&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;1. En el BOIB núm.121, de 15 de septiembre de 2022, se publicó la Resolución de la Directora de la FFTM, de día 07 de septiembre de 2022, por la que se aprueban las bases de la convocatoria para la realización de convenios de colaboración de co-marketing estratégico con la FFTM en acciones que fomenten la demanda hacia el destino Menorca con los mercados emisores.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;2. El apartado 1.b) de las bases de la convocatoria para la realización de convenios de colaboración de co-marketing estratégico con la FFTM en acciones que fomenten la demanda hacia el destino Menorca con los mercados emisores, se define la línea A Temporada como la ruta comprendida entre el 15 de marzo al 15 de junio y del 15 de septiembre al 31 de octubre, de 2023 y 2024.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;3. Dado que ha habido un error material en la fecha de inicio de la línea A Temporada, que se recoge en las bases, es adecuada la modificación de esta fecha a lo largo de todo el documento de bases de la convocatoria para la realización de convenios de colaboración de co-marketing estratégico con la FFTM en acciones que fomenten la demanda hacia el destino Menorca con los mercados emisores, por tanto, se hace necesario modificar el apartado 1, Objeto, del documento de bases, y los anexos A1 y A2.&lt;/span&gt; &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;Fundamentos de derecho&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;-Artículo 3 de los Estatutos de la FFTM, aprobados por acuerdo del Pleno del Consejo Insular de Menorca en sesión de carácter ordinario de 17 de noviembre de 2014 (BOIB n.º 95, de 30 de junio de 2015).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;-Acuerdo del Patronato de la Fundación Fomento del Turismo de Menorca de fecha 7 de octubre de 2020, de aprobación de la delegación de funciones del Patronato de la nueva Dirección/Gerencia, corresponde a la directora de la FFTM la aprobación de la presente convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;-Artículos 47 a 53 de la Ley 40/2015, de 1 de octubre, de régimen jurídico del sector público.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;-Artículos 121 y 122 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Por todo eso, la directora de la Fundación Fomento del Turismo de Menorca, en uso de las atribuciones que le son conferidas:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;RESUELVE&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1.- Aprobar la nueva redacción de las Bases de la convocatoria para la realización de convenios de colaboración de co-marketing estratégico con la FFTM en acciones que fomenten la demanda hacia el destino Menorca con los mercados emisores. &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2.- Modificar el apartado 1 (OBJETO) de la convocatoria para la realización de convenios de colaboración de co-marketing estratégico con la FFTM en acciones que fomenten la demanda hacia el destino Menorca con los mercados emisores, publicada en fecha 15 de septiembre de 2022, en el BOIB núm.121, en el sentido siguiente.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Donde dice:&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;“&lt;strong&gt;&lt;em&gt;1. OBJETO&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;El objeto de esta convocatoria, pública y abierta, es ofrecer a las entidades vinculadas a las dos líneas de actuación descritas a continuación, la posibilidad de realizar convenios de colaboración en modalidad de comarketing estratégico para mejorar la demanda turística hacia el destino Menorca, fuera de los meses de verano (del 16 de junio al 14 de septiembre), tanto para el mercado nacional como internacional.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Las campañas están destinadas a promocionar Menorca en los mercados emisores mediante la publicidad de rutas/trayectos turísticos directos ya existentes o el fomento de la creación de nuevas rutas/trayectos con el aeropuerto de Menorca (Mahón) o puertos de Menorca. &lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Las campañas están destinadas a promocionar Menorca en los mercados emisores mediante la publicidad de:&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;· &lt;em&gt;Las rutas/trayectos directos ya existentes con el aeropuerto o puertos de Menorca y fomentar la creación de nuevas rutas/trayectos directos con la isla.