    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Acuerdo del Pleno de fecha 11 de abril de 2022 del Ayuntamiento de Eivissa, por el cual se aprueba inicialmente el Reglamento regulador de&amp;nbsp; uso de los huertos ecosociales de la finca de Can Tomeu del municipio de Eivissa &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Al no haberse presentado reclamaciones durante el plazo de exposición al público, queda automáticamente elevado a definitivo el Acuerdo plenario inicial aprobatorio del Reglamento regulador de uso de los huertos ecosociales de la finca de Can Tomeu del municipio de Ibiza, el texto íntegro, que se detalla a continuación, el cual se hace público, para su general conocimiento y en cumplimiento de lo previsto en el artículo 70.2 de la Ley 7/1985, de 2 de abril, Reguladora de las Bases del Régimen Local. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;TEXTO ÍNTEGRO&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;«&lt;strong&gt;REGLAMENTO REGULADOR DE USO DE LOS HUERTOS ECOSOCIALES DE LA FINCA DE CAN TOMEU DEL MUNICIPIO DE EIVISSA&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;Exposición de motivos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;El artículo 25 de la Ley 7/1985, de 2 de abril, Reguladora de las Bases del Régimen Local, establece que el municipio, para la gestión de sus intereses y en el ámbito de sus competencias, puede promover toda clase de actividades y prestar cuantos servicios públicos contribuyan a satisfacer las necesidades y aspiraciones de la comunidad vecinal. Esta norma atribuye a los municipios, en todo caso y en los términos de la legislación del Estado y de las comunidades autónomas, competencias en materia de protección del medio ambiente&lt;span style="color:black"&gt; urbano&lt;/span&gt;, de prestación de los servicios sociales y de promoción y reinserción social, así como en materia de ocupación del tiempo libre.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Los huertos urbanos tienen una gran aceptación en diferentes municipios del Estado, pues reúnen vertientes sociales y ambientales. Por un lado, se favorece la creación de un tejido de nuevas relaciones sociales y mejora la calidad de vida de las personas que participan. Por otro&lt;span style="color:black"&gt;, &lt;/span&gt;se da uso a espacios municipales infrautilizados, revitalizándolos y ofreciendo nuevas oportunidades a la vecindad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;El Ayuntamiento de Eivissa tiene interés en poner en marcha un proyecto de huertos ecosociales en la finca de Can Tomeu, ubicada en su término municipal. La finca &lt;span style="color:black"&gt;posee&lt;/span&gt; una extensión de más de 15.000 metros cuadrados y actualmente se destina a realizar actividades enmarcadas dentro del ámbito de la educación no formal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Los huertos ecosociales de &lt;span style="color:black"&gt;la finca&lt;/span&gt; de Can Tomeu son una iniciativa más del Ayuntamiento de Eivissa, cuyo objetivo es fomentar la vida social, la participación ciudadana, la relación intergeneracional, el desarrollo sostenible, la educación ambiental y la agricultura tradicional y ecológica.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Con la puesta a disposición de este espacio, el &lt;span style="color:black"&gt;Ayuntamiento de Eivissa&lt;/span&gt; &amp;nbsp;pretende que diferentes sectores de la población adopten una actitud activa en su tiempo libre y de ocio, a la vez que se potencien valores saludables, sociales y ambientales, fomentando la colaboración y la comunicación entre personas. Los huertos ecosociales son también espacios educativos, y constituyen una herramienta fundamental para la educación ambiental.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;TÍTULO I&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;DISPOSICIONES GENERALES&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;Artículo 1. Objeto&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;El presente Reglamento tiene por objeto establecer los derechos y obligaciones de las personas beneficiarias, la regulación, uso y funcionamiento de los huertos así como el procedimiento de adjudicación y régimen sancionador de los huertos ecosociales de la finca de Can Tomeu.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;Artículo 2. Régimen jurídico&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;Este Reglamento se dicta de conformidad con lo que dispone el artículo 49 de la Ley Reguladora de las Bases del Régimen Local y los artículos 29.2h) e y) de la Ley 20/2006, de 15 de diciembre, municipal y de régimen local de las Illes Balears. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;Artículo 3. Naturaleza jurídica de la autorización&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Con la puesta en marcha de este Reglamento se trata de ceder mediante licencia de uso privativo a personas físicas, entidades o asociaciones sin &lt;span style="color:black"&gt;ánimo&lt;/span&gt; de lucro, el uso de bienes de dominio público municipal, y en concreto de pequeñas parcelas de cultivo, con la finalidad de crear espacios de participación ciudadana que contribuyan a la mejora de la calidad de vida de las personas, a la integración social y al fomento de la colaboración de la ciudadanía en actividades de mejora ambiental.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;La autorización del uso de los huertos no supone en ningún caso la transmisión de la propiedad del terreno &lt;span style="color:black"&gt;o del espacio de cultivo cedido, respecto tanto del terreno como de todas las instalaciones existentes en el momento de la adjudicación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;La persona adjudicataria tan solo tiene la posesión precaria de la parcela de cultivo que se le asigne, de conformidad con lo previsto en el presente Reglamento y la licencia de uso privativo de dominio público que finalmente le sea otorgada de conformidad con la legislación vigente: Constitución Española; Código Civil; Ley 20/2006, de 15 de diciembre, municipal y de régimen local de las Illes Balears; Ley 7/1985, de 2 de abril, Reguladora de las Bases del Régimen Local; Ley 33/2003, de 3 de noviembre, del Patrimonio de las Administraciones Públicas; Real Decreto Legislativo 781/1986, de 18 de abril, del texto refundido de las disposiciones legales vigentes en materia de Régimen Local; Real Decreto 1372/1986, de 13 de junio, del Reglamento de Bienes de las Entidades Locales; Decreto de 17 de junio de 1955 de Reglamento de Servicios de las Corporaciones locales, así como la demás normativa concordante.