    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El Consell Executiu del Consell Insular d'Eivissa, en reunión ordinaria de fecha 29 de septiembre de 2022, aprobó por unanimidad, el siguiente acuerdo: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;PRIMERO. &lt;/em&gt;&lt;/strong&gt;&lt;em&gt;Aprobar la convocatoria de ayudas económicas, en régimen de concurrencia no competitiva, dirigidas a entidades o asociaciones en el ámbito de servicios sociales que hayan realizado inversiones para la ampliación y mejora de sus infraestructuras y para la adquisición de vehículos y equipamientos especializados, durante los años 2021 i 2022.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;SEGUNDO. &lt;/em&gt;&lt;/strong&gt;&lt;em&gt;Aprobar las bases de ayudas económicas y los anexos que la acompañan que han de regir dicha convocatoria y que obran en el expediente con el CSV: 14161355472663447247.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;TERCERO. &lt;/em&gt;&lt;/strong&gt;&lt;em&gt;Autorizar el gasto de un máximo de 1.500.000 euros (un millón quinientos mil euros), con cargo a la aplicación presupuestaria 2310.78900, de los vigentes presupuestos de la Corporación, para las ayudas económicas a entidades y asociaciones sin ánimo de lucro en materia de servicios sociales, en el ámbito de la isla de Eivissa, año 2022.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;CUARTO. &lt;/em&gt;&lt;/strong&gt;&lt;em&gt;Delegar en la consellera executiva del Departament de Benestar Social i Recursos Humans la resolución de concesión y pago de las ayudas, tal y como expone la base onceava de la convocatoria.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;QUINTO. &lt;/em&gt;&lt;/strong&gt;&lt;em&gt;Publicar en el Boletín Oficial de las Illes Balears y en la sede electrónica del Consell Insular las referidas bases, y posteriormente remitir la convocatoria y el extracto de la convocatoria a la Base de Datos Nacional de Subvenciones que dará traslado al Boletín Oficial de las Illes Balears del extracto para su publicación, tal cómo establece la normativa vigente de subvenciones. La eficacia de la convocatoria queda supeditada a la publicación del extracto en el en el BOIB.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Bases de &lt;span style="background-color:white"&gt;ayudas económicas, en régimen de concurrencia no competitiva, dirigidas a entidades o asociaciones en&lt;/span&gt; &lt;span style="background-color:white"&gt;el ámbito de servicios sociales que hayan realizado inversiones para&lt;/span&gt; &lt;span style="background-color:white"&gt;la ampliación&lt;/span&gt; &lt;span style="background-color:white"&gt;y&lt;/span&gt; &lt;span style="background-color:white"&gt;la mejora de sus infraestructuras y&lt;/span&gt; &lt;span style="background-color:white"&gt;para&lt;/span&gt; &lt;span style="background-color:white"&gt;la adquisición de vehículos y de equipamientos especializados, durante&lt;/span&gt; &lt;span style="background-color:white"&gt;los&lt;/span&gt; &lt;span style="background-color:white"&gt;años 2021 y 2022&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Primera. Justificación &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La Ley 4/2009, de 11 de junio, de servicios sociales en las Illes Balears, en su articulo 90.1 prevé que las administraciones públicas, en materia de servicios sociales, pueden otorgar subvenciones y otras ayudas a las entidades de iniciativa social para cooperar en el cumplimiento de sus actividades de servicios sociales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El Departament de Benestar Social i Recursos Humans pretende, con la aprobación de la presente convocatoria de ayudas, dar soporte a las entidades sin ánimo de lucro del ámbito de servicios sociales, con la finalidad de favorecer la mejora de las infraestructuras existentes, la ampliación de la cobertura de necesidades con la creación de nuevos espacios de atención y la adquisición de vehículos, así como equipamientos especializados que repercutirán en una mayor calidad en la atención que reciben las personas usuarias de los referidos servicios sociales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Esta convocatoria está prevista en el Plan estratégico de subvenciones del Consell Insular d'Eivissa para el año 2020-2022, aprobado por acuerdo del Consell Executiu de fecha 7 de febrero de 2020 y publicado en el BOIB núm. 20, de 15 de febrero de 2020; modificado en materia de servicios sociales, entre otros, por las resoluciones de fecha 26 de enero de 2022 y de fecha 2 de agosto de 2022, dictadas ambas por el consejero ejecutivo del Departament d'Hisenda, Gestió Econòmica, Esports i Joventut publicadas en el BOIB núm. 18, de 3 de febrero de 2022 y en el BOIB núm. 106, de fecha 11 de agosto de 2022.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Segunda. Objeto y finalidad&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El objeto de estas bases es fijar los criterios y el procedimiento de concesión de las ayudas económicas dirigidas a dar soporte a la financiación de los gastos de inversión que en materia de servicios sociales realicen las entidades y las asociaciones sin ánimo de lucro en la isla de Eivissa, de acuerdo con las características y los requisitos que establecen estas bases.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los gastos de inversión previstos en esta subvención son los ocasionados por las entidades que han tenido que hacer obras para mejorar y/o ampliar las infraestructuras existentes y para hacer frente a los gastos derivados de la adquisición de vehículos para la atención de las personas usuarias, así como equipamientos especializados necesarios para la atención del colectivo de atención.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Queda excluida de esta convocatoria, la tipología de entidades siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Entidades y asociaciones de personas mayores sin ánimo de lucro.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Tercera. Consignación presupuestaria&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El presupuesto para esta convocatoria es de un millón quinientos mil euros (1.500.000 €) con cargo a la aplicación presupuestaria 2310 78900 del vigente presupuesto de la Corporación, que se distribuirá según las modalidades que se detallan en la base quinta de esta convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Cuarta. Ámbito temporal y ámbito de aplicación&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Son subvencionables los gastos ocasionados objeto de esta convocatoria, que cumplan los requisitos que establece la misma realizados dentro del periodo comprendido entre el 1 de enero de 2021 y hasta el 15 de noviembre de 2022, ambos incluidos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El ámbito de aplicación territorial de esta convocatoria es la isla de Eivissa, de forma que únicamente podrán ser beneficiarias aquellas entidades o asociaciones que desarrollen proyectos dirigidos a personas que vivan en la isla de Eivissa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Quinta. Modalidades de las ayudas y actividades subvencionables&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;5.1.