    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El apartado&amp;nbsp;9.3. de la Resolución del&amp;nbsp;Presidente del Fondo de&amp;nbsp;Garantía Agraria&amp;nbsp;y Pesquera de&amp;nbsp;las&amp;nbsp;Islas Baleares&amp;nbsp;(FOGAIBA) de 10 de julio de 2015 por la&amp;nbsp;que se convocan, subvenciones&amp;nbsp;para Inversiones en las explotaciones agrarias, correspondientes a los años 2015-2019, &amp;nbsp;especifica&amp;nbsp;que la resolución&amp;nbsp;expresa&amp;nbsp;se notificará&amp;nbsp;a&amp;nbsp;los interesados mediante&amp;nbsp;su publicación en el&amp;nbsp;Boletín Oficial de las&amp;nbsp;Islas Baleares&amp;nbsp;de acuerdo con los&amp;nbsp;términos&amp;nbsp;previstos en el artículo&amp;nbsp;45.2&amp;nbsp;de la Ley&amp;nbsp;39/2015, de 1 de octubre, del&amp;nbsp;procedimiento administrativo común de&amp;nbsp;las&amp;nbsp;administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los expedientes&amp;nbsp;han sido&amp;nbsp;tramitados&amp;nbsp;por el Fondo&amp;nbsp;de Garantía Agraria&amp;nbsp;y Pesquera de&amp;nbsp;las&amp;nbsp;Islas Baleares&amp;nbsp;(FOGAIBA) en cumplimiento de lo&amp;nbsp;dispuesto en el artículo&amp;nbsp;43&amp;nbsp;de&amp;nbsp;la Ley&amp;nbsp;39/2015, de &amp;nbsp;1 de octubre, y&amp;nbsp;del procedimiento administrativo común de las&amp;nbsp;administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El vicepresidente&amp;nbsp;en Materia Agraria&amp;nbsp;del FOGAIBA, con fecha 26&amp;nbsp;de julio&amp;nbsp;de 2022, firmó la siguiente resolución, &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;1.Con fecha de 16 de julio de 2015 se publicó, en el Boletín Oficial de las Islas Baleares núm. 106, la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Illes Balears (FOGAIBA) por la que se convocan, para los años 2015 a 2019, subvenciones para inversiones en las explotaciones agrarias, modificada mediante las resoluciones de fecha 17 de diciembre de 2015 (BOIB núm. 185), en fecha 22 de junio de 2016, (BOIB núm. 81), con fecha 26 de junio de 2018 (BOIB núm. 80), en fecha 2 de marzo de 2020 y 6 de mayo de 2020. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;2.El 4 de febrero de 2022, el vicepresidente del FOGAIBA, dictó una Resolución de concesión de ayudas para inversiones en las explotaciones agrarias, que se publicó en el Boletín Oficial de las Islas Baleares número 23, de 12 de febrero de 2022, en la que figuraba una concesión a favor de ALIMENTACION MEDITERRANEA&amp;nbsp;SAT, con CIF V&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;0&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;7&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;939119&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;, con un importe de ayuda &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;concedido &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;de &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;Ciento doce mil quinientos sesenta y siete y treinta y un céntimos (112&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;.5&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;67&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;,&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;31&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;€&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;)&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;y un plazo de 6 meses, con número de expediente INEA 2019_1/473. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;3.El 20&amp;nbsp;de &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;juni&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;o de 2022, con registro de entrada núm. GOIB&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;404364&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;/2022, la persona indicada en el apartado anterior &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;ha &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;present&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;ado&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;su desistimiento&amp;nbsp;de la ayuda, lo que supone llevar a cabo la revocación total de la ayuda concedida. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;4.El artículo 21.1 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, establece la obligación de la Administración a dictar resolución expresa y notificarla. En su párrafo segundo especifica que “En los casos de prescripción, renuncia del derecho, caducidad del procedimiento o desistimiento de la solicitud, así como la desaparición sobrevenida del objeto del procedimiento, la resolución consistirá en la declaración de la circunstancia que concurra en cada caso, con indicación de los hechos producidos y normas aplicables». &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;5.El artículo 43 del Texto refundido de la Ley de Subvenciones, aprobado por Decreto Legislativo 2/2005, de 28 de diciembre, dispone que «Pertoca la revocación de la subvención cuando, posteriormente a la resolución de concesión válida y ajustada a derecho , el beneficiario incumple total o parcialmente las obligaciones o compromisos contraídos a los que está condicionada la eficacia del acto de concesión de la subvención. Como consecuencia de la revocación de la subvención, queda sin efecto, total o parcialmente, el acto de concesión y procede el reintegro de las cantidades indebidamente percibidas». &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;6.Considerando todo ello, se propone realizar la revocación total debido al desistimiento de la ayuda concedida por el beneficiario que se indica en el anexo de esta resolución.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Propuesta de Resolución&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Por todo ello, se informa &amp;nbsp;favorablemente y se propone al vicepresidente en Materia Agraria del FOGAIBA que dicte una resolución en los siguientes términos:&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;1.Aceptar el desistimiento presentado por ALIMENTACION MEDITERRANEA&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;SAT, con CIF V&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;0&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;7&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;939119, a la ayuda concedida por la Resolución del vicepresidente del FOGAIBA de día 4 de febrero de 2022. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;2. Revocar la ayuda concedida &amp;nbsp;en la resolución del vicepresidente del FOGAIBA de día 4&amp;nbsp;de &lt;/em&gt;&lt;em&gt;febrero &lt;/em&gt;&lt;em&gt;de 202&lt;/em&gt;&lt;em&gt;2&lt;/em&gt;&lt;em&gt;, correspondiente a&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;l&lt;/em&gt;&lt;em&gt;os&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;interesados señalados en el anexo adjunto y por el importe indicado en el anexo de esta resolución.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;3. Declarar concluido el procedimiento y archivar el expediente INEA2019_1/473.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;4. Publicar esta Resolución &lt;/em&gt;&lt;em&gt;en el B&lt;/em&gt;&lt;em&gt;oletín &lt;/em&gt;&lt;em&gt;O&lt;/em&gt;&lt;em&gt;ficial de les &lt;/em&gt;&lt;em&gt;I&lt;/em&gt;&lt;em&gt;lles Balears.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Interposición de recursos&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Contra esta resolución, que no agota la vía administrativa, podrá interponerse recurso de alzada ante la&amp;nbsp;conse&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;ll&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;er&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;a&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;de Agricultura&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;,&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;Pesca&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;y Alimentación&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;, en el plazo de un mes, a contar desde el día siguiente a la notificación de la resolución, de acuerdo con el artículo 58.4 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la comunidad autónoma de las Islas Baleares, y l&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;os&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;artículos 121 y 122&amp;nbsp;de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
