    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;El apartado&amp;nbsp;9.3. de la Resolución del&amp;nbsp;Presidente del Fondo de&amp;nbsp;Garantía Agraria&amp;nbsp;y Pesquera de&amp;nbsp;las&amp;nbsp;Islas Baleares&amp;nbsp;(FOGAIBA) de 10 de setiembre de 2015 por la&amp;nbsp;que se convocan, subvenciones&amp;nbsp;para la Creación de empresas de Jóvenes agricultores, correspondientes a los años 2015-2019, &amp;nbsp;especifica&amp;nbsp;que la resolución&amp;nbsp;expresa&amp;nbsp;se notificará&amp;nbsp;a&amp;nbsp;los interesados mediante&amp;nbsp;su publicación en el&amp;nbsp;&lt;em&gt;Boletín Oficial de las&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;Islas Baleares&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;de acuerdo con los&amp;nbsp;términos&amp;nbsp;previstos en el artículo&amp;nbsp;45.2&amp;nbsp;de la Ley&amp;nbsp;39/2015, de 1&amp;nbsp;de octubre, del&amp;nbsp;procedimiento administrativo común de&amp;nbsp;las&amp;nbsp;administraciones públicas. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;Los expedientes&amp;nbsp;han sido&amp;nbsp;tramitados&amp;nbsp;por el Fondo&amp;nbsp;de Garantía Agraria&amp;nbsp;y Pesquera de&amp;nbsp;las&amp;nbsp;Islas Baleares&amp;nbsp;(FOGAIBA) en cumplimiento de lo&amp;nbsp;dispuesto en el artículo&amp;nbsp;43&amp;nbsp;de&amp;nbsp;la Ley&amp;nbsp;39/2015, de 1 de octubre, del procedimiento administrativo común de las&amp;nbsp;administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;El vicepresidente&amp;nbsp;en materia agraria del FOGAIBA, con fecha 8&amp;nbsp;de setiembre&amp;nbsp;de 2022, firmó la siguiente resolución, &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;&lt;em&gt;Antecedentes&lt;/em&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;1.Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 10 de septiembre de 2015, por la que se convocan, para los años 2015 a 2019, subvenciones para la creación de empresas de jóvenes agricultores . La citada Resolución se modificó en fecha 26 de abril de 2016 (BOIB núm. 54). &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2.Una vez analizada toda la documentación presentada, el vicepresidente del FOGAIBA resolvió favorablemente la concesión de la ayuda a favor de los interesados que figuran en el anexo de la Resolución con los datos y los importes correspondientes. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;3.El 26 de mayo de 2018, en el BOIB núm. 65, se publicó la Resolución de la concesión a los beneficiarios de las ayudas, R1 de 15 diciembre de 2020, en la que se incluye a Juan Miguel Alzamora Oliva (núm. Exp. CEJA2019_1/011), con un importe prima de 42.000, 00€. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;4.El 19 de marzo de 2021 (con registro de entrada 60721) se presentó la solicitud del primer pago parcial de la prima (50 %), se hizo un pago por importe de 21.000,00 €. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;5.El 11 de agosto de 2022 (registro de entrada 453662), el beneficiario presentó la solicitud del segundo pago, y el 30 de agosto de 2022, con registro de entrada 484309) presenta una instancia donde informa que ahora tiene 27,95 UBM y pide que el pago del complemento de orientación productiva ganadera se realice teniendo en cuenta este dato. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Esto implica hacer una revocación parcial de 1.800,00 euros, por tanto, el pago correspondiente al 2º tramo será de una cuantía de 19.200,00 €.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Orden del Consell&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;er de Agricultura, Medio Ambiente y Territorio de 19 de febrero de 2015, por la que se establecen las bases reguladoras para la concesi&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;ó&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;n de subvenciones en el marco del Programa de Desarrollo Rural de las Islas Baleares desde 2014&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;-2020.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;3. Ley 39/2015, del&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;1 de octubre, de r&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;é&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;gimen jur&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;í&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;dico de las administraciones p&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;úblicas.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;Propuesta de Resolución &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Por todo ello, se informa favorablemente y proposo al vicepresidente del FOGAIBA que dicte resolución en los siguientes términos: &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Revocar parcialmente las resoluciones de ayuda concedidas a las personas beneficiarias por el importe y con los plazos detallados en el anexo de esta resolución, que es de 1 expediente y que comienza y termina con Juan Miguel Alzamora Oliva, que suma un importe total de 1.800,00 euros, relativa a la línea de ayuda “Creación de empresas de jóvenes agricultores”.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;Interposición de recursos&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;Contra esta resolución, que no agota la vía administrativa, podrá interponerse recurso de alzada ante la&lt;/em&gt;&lt;em&gt;&amp;nbsp;conse&lt;/em&gt;&lt;em&gt;ll&lt;/em&gt;&lt;em&gt;er&lt;/em&gt;&lt;em&gt;a&lt;/em&gt;&lt;em&gt;&amp;nbsp;de Agricultura&lt;/em&gt;&lt;em&gt;,&lt;/em&gt;&lt;em&gt;&amp;nbsp;Pesca&lt;/em&gt;&lt;em&gt;&amp;nbsp;y Alimentación&lt;/em&gt;&lt;em&gt;, en el plazo de un mes, a contar desde el día siguiente de la notificación de la resolución, de acuerdo con el artículo 58.4 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la comunidad autónoma de las Islas Baleares, y &amp;nbsp;l&lt;/em&gt;&lt;em&gt;os&lt;/em&gt;&lt;em&gt;&amp;nbsp;artículo&lt;/em&gt;&lt;em&gt;s 121 y 122&amp;nbsp;de la Ley 39/2015, de 1 de octubre del Procedimiento Administrativo Común de las Administraciones Públicas. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