&lt;/strong&gt; Se establecen dos modalidades de ayuda con la siguiente consignación presupuestaria para cada una:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;a)&lt;/em&gt; Modalidad A: Ayudas económicas para proyectos de inversiones a entidades y asociaciones en el ámbito de servicios sociales sin ánimo de lucro, dirigidas a aquellas entidades que, para ampliar la cobertura de necesidades al colectivo de atención, así como para mejorar las infraestructuras existentes, han tenido que hacer obras, durante los años 2021 y 2022. Las entidades participantes en estas modalidades podrán presentar proyectos de inversión que afecten a más de un centro y/o punto de atención. Consignación presupuestaria: 1.000.000 €. La ayuda máxima que puede recibir cada entidad o asociación en esta modalidad es de 200.000 €.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;b)&lt;/em&gt; Modalidad B: Ayudas económicas para proyectos de inversiones dirigidas a entidades y asociaciones en el ámbito de servicios sociales sin ánimo de lucro que han hecho frente o prevén tener gastos para la adquisición de vehículos para la atención y/o el tratamiento de las personas usuarias, así como equipamientos especializados necesarios para la atención de las personas usuarias, durante los años 2021 y 2022. Consignación presupuestaria: 500.000 €. La ayuda máxima que puede recibir cada entidad o asociación en esta modalidad es de 75.000 €.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;A efectos de esta convocatoria se entiende por &lt;em&gt;equipamientos especializados&lt;/em&gt; aquellos instrumentos, equipamientos o sistemas técnicos que son necesarios para evitar, compensar, mitigar o neutralizar la deficiencia o la discapacidad y mejorar la autonomía personal y calidad de vida de las personas atendidas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Una misma entidad podrá presentar una única solicitud de ayuda económica por modalidad. Se deberá presentar una solicitud con la documentación correspondiente establecida en la cláusula novena para cada modalidad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En el caso de que una entidad se presente a dos modalidades, la suma de las cantidades solicitadas no puede superar los 275.000 €.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El límite anterior de 275.000 € se podrá superar solamente cuando se den las circunstancias establecidas en el tercer supuesto de reparto de la base décima de esta convocatoria, que regula el procedimiento de concesión de las ayudas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Cada modalidad tiene establecida una ayuda máxima que se puede recibir. Esta ayuda máxima solamente se podrá superar en el caso de que, una vez hecho el reparto establecido en la base décima quede remanente en la modalidad en la que participe, siempre y cuando no supere la cantidad solicitada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;5.2.&lt;/strong&gt; Los gastos subvencionables son los derivados de las inversiones que, las entidades han realizado o tienen que realizar, para los conceptos siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Obras para la mejora de las infraestructuras ya existentes donde se desarrollan los servicios sociales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Obras para la adaptación de nuevos espacios (centros, viviendas) destinados a la ampliación de la cobertura que ofrece la entidad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Inversiones relacionadas con la mejora y el mantenimiento de los centros/servicios donde se desarrolla la actividad de la asociación, que no supongan obras, como por ejemplo fontanería, electricidad, pintura, paneles separadores...&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los gastos derivados de la redacción de proyectos de inversión (obras, remodelaciones...), siempre que se ejecute la obra prevista en el proyecto.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los gastos relativos a los trabajos técnicos vinculados a los proyectos de inversión presentados, así como las licencias y los gastos fiscales correspondientes. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Gastos relacionados con la adquisición de vehículos que se destinen a la actividad propia de la entidad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Adquisición de equipamientos especializados destinados a la atención de personas usuarias.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;5.3.&lt;/strong&gt; Las particularidades a tener en cuenta en relación con los gastos subvencionables son los siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En el caso de presentarse a la modalidad A de las ayudas, se deberá justificar la necesidad de la inversión realizada mediante un informe justificativo de la necesidad de ampliación y/o mejora de las infraestructuras, o aquellas relacionadas con su mantenimiento. Se deberá justificar, según corresponda en cada caso, estar en posesión de las correspondientes autorizaciones administrativas, como por ejemplo: licencia de obras / licencia de actividad / comunicación previa, cédula de habitabilidad. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En el caso de presentarse a la modalidad B de las ayudas, si se solicita una ayuda para la adquisición de un vehículo, este debe ir a nombre de la entidad y se deberá presentar un informe justificativo del uso al cual se destinará el vehículo para el que se solicita la ayuda.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En el caso de presentarse a la modalidad B de las ayudas, si se solicita una ayuda para la adquisición de equipamientos especializados se deberá presentar un informe que exponga a qué necesidad da cobertura el referido equipamiento y a qué actividad/proyecto está relacionada su adquisición.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;5.4.&lt;/strong&gt; Las entidades beneficiaras de una ayuda económica regulada por estas bases, deberán cumplir con lo establecido en el articulo 31.4 de la Ley 38/2003, de 17 de noviembre, general de subvenciones, en relación con las subvenciones otorgadas para la adquisición, la construcción, la rehabilitación y la mejora de bienes inventariables, los cuales han de seguir las siguientes reglas:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;a)&lt;/em&gt; El período durante el cual la entidad beneficiaria debe destinar los bienes a la finalidad concreta para la cual fue concedida la subvención, no podrá ser inferior a cinco años en caso de bienes inscribibles en un registro público, ni a dos años para el resto de bienes. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;b)&lt;/em&gt; El incumplimiento de la obligación de destino referida en el párrafo anterior, que se producirá en todo caso con la alienación o el gravamen del bien, es causa de reintegro, en los términos que establece el capítulo II del título II de esta ley y el bien quedará sujeto al pago del reintegro, sea cual sea el poseedor, salvo que resulte ser un tercer protegido para la fe pública registral o se justifique la adquisición de los bienes con buena fe y justo título o en establecimiento mercantil o industrial, en caso de bienes muebles no inscribibles.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Por otro lado, el artículo 31.5 de la referida Ley 38/2003 establece que no se considerará incumplida la obligación de destino referida en el apartado anterior cuando: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;a)&lt;/em&gt; Tratándose de bienes no inscribibles en un registro público, fuesen sustituidos por otros que sirven en condiciones análogas a la finalidad para la cual se concedió la subvención y este uso se mantenga hasta completar el plazo establecido, siempre que la sustitución haya estado autorizada por la Administración concedente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;b)&lt;/em&gt; Tratándose de bienes inscribibles en un registro público, el cambio de destino, la alienación o el gravamen, sea autorizado por la Administración concedente. En este supuesto, el adquirente asumirá la obligación de destino por el plazo restante, y en caso de incumplimiento de esta, del reintegro de la subvención.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;5.5.&lt;/strong&gt; No serán gastos subvencionables:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Los gastos de inversión relacionados con la adquisición de bienes inventariables: mobiliario, equipos de oficina, equipos informáticos, equipos audiovisuales y equipos de imagen.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Los intereses deudores de las cuentas bancarias.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Intereses, recargos y sanciones administrativas y penales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Los gastos de procedimientos judiciales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Los impuestos indirectos cuando sean susceptibles de recuperación o compensación, ni los impuestos personales sobre la renta. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;div style="page-break-after:always"&gt;&lt;span style="display:none"&gt;&amp;nbsp;&lt;/span&gt;&lt;/div&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Sexta. Entidades beneficiarias&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Podrán solicitar la subvención únicamente las entidades y las asociaciones de servicios sociales sin ánimo de lucro que realicen las actuaciones que figuran en el objeto de esta convocatoria, y que cumplan los requisitos siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ol&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Estar legalmente constituidas con dos años de antelación a la fecha de finalización del plazo de presentación de la solicitudes. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;No tener ánimo de lucro.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Estar inscritas en el Registro de Asociaciones del Govern de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Estar inscritas en el Registro de Servicios Sociales previsto en la Ley 4/2009, de 11 de junio, de servicios sociales de las Illes Balears o haber solicitado la inscripción y estar en condiciones de obtenerla, antes de la publicación de estas bases en el BOIB.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Tener su domicilio social en la isla de Eivissa, que tengan delegación o que habitualmente desarrollen allí sus actividades.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Estar al corriente en el cumplimiento de las obligaciones tributarias y de la Seguridad Social y con las obligaciones tributarias del Consell Insular d'Eivissa, con anterioridad a dictar la propuesta de resolución de concesión y en el momento de efectuar el pago.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;No encontrarse sometidas a ninguno de los supuestos de prohibición por ser beneficiarias de subvenciones establecidas en el artículo 10 del Texto refundido de la Ley de subvenciones, aprobado por Decreto legislativo 2/2005, de 28 de diciembre, y con el artículo 13 de la Ley 38/2003, de 17 de noviembre, general de subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En esta convocatoria, no se consideran entidades beneficiarias: las entidades con finalidad lucrativa, comercial, mercantil o similares; los colegios y las asociaciones profesionales; las federaciones y las entidades deportivas; los centros docentes o de enseñanza; las corporaciones locales y las entidades de derecho público y las entidades de tipo político o sindical.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ol&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Séptima. Compatibilidad de las ayudas&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Las subvenciones que se otorguen de acuerdo con esta convocatoria son compatibles con las que puedan otorgar otras entidades públicas o privadas por el mismo objeto.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El importe de las subvenciones en ningún caso, puede ser de una cuantía tal que, aisladamente o en concurrencia con otras subvenciones, ayudas, ingresos o recursos, supere el coste de la actividad subvencionada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Octava. Publicidad&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:null"&gt;Estas bases se publicarán en el &lt;em&gt;Butlletí Oficial de les Illes Balears &lt;/em&gt;(BOIB) y en el tablón de anuncios de la Sede electrónica del Consell Insular d'Eivissa (www.seu.conselldeivissa.es).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La convocatoria y un extracto de las bases se publicarán en la Base de Datos Nacional de Subvenciones, que dará traslado al BOIB del extracto para su publicación, en virtud de lo que prevé el articulo 20 de la Ley 38/2003, de 17 de noviembre, general de subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La eficacia de la convocatoria queda supeditada a la publicación del extracto en el BOIB.