    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;El Instituto de Industrias Culturales de las Illes Balears (en adelante, ICIB) es una entidad pública empresarial de las que prevé el artículo 2.1.&lt;em&gt;b&lt;/em&gt;) de la Ley 7/2010, de 21 de julio, del Sector Público Instrumental de la Comunidad Autónoma de las Illes Balears, con personalidad jurídica propia y diferenciada, y con capacidad de actuar y autonomía de gestión plenas, sin perjuicio de la relación de tutela de la Administración de la comunidad autónoma. El ICIB está adscrito a la Consejería de Fondos Europeos, Universidad y Cultura, &lt;/span&gt;en virtud del Decreto 11/2021, de 15 de febrero, de la presidenta de las Illes Balears, por el que se establece la estructura orgánica básica de las consejerías de la Administración de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;El ICIB tiene como fines generales los relacionados con el desarrollo de las industrias y empresas culturales y creativas en el marco de la Comunidad Autónoma de las Illes Balears, de conformidad con sus Estatutos. Los ámbitos iniciales de actuación del ente son el audiovisual y la cultura digital, las artes escénicas, las artes visuales, el mundo editorial y la música, sin perjuicio de que en el futuro se puedan incorporar otros sectores, como el patrimonio, la artesanía, el diseño y la publicidad, u otros campos de la cultura.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;El artículo 30.26 del Estatuto de Autonomía de las Illes Balears dispone que la Comunidad Autónoma tiene las competencias correspondientes a cultura, actividades artísticas y culturales, y fomento y difusión de la creación y producción teatral, musical, cinematográfica y audiovisual, literaria, de danza y de artes combinadas, así como su difusión nacional e internacional.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;El Acuerdo del Consejo de Gobierno de 20 de diciembre de 2021 por el que se aprueba el Plan Estratégico de Subvenciones de la Comunidad Autónoma de las Illes Balears para el ejercicio 2021-2023 prevé la línea de subvención I.5.6 para ayudas para proyectos culturales. &lt;/span&gt;&lt;span style="color:#000000"&gt;De acuerdo con el artículo 1 de la Orden de la consejera de Educación y Cultura de 1 de julio de 2009 por la que se establecen las bases reguladoras de las subvenciones en materia de educación y cultura (BOIB n.º 100, de 11 de julio), pueden ser objeto de subvenciones las actividades correspondientes a la promoción de la cultura y de las artes plásticas tanto entre las Illes Balears como en el exterior.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Estas ayudas están sometidas a los requisitos y límites establecidos en el Reglamento (UE) n.º 651/2014 de la Comisión, de 17 de junio de 2014, y les es de aplicación la exención correspondiente a la categoría de ayudas a la cultura y la conservación del patrimonio (artículo 53).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Por todo ello, de acuerdo con lo dispuesto en&lt;span style="background-color:#ffffff"&gt; el artículo 15 del Texto Refundido de la Ley de Subvenciones, aprobado por Decreto Legislativo 2/2005, de 28 de diciembre, y haciendo uso de las facultades que me atribuye el artículo 10.1.&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;i&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:#ffffff"&gt;) de los Estatutos del ICIB, dicto la siguiente&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Resolución&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;1. Aprobar la convocatoria de subvenciones para apoyar proyectos culturales para el año 2022&lt;/span&gt;, que consta como en Anexo 1 de esta Resolución.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;2. Aprobar el presupuesto de esta convocatoria, que tiene un importe máximo de 440.000 € (cuatrocientos cuarenta mil euros).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;3. Autorizar un gasto de 440.000 € con cargo al capítulo IV del presupuesto del ICIB.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="background-color:#ffffff"&gt;4. Ordenar trasladar el contenido de esta Resolución a la &lt;/span&gt;Base datos nacional de subvenciones, así como toda la información requerida en la misma Base de datos, de acuerdo con el artículo 20.8 de la Ley 38/2003, de 17 de noviembre; el artículo 34 del Decreto Legislativo 2/2005, de 28 diciembre, por el que se aprueba el Texto Refundido de la Ley de Subvenciones, y el Real Decreto 130/2019, de 8 de marzo, por el que se regula la Base nacional de subvenciones y la publicidad de las subvenciones y demás ayudas públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;4. Publicar la convocatoria en el &lt;em&gt;Boletín Oficial de las Illes Balears.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Interposición de recursos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Contra esta Resolución, que agota la vía administrativa, podrá interponerse un recurso potestativo de reposición ante el presidente del ICIB en el plazo de un mes a contar a partir del día siguiente a su publicación en el &lt;em&gt;Boletín Oficial de