470 ![CDATA[<p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Por el Pleno de la Corporación Municipal, reunido en sesión extraordinaria día 9 de septiembre de 2022, se adoptó, entre otros, el acuerdo siguiente:</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>«PRIMERO. </strong>Aprobar el establecimiento de precios públicos y el Acuerdo regulador de estos, según se transcribe a continuación:</span></p> <p style="text-align:center"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">Precio público para las prestaciones de servicios de la escuela infantil pública y otros servicios educativos de 0 a 3 años</span></strong></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>ARTÍCULO 1.º </strong></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>OBJETO Y FUNDAMENTO</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">En conformidad con el que dispone el artículo 41 del RDL 2/2004 por el cual se aprueba el texto refundido de la Ley reguladora de las haciendas locales, este ayuntamiento acuerda establecer en este término municipal el precio público relativo para las prestaciones de servicios de la escuela infantil pública y otros servicios educativos de 0 a 3 años. Será de aplicación a este precio público la regulación que disponen los artículos que van del 41 al 48 de la Ley 39/1988, reguladora de las haciendas locales. </span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>ARTÍCULO 2º </strong></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">OBLIGADOS AL PAGO</span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Están obligados al pago de los precios públicos contenidos en esta normativa:</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">a) Las personas físicas o jurídicas (padres, madres o quienes ostente la tutoría de los niños) que se benefician de los servicios educativos prestados por las escuelas infantiles públicas.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">b) O, si procede, quién pueda estar obligado al pago de los alimentos de estos con arreglo al que prevé el Código Civil.</span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">NORMAS DE GESTIÓN </span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. Las tarifas mensuales se tienen que abonar dentro de los diez primeros días por domiciliación bancaria, excepto el primer mes de admisión, que se abonará antes del inicio del servicio.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Las altas que se produzcan dentro de los quince primeros días de cada mes abonarán la cuota mensual.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Las familias con una problemática social grave, previo informe motivado del Departamento de Servicios Sociales, estarán exentos. Esta exención será de carácter rogado y resuelta la petición de exención por Decreto de la Concejalía de Servicios Sociales.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. En el supuesto de que algún usuario pueda ser incluido en distintos grupos de tarifas, el precio público a aplicar será el de menor cuantía.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. Las bajas definitivas en la prestación del servicio o las modificaciones en el régimen de estancia tienen que ser comunicadas por los padres o tutores con anterioridad en el día 20 del mes anterior en que tengan que producir efecto, y tienen que ser presentadas con el impreso elaborado a tal efecto en el registro general de entrada.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">6. La falta de asistencia de un niño durante un periodo de un mes sin aviso previo implica la baja definitiva de la escuela, sin que esto afecte el recibo del mes no asistido.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">7. Igualmente implica la baja definitiva de la escuela el impago de un recibo en el plazo establecido.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">8. Si como consecuencia de una enfermedad un niño no asiste en la escuela en un periodo igual o superior en un mes, los padres, madres o tutores pueden solicitar la devolución de la mitad de la cuota correspondiente. Hay que acompañar la solicitud de devolución de cuota por enfermedad con un certificado médico en el cual conste el motivo y la duración de la baja. Posteriormente, el Ayuntamiento tiene que solicitar un informe en la escuela infantil que corrobore la no-asistencia.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">9. Por la aplicación de las cuotas contempladas por las familias numerosas y familias monoparentales tendrán que aportar el carné de familia numerosa o familia monoparental en vigor.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">10. Por la aplicación de las cuotas contempladas por las familias que tengan un hijo con necesidades educativas especiales tendrán que aportar el informe del especialista correspondiente.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">11. Por la aplicación de las cuotas contempladas por las familias que tengan un hijo con discapacidad igual o superior al 33% tendrán que aportar la declaración administrativa de discapacidad expedida por el órgano competente de la Comunidad Autónoma o certificado del IMSERSO.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">12. El importe diario se pagará el mismo día directamente en el centro centre.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">13.