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Novena. Presentación de solicitudes y documentación adjunta&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El plazo para presentar las solicitudes será de diez días hábiles, a partir del día siguiente a la fecha de publicación del extracto de la convocatoria de las ayudas reguladas en estas bases en el BOIB.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:null"&gt;Las solicitudes de las ayudas se formalizarán mediante instancia, según el modelo normalizado que figura en el Anexo I de estas bases, debidamente cumplimentado. El modelo de solicitud, así como los anexos que lo deben acompañar, se facilitaran en la dirección de la Sede electrónica (https://seu.conselldeivissa.es).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Se presentaran en el Registro Electrónico General de la misma Institución o en cualquiera de las formas establecidas en el artículo 14.2 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Las solicitudes irán acompañadas de la documentación siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Documento que acredite que la persona solicitante es la representante legal de la entidad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Copia de la tarjeta de identificación fiscal (NIF) de la entidad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Documentación que acredite la inscripción de la entidad en el Registro de Asociaciones de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Documento acreditativo de la inscripción de la entidad o la asociación en el Registro Unificado de Servicios Sociales de las Illes Balears previsto en la Ley 4/2009, de 11 de junio, de servicios sociales de las Illes Balears o la solicitud de inscripción en caso de estar en situación de trámite.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los estatutos de la asociación debidamente legalizados, en los cuales deberá constar explícitamente la inexistencia de ánimo de lucro, así como el ámbito territorial de la entidad o la asociación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Presupuesto detallado de ingresos y gastos del coste total del proyecto de inversión, por cual se solicita la subvención, según modelo normalizado que figura como Anexo II de esta convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Memoria explicativa de la inversión por la cual se solicita la subvención (Anexo III), que debe hacer referencia a qué necesidad da cobertura el referido gasto de inversión y a que centro y/o punto de atención de la entidad afecta la inversión, especificando cual es la actividad de la entidad a la cual repercutirá la inversión.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:null"&gt;&lt;span style="background-color:white"&gt;Solicitud de alta o modificación como acreedor del Consell Insular d'Eivissa a efectos económicos; este trámite está disponible en la dirección de la Sede electrónica (&lt;/span&gt;https://seu.conselldeivissa.es&lt;span style="background-color:white"&gt;). Esta solicitud solo&lt;/span&gt; &lt;span style="background-color:white"&gt;la deben&lt;/span&gt; &lt;span style="background-color:white"&gt;cumplimentar las entidades que haga más de cinco&lt;/span&gt; &lt;span style="background-color:white"&gt;años que presentaron&lt;/span&gt; &lt;span style="background-color:white"&gt;el antiguo impreso o que hayan cambiado de cuenta bancaria&lt;/span&gt; &lt;span style="background-color:white"&gt;y aquellas entidades que presenten solicitud por primera vez.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Declaración responsable de no haber solicitado otra ayuda o subvención por el mismo concepto; si es el caso, relación de las subvenciones y ayudas solicitadas o concedidas, con indicación de los importes y de las entidades subvencionadoras y declaración de no incurrir en ninguna de las prohibiciones establecidas en los apartados 2 y 3 del artículo 13 de la Ley 38/2003, de 17 de noviembre, general de subvenciones (Anexo IV y Anexo V).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Documento acreditativo del régimen de tenencia del espacio donde se realiza el proyecto por el cual se solicita la subvención.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Documentación que justifique estar en posesión de las correspondientes autorizaciones administrativas, como: licencia de obras / licencia de actividad / comunicación previa, cédula de habitabilidad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Cualquier otra documentación que la entidad o la asociación considere conveniente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Las entidades solicitantes que hayan efectuado gastos imputables al proyecto de inversión por el cual se solicita la ayuda, desde el 1 de enero de 2021 hasta la fecha de la presentación de la solicitud, podrán presentar la documentación justificativa de estas para que el órgano instructor valore la justificación presentada y proceda al pago de los gastos una vez que se haya aprobado la concesión de las ayudas, tal como se expone en la cláusula decimotercera.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Las asociaciones y/o las entidades privadas sin ánimo de lucro que hayan presentado en este Consell cualquier documento citado anteriormente, en virtud de anteriores convocatorias de subvenciones en materia de acción social, solo deberán aportar la documentación que sea necesaria actualizar o renovar, siempre que no hayan transcurrido más de cinco años desde que presentó la documentación y se señalen la fecha y el órgano ante el cual se presentó.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El Consell Insular d'Eivissa puede solicitar, además, toda la documentación complementaria que considere necesaria para evaluar correctamente la solicitud.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Si la instancia o la documentación presentadas fueran incorrectas o incompletas, el Consell Insular requerirá la rectificación o los complementos necesarios, que deberán aportarse en el plazo de diez días hábiles, a partir del requerimiento correspondiente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Si durante este plazo las persones interesadas no hacen la rectificación reclamada o no presentan la documentación requerida, se considerará que desisten de su petición, después de haber tomado la resolución pertinente, de acuerdo con el artículo 68.1 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Décima. Procedimiento de concesión de las ayudas&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La concesión de las ayudas correspondientes a esta convocatoria son en régimen de concurrencia no competitiva.