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;Artículo &lt;/span&gt;4. Objetivos de los huertos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;La gestión de los huertos sociales y ecológicos municipales tienen como objetivos:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;a) Ofrecer espacios de esparcimiento y actividad saludable.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;b) Recuperar espacios públicos para la actividad agraria de uso público.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;c) Fomentar la participación ciudadana y el desarrollo sostenible. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;d) Promover buenas prácticas ambientales de cultivo: gestión de los residuos, ahorro de agua, agricultura ecológica, recuperación de usos y costumbres de la agricultura tradicional, etc.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;e) Potenciar el carácter educativo, lúdico &lt;span style="color:black"&gt;y formativo&lt;/span&gt; de los huertos ecosociales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;f) Promover hábitos saludables y una alimentación sana. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;g) Impulsar un mayor conocimiento y respeto por el medio ambiente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;h) Promover las relaciones y el intercambio cultural intergeneracional, facilitando la participación infantil, juvenil y gente mayor, teniendo como escenario el medio ambiente natural.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;Artículo&lt;/span&gt; 5. Distribución&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;La superficie de la zona de actuación es de 3.806 m², delimitada por un vallado perimetral. Está formada por 48 parcelas individuales, entre 30 y 50 m² cada una y 1 parcela de talleres de 345 m², aproximadamente. La zona común contiene un área de descanso con mesas de pícnic y sombreado, dos módulos destinados a baño y un módulo de almacén, zona de compostaje y residuos, y mesas de cultivo. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Cada parcela esta delimitada y cuenta con un sistema de riego por goteo y un contador de agua individualizado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Las 49 parcelas se dividen en los siguientes bloques:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;Bloque 1 -&lt;span style="color:black"&gt; 42 parcelas de uso individual, distribuidas en:&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;&lt;strong&gt;Grupo 1:&lt;/strong&gt;14 parcelas destinadas a personas de entre 18 y 40 años.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;&lt;strong&gt;Grupo 2:&lt;/strong&gt;14 parcelas destinadas a personas de entre 41 y 64 años.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;&lt;strong&gt;Grupo 3:&lt;/strong&gt;14 parcelas destinadas a personas de más de 65 años.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;En el caso de quedar vacante alguna parcela en alguno de los grupos del presente bloque, pasarán a incrementar el número de parcelas de cultivo asignadas al siguiente grupo de edad por orden rotativo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;Bloque 2 - 6 parcelas&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;, destinadas a asociaciones del ámbito del bienestar social.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;Bloque 3 - 1&lt;/span&gt;&lt;/span&gt; &lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;parcela de talleres&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;, gestionada directamente por el Ayuntamiento de Eivissa y&amp;nbsp; destinada a actividades educativas y formativas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;Artículo 6. Duración de la licencia&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;La adjudicación del uso privativo de cada uno de los huertos se otorga por un periodo de 2 años&lt;/span&gt;&lt;/span&gt;&lt;span style="color:black"&gt; &lt;span style="background-color:white"&gt;contados a partir del día siguiente a la firma de la formalización de la licencia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;La licencia se puede prorrogar por un período de 2 años más,&lt;/span&gt;&lt;/span&gt; &lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;entendiéndose automáticamente prorrogada la concesión, salvo revocación, renuncia de alguna de las partes con un mes de antelación antes del vencimiento o extinción de la misma por mutuo acuerdo. La duración de la licencia otorgada no puede exceder de 4 años.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;Tras la expiración de la licencia o, en su caso, prórroga de la misma, no se puede otorgar de nuevo licencia a favor de la misma persona.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Excepcionalmente, puede adjudicarse una parcela a favor de una persona interesada que haya obtenido previamente licencia y la misma haya expirado, en el supuesto siguiente: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;1. Cuando, una vez finalizado el procedimiento de adjudicación, el número de solicitudes sea menor al número de parcelas disponibles. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;2. Cuando la persona interesada sea solicitante de parcela nuevamente y aparezca como el siguiente en la lista de espera, según se determina en el artículo 16.