &amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;de 202&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