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los criterios de distribución que han de regir el otorgamiento de la subvención para ambas modalidades son:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Una misma entidad podrá presentar una única solicitud de ayuda económica por modalidad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Cada modalidad tiene establecido un importe de ayuda máxima que puede recibir una entidad participante.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La suma de la ayuda que puede recibir una misma entidad no puede superar el importe de 275.000 €.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El reparto de la dotación presupuestaria de cada modalidad se puede realizar según el supuesto que se dé:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Primer supuesto: &lt;/strong&gt;Se otorgará hasta el 100 % de la cantidad solicitada por la entidad o asociación para cada una de las modalidades previstas en la presente convocatoria, siempre que no se agote el importe global máximo destinado a cada modalidad y con el límite máximo previsto por entidades o asociaciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Segundo supuesto:&lt;/strong&gt; Cuando la suma de las cantidades solicitadas supere el importe de la dotación asignada para cada modalidad, se repartirá entre las entidades participantes la cantidad solicitada si esta no supera el importe de 200.000 € por lo que respecta a la modalidad A y el importe de 75.000 € en el caso de la modalidad B.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En el caso de que el importe solicitado supere los importes referidos anteriormente, se asignará el importe de 200.000 € a las entidades que participen en la modalidad A y 75.000 € a las entidades que participen en la modalidad B.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En el caso de que el reparto anterior no se pueda asignar por que se agota la asignación presupuestaria, se sumarán los importes asignados de 200.000€, en el caso de la modalidad A y de 75.000 € en el caso de la modalidad B, y se calculará el porcentaje del excedente. Posteriormente, este excedente obtenido se aplicará a cada entidad reduciendo la cantidad de 200.000 € o de 75.000 €. El resultado de esta reducción supondrá el importe de la ayuda que se ha de conceder a cada entidad participante.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Tercer supuesto: &lt;/strong&gt;Cuando la suma de las cantidades solicitadas supere el importe de la dotación asignada para cada modalidad, se repartirá entre las entidades participantes la cantidad solicitada si esta no supera el importe de 200.000 € por lo que respecta a la modalidad A y el importe de 75.000 € en el caso de la modalidad B.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En el caso de que el importe solicitado supere los importes referidos anteriormente, se asignará el importe de 200.000 € a las entidades que participen en la modalidad A y 75.000 € a las entidades que participen en la modalidad B.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Si una vez hecho el reparto anterior queda dotación en una modalidad, se seguirá repartiendo el excedente de la modalidad de manera proporcional a la diferencia entre la cantidad solicitada y el importe inicialmente adjudicado y se podrá superar el límite establecido para la modalidad (200.000 € en el caso de la modalidad A y 75.000 € en el caso de la modalidad B).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Si una vez hecho el reparto establecido en los supuestos anteriores, hay remanente en una modalidad, esta cantidad se podrá pasar a la otra modalidad, de manera que se sumará a la cantidad prevista inicialmente y se repartirá la cantidad resultante, siguiendo los mismos criterios expuestos anteriormente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Undécima . Instrucción, resolución y notificación&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La instrucción, la realizará la cap de secció de Serveis Socials, que en caso de ausencia justificada sera sustituida por la cap de secció adscrita, empleadas públicas del Departament de Benestar Social i Recursos Humans. La persona instructora debe llevar a cabo las actuaciones a las que se refiere el artículo 24 de la Ley 38/2003, de 17 de noviembre, general de subvenciones y el artículo 16 y siguientes del Texto refundido de la Ley de subvenciones, aprobado por Decreto legislativo 2/2005, de 28 de diciembre y debe formular la propuesta de resolución.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El órgano instructor puede solicitar los informes técnicos, tanto a las entidades como a técnicos especializados, que considere adecuados para elaborar la propuesta de resolución.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Para resolver la fase de valoración de la documentación aportada junto con la solicitud de la ayuda y determinar si las solicitudes presentadas cumplen los requisitos para ser entidades beneficiarias de la ayuda económica, se dispondrá de la valoración de un/a técnico/a de Serveis Tècnics del Departament de Presidència i Gestió Ambiental i de un/a técnico/a de la Secció de Serveis Socials del Departament de Benestar Social i Recursos Humans del Consell Insular d'Eivissa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Una vez evaluadas las solicitudes, la persona instructora emitirá una propuesta de resolución provisional, debidamente motivada, que se notificará a las entidades o las asociaciones interesadas mediante publicación en la Sede electrónica del Consell Insular d'Eivissa y se concederá un trámite de audiencia para que en un plazo de diez días hábiles desde la publicación de la propuesta de resolución puedan presentar alegaciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Finalizado el trámite de audiencia sin que se hayan presentado alegaciones o una vez que se hayan resuelto las presentadas, la persona instructora emitirá informe, que servirá de base para la elaboración de la propuesta de resolución definitiva al órgano competente para resolver la concesión de estas ayudas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Las propuestas de resolución provisional y definitiva no reconocen ningún derecho a favor del beneficiario propuesto ante la Administración, mientras no se haya notificado la resolución de concesión.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El órgano competente para aprobar esta convocatoria es el Consell Executiu del Consell Insular d'Eivissa, a propuesta de la consellera executiva del Departament de Benestar Social i Recursos Humans. Si bien la concesión se realizará mediante resolución de la consellera executiva del Departament de Benestar Social i Recursos Humans, por delegación del Consell Executiu.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La publicación de los actos y trámites del procedimiento y, en particular, la apertura del trámite de audiencia y la resolución de concesión, se realizará en el tablón de anuncios de la Sede electrónica del Consell Insular (https://seu.conselldeivissa.es), de acuerdo con el artículo 45.1.&lt;em&gt;b &lt;/em&gt;de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los expedientes se resolverán en un plazo máximo de seis meses a contar desde la finalización del plazo de presentación de las solicitudes a las que se refiere esta convocatoria. Transcurrido este plazo sin que se haya dictado acuerdo exprés, la solicitud se debe entender desestimada, de conformidad con lo que prevé el artículo 25.4 de la Ley 38/2003, de 17 de noviembre, general de subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El acuerdo de concesión de las subvenciones será motivado y fijará con carácter definitivo la cuantía de las subvenciones concedidas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El acuerdo del Consell Executiu y la resolución de la consellera executiva del Departament de Benestar Social i Recursos Humans, actuando por delegación, no agota la vía administrativa y se podrá interponer recurso de alzada ante el Pleno del Consell Insular d'Eivissa en el plazo de un mes contador a partir del día siguiente al de la notificación, de acuerdo con los artículos 112.1, 121 i 122 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, en relación con el artículo 66.2 de la Ley 4/2022, de 28 de junio, de consells insulars y artículo 147.1 del Reglament orgànic del Consell Insular d'Eivissa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Doceava. Obligaciones de las entidades beneficiarias&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Las entidades beneficiarias de las subvenciones estarán obligadas a:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ol&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Llevar a cabo la actividad subvencionada que fundamenta la concesión de la subvención.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Justificar ante el Consell Insular d'Eivissa el cumplimiento de los requisitos y las condiciones y también la realización de la actividad y el cumplimiento de la finalidad que determinen la concesión o el goce de la subvención.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Comunicar de forma expresa al Consell Insular d'Eivissa cualquier propuesta de cambio que altere o modifique la inversión subvencionada y/o la finalidad por la cual estaba destinada la inversión realizada, para dar cumplimiento a la obligación de destino regulado en el artículo 31.4 y al artículo 31.5 de la Ley 38/2003, de 17 de noviembre, general de subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Comunicar al Consell Insular d'Eivissa la solicitud o la obtención de otras subvenciones para la misma finalidad procedentes de cualquier administración o entidad pública o privada, nacional o internacional. Esta comunicación ha de hacerse en el plazo de diez días hábiles a contar a partir de la solicitud o la obtención de la subvención concurrente y en todo caso, antes de justificar la aplicación que se haya dado al fondo percibido.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Someterse a las actuaciones de comprobación, seguimiento e inspección que pueda realizar el Consell Insular d'Eivissa y aportar toda la información y la documentación que le sea requerido.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Acreditar, en el momento de presentar la documentación justificativa de la realización del objeto subvencionable, que la entidad está al corriente en el cumplimiento de las obligaciones tributarias y con la Seguridad Social, así como con el Consell Insular d'Eivissa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Disponer de los libros contables, registros y el resto de documentación exigida para la normativa, a fin de garantizar el adecuado ejercicio de las facultades de comprobación y control y conservar los documentos justificativos de la aplicación de los fondos recibidos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Reintegrar los fondos recibidos en los supuestos previstos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Adoptar las medidas de difusión relativas al carácter público del financiamiento de la actividad objeto de subvención. A este efecto, se debe incluir de forma visible el soporte del Consell Insular d'Eivissa en las actuaciones realizadas por la entidad o la asociación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ol&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Así mismo, también quedan sometidas a todas aquellas otras obligaciones que deriven del Decreto legislativo 2/2005, de 28 de diciembre, por el cual se aprueba el texto refundido de la Ley de subvenciones y de la Ley 38/2003, de 17 de noviembre, general de subvenciones, y su Reglamento aprobado por Real decreto 887/2006, de 21 de julio, en todo aquello que le sea de aplicación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El Consell Insular d'Eivissa podrá inspeccionar las inversiones subvencionadas, sin perjuicio de las competencias que puedan corresponder, por normativa legal o reglamentaria, a otros organismos o instituciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Cualquier alteración de las condiciones tenidas en cuenta para conceder la ayuda y, en cualquier caso, la obtención de subvenciones incompatibles pueden dar lugar a la modificación de la resolución de concesión.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Treceava. Pago de la subvención y justificación&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El pago de la ayuda económica se efectuará mediante resolución de la consellera executiva del Departament de Benestar Social i Recursos Humans.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Las resoluciones de la consellera executiva, dictadas por delegación y que se deben considerar dictadas por el órgano delegante (el Consell Executiu), no agotan la vía administrativa y se podrá interponer recurso de alzada ante el Pleno del Consell Insular d'Eivissa en el plazo de un mes contador a partir del día siguiente de la publicación de la resolución en el BOIB, de acuerdo con los artículos 112.1, 121 i 122 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, en relación con el artículo 66.2 de la Ley 4/2022, de 28 de junio, de consells insulars y el articulo 147.1 del Reglament orgànic del Consell Insular d'Eivissa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La justificación y el pago de la ayuda que se conceda se efectuará de la manera siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Primero. &lt;/strong&gt;La justificación de los gastos derivados de la ejecución del proyecto durante el plazo comprendido entre el 1 de enero de 2021 y hasta la fecha de la presentación de la solicitud se deberá presentar junto a la solicitud de la ayuda económica.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El abono de los gastos imputados a la subvención se realizará una vez que se haya concedido la ayuda económica y una vez que se haya valorado la justificación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Se deberá presentar la documentación económica del coste de los gastos subvencionados tal y como se determina en esta base, excepto la liquidación final de ingresos y gastos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Además, el equipo constituido por un/a técnico/a de Serveis Tècnics del Departament de Presidència i Gestió Ambiental i un/a técnico/a de la Secció de Serveis Socials del Departament de Benestar Social i Recursos Humans del Consell Insular d'Eivissa realizará una visita de comprobación para acreditar la realización de las inversiones subvencionadas. Este equipo también valorará la documentación aportada para la justificación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Segundo. &lt;/strong&gt;El resto de la cantidad a abonar se pagará una vez justificados y revisados los gastos correspondientes al resto del periodo subvencionable, es decir desde la fecha de presentación de las solicitudes hasta el 15 de noviembre de 2022. Su justificación se debe presentar como fecha máxima el 30 de noviembre de 2022.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Para que los gastos imputados sean abonados en este plazo los técnicos y técnicas del Consell Insular d'Eivissa referidos anteriormente también realizaran la visita.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:null"&gt;Ambas justificaciones se deberán presentar en la dirección de la Sede electrónica (https://seu.conselldeivissa.es).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La subvención únicamente se dará como totalmente justificada una vez justificado el 100% del coste total previsto para la ejecución del proyecto de inversión objeto de esta convocatoria, presentado en la solicitud de la ayuda.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La documentación que se debe presentar para justificar debidamente los gastos subvencionables en cada modalidad, en ambas justificaciones es:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Documentación técnica consistente en una memoria justificativa del cumplimiento de las condiciones establecidas para la concesión de la subvención, con indicación de los gastos llevados a cabo, haciendo indicación de qué repercusión han tenido en relación con la actividad de la entidad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Documentación económica justificativa del coste del proyecto subvencionado en el que constará:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2.1. Una lista clasificada de los gastos realizados, con identificación del acreedor y del documento, su importe, fecha de emisión y, si es el caso, fecha de pago, así como los totales por concepto, tal y como se indica en el Anexo VI.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:null"&gt;Por otro lado, se facilitará en formato Excel la citada lista de gatos en el correo corporativo, en el momento de la presentación de la justificación: dep.benestar@conselldeivissa.es.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2.2. Las facturas originales de los gastos correspondientes a la inversión realizada con los respectivos justificantes de pago, emitidos y pagados desde el día 1 de enero de 2021 y hasta el 15 de noviembre de 2022, respetando los dos plazos de justificación establecidos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La entidad beneficiaria será la responsable de estampillar las facturas y el resto de documentos que sean cofinanciados, indicando las cantidades imputables a cada una de las subvenciones recibidas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Para justificar debidamente los gastos subvencionables se deberá aportar la acreditación de su abono dependiendo de los medios de pago que se hayan utilizado, a través de la documentación que a continuación se indica:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;a)&lt;/em&gt; Pago mediante transferencia bancaria o ingresos en cuenta bancaria:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:80px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Documento bancario acreditativo del pago en el cual figuren el concepto de la transferencia o el ingreso, la fecha del documento, el importe y los datos del ordenante y del destinatario, que han de coincidir con el beneficiario y con el emisor de la factura, respectivamente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;b)&lt;/em&gt; Pago en metálico: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:80px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Una factura original firmada y sellada por el proveedor, con la expresión “recibido en metálico” o similar.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;c)&lt;/em&gt; Pago mediante cheque nominativo:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Copia del cheque nominativo o pagaré nominativo emitido a nombre del proveedor que emite la factura o documento equivalente, siempre que esté vencido.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Extracto de la cuenta corriente del beneficiario de la ayuda en el que figure el cargo de este cheque o pagaré.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;d)&lt;/em&gt; Pago mediante tarjeta de crédito o débito:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:80px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Extracto de la cuenta en que figure el cargo del pago con tarjeta.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;e)&lt;/em&gt; Pago mediante domiciliación bancaria:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Extracto bancario donde figure el cargo de la domiciliación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2.3. Una declaración jurada sobre la justificación económica en que se declara que la entidad se encuentra dentro de preceptos previstos en la normativa reguladora de subvenciones, que cumplen con lo que se establece en las bases reguladoras en cuanto a las facturas justificativas, que los fondos percibidos se han aplicado íntegramente al objeto de la subvención y con el compromiso en relación con el cumplimiento de la obligación de destino de la inversión subvencionada en cumplimiento del articulo 31.4 y del articulo 31.5 de la Ley 38/2003, de 17 de noviembre, general de subvenciones (Anexo VII).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2.4. Para la última justificación, se debe aportar, además de la documentación anterior, la liquidación final de ingresos y gastos del proyecto subvencionado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Si se da el caso de que una entidad no haya efectuado gastos en el segundo plazo de justificación, ha de presentar toda la documentación justificativa en la primera justificación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Para aprobar la justificación y proceder al pago de la subvención se podrá solicitar cualquier otra documentación o informes técnicos que el Departamento de Benestar Social i Recursos Humans considere oportunos. Así mismo, se podrá solicitar a cualquiera de las entidades beneficiarias los originales de las facturas y justificantes de pago correspondientes a los gastos imputados a la subvención recibida.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Si el órgano competente para comprobar la justificación de la subvención aprecia defectos, lo debe comunicar a la entidad beneficiaria para que enmiende la justificación en el plazo de diez días.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Decimocuarta. Supuestos de reintegro&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;De acuerdo con lo que dispone el artículo 37 de la Ley 38/2003, de 17 de noviembre, general de subvenciones, será procedente el reintegro de las cantidades percibidas y la exigencia del interés de demora correspondiente desde el momento del pago de la subvención hasta la fecha en que se acuerde la procedencia del reintegro, o la fecha en que la persona deudora ingrese el reintegro si es anterior a esta, en los supuestos y las condiciones que se determinen en el referido artículo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;A efectos de posibles incumplimientos de las condiciones impuestas con motivo de la concesión de la subvención y, de conformidad con el artículo 13.&lt;em&gt;n &lt;/em&gt;del Decreto legislativo 2/2005, de 28 de diciembre, se establecen los siguientes criterios de graduación del posible incumplimiento:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El órgano instructor aplicará estos criterios para determinar la cantidad que finalmente deberá percibir la entidad o la persona beneficiaria o, en su caso, el importe a reintegrar.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El reintegro se realizará por el procedimiento establecido en el título II de la Ley 38/2003, de 17 de noviembre, general de subvenciones. Las cantidades reintegrables tienen la consideración de ingresos de derecho público y pueden ser exigidas por la vía de apremio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Decimoquinta. Régimen de infracciones y sanciones&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El régimen de infracciones y sanciones administrativas aplicables será el establecido en el título IV de la Ley 38/2003, de 17 de noviembre, general de subvenciones, y en el título V del Texto refundido de la Ley de subvenciones, aprobado por Decreto legislativo 2/2005, de 28 de diciembre. Todo ello sin perjuicio de las responsabilidades penales o civiles en qué se pueda incurrir.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Esta convocatoria se regirá por las disposiciones contenidas en sus bases y por la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, por Decreto legislativo 2/2005, de 28 de diciembre, por el que se aprueba el Texto refundido de la Ley de subvenciones de la Comunidad Autónoma de las Illes Balears y para la Ley estatal 38/2003, de 17 de noviembre, general de subvenciones y su Reglamento, aprobado por Real decreto 887/2006, de 21 de julio, en todo aquello que le sea de aplicación y el resto de normativa aplicable.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Respecto a la protección&lt;/span&gt; &lt;span style="background-color:white"&gt;y el&lt;/span&gt; &lt;span style="background-color:white"&gt;manejo de datos de carácter personal para la realización de las actividades objeto&lt;/span&gt; &lt;span style="background-color:white"&gt;de esta convocatoria se deben observar las prescripciones contenidas en la Ley orgánica 3/2018, de 5 de diciembre, de protección de datos&lt;/span&gt; &lt;span style="background-color:white"&gt;y garantía de los derechos digitales, en el Reglamento (UE) 2016/679 del Parlamento&lt;/span&gt; &lt;span style="background-color:white"&gt;y del Consell, de 27 de abril de 2016, relativo a la protección de las personas físicas por lo que respecta al manejo de datos personales y a la libre circulación&lt;/span&gt; &lt;span style="background-color:white"&gt;de estos datos&lt;/span&gt; &lt;span style="background-color:white"&gt;y&lt;/span&gt; &lt;span style="background-color:white"&gt;por el&lt;/span&gt; &lt;span style="background-color:white"&gt;que&lt;/span&gt; &lt;span style="background-color:white"&gt;se deroga la Directiva 95/46/CE (Reglamento general de protección de datos) (DOUE 4-5-2016), y el resto de legislación vigente en materia de protección de datos personales, que le sea de aplicación&lt;/span&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Esta solicitud solo&lt;/span&gt; &lt;span style="background-color:white"&gt;la deben cumplimentar las entidades que haga&lt;/span&gt; &lt;span style="background-color:white"&gt;más de cinco años que presentaron&lt;/span&gt; &lt;span style="background-color:white"&gt;el antiguo impreso o que hayan cambiado de cuenta bancaria, y aquellas entidades que presenten solicitud&lt;/span&gt; &lt;span style="background-color:white"&gt;por primera vez.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. De conformidad con el artículo 39 de la Ley 38/2003, los gastos subvencionables cumplen con lo que establece la base decimotercera (pago de la subvención y justificación) de estas bases, en el hecho de que las facturas justificativas que presenta en esta convocatoria están vinculadas al proyecto subvencionado como consecuencia de la actividad subvencionada y emitidas y pagadas desde el día 1 de enero de 2021 hasta el 15 de noviembre de 2022.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Todas las facturas especificadas en el Anexo VI se han presentado únicamente a esta convocatoria con el importe establecido en la citada relación y que los fondos percibidos se han aplicado íntegramente al objeto de la subvención.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. En el supuesto de adquisición, construcción, rehabilitación y mejora de bienes inventariables, los bienes se destinarán al fin concreto para el que se concedió la subvención, que no podrá ser inferior a cinco años en caso de bienes inscribibles en un registro público, ni a dos años para el resto de bienes, en cumplimiento del art. 31.4 y en el art. 31.5 de la ley 38/2003, de 17 de noviembre, general de subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