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;a)&lt;/em&gt;&lt;/strong&gt;&lt;em&gt; Así pues, se establecen las siguientes líneas de actuación de comarketing estratégico de conectividad:&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;Se define línea A Temporada la ruta comprendida del 15 de marzo al 15 de junio y del 15 de septiembre al 31 de octubre, de 2023 y 2024 (esta línea se considerará &lt;strong&gt;propuesta única e indivisible&lt;/strong&gt;).&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;Se define línea B la ruta comprendida del 15 de marzo al 15 de junio y del 15 de septiembre al 31 de octubre, de 2023 y 2024 (esta línea se considerará &lt;strong&gt;propuesta única e indivisible&lt;/strong&gt;).&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Quedan excluidas de esta convocatoria las rutas/trayectos interislas. &lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Se define como RUTA aérea el trayecto de un vuelo desde el aeropuerto de origen hasta el aeropuerto de destino. En este caso concreto, las rutas que se describen siempre serán de vuelos directos entre el aeropuerto de origen y el de destino. &lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Se define como RUTA marítima el trayecto de un barco desde el puerto de origen hasta el puerto de destino. En el caso del mercado nacional, las rutas que se describen siempre serán de trayectos directos entre el puerto de origen y el de destino, mientras que en el caso de mercados internacionales, las rutas podrán ser directas o indirectas.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;c)&lt;/em&gt;&lt;/strong&gt;&lt;em&gt; Estas campañas deben promocionar una de las siguientes opciones:&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;La campaña solo podrá publicitar aquellos periodos en los que las entidades colaboradoras dispongan de rutas/trayectos operativos. &lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;No se aceptarán campañas iniciadas previamente a la firma del convenio o que no cumplan los requisitos establecidos en estas bases. &lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Las entidades deberán presentar las propuestas de campañas incluyendo las dos anualidades 2023 y 2024, de manera que la entidad que presente la campaña para sólo 1 año quedará excluida.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;e)&lt;/em&gt;&lt;/strong&gt;&lt;em&gt; Periodo mínimo de operatividad de la/s ruta/s o trayecto/s que se promocionen con la campaña según cada línea de actuación:&lt;strong&gt; &lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;Las entidades colaboradoras deberán comprometerse a mantener la/s ruta/s o trayecto/s que se promocionen con las campañas, según los requisitos establecidos en el siguiente&lt;/em&gt;&lt;/strong&gt;&lt;em&gt; &lt;strong&gt;cuadro que tendrán que cumplir.&lt;/strong&gt; &lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;*En la línea A Invierno, &lt;/em&gt;&lt;/strong&gt;&lt;em&gt;excepcionalmente, las entidades que se presenten a esta línea dispondrán de un 10% de margen de NO cumplimiento de conectividad directa, siempre que quede totalmente justificado por motivos de baja ocupación. Aun así, esta excepción tiene que garantizar la conectividad con escala, siendo la llegada al destino, como máximo, de 5 horas desde la salida programada del punto emisor.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Este 10% de margen de no cumplimiento de conectividad directa, se computará de forma anual y no será acumulable de un año para otro. Asimismo, las semanas en las que NO haya oferta de conectividad directa nunca podrán ser consecutivas ni estar comprendidas dentro del mismo mes.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;La justificación de la baja ocupación será entregada a la Comisión Ejecutiva, en tiempo y forma según se determine en el convenio de colaboración.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;En caso de que la entidad solicitante cesara de operar la/s ruta/s o trayecto/s que se promocionan con la campaña, motivada por asuntos operativos o de baja ocupación o según lo que recoge el apartado 16 de estas bases como circunstancia fortuita y/o de fuerza mayor, solo &lt;span style="color:black"&gt;se abonará la cuantía proporcional de la campaña ejecutada y justificada.”&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Debe decir:&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;“&lt;strong&gt;&lt;em&gt;1. OBJETO&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;El objeto de esta convocatoria, pública y abierta, es ofrecer a las entidades vinculadas a las dos líneas de actuación descritas a continuación, la posibilidad de realizar convenios de colaboración en modalidad de comarketing estratégico para mejorar la demanda turística hacia el destino Menorca, fuera de los meses de verano (del 16 de junio al 14 de septiembre), tanto para el mercado nacional como internacional.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Las campañas están destinadas a promocionar Menorca en los mercados emisores mediante la publicidad de rutas/trayectos turísticos directos ya existentes o el fomento de la creación de nuevas rutas/trayectos con el aeropuerto de Menorca (Mahón) o puertos de Menorca. &lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Las campañas están destinadas a promocionar Menorca en los mercados emisores mediante la publicidad de:&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;· &lt;em&gt;Las rutas/trayectos directos ya existentes con el aeropuerto o puertos de Menorca y fomentar la creación de nuevas rutas/trayectos directos con la isla.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;Se define línea A Temporada la ruta comprendida desde el primer lunes de abril al 15 de junio y del 15 de septiembre al 31 de octubre, de 2023 y 2024 (esta línea se considerará &lt;strong&gt;propuesta única e indivisible&lt;/strong&gt;).&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;Se define línea B la ruta comprendida desde el primer lunes de abril al 15 de junio y del 15 de septiembre al 31 de octubre, de 2023 y 2024 (esta línea se considerará &lt;strong&gt;propuesta única e indivisible&lt;/strong&gt;).&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Quedan excluidas de esta convocatoria las rutas/trayectos interislas. &lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Se define como RUTA aérea el trayecto de un vuelo desde el aeropuerto de origen hasta el aeropuerto de destino. En este caso concreto, las rutas que se describen siempre serán de vuelos directos entre el aeropuerto de origen y el de destino. &lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Se define como RUTA marítima el trayecto de un barco desde el puerto de origen hasta el puerto de destino. En el caso del mercado nacional, las rutas que se describen siempre serán de trayectos directos entre el puerto de origen y el de destino, mientras que en el caso de mercados internacionales, las rutas podrán ser directas o indirectas.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;c)&lt;/em&gt;&lt;/strong&gt;&lt;em&gt; Estas campañas deben promocionar una de las siguientes opciones:&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;No se aceptarán campañas iniciadas previamente a la firma del convenio o que no cumplan los requisitos establecidos en estas bases. &lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Las entidades deberán presentar las propuestas de campañas incluyendo las dos anualidades 2023 y 2024, de manera que la entidad que presente la campaña para sólo 1 año quedará excluida.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;*En la línea A Invierno, &lt;/em&gt;&lt;/strong&gt;&lt;em&gt;excepcionalmente, las entidades que se presenten a esta línea dispondrán de un 10% de margen de NO cumplimiento de conectividad directa, siempre que quede totalmente justificado por motivos de baja ocupación. Aun así, esta excepción tiene que garantizar la conectividad con escala, siendo la llegada al destino, como máximo, de 5 horas desde la salida programada del punto emisor.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Este 10% de margen de no cumplimiento de conectividad directa, se computará de forma anual y no será acumulable de un año para otro. Asimismo, las semanas en las que NO haya oferta de conectividad directa nunca podrán ser consecutivas ni estar comprendidas dentro del mismo mes.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;La justificación de la baja ocupación será entregada a la Comisión Ejecutiva, en tiempo y forma según se determine en el convenio de colaboración.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;En caso de que la entidad solicitante cesara de operar la/s ruta/s o trayecto/s que se promocionan con la campaña, motivada por asuntos operativos o de baja ocupación o según lo que recoge el apartado 16 de estas bases como circunstancia fortuita y/o de fuerza mayor, solo se abonará la cuantía proporcional de la campaña ejecutada y justificada.”&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;3.- Modificar el anexo A1 de la convocatoria para la realización de convenios de colaboración de co-marketing estratégico con la FFTM en acciones que fomenten la demanda hacia el destino Menorca con los mercados emisores, publicada en fecha 15 de septiembre de 2022 , en el BOIB núm.121, en el sentido siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
