    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="color:#212121"&gt;El apartado 9.3 de la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 13&amp;nbsp;de diciembre de 2019, por la cual se convocan, para el año 2019, subvenciones para inversiones en la prevención de los daños causados en los bosques por incendios forestales, desastres naturales y catástrofes, especifica que la resolución expresa se notificará a las personas interesadas mediante su publicación en el &lt;/span&gt;&lt;em&gt;&lt;span style="color:#212121"&gt;Boletín Oficial de las Illes Balears&lt;/span&gt;&lt;/em&gt;&lt;span style="color:#212121"&gt;&amp;nbsp;de acuerdo con los términos que prevé el artículo 45.2 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#212121"&gt;Los expedientes han sido tramitados por el Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) en cumplimiento de lo dispuesto en el artículo 43 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#212121"&gt;El vicepresidente&amp;nbsp;en Materia Agraria del FOGAIBA, con fecha 3&lt;/span&gt;&lt;span style="color:#000000"&gt;&amp;nbsp;de octubrede 2022&lt;/span&gt;&lt;span style="color:#212121"&gt;, firmó la siguiente resolución:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Antecedentes&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;&lt;em&gt;1.Con fecha de 17 de diciembre de 2019 se publicó, en el Boletín Oficial de las Islas Baleares núm. 169, la Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) por la que se convocan, para el año 2019, subvenciones para inversiones en la prevención de los daños causados en&amp;nbsp;los bosques por incendios forestales, desastres naturales y catástrofes.&lt;/em&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;&lt;em&gt;2.Con fecha 3 de mayo de 2021, el vicepresidente en materia agraria del Fogaiba dictó una resolución de concesión a los beneficiarios de las ayudas R1, que se publicó en el BOIB núm. 62 de 13 de mayo de 2021. &lt;/em&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;&lt;em&gt;3.Entre los beneficiarios de esta resolución, figuran dos concesiones a favor de CARLOS MARI MAYANS, por un importe de 8.584,00 € y de ALGAIARENS SRM, por un importe de 24.000,00, que no son correctos. &lt;/em&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;&lt;em&gt;4.Respeto al SR. CARLOS MARI MAYANS, su solicitud de ayuda se contemplaban las siguientes inversiones: faja de prevención de incendios forestales en una superficie de 0,63 hectáreas (Ha), aclareo de arbolado forestal con una superficie de 1,15 hectáreas (Ha) y recuperación de cultivo en zonas abancaladas a una superficie de 1,30 Ha. &lt;/em&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;&lt;em&gt;En el acta de control previo se reflejaron las siguientes superficies: una superficie de 0,50 Ha de faja de prevención de incendios forestales, una superficie de 1,15 Ha de aclareo de arbolado forestal y 0,82 Ha de recuperación de cultivo en zonas abancaladas. &lt;/em&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;&lt;em&gt;La subvención concedida fue en base a las siguientes actuaciones: faja de prevención de incendios forestales a una superficie de 0,50 Ha, aclareo de arbolado forestal con una superficie de 1,15 Ha y recuperación de cultivo en zonas abancaladas a una superficie de 0,82 Ha.&lt;/em&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;&lt;em&gt;En la concesión hubo un error en las superficie de faja de prevención de incendios forestales, se concedieron 0,50 Ha cuando realmente le correspondían 0,63 Ha. &lt;/em&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;&lt;em&gt;El del titular del expediente presentó una solicitud de revisión de oficio para esclarecer tal discrepancia y el Servicio Forestal ha redectado, con fecha 21 de septiembre de 2022, un informe aclarando la discrepancia. &lt;/em&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;&lt;em&gt;5. El representante de ALGAIARENS SRM, con fecha 28 de septiembre de 2022, presenta una solicitud de revisión de oficio de la concesión de su expediente, al no incluir el incremento del 5% que contempla la convocatoria por tener un Plan de Gestión Forestal. La intensidad de la ayuda será un 85% sobre el importe legible, en lugar del 80% que se le concedió. &lt;/em&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;&lt;em&gt;6. Teniendo en cuenta que con el crédito existente es posible resolver este expediente sin afectar a lo dispuesto en los apartados séptimo y octavo de la convocatoria. &lt;/em&gt;&lt;/em&gt;&lt;/p&gt;

Orden del Conseller de Agricultura, Medio Ambiente y Territorio de 19 de febrero de 2015, por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco del Programa de Desarrollo Rural de las Islas Baleares desde 2014 hasta 2020.&lt;/em&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;em&gt;&lt;em&gt;3. Ley 39/2015 de 1 de octubre del procedimiento administrativo común&amp;nbsp;de las Administraciones Públicas.&lt;/em&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;em&gt;&lt;em&gt;Propuesta de Resolución &lt;/em&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;&lt;em&gt;Por todo ello, se informa favorablemente y propongo al vicepresidente del FOGAIBA que dicte una resolución en los siguientes términos:&lt;/em&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;&lt;em&gt;1.Modificar la Resolución del vicepresidente en materia agraria de 3 de mayo de 2021 de concesión (R1), por el importe y los datos detallados en el anexo 1 de esta resolución, que son&amp;nbsp;un total de 2&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;expediente&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;s&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;que comienza con CARLOS MARI MAYANS y de ALGAIRENS SRM&amp;nbsp;, relativa a la línea de ayuda «para inversiones en la prevención de los daños causados a los bosques por incendios forestales, desastres naturales y catástrofes» a consecuencia de dos revisiones de oficio. &lt;/em&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;&lt;em&gt;2. Ampliar el importe de&amp;nbsp;las concesion&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;es&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;de la Resolución de ayuda concedida antes mencionada&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;s&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;concedida&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;s&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;a&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;&lt;em&gt;l&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;os&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;beneficiario&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;s&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;por los&amp;nbsp;importes&amp;nbsp;y con los datos detallados en el anexo 1 de esta resolución. &lt;/em&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;&lt;em&gt;3. Notificar esta resolución a la persona interesada, mediante la publicación en el Boletín Oficial de las Islas Baleares. &lt;/em&gt;&lt;/em&gt;&lt;/p&gt;