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;Artículo 7. Garantías sanitarias y de seguridad&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;La persona adjudicataria tiene la responsabilidad del cuidado del huerto asignado, de los productos obtenidos, de sus instalaciones y de su mantenimiento en adecuadas condiciones de higiene, salubridad y sanidad que sean exigibles conforme a la normativa vigente. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;El Ayuntamiento de Eivissa esta exento de responsabilidad por los daños y accidentes que pudieran sufrir o causar las personas adjudicatarias y/o las acompañantes como consecuencia del desarrollo de la actividad de cultivo, tanto a terceros como a bienes, así como de los daños que pudieran sufrir éstas durante su estancia en el recinto. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt; &lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;TÍTULO II&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;PERSONAS BENEFICIARIAS&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;Artículo 8. Requisitos de las personas beneficiarias&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;Para participar en la convocatoria, las personas interesadas deberán cumplir en la fecha de finalización del plazo de presentación de solicitudes, y durante todo el proceso selectivo, los requisitos siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;1. Personas físicas:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;- Realizar una solicitud formal en el periodo de inscripción.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;- Ser mayor de edad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;- Estar empadronada en el municipio de Eivissa con una antigüedad mínima de 1 año antes de&lt;/span&gt;&lt;/span&gt; &lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;la fecha en que finalice el plazo de presentación de solicitudes de adjudicación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;- No haber sido objeto de privación de uso de un huerto con anterioridad por sanción o revocación de la concesión.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;- Estar al corriente de las obligaciones tributarias y de la Seguridad Social.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;- No disponer del uso de ningún otro huerto en el municipio de Eivissa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;Las personas físicas beneficiarias del uso de parcelas de cultivo tienen que desarrollar personalmente las actividades objeto de la licencia otorgada. No obstante, pueden disponer de la ayuda de una persona autorizada que las asista. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;Además, pueden contar con la ayuda de una tercera persona que puede sustituirla cuando sea necesario. En cualquier caso, la persona adjudicataria responde íntegramente por los actos de la persona sustituta ante la administración y ante terceros, sin perjuicio de las acciones que pueda ejercer legalmente frente a la misma.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;La persona sustituta reunirá los siguientes requisitos:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;- Estar empadronada en el municipio de Eivissa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;- Tener un mínimo de 16 años.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;- Contar con el consentimiento de su madre, padre o del tutor legal, en caso de ser menor de edad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;- No disponer, en concepto de adjudicatario o adjudicataria, del uso de otro huerto municipal en el municipio de Eivissa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;2. Asociaciones o entidades sin ánimo de lucro del ámbito del bienestar social:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;- Hacer una solicitud formal en el periodo de inscripción.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;- Estar inscrita en el Registro municipal de entidades del Ayuntamiento de Eivissa con una antigüedad mínima de 1 año antes de la fecha en que finalice el plazo de presentación de solicitudes de adjudicación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;-Tener el domicilio social o la sede social en el municipio de Eivissa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;- Estar al corriente de las obligaciones tributarias y de la Seguridad Social.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;- Presentar un proyecto de actuación indicando los objetivos a conseguir mediante la adjudicación de la parcela.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;El número máximo de personas que pueden asistir por entidad es de 7 personas más los responsables o monitores acompañantes. En el caso de que el proyecto de actuación contemple y justifique la asistencia de un número mayor de participantes, que en todo caso no podrá superar el número de 12 personas más las personas responsables o monitoras acompañantes, la adjudicataria deberá expresarlo por escrito y justificarlo debidamente mediante su solicitud y obtener autorización expresa por parte del Ayuntamiento de Eivissa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;Estos requisitos se mantendrán durante la vigencia de la licencia. El Ayuntamiento puede, en todo momento, realizar controles puntuales o globales, sobre la concurrencia de dichos requisitos y, si es necesario, puede revocar las licencias.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;Artículo 9. Derechos de las personas adjudicatarias&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;Las personas adjudicatarias tienen derecho a cultivar cualquier variedad de hortalizas, verduras, plantas aromáticas y flores, aptas para el consumo humano en el huerto que le ha sido adjudicado, por el tiempo establecido en la licencia de uso.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;Artículo 10. Obligaciones de las personas adjudicatarias&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;Las personas adjudicatarias estan obligadas a:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;1.