&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;1. El 22 de diciembre de 2020 se publicó la convocatoria pública de subvenciones para actuaciones de rehabilitación energética en edificios existentes (Programa&amp;nbsp;PREE) dentro del Programa Operativo FEDER&amp;nbsp;2014-2020, mediante la Resolución del vicepresidente y consejero de Transición Energética y Sectores Productivos de 14 de diciembre de 2020 (BOIB n.º&amp;nbsp;212, de 22 de diciembre).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;2. En fecha 30 de diciembre de 2020 la entidad Can Quintin, SL, con NIF&amp;nbsp;B84902618, presentó una solicitud de subvención para la reforma integral interior de la vivienda, con actuaciones de consolidación estructural, mejora de eficiencia energética y ampliación de porche posterior.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;3. En fecha 15 de septiembre de 2022 (BOIB n.º&amp;nbsp;121) se publicó la Propuesta de resolución de concesión del director general de Energía y Cambio Climático por la que se proponía a la entidad Can Quintin, SL, con NIF&amp;nbsp;B84902618, una subvención de 6.485,72&amp;nbsp;euros sobre un importe subvencionable de 159.972,29&amp;nbsp;euros.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;4. Se ha detectado un error en la cantidad de la inversión subvencionable y el importe de subvención propuesto.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;5. Los servicios técnicos de la Dirección General de Energía y Cambio Climático han emitido un nuevo informe favorable con los siguientes aspectos:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;— La persona o entidad solicitante, por su naturaleza, puede ser beneficiaria de la subvención.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;— La entidad Can Quintin, SL, con NIF&amp;nbsp;B84902618, ha adjuntado la documentación prevista en la convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;— La entidad solicitante está al corriente de las obligaciones con la Seguridad Social y con la Administración Tributaria, tanto estatal como autonómica.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;6. El técnico competente, en aplicación del procedimiento de concesión que establece el apartado octavo de la mencionada Resolución, ha informado favorablemente sobre la concesión de la subvención descrita en el anexo, la cual se ha calculado de acuerdo con la Resolución de convocatoria de estas ayudas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;Fundamentos de derecho&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;1. El Decreto Legislativo&amp;nbsp;2/2005, de 28 de diciembre, por el que se aprueba el texto refundido de la Ley de Subvenciones (BOIB n.º&amp;nbsp;196, de 31 de diciembre de 2005).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;2. El Decreto&amp;nbsp;75/2004, de 27 de agosto, por el que se despliegan determinados aspectos de la Ley de finanzas y de las leyes de presupuestos generales de la Comunidad Autónoma de las Illes Balears (BOIB n.º&amp;nbsp;122, de 2 de septiembre de 2004).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;3. La Orden de la consejera de Comercio, Industria y Energía de 15 de mayo de 2008 por la que se establecen las bases reguladoras para la concesión de subvenciones en materia de energía (BOIB n.º&amp;nbsp;72, de 24 de mayo de 2008).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;4. El Real Decreto&amp;nbsp;737/2020, de 4 de agosto, por el que se regula el programa de ayudas para actuaciones de rehabilitación energética en edificios existentes y se regula la concesión directa de las ayudas de este programa a las comunidades autónomas y ciudades de Ceuta y Melilla (BOE n.º&amp;nbsp;212, de 6 de agosto de 2020).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;5. La resolución del vicepresidente y consejero de Transición Energética y Sectores Productivos de 14 de diciembre de 2020 por la que se aprueba la convocatoria pública de subvenciones para actuaciones de rehabilitación energética en edificios existentes (Programa&amp;nbsp;PREE) (BOIB n.º&amp;nbsp;212, de 22 de diciembre de 2020).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;Propuesta de resolución&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Propongo al consejero de Transición Energética, Sectores Productivos y Memoria Democrática que dicte una resolución en los siguientes términos:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;1. Modificar la Propuesta de resolución de concesión del director general de Energía y Cambio Climático de 12 de septiembre de 2022 en lo que afecta al titular del expediente PREE-3/2020, la entidad Can Quintin, SL, con NIF&amp;nbsp;B84902618.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;2. Aprobar la concesión de una subvención al beneficiario que figura en el anexo, de acuerdo con el concepto y el importe que también figuran.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;3. Autorizar y disponer el gasto con cargo a la partida presupuestaria indicada en el anexo de los presupuestos vigentes de la Comunidad Autónoma de las Illes Balears. Esta ayuda puede ser cofinanciada a cargo del Programa Operativo FEDER&amp;nbsp;2014-2020 de las Illes Balears, encuadrado en: objetivo temático&amp;nbsp;4 «Economía baja en carbono»; objetivos específicos OE&amp;nbsp;4.1.2 «Energías renovables para usos térmicos»; OE&amp;nbsp;4.2.1 «Eficiencia energética en empresas», y OE&amp;nbsp;4.3.1 «Eficiencia energética en edificación, infraestructuras y servicios públicos».&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;4. Las inversiones objeto de la solicitud se deberán ejecutar y pagar dentro del periodo que va desde el día de presentación de la solicitud hasta el plazo de dieciocho meses a contar desde la fecha de la notificación de la resolución de concesión.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;5. El plazo para justificar la realización de las actividades subvencionadas en ningún caso puede ser posterior a los tres meses de la finalización del plazo máximo concedido para su ejecución.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;6. El pago y la justificación de las actuaciones se deberá hacer de acuerdo con lo que dispone el apartado décimo de la Resolución del vicepresidente y consejero de Transición Energética y Sectores Productivos de 14 de diciembre de 2020 por la que se aprueba la convocatoria pública de subvenciones para actuaciones de rehabilitación energética en edificios existentes (Programa&amp;nbsp;PREE). Se deberá acreditar el pago de los justificantes mediante un documento, extracto o certificado bancario.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;7. Los beneficiarios estarán obligados a cumplir lo que dispone el apartado decimocuarto de la Resolución del vicepresidente y consejero de Transición Energética y Sectores Productivos de 14 de diciembre de 2020 por la que se aprueba la convocatoria pública de subvenciones para actuaciones de rehabilitación energética en edificios existentes (Programa&amp;nbsp;PREE).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;8. Toda alteración de las condiciones establecidas para la concesión de la subvención, como también la obtención concurrente de subvenciones o ayudas otorgadas por otras administraciones públicas o entes públicos, nacionales o internacionales, dará lugar a la revisión parcial o total de la subvención y, por tanto, al reintegro de la cantidad correspondiente más los intereses de demora.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Contra esta Propuesta de resolución se puede alegar lo que se considerase conveniente en el plazo máximo de diez días hábiles a contar desde el día siguiente de su publicación en el Boletín Oficial de las Illes Balears. En caso contrario, se entenderá que se está conforme con el contenido de la Propuesta.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
