    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="line-height:114%"&gt;El apartado&amp;nbsp;9.3. de la Resolución del&amp;nbsp;Presidente del Fondo de&amp;nbsp;Garantía Agraria&amp;nbsp;y Pesquera de&amp;nbsp;las&amp;nbsp;Islas Baleares&amp;nbsp;(FOGAIBA) de 10 de julio de 2015 por la&amp;nbsp;que se convocan, subvenciones&amp;nbsp;para Inversiones en las explotaciones agrarias, correspondientes a los años 2015-2019, especifica&amp;nbsp;que la resolución&amp;nbsp;expresa&amp;nbsp;se notificará&amp;nbsp;a&amp;nbsp;los interesados mediante&amp;nbsp;su publicación en el&amp;nbsp;Boletín Oficial de las&amp;nbsp;Islas Baleares&amp;nbsp;de acuerdo con los&amp;nbsp;términos&amp;nbsp;previstos en el artículo&amp;nbsp;45.2&amp;nbsp;de la Ley&amp;nbsp;39/2015, de 1 de octubre, del&amp;nbsp;procedimiento administrativo común de&amp;nbsp;las&amp;nbsp;administraciones públicas.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:114%"&gt;Los expedientes&amp;nbsp;han sido&amp;nbsp;tramitados&amp;nbsp;por el Fondo&amp;nbsp;de Garantía Agraria&amp;nbsp;y Pesquera de&amp;nbsp;las&amp;nbsp;Islas Baleares&amp;nbsp;(FOGAIBA) en cumplimiento de lo&amp;nbsp;dispuesto en el artículo&amp;nbsp;43&amp;nbsp;de&amp;nbsp;la Ley&amp;nbsp;39/2015, de &amp;nbsp;1 de octubre, y&amp;nbsp;del procedimiento administrativo común de las&amp;nbsp;administraciones públicas.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:114%"&gt;El vicepresidente&amp;nbsp;en Materia Agraria del FOGAIBA, con fecha 12 de setiembre&amp;nbsp;de 2022, firmó la siguiente resolución, &lt;/span&gt;​​​​​​​&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;Antecedentes&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;1. Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 10 de julio de 2015 por la que se convocan, para los años 2015 a 2019, subvenciones para inversiones en las explotaciones agrarias. La citada Resolución se modificó en fecha 17 de diciembre de 2015 (BOIB núm. 185), en fecha 22 de junio de 2016 (BOIB núm. 81) y en fecha 26 de junio de 2018 (BOIB núm. 80). &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2. Una vez analizada toda la documentación presentada, el vicepresidente del FOGAIBA resolvió favorablemente la concesión de la ayuda a favor de ANTONI GELABERT MESTR&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;E&amp;nbsp;entre otros,&amp;nbsp;que figuran en el anexo de la Resolución de concesión, RES3 de fecha 26 de junio de 2019, (BOIB núm. 89, de 4 de julio de 2019) con los datos y los importes correspondientes&amp;nbsp;(con un importe concedido de 46.254,32 €). &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;3. Dada la Resolución de concesión de la ayuda mencionada, y de acuerdo con lo que establece el apartado décimo de la convocatoria antes mencionada, el beneficiario se obliga, entre otros, a realizar las actuaciones auxiliadas dentro del plazo establecido y en justificar los gastos relacionados con la inversión para la recepción de los fondos comunitarios en la forma y plazos determinados en la convocatoria. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;4. El punto 3 del apartado duodécimo de la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Illes Balears por la que se convocan, para los años 2015 a 2019, subvenciones para inversiones en las explotaciones agrarias establece que durante el plazo de justificación establecido, los beneficiarios tendrán que presentar las correspondientes solicitudes de pago. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Este plazo para notificar y justificar la realización de las inversiones propuestas en la Resolución es, en este caso, de inversión inmueble, de doce meses a contar desde el día siguiente a la fecha de la Resolución de concesión de la ayuda (esto es el 4 de julio de 2019). Todo esto de conformidad con lo que dispone la Orden del consejero de Agricultura, Medio Ambiente y Territorio de 19 de febrero de 2015, por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco del Programa de Desarrollo Rural de las Islas Baleares 2014-2020. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;5. Por tanto, en este caso el plazo para presentar la solicitud de pago finalizaba el 4 de julio de 2021 (con prórroga incluida). &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;6. El 14 de octubre de 2019 (RGE núm.: 21854) el beneficiario presentó la solicitud de pago parcial. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;7. El 29 de junio de 2021 (RGE núm. 268638) el beneficiario presentó la solicitud de pago final. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;8. Con fecha 9 de febrero de 2022 se notificó al beneficiario enmiendas de deficiencias, puesto que no había presentado el final de obra del Ayuntamiento y la escritura pública de obra. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;9. El 16 de marzo de 2022 (RGE núm. 143082), responde a las enmiendas de deficiencias y manifiesta que no puede aportar la escritura de obra nueva ni el final de obra porque está pendiente del Ayuntamiento. En el mismo escrito solicita el desistimiento de la solicitud de pago final registrada el 29 de junio de 2021 &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;10. Con fecha 18 de marzo de 2022 el vicepresidente en materia agraria del FOGAIBA dicta resolución aceptando el desistimiento de la solicitud de pago final antes citada. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;11. El 30 de junio de 2022 (RGE núm. 365401), el beneficiario presenta una nueva solicitud de pago final (hay que mencionar que tampoco presenta la documentación que el 9 de febrero de 2022 se le requirió). &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;12. Dado todo esto, y teniendo en cuenta que el plazo de justificación establecido y por tanto para presentar la solicitud de pago finalizó el 4 de julio de 2021 se propone inadmitir la solicitud de pago final registrada el 30 de junio de 2022 por presentarse fuera de plazo.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;Fundamentos de derecho&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;1. &lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;3. Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;Propuesta de Resolución de concesión&amp;nbsp;&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Por todo ello,informa favorablemente y se propone al vicepresidente del FOGAIBA que dicte una resolución en los siguientes términos:&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;1. Inadmitir la solicitud de pago final presentada por ANTONI GELABERT MESTRE, con NIF &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;em&gt;***3696**&lt;/em&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;, el día 30 de junio de 2022 (RGE núm. 365401) por ser extemporánea.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2.&amp;nbsp;&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;Notif&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;icar esta resolución &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;mediante la publicación en el Boletín Oficial de las Islas Baleares.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;Interposición de recursos&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;Contra esta resolución, que no agota la vía administrativa, podrá interponerse recurso de alzada ante el conseller de Medio Ambiente, Agricultura y Pesca, en el plazo de un mes, a contar desde el día siguiente a la notificación de la resolución, de acuerdo con el artículo 58.4 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la comunidad autónoma de las Islas Baleares, y el artículo 68.1 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