&lt;strong&gt; &lt;/strong&gt;Asumir los gastos generados para la conservación y mantenimiento ordinario de la parcela adjudicada: planteles, semillas, adobos y otros elementos necesarios para el cultivo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;2. Avisar inmediatamente al Ayuntamiento de Eivissa si detectan cualquier daño o desperfecto en la parcela o en sus instalaciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;3. Cultivar la parcela cedida conforme a los criterios de agricultura ecológica. Este criterio afecta a todas las tareas de cultivo que puedan llevarse a cabo en el huerto (preparación del terreno, limpieza y acondicionamiento, desbrozado, cava, siembra, plantación, abonado, control de plagas, riego, etc.), cuidando y realizando las reparaciones ordinarias sin derecho a exigir indemnización alguna, durante el tiempo en que participe en el proyecto.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;4. Cultivar sin productos fitosanitarios artificiales (herbicidas, pesticidas/plaguicidas artificiales) ni fertilizantes o abonos químicos que no estén reconocidos por la práctica de la agricultura ecológica así como aquellos no autorizados por la legislación vigente en materia de agricultura ecológica. Sólo se permitirá el uso de abono de origen natural u orgánico.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;5. Mantener limpias y en perfecto estado de conservación las herramientas necesarias para el cultivo que sean propiedad del Ayuntamiento y que éste pueda poner a disposición de las personas adjudicatarias. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;6. Mantener el entorno de las parcelas en perfecto estado, limpios y libres de todo tipo de hierbas y residuos. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;7. Cumplir las ordenanzas municipales y resto de normativa local, autonómica o estatal que les pueda afectar.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;8. Responder de los daños de todo tipo causados en el huerto, en sus instalaciones, y en las instalaciones comunes de riego u otras de la zona de huerta, tanto si son causados personalmente por la persona usuaria, la persona sustituta o por su acompañante.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;9. Asumir cualquier responsabilidad en caso de accidente personal o de la persona que ayude o acompañe.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;10. Hacerse cargo de las indemnizaciones económicas y de las reparaciones que se generen derivadas de los daños causados al huerto y a sus instalaciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;11.Tanto las personas adjudicatarias de cada parcela, como las personas autorizadas, deberán identificarse, en caso de requerimiento, mediante la tarjeta identificativa que proporcionará el Ayuntamiento de Eivissa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;12. Reciclar los desechos orgánicos derivados del cultivo de su parcela y depositarlos en los lugares destinados a su fin. Todos los residuos no orgánicos se deben depositar en los contenedores correspondientes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;13. Realizar la formación en relación con el cultivo de huertos ecológicos que se imparta por el Ayuntamiento destinada a las personas adjudicatarias. Dicha formación será de carácter obligatorio, y se debe justificar la no comparecencia ya sea por enfermedad o por cualquier otra causa justificada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;14. Las otras que se deriven de las bases de las correspondientes convocatorias o de las instrucciones fijadas por el Ayuntamiento de Eivissa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;Artículo 11. Prohibiciones&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;No se permite a las personas adjudicatarias: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;1. El cultivo de cualquier especie no apta para el consumo humano; se admite como única excepción de cultivo plantas de jardinería (siempre y cuando sea utilizada por sus propiedades en el control de plagas o enfermedades) y aromáticas destinadas a la cocina, especias y condimentos de alimentos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;2. El cultivo de plantas degradantes del suelo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;3. La utilización de fertilizantes y productos fitosanitarios que contaminen o dañen la tierra o el agua.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;4. El cultivo de plantas venenosas o que ocasionen efectos tóxicos, psicotrópicos, alucinógenos, estupefacientes, que puedan ser dañinas, en mayor o menor medida, para la salud de las personas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;5. La comercialización, por la forma que sea, de los productos obtenidos en el cultivo del huerto.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;6. La realización de cualquier clase de obra, y en concreto la instalación de vallados o separaciones, barbacoas, tablas fijas, bancos, así como la construcción o instalación de nuevos elementos o modificación de los existentes, sin autorización previa por parte del Ayuntamiento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;7. La tenencia y cría de cualquier clase de animal así como la construcción de jaulas y/o casetas destinadas a estos. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;8. La acumulación o abandono de cualquier material o basura no orgánica, exceptuando los materiales destinados al compostaje, ya sea dentro o fuera del huerto, así como la aportación de cualquier tipo de objeto ajeno a la función del huerto susceptible de alterar la estética del lugar.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;9. La alteración de los caminos y conducciones de riego del huerto adjudicado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;10. El cambio y/o movimiento de los hitos y vallado que delimite el huerto municipal. La persona adjudicataria se obliga a ejecutar su trabajo dentro de los límites del huerto adjudicado, sin extralimitar su actividad más allá de los límites acotados del huerto.