El Consejo Ejecutivo del Consejo Insular de Menorca, mediante el acuerdo adoptado en la sesión de carácter ordinario de día 11 de abril de 2022, aprobó las bases y la convocatoria de las ayudas para paliar los daños ocasionados en las explotaciones agrarias por la depresión aislada en niveles altos (de ahora en adelante DANA) de día 21 de septiembre de 2021. Estas bases se publicaron en lo BOIB núm. 61 de 10 de mayo de 2022.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#00000a"><span style="line-height:100%">2. El plazo de presentación de solicitudes se extendió de día 16 de mayo a día 3 de junio de 2022, ambos incluidos. Durante este plazo se presentaron 31 solicitudes de ayuda y, de estas, 28 cumplen todos los requisitos establecidos en las bases. Del resto de solicitudes presentadas, uno de los solicitantes duplicó su solicitud, uno desistió en su petición y otro no cumple los requisitos de las bases.</span></span></span></p> <table border="1" style="border:1px solid #000000; El objeto de esta ayuda es compensar los daños provocados como consecuencia directa de la DANA de día 21 de septiembre de 2021, que atravesó Menorca descargando lluvias torrenciales que, en el caso de algunas zonas de Ferreries, superaron los 126 litros por metro cuadrado, y con una intensidad superior a los 80 l/h.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#00000a"><span style="line-height:100%"><span style="color:#000000">Estas ayudas se conceden de acuerdo con el Reglamento UE núm. 1408/2013, de la Comisión de 18 de diciembre de 2013, relativo a la aplicación de los artículos 107 y 108 del Tratado de funcionamiento de la Unión Europea a las ayudas de minimis en el sector agrícola (Diario Oficial de la Unión Europea núm. L352 de 24 de diciembre de 2013), modificado por el Reglamento UE núm. 2019/316 de la Comisión de 21 de febrero de 2019.</span></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#00000a"><span style="line-height:100%">5. La finalidad de estas ayudas es compensar los daños provocados como consecuencia directa de la DANA de día 21 de septiembre de 2021, dado que se trata de un fenómeno climático adverso asimilable a un desastre natural, que ocasionó graves desperfectos que ponen en peligro la viabilidad de las explotaciones agrarias afectadas.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#00000a"><span style="line-height:100%">6. La base 6 de estas ayudas establece la cuantía de las ayudas y determina el importe de la subvención. El punto sexto establece el pago anticipado de 3.000 € en el momento de aprobar la concesión de las ayudas.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#00000a"><span style="line-height:100%">7. <span style="color:#000000">La base 7 de las ayudas establece cuáles son los gastos subvencionables. El punto tercero dice que «De acuerdo con el establecido en el artículo 31 de la Ley 38/2003, de 17 de noviembre, general de subvenciones, es gasto subvencionable y, por lo tanto, forma parte del presupuesto inicial del proyecto que se presente, la que responda a la naturaleza de este, sea estrictamente necesaria para planificar, preparar, coordinar, ejecutar y difundir el proyecto y, esté legalmente justificada con facturas u otros documentos que lo acrediten.</span></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#00000a"><span style="line-height:100%"><span style="color:#000000">Además del cumplimiento de los requisitos establecidos en esta base, solo se puede considerar como gasto realizado y, por lo tanto, subvencionable la que se haya pagado antes de acabar el plazo de presentación de la justificación de la ayuda. En caso de las actuaciones que no comporten gastos directo, la justificación se tiene que hacer a través del informe previo. La forma de acreditar este pago y el plazo para llevarlo a cabo se regulan en la base décima (Justificación de los gastos). font-size:12px"><span style="color:#00000a"><span style="line-height:100%"><span style="color:#000000"><strong>Segundo.</strong> Denegar, después de haber tramitado el correspondiente requerimiento, la ayuda solicitada por Ganaderia Son Martorellet, SL con NIF B07310436 dado que no consta en el Registro General de Explotaciones Agrarias de Menorca (RÍA) y tampoco constaba en el momento en que se produjeron los daños por la DANA.</span></span></span></span></p> <p><strong>Tercero</strong>. Entender que el solicitante Obres Sa Sínia SL con NIF B07310436 ha desistido en su petición, dado que no ha contestado al requerimiento.</p> <p><strong>Cuarto</strong>. El plazo para justificar el cumplimiento de los compromisos adquiridos es el día 31 de octubre de 2022, salvo que haya causas excepcionales que lo impidan y que los beneficiarios puedan alegar por escrito antes de que acabe este plazo.</p> <p><strong>Quinto</strong>.
