    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="color:black; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Según lo establecido en el artículo 24.1 letra &lt;/span&gt;&lt;em&gt;i)&lt;/em&gt;&lt;span style="color:black; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt; de los Estatutos de la Fundació Orquestra Simfònica de les Illes Balears (BOIB nº 202, de 1 de diciembre de 2020), corresponde al gerente desarrollar la política de personal, según las directrices del Patronat, y promover los procedimientos de selección y promoción.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Según el Acord del Patronat de la Fundación de aprobación de la Oferta Pública de Empleo de 2021 (BOIB nº 178, de 28 de diciembre de 2021), las convocatorias de las plazas incluidas en dicha oferta pública de empleo deberán ejecutarse en un plazo máximo de tres años desde la publicación de su aprobación en el Butlletí Oficial de les Illes Balears, incluyéndose en dicha oferta tres plazas que se convocan mediante la presente Resolución.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Por otra parte, el Acord del Patronat de la Fundació, de 23 de mayo de 2022, por el cual se aprueba la oferta pública de estabilización y la oferta de empleo pública ordinaria para el año 2022 correspondiente al personal laboral de la Fundació, incluye una plaza de oferta pública ordinaria, la cual se convoca mediante la presente Resolución.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;El artículo 17 del Conveni Col·lectiu del personal de la Fundació dispone que la selección de personal para el ingreso a la Fundació será cubierta mediante oposición libre.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Por todo ello, dicto la siguiente&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;Resolución&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;PRIMERO.- &lt;/span&gt;&lt;/strong&gt;&lt;span style="color:black"&gt;Convocar oposición por turno libre para cubrir 4 plazas con contrato laboral fijo de profesor de la Orquestra Simfònica de les Illes Balears, correspondiéndose 3 a la Oferta Pública de Empleo de 2021 (tasa de reposición ordinaria) y 1 a la Oferta Pública de Empleo de 2022 (tasa&amp;nbsp;&amp;nbsp; de reposición ordinaria), que es desglosan de la siguiente manera:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;1 plaza de viola &lt;em&gt;tutti&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;1 plaza de violonchelo &lt;em&gt;tutti&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;1 plaza de ayuda de solista de flauta&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;SEGUNDO.- &lt;/span&gt;&lt;/strong&gt;&lt;span style="color:black"&gt;Aprobar las bases específicas que regirán la presente convocatoria, que se adjuntan.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;TERCERO.- &lt;/span&gt;&lt;/strong&gt;&lt;span style="color:black"&gt;Ordenar la publicación de esta convocatoria en el Butlletí Oficial de les Illes Balears y en la página web de la Fundació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La plaza convocada de violín segundo &lt;em&gt;tutti&lt;/em&gt; se corresponde con una plaza del grupo de titulación A, en la especialidad de violín, con las funciones y características siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Interpretar la parte correspondiente de la obra para los &lt;em&gt;tutti&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Obligación de sustituir al ayuda de solista en caso de ser necesario, percibiendo la parte proporcional de la diferencia de sueldo según prevé la normativa de aplicación (E. &lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;2.&amp;nbsp;Requisitos de los aspirantes&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Para ser admitidos en el proceso selectivo, los aspirantes deberán tener en el día de fin de plazo de presentación de solicitudes los requisitos siguientes de participación:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Nacionalidad: Poseer la nacionalidad española o cualquier otra nacionalidad o situación de las que permiten el acceso al empleo público según el artículo 57 del Texto Refundido de la Ley del Estatuto básico del empleado público, aprobado por Real Decreto Legislativo 5/2015. &lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Edad: Tener más de dieciséis años y no haber alcanzado la edad de jubilación forzosa.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Habilitación: No haber sido separado/a, mediante expediente disciplinario, del servicio de cualquiera de las Administraciones Públicas, o de los órganos constitucionales o estatutarios de las Comunidades Autónomas ni hallarse en inhabilitación absoluta o especial para empleos o cargos públicos por resolución judicial, para el acceso al cuerpo o escala de funcionario y no poseer la condición de personal funcionario de carrera del cuerpo y especialidad convocado. En el caso de ser nacional de otro Estado, no hallarse inhabilitado/a o en situación equivalente ni haber sido sometido/a sanción disciplinaria o equivalente que impida, en su Estado, en los mismos términos, el acceso al empleo público.