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;11. Plantar árboles o arbustos que puedan invadir fincas o parcelas colindantes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;12. La cesión, préstamo, arrendamiento o subarrendamiento del huerto a una tercera persona. La persona adjudicataria se obliga a ejecutar su trabajo personalmente, salvo casos de fuerza mayor que deberá acreditar ante el Ayuntamiento, y salvo la ayuda mutua entre horticultores o la persona autorizada al efecto.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;13. Dejar el huerto sin trabajar. En caso de que la imposibilidad temporal supere la duración de tres meses, la persona adjudicataria deberá comunicar esta circunstancia al Ayuntamiento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;14. Cualquier otro uso no previsto anteriormente y que produzca molestias, malos olores, limite el uso y el disfrute del resto de parcelas o que afecte al entorno del lugar.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;Artículo 12. Horario y acceso&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;La apertura del huerto municipal de la finca de Can Tomeu será de lunes a domingo en los siguientes horarios:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;a) Del 1 de noviembre al 30 de abril: de 08:00 a 19:00 h.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;b) Del 1 de mayo al 31 de octubre: de 08:00 a 21:00 h.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;Sin perjuicio de lo anterior, el horario de acceso a los huertos de la finca de Can Tomeu podrá ser modificado, cuando sea necesario, según criterio municipal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;Las personas físicas beneficiarias tendrán un carnet acreditativo en el que figurarán las personas que están autorizadas al acceso de las instalaciones, incluida la persona que pueda sustituir a la titular. En el caso de las asociaciones o entidades sin ánimo de lucro se indicará únicamente el número de personas autorizadas al acceso de las instalaciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;Artículo 13. Mantenimiento de los huertos&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;Las obras y reparaciones de renovación o reposición del huerto o de sus elementos que sean debidas al envejecimiento u otras causas en las que no concurran daño o negligencia de la persona adjudicataria, serán a cargo del Ayuntamiento de Eivissa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;En cualquier caso, para el mantenimiento y desarrollo de la actividad, la persona adjudicataria se compromete a respetar las obligaciones y prohibiciones detalladas anteriormente. Asimismo, se compromete a efectuar un uso responsable del agua suministrada para el riego. En caso de sobrepasar los límites estipulados, atendiendo al consumo máximo permitido para la extensión y tipo de cultivo de la parcela, se debe abonar al Ayuntamiento el importe correspondiente a la cantidad sobrepasada, de acuerdo con el siguiente cuadro:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;A partir de este consumo, se aplicarán las tarifas vigentes del momento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;El Ayuntamiento se reserva el derecho a modificar los máximos en las correspondientes convocatorias en base a criterios técnicos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;div style="page-break-after:always"&gt;&lt;span style="display:none"&gt;&amp;nbsp;&lt;/span&gt;&lt;/div&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;Artículo 14. Normas de la agricultura ecológica&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;El tipo de agricultura que se practicará será tradicional y ecológica. De conformidad con el artículo 10.4 de este &lt;span style="background-color:white"&gt;Reglamento, queda expresamente prohibido el uso de productos fitosanitarios artificiales y abonos químicos. Se hará una horticultura sostenible, a fin de mantener el suelo en perfectas condiciones para futuras personas usuarias.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;El cultivo del huerto se hará de manera respetuosa con el medio ambiente, siguiendo las indicaciones del Ayuntamiento. No se pueden utilizar, por tanto, productos de limpieza, abonos, herbicidas o fungicidas que contaminen el terreno o puedan representar un peligro para la salud. Tampoco se pueden emplear trampas u otros métodos de captura para la fauna o cebos con sustancias venenosas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;Los adjudicatarios o las adjudicatarias se comprometen a respetar las normas de la agricultura ecológica, especialmente a las concernientes al ahorro del agua, al empleo de fertilizantes orgánicos y al uso de productos fitosanitarios respetuosos con el medio ambiente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;TÍTULO III&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;PROCEDIMIENTO DE ADJUDICACIÓN&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;Artículo 15. Procedimiento de adjudicación&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;1. El procedimiento aplicable a la autorización o licencia para el uso, disfrute y aprovechamiento de las parcelas de huertos sociales y ecológicos será en régimen de concurrencia, atendiendo al número limitado de parcelas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;2. Este procedimiento se inicia de oficio por el Ayuntamiento, por resolución dictada por el órgano competente que contiene la aprobación de la convocatoria de concesión de autorizaciones de ocupación de los huertos de la finca de Can Tomeu. Esta convocatoria se publica en el tablón de anuncios de la sede electrónica del Ayuntamiento de Eivissa, así como en los demás medios de difusión de que disponga éste.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;3. Las personas interesadas en concurrir a la convocatoria deberán formular la solicitud mediante el correspondiente trámite en el Registro de Entrada (SAC, c. de Canàries, 35), con cita previa, o través de la sede electrónica del Ayuntamiento de Eivissa (https://eivissa.sedelectronica.es).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;También pueden presentarse a través de alguna de las formas previstas en el artículo 16.4 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas. En este caso, se tiene que presentar la solicitud disponible en la sede electrónica del Ayuntamiento de Eivissa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La presentación de la solicitud comporta la autorización de la persona solicitante para que el Ayuntamiento obtenga de forma directa los certificados telemáticos, si procede, para la acreditación de las circunstancies previstas en los artículos 18 y 19 del RD 887/2006, de 21 de julio, de encontrarse al corriente de las obligaciones tributarias con la Administración estatal y el Ayuntamiento de Eivissa, así como estar al corriente del cumplimiento de las obligaciones ante la Seguridad Social, en aplicación del Convenio en materia de interoperabilidad telemática entre las administraciones públicas del ámbito territorial de las Illes Balears, al cual se ha adherido el Ayuntamiento. La persona solicitante puede denegar de forma expresa el consentimiento y aportar los correspondientes certificados.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;4. La documentación y/o los datos que deben acompañar a la solicitud serán indicados en la convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;5. El plazo para la presentación de las solicitudes se determinará en la correspondiente convocatoria, sin que éste pueda ser inferior a quince días hábiles desde su publicación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;6. &lt;/span&gt;&lt;/span&gt;En caso de que la solicitud o la documentación sean incorrectas o incompletas, el Ayuntamiento requerirá su subsanación en un plazo de diez días. Una vez transcurrido este plazo sin que la persona solicitante haya dado cumplimiento al requerimiento, se tendrá por desistida su petición y se archivará el expediente. De acuerdo con el artículo 45.1.b) de la Ley 39/2015, de 1 de octubre, de Procedimiento Administrativo Común de las Administraciones Públicas, la publicación de estos requerimientos de subsanación se realizará en el tablón de anuncios de la sede electrónica del Ayuntamiento de Eivissa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;7. &lt;/span&gt;&lt;/span&gt;Una vez comprobada la documentación presentada&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;, se elaborará una lista provisional de personas admitidas y excluidas, con indicación de las causas de exclusión. Se otorgará un plazo de 10 días hábiles, contados a partir del día siguiente de la publicación de las listas provisionales en el tablón de anuncios de la sede electrónica del Ayuntamiento de Eivissa, para poder presentar alegaciones. Si no se presentan reclamaciones, la lista provisional se entenderá como definitiva automáticamente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;8. Una vez finalizado el plazo a que hace referencia el párrafo anterior, el Ayuntamiento tiene que dictar una resolución con la lista definitiva de personas admitidas y excluidas. Si el número de personas admitidas es mayor que el de parcelas disponibles, se hará un sorteo público para adjudicar las parcelas libres a las personas físicas y jurídicas admitidas, ante el/la secretario/a del Ayuntamiento (o persona en quien delegue) y el/la regidor/a responsable. La fecha, hora y lugar del sorteo se indicará en dicha lista definitiva, que se publicará en el tablón de anuncios de la sede electrónica del Ayuntamiento de Eivissa. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;9. En el sorteo se extraerán todas las papeletas y el orden de extracción debe determinar el orden de prelación de las personas aspirantes. Del sorteo, deben salir dos listas: una para personas físicas y una para personas jurídicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;10. Una vez realizado el sorteo, el Ayuntamiento de Eivissa dictará resolución de adjudicación de las licencias de uso privativo de dominio público para el cultivo de los huertos urbanos de la finca de Can Tomeu, de acuerdo con el orden de prelación derivado del sorteo público y del número de parcelas habilitadas para cada convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;Artículo 16. Vacantes y listas de espera&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;1. Las personas admitidas que no hayan sido adjudicatarias de ningún huerto pasarán a formar parte de una lista de espera, según el lugar en que hayan quedado en el sorteo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;2. Cuando haya un huerto vacante, debe ofrecerse de acuerdo con el orden estricto de prelación de la lista de espera correspondiente al huerto y al tipo de persona solicitante. La notificación se formalizar&lt;/span&gt;&lt;/span&gt;&lt;span style="color:black"&gt;á por medio de correo electrónico o por vía telefónica.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;3. Si la persona solicitante a quien se ofrece el cultivo de un huerto no manifiesta su conformidad en el plazo de cinco días, se entenderá que renuncia al cultivo del huerto urbano y se la excluirá de la adjudicación, aunque podrá continuar en la lista de espera.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;4. En el caso de quedar una o más parcelas vacantes de alguno de los grupos del Bloque 1 indicado en el artículo 5, pasarán a incrementar el número de parcelas de cultivo del siguiente grupo de forma rotatoria. En el caso de quedar vacante alguna parcela del Bloque 2 del artículo previamente indicado, pasará a incrementar el número de parcelas del Bloque 1.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;TITULO IV&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;EXTINCIÓN DE LA CONCESIÓN&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;Artículo 17. Finalización de la concesión&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;La concesión se tendrá por extinguida en los siguientes supuestos:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;a) Por la expiración de la vigencia de la licencia así como de la prórroga concedida.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;b) Antes del vencimiento del plazo autorizado: por renuncia, muerte o incapacidad del usuario o de la usuaria para mantener el huerto. En este caso, sus familiares estarán autorizados para recoger los frutos en el plazo de la cosecha en curso.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;c) Por voluntad unilateral del Ayuntamiento de no prorrogar la licencia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;Artículo&lt;/span&gt;&lt;/span&gt;&lt;span style="color:black"&gt; 18. Revocación de la concesión&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;La concesión podrá ser revocada por los siguientes motivos:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;a) Por desaparición sobrevenida de las circunstancias que motivaron la adjudicación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;b) Por haber cesado el cultivo más de tres meses sin causa justificada y sin que haya una comunicación expresa y motivada al Ayuntamiento de Eivissa y éste lo acepte.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;c) Por incumplimiento manifiesto de lo estipulado en el artículo 10 de este Reglamento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;d) Por baja voluntaria mediante un escrito presentado en el Registro de Entrada del Ayuntamiento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;e) Por razones de interés general o causas relacionadas con la gestión del suelo en el que se ubica la parcela, que debe ser comunicada a la persona adjudicataria con al menos tres meses de antelación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;f) Por la comisión de una falta grave, con tramitación previa del correspondiente expediente sancionador.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;Artículo 19. Finalización de la concesión&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;El acuerdo municipal que declare la caducidad o la revocación se producirá con acta previa de comprobación del estado del huerto, levantada en presencia de la persona adjudicataria o sus causahabientes, y determinará la finalización de la concesión. Dentro de los veinte días naturales siguientes al de la recepción de la notificación del acuerdo de finalización, la persona adjudicataria deberá dejar el huerto vacío y sin utensilios, a entera disposición del Ayuntamiento de Eivissa y queda facultado expresamente el Ayuntamiento para proceder al lanzamiento una vez transcurrido el plazo indicado. Las obras y plantaciones que tengan el concepto de mejora efectuada por la persona adjudicataria y que no puedan ser retirados sin daño, pasarán a ser propiedad del Ayuntamiento sin que ello genere derecho a indemnización a favor de la persona usuaria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;Artículo 20.Transmisiones&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Las personas adjudicatarias en ningún caso podrán ceder, grabar o disponer, a título oneroso o gratuito, los derechos que se deriven de la concesión de uso, ni transmitirla a terceros.&lt;/span&gt;&lt;strong&gt; &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;TÍTULO V&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;GESTIÓN Y SEGUIMIENTO DE LAS EXPLOTACIONES&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;Artículo 21. Gestión y seguimiento&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. El Ayuntamiento de Eivissa asignará la gestión y seguimiento a un/a técnico/a responsable, municipal o perteneciente a una entidad gestora debidamente acreditada y autorizada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;2. La gestión y seguimiento consistirán básicamente en:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;a) Elaborar las propuestas de adjudicación de las parcelas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;b) Velar por el adecuado uso de las parcelas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;c) Proponer sanciones y revocaciones de concesiones de uso.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;d) Resolver problemáticas que no estén incluidas en la normativa y hacer propuestas de mejora.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;e) Programar y llevar a cabo reuniones con las personas usuarias para valorar la marcha de la explotación con una periodicidad mínima anual sin perjuicio de llevar a cabo cuantas reuniones sean necesarias bien a solicitud de las personas beneficiarias o bien desde el propio órgano de gestión.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;f) Control y, en su caso, programación&amp;nbsp; de las actividades formativas y educativas que se lleven a cabo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;TÍTULO VI&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;RÉGIMEN DISCIPLINARIO Y PROCEDIMIENTO SANCIONADOR&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;Artículo 22. Procedimiento sancionador&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Se consideran infracciones las acciones o omisiones que contradigan el contenido de este Reglamento y que vengan tipificadas como faltas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;El procedimiento sancionador se inicia de oficio por parte del Ayuntamiento de Eivissa o como consecuencia de denuncia de cualquier persona usuaria, siempre que se describa la infracción presuntamente cometida y la presunta persona infractora.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Son responsables de las infracciones todas las personas usuarias que lleven a término las acciones o omisiones tipificadas en este Reglamento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;Tipificación&lt;/span&gt;&lt;/strong&gt;&lt;span style="color:black"&gt;: Las faltas se tipifican como leves, graves y muy graves.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;1. &lt;strong&gt;Son faltas leves&lt;/strong&gt;:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;a) El descuido en el mantenimiento del huerto.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;b) La vulneración de lo que se dispone en el artículo 10.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;2. &lt;strong&gt;Son faltas graves&lt;/strong&gt;:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;a) Realizar un consumo irracional del agua o no reparar fugas en el riego.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;b) La vulneración de lo que se dispone en el artículo 11.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;c) No respetar el horario estipulado, indicado en el artículo 12.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;d) La reincidencia de dos o más infracciones leves en el período de un año.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;3.&lt;strong&gt; Son faltas muy graves&lt;/strong&gt;:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;a) Hurto o manipulación de&lt;/span&gt;&lt;span style="color:#333333"&gt; productos y/o materiales de &lt;/span&gt;&lt;span style="color:black"&gt;huertos de otros usuarios o usuarias, o de productos o material titularidad del Ayuntamiento de Eivissa ubicados dentro del recinto de la finca de Can Tomeu.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;b) &lt;/span&gt;&lt;span style="color:#333333"&gt;El uso reiterado de productos químicos no autorizados en agricultura ecológica o residuos siempre que hayan producido un daño o dete&lt;/span&gt;&lt;span style="color:#111111"&gt;rioro grave al medio ambiente o hayan puesto en peligro grave la salud de las personas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;c) La reiteración en más de una ocasión de ser causante de conflictos personales y alterar la buena convivencia de la explotación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;d) La reincidencia de dos o más faltas graves dentro del plazo de un año.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;Graduación de las infracciones&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#111111"&gt;Para la graduación de las sanciones se atenderá a los siguientes criterios:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ol&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#111111"&gt;Intencionalidad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#111111"&gt;Reiteración de la infracción.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#111111"&gt;Número de perjudicados.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#111111"&gt;Gravedad del daño causado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#111111"&gt;Posibilidad de revertir los daños y efectos de la infracción.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#111111"&gt;Advertencias previas efectuadas al presunto infractor o presunta infractora.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#111111"&gt;Las medidas de reparación adoptadas por el infractor antes de adoptarse la resolución infractora.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ol&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;Artículo 23. Instrucción y sanción&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;a) El órgano instructor será un funcionario designado por la administración.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;b) El órgano sancionador será el alcalde del Ayuntamiento de Eivissa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;1. Sanciones:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;a) Las faltas leves se sancionarán con amonestación efectuada por escrito indicando el carácter de la misma y recordando que la reincidencia en la misma falta, en el plazo de un año, dará lugar a falta grave.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;b) Las faltas graves se sancionarán con amonestación escrita, requerimiento a la persona adjudicataria para reponer al estado original la situación alterada y la pérdida de la condición de persona usuaria por un período de 30 días.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;c) Las faltas muy graves se sancionarán con la pérdida definitiva o extinción permanente de la concesión del derecho de uso del huerto, que se comunicará por escrito a la persona adjudicataria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#111111"&gt;Artículo 24. Prescripción de las infracciones&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#111111"&gt;Las infracciones leves se consideran prescritas transcurrido un año desde la finalización de la comisión, las graves a los dos años y las muy graves a los cuatro años.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#111111"&gt;La prescripción de las infracciones no afecta ni disminuye el período legal establecido para la reclamación de la restitución de la parcela a su estado original y/o de los daños y perjuicios ocasionados.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;DISPOSICIÓN ADICIONAL&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;En lo no previsto por el presente Reglamento, se estará a lo dispuesto en las normas y leyes que resulten de aplicación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;DISPOSICIÓN DEROGATORIA&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Se entenderán derogadas aquellas disposiciones del mismo rango que contradigan o contravengan los preceptos contenidos en este Reglamento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;DISPOSICIÓN FINAL&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;El presente Reglamento entra en vigor al día siguiente de la publicación del texto íntegro en el Boletín Oficial de las Islas Baleares de conformidad con lo dispuesto Ley 7/1985, de 2 de abril, Reguladora de las Bases de Régimen Local.»&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Contra el presente Acuerdo, se interpondrá recurso contencioso-administrativo, ante la Sala de lo contencioso administrativo del Tribunal Superior de Justicia de las Islas Baleares con sede en Palma de Mallorca, en el plazo de dos meses a contar desde el día siguiente en la publicación del presente anuncio, en conformidad con el artículo 46 de la Ley 29/1998, de 13 de julio, de la Jurisdicción Contencioso-Administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
