&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El apartado 9.3 de la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 10 de setiembre de 2015 por la cual se convocan subvenciones para la Creación de empresas de Jóvenes agricultores, para los años 2015-2019, especifica que la resolución expresa se notificará a las personas interesadas mediante su publicación en el &lt;em&gt;Boletín Oficial de las Islas Baleares&lt;/em&gt;&amp;nbsp;de acuerdo con los términos que prevee el artículo 45.2 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Los expedientes han sido tramitados por el Fondo de Garantia Agraria y Pesquera de las Islas Baleares (FOGAIBA), en cumplimiento del que dispone el artículo 43 de la Ley 39/2015, de 1 de octubre, del Procedimiento Común de las Administraciones Públicas.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;1.Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 10 de septiembre de 2015, por la que se convocan, para los años 2015 a 2019, subvenciones para la creación de empresas de jóvenes agricultores . La citada Resolución se modificó en fecha 26 de abril de 2016 (BOIB núm. 54). &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;2.Una vez analizada toda la documentación presentada, el vicepresidente del FOGAIBA resolvió favorablemente la concesión de la ayuda a favor del interesado que figura en el anexo de la Resolución con los datos e importes correspondientes. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;&lt;em&gt;3. El 2 de mayo de 2019, en el BOIB núm. 59, se publicó la Resolución de la concesión a los beneficiarios de las ayudas, R4 de 5 de abril de 2019, en la que se incluye Joana Pou Sureda (núm. Exp. CEJA2018_1/114), con un importe prima de 60.000,00€.&lt;/em&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;&lt;em&gt;4. El 28 de mayo de 2019 (con registro de entrada 15717) se presentó la solicitud del primer pago parcial de la prima (50 %), se realizó un pago por importe de 30.000,00€.&lt;/em&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;&lt;em&gt;5. El 8 de junio de 2022 (con registro de entrada 23433298), el beneficiario presentó la solicitud de desistimiento del complemento de 15.000,00 € por incorporación de dos personas jóvenes a una empresa.&lt;/em&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;&lt;em&gt;Por ello, implica realizar una revocación parcial de 15.000,00 euros, por tanto, el pago correspondiente al 2º tramo será de una cuantía de 15.000,00€.&lt;/em&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;em&gt;Fundamentos de derecho&lt;/em&gt;&lt;/strong&gt;&lt;/p&gt;

Orden del conseller de Agricultura, Medio Ambiente y Territorio de 19 de febrero de 2015, por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco del Programa de Desarrollo Rural de las Islas Baleares desde 2014 hasta 2020.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;3. Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;em&gt;Propuesta de Resolución&lt;/em&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;Por todo ello, se informa favorablemente y se propone al vicepresidente del FOGAIBA que dicte una resolución en los siguientes términos:&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;Revocar parcialmente las&amp;nbsp;r&lt;/em&gt;&lt;em&gt;esoluci&lt;/em&gt;&lt;em&gt;o&lt;/em&gt;&lt;em&gt;n&lt;/em&gt;&lt;em&gt;es&lt;/em&gt;&lt;em&gt;&amp;nbsp;de ayuda concedida&lt;/em&gt;&lt;em&gt;s&lt;/em&gt;&lt;em&gt;&amp;nbsp;a&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;l&lt;/em&gt;&lt;em&gt;as personas&lt;/em&gt;&lt;em&gt;&amp;nbsp;beneficiari&lt;/em&gt;&lt;em&gt;as&lt;/em&gt;&lt;em&gt;, por el importe y con los &lt;/em&gt;&lt;em&gt;plaz&lt;/em&gt;&lt;em&gt;os detallados en el anexo de esta Resolución, que es un total de 1 expediente y que empieza y termina por J&lt;/em&gt;&lt;em&gt;OAN&lt;/em&gt;&lt;em&gt;A&lt;/em&gt;&lt;em&gt;&amp;nbsp;POU SUREDA&lt;/em&gt;&lt;em&gt;, que suma un total de &lt;/em&gt;&lt;em&gt;15&lt;/em&gt;&lt;em&gt;.000,00 &lt;/em&gt;&lt;em&gt;euros&lt;/em&gt;&lt;em&gt;, relativa a la línea de ayuda &lt;/em&gt;&lt;em&gt;“Creación de empresas de jóvenes agricultores”.&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;em&gt;Interposición de recursos&lt;/em&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;Contra esta resolución, que no agota la vía administrativa, podrá interponerse recurso de alzada ante la consellera de Agricultura, Pesca y Alimentación en el plazo de un mes, a contar desde el día siguiente de la notificación de la resolución, de acuerdo con el artículo 58.4 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Islas Baleares, y los&amp;nbsp;artículos&amp;nbsp;121 y 122&amp;nbsp;de la Ley 39/2015, de 1 de octubre, del Procedimiento administrativo común de las Administraciones públicas.&lt;/em&gt;&lt;/p&gt;