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&amp;nbsp; Titulación: Poseer la titulación exigida de título superior de Música, en la especialidad correspondiente a la plaza a la cual se presente el aspirante; o el correspondiente de otro país, debidamente homologado para que extienda sus efectos en España; o cumplir los requisitos para que será homologable en el plazo de presentación de solicitudes de participación, con los efectos rescisorios correspondientes si no se consiguiera la homologación. &lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Conocimientos de lengua catalana: Certificado de nivel de catalán B2. En cuanto al conocimiento de la lengua catalana es aplicable la Disposición Adicional cuarta del Decreto 11/2017, de 24 de marzo, en la redacción introducida por la disposición adicional vigesimocuarta de la Ley de Presupuestos de la Comunidad Autónoma de las Illes Balears para el año 2019. Si en el momento de la incorporación no puede acreditar el nivel exigido de conocimientos en lengua catalana, en su contrato se hará constar que queda obligado a&amp;nbsp;alcanzar y a acreditar el nivel mínimo de catalán en el plazo de un año, y en los dos años sucesivos el nivel de catalán correspondiente al puesto de trabajo (B2).&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Capacidades físicas y psíquicas: Posesión de las capacidades y aptitudes físicas y psíquicas necesarias para el ejercicio de las funciones correspondientes&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Por otra parte, los aspirantes que superen las pruebas selectivas, deberán acreditar, mediante un certificado obtenido por revisión médica, que poseen las capacidades y aptitudes físicas y psíquicas necesarias para el cumplimiento de las correspondientes funciones o tareas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;3.&amp;nbsp;Plazo y lugar de presentación de las solicitudes&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El plazo de presentación de las solicitudes se establece en 25 días naturales contados a partir del día siguiente de la publicación de la convocatoria y las bases en el Butlletí Oficial de les Illes Balears. En caso de que el último día de plazo señalado sea inhábil, el plazo de presentación se extenderá hasta el día hábil siguiente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La presentación de las solicitudes deberá efectuarse telemáticamente, enviando el modelo de solicitud y el resto de documentación al correo electrónico oposicions@simfonicadebalears.com&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La no presentación de la solicitud en tiempo y forma supondrá la no admisión del solicitante.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Para cualquier duda sobre la presentación de instancias o sobre el proceso selectivo, puede escribir un correo electrónico a oposicions@simfonicadebalears.com o llamar al 971287565 (departamento de producción).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;4.&amp;nbsp;Modelo de solicitud y documentación a presentar &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La solicitud podrá formalizarse según el modelo normalizado que figura en el anexo II de las presentes bases. Dicha solicitud incluye una declaración jurada del aspirante en relación al cumplimiento de todos los requisitos de la convocatoria. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;A parte de la solicitud, deberá presentarse obligatoriamente&lt;/strong&gt;, la siguiente documentación: &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;A parte de la anterior documentación obligatoria, y a efectos de ser considerado como mérito, según lo establecido en la Disposición Adicional cuarta del Decreto 11/2017, de 24 de marzo, los aspirantes que dispongan de un certificado de nivel de catalán superior al exigido, podrán presentar una fotocopia del mismo para que se valore como mérito, concretamente, los siguientes: &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;5.&amp;nbsp;&amp;nbsp; &amp;nbsp;Admisión de los aspirantes &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Una vez finalizado el plazo de presentación de las solicitudes, se publicará en la web (apartado ADMINISTRACIÓN/RECURSOS HUMANOS) de la Fundació (https://simfonicadebalears.com) la lista provisional de admitidos y excluidos, con indicación expresa de la causa de exclusión. Dicha publicación (identificación con los números de DNI) se considerará con carácter general como notificación a los interesados. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Con tal de enmendar las causas que hayan motivado la exclusión en dicha lista, los aspirantes dispondrán de un plazo de tres días hábiles contados a partir del día siguiente de la publicación para alegar y presentar la documentación correspondiente en el correo electrónico oposicions@simfonicadebalears.com &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Por medio de la lista definitiva de personas admitidas y excluidas se decidirá sobre las alegaciones planteadas por los interesados en el procedimiento sobre su exclusión, y la publicación de la lista en la web de la Fundación les servirá de notificación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;6.&amp;nbsp;&amp;nbsp; &amp;nbsp;Tribunal calificador &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La evaluación de las pruebas de los aspirantes será encomendada al órgano colegiado de carácter técnico previsto en el Conveni Col·lectiu que actuará sometido a las normas de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las administraciones públicas. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Para las pruebas de violín segundo, viola y violonchelo, el tribunal será el siguiente: &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Presidente: director titular de la Orquestra Simfònica. Suplente: director de orquesta con amplia trayectoria profesional. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En el momento de la determinación nominal del Tribunal, podrá nombrarse un especialista del instrumento correspondiente, el cual formará parte del Tribunal con voz y voto. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los representantes del comité de empresa podrán asistir tanto a las pruebas como a las deliberaciones en calidad de observadores, pero no podrán intervenir en los debates ni en las deliberaciones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El Tribunal no podrá constituirse ni actuar sin la asistencia del presidente, el secretario y sin la asistencia de más de la mitad de sus vocales, titulares o suplentes, indistintamente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El Tribunal queda facultado para resolver las dudas o las incidencias que se presenten y tomar los acuerdos necesarios en cuanto a la interpretación de las bases. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Al tiempo de la publicación de la lista definitiva de admitidos y excluidos, se publicará en la web de la Fundació la identificación nominal de los miembros titulares, y los suplentes correspondientes, del Tribunal calificador.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El Tribunal extenderá un acta de todas sus sesiones. En las actas, y siguiendo con lo dispuesto en el artículo 18 de la Ley 40/2015, de 1 de octubre, de Régimen jurídico del sector público, se expondrá la puntuación otorgada por el Tribunal. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La abstención y la recusación de los miembros del Tribunal se hará efectiva de acuerdo con lo dispuesto en los artículos correspondientes de la normativa de régimen jurídico del sector público. En concreto, los siguientes: &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;a) Tener interés personal en el asunto que se trate o en otro en cuya resolución pueda influir la de aquel; ser administrador de sociedad o entidad interesada, o tener cuestión litigiosa pendiente con algún interesado. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;b) Tener un vínculo matrimonial o situación de hecho asimilable y el parentesco de consanguinidad en cuarto grado o de afinidad en el segundo, con cualquiera de los interesados, con los administradores de entidades o sociedades interesadas y también con los asesores, representantes legales o mandatarios que intervengan en el procedimiento, así como compartir despacho profesional o estar asociado con estos para el asesoramiento, la representación o el mandato. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;c) Tener amistad íntima o enemistad manifiesta con alguna de las personas mencionadas en el apartado anterior. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;d) Haber intervenido como perito o como testigo en el procedimiento que se trate. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;e) Tener relación de servicio con persona natural o jurídica interesada directamente en el asunto, o haberle prestado en los dos últimos años servicios profesionales de cualquier tipo y en cualquier circunstancia o lugar.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;7.&amp;nbsp;Desarrollo del proceso selectivo y ejecución de las audiciones&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Las audiciones se llevarán a cabo entre los días 19 y 22 de diciembre de 2022, ambos incluidos, en el Palau de Congressos de Palma (c/ Felicià Fuster nº 22, CP 07006, de Palma). El día 19 se llevarán a cabo las audiciones de ayuda de solista de flauta, el día 29, las de violín tutti segundo, el día 21, las de violonchelo tutti, y el día 22 las de viola tutti. A las 09:00 h. de cada uno de los mencionados días se llevará a cabo el sorteo del orden de audición de los aspirantes. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En cada fase, la comparecencia de los aspirantes será requerida de viva voz; se excluirán los que no comparezcan al sorteo. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En cada una de las pruebas, el Tribunal se reserva la potestad de ponerles fin en el momento que considere oportuno. Se velará para evitar cualquier marca, aviso o señal que pudiera identificar el aspirante. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Queda prohibido el uso de teléfonos móviles o otros dispositivos para todos los aspirantes y para los miembros del Tribunal durante la realización de las pruebas con tal de impedir cualquier tipo de comunicación entre el Tribunal y cualquier persona ajena a este. Los aspirantes quedan advertidos de que el hecho de utilizarlos dará lugar a la exclusión de la audición. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los aspirantes deberán observar en cada momento las instrucciones de los miembros del Tribunal o del secretario durante la celebración de las pruebas para un desarrollo adecuado. Cualquier alteración en el normal desarrollo de las pruebas por parte de alguno de los aspirantes quedará reflejada en el acta correspondiente, pudiendo continuar el mencionado aspirante el desarrollo del ejercicio con carácter condicional hasta que el Tribunal resuelva sobre el incidente. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los aspirantes perderán su derecho cuando de personen al lugar de celebración de los ejercicios cuando ya se haya iniciado el sorteo previo a las fases o por la inasistencia a las mismas, aunque se deba a causas de fuerza mayor. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Las pruebas serán abiertas al público, cumpliendo con las medidas sanitarias relativas al COVID-19. No podrá accederse a las salas una vez comenzadas las pruebas. De igual modo, no se permitirá el uso de móviles u otros dispositivos electrónicos al público asistente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Las pruebas de selección consistirán en cuatro fases, siendo las tres primeras audiciones y la última un trial, con las concreciones siguientes: &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Primera fase: con cortina, tendrá carácter eliminatorio para los candidatos que obtengan menos de 6 puntos.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Segunda fase: con cortina, tendrá carácter eliminatorio para los candidatos que obtengan menos de 6 puntos.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Tercera fase: con cortina, tendrá carácter eliminatorio para los candidatos que obtengan menos de 6 puntos.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Finalizada la tercera fase, el Tribunal acordará que pasen a la siguiente fase consistente en una Prueba de Orquesta (Trial) los tres candidatos que, habiendo superado la tercera fase, hubieran obtenido las notas más altas resultado de la media de la segunda y tercera fase (mínimo de 6 en ambas), y sumado al mérito de lengua catalana a dicha media.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Cuarta fase: Prueba de Orquesta (Trial) &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Consistirá en la participación de cada uno de los tres aspirantes seleccionados en un máximo de tres programas a ejecutar por la OSIB, uno de ellos, al menos, bajo del director titular de la OSIB.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Durante esta fase del proceso de selección, los candidatos se someterán a las mismas condiciones laborales que los trabajadores que acuden como refuerzo a la ejecución de programas concretos con la OSIB. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El orden de participación de los candidatos se determinará por sorteo y solamente podrá modificarse en el caso de imposibilidad justificada de asistir al que le corresponda. A la vista del desarrollo de esta prueba, el Tribunal podrá decidir que alguno de los candidatos no agote los tres programas previstos, lo cual supondrá su exclusión del procedimiento. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Tras el desarrollo de esta prueba, el Tribunal procederá a la selección final del candidato y para ello se procederá de la siguiente forma: &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;• En una primera votación se descartará al candidato que, de los tres que hayan pasado a la Fase de Prueba de Orquesta (Trial), haya mostrado menor nivel según el parecer del Tribunal. Para ello se procederá a votar a los tres candidatos por parte de cada miembro del Tribunal, que dispondrá de un único voto, y se descartará al que menos votos positivos haya obtenido. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;• Sobre los dos candidatos restantes se procederá a una nueva votación en las mismas condiciones, y se propondrá para su contratación a aquel que mayor número de votos positivos haya obtenido, debiendo contar con el voto favorable del director titular.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;8.&amp;nbsp;Sistema de calificación&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Cada miembro del Tribunal puntuará cada ejercicio de cada fase con un número del 0 (puntuación más baja) al 10 (puntuación más alta), y podrá añadir como máximo un decimal. Una vez anotadas todas las puntuaciones de todo el Tribunal, se rechazarán la más alta y la más baja. Finalmente, se realizará una media con dos decimales, la cual será la puntuación final de la fase.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La puntuación que los miembros del Tribunal otorguen a cada aspirante será secreta. Cada miembro del Tribunal tendrá un folio para cada prueba, en el cual escribirá la nota otorgada y las observaciones que considere. Este folio será anónimo y la persona que ejerza la secretaría del Tribunal lo recogerá al final de cada prueba. El resultado de la fase será anunciado públicamente por parte del secretario del Tribunal y al día siguiente en la web de la Fundació. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Para la confección de las listas de resultados acabada la tercera fase (la cual determinará quién pasa a la fase de Trial), a los aspirantes que hayan obtenido un mínimo de 6 tanto en la segunda como en la tercera fase, deberá sumárseles el hacer la media de la segunda y la tercera fase, y en dicha media deberá sumarse el mérito relativo a la acreditación de los siguientes niveles de catalán de la siguiente forma: &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;
	&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Certificado de nivel C1 de catalán: +0,10 puntos. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Certificado de nivel C2 de catalán: +0,20 puntos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Dado que los dos niveles de catalán pertenecen al mismo itinerario, la puntuación no es acumulativa, en el sentido de que la puntuación para el certificado de nivel superior se le subsuma la del certificado de nivel inferior.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;9.&amp;nbsp;Resultados de las pruebas y trial&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Una vez acabada la tercera fase, el Tribunal publicará una lista provisional por instrumento y por orden de mayor a menor puntuación de los aspirantes que hayan superado todas las fases, sumándose a la puntuación de la tercera fas (si hubieran obtenido más de un 6) el mérito del conocimiento de lengua catalana para la confección de esas listas. Las personas que ocupen los tres primeros puestos de la lista, pasaran a la fase de Trial. El resto de personas conformarán las bolsas. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La publicación de las listas provisionales dará lugar al inicio de un plazo de tres días hábiles contados a partir del día siguiente a la publicación en caso de que se desee recurrir o impugnar los resultados. Finalizado dicho plazo, se publicarán las listas definitivas, y la publicación de las mismas servirá de comunicación en relación con las posibles reclamaciones. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Durante la fase Trial, el resultado de cada votación y decisión tomada deberá de ser publicada en la web de la Fundació. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Por lo tanto, el Tribunal declarará para cada una de las plaza o especialidades, como único aprobado a cada plaza, a los aspirantes que superen la fase de Trial como los más votados y elevará el acta al órgano competente. Según el Conveni Col·lectiu, sus contratos establecerán un período de prueba de seis meses. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Las personas propuestas para ocupar las plazas podrán ser requeridas en el momento de la firma del contrato para presentar los originales de las titulaciones o certificados presentados como requisitos y méritos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;10.&amp;nbsp;Funcionamiento de las bolsas&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los aspirantes que hayan superado la tercera fase (más de un 6) pero que no pasen a la fase de Trial, formarán parte de una bolsa de empleo para futuras contrataciones laborales como interinos o como refuerzos. Estas listas serán prioritarias sobre anteriores listas conformadas a tal efecto, quedando estas últimas como subsidiarias. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Las bolsas de empleo tendrán una vigencia máxima de tres años, a partir de la publicación de las listas definitivas de cada instrumento. La vigencia de las bolsas podrá ser prorrogada con carácter extraordinario mediante Resolución motivada. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La llamada de las personas se realizará por estricto orden de la puntuación obtenida. Una vez finalizada la relación laboral por el Real Decreto 1435/85 o la relación laboral temporal o de interinidad, el aspirante se reincorporará a la bolsa en su puesto originario. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La renuncia a incorporarse a una plaza, excepto en los casos de llamadas realizadas en el marco del régimen jurídico de artistas en espectáculos públicos (Real Decreto 1435/85), supondrá pasar al último puesto de la lista. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Las bolsas de los instrumentos incluidos en esta convocatoria serán las prioritaria de la Orquesta, y las anteriores quedarán como bolsas subsidiarias cuando se agoten las formadas por la presente oposición. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Solamente los candidatos que figuran en las listas de interinos que hayan obtenido más de un 7 podrán ser contratados para ejercer las funciones de solista en las diferentes modalidades de contratos que se precisen.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;11.&amp;nbsp;Protección de datos de carácter personal&lt;/strong&gt; &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En cumplimiento de lo dispuesto en la Ley orgánica 3/2018, de Protección de datos personales y garantías de los derechos digitales, la FOSIB informa a las personas interesadas en participar en el proceso selectivo objeto de la presente convocatoria, que los datos de carácter personal que faciliten serán incorporados a un archivo cuya finalidad es la selección de personal y les reconoce la posibilidad de ejercer gratuitamente los derechos de acceso, rectificación, cancelación y oposición, mediante escrito, acompañado de la fotocopia del DNI o documento equivalente, que podrá ser presentado en el registro de la FOSIB o en el correo informacio@simfonicadebalears.com &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La participación en el proceso selectivo supone la autorización de la FOSIB para proceder al tratamiento de sus datos en los términos anteriormente descritos, así como la publicación de los datos meramente identificativos y de los resultados de la convocatoria en los diarios y boletines oficiales correspondientes y en los tableros de anuncios o en la página web de laFOSIB, en su caso. Además, la participación también supone la autorización para que se traten los datos personales para la gestión de la bolsa de empleo que se derive de este proceso. De igual modo, implica la autorización para el tratamiento de la documentación que deben aportar los aspirantes en el curso del procedimiento de selección. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;12.&amp;nbsp;Reserva para personas con discapacidad&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;De acuerdo con lo dispuesto en el último párrafo del artículo 59.1 del Real Decreto Legislativo 5/2015, de 30 de octubre, por el cual se aprueba el Texto refundido de la Ley del Estatuto básico del empleado público, se reserva una cuota del 7% de las vacantes para que las cubran personas con un grado de discapacidad igual o superior al 33%, sin perjuicio que deba acreditarse la compatibilidad con las funciones de la categoría profesional correspondiente. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;A tal efecto, se les debe ofrecer las vacantes número 7 y las posteriores, de catorce en catorce, de la bolsa, es decir, los números 21, 35, 49, 63… y así sucesivamente. No obstante, se les debe ofrecer también puestos de trabajo cuando les corresponda por la puntuación obtenida en el proceso. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Las plazas correspondientes a la Oferta Pública de Empleo 2021 no son de reserva para personas con discapacidad. No obstante, con independencia de que formen parte de la bolsa general, deberá constituirse una lista de turno específico de personas con discapacidad, por orden de prelación. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En cualquier caso, la oferta del puesto esta supeditada al hecho de que la discapacidad de la persona aspirante concreta sea compatible con las tareas del puesto de trabajo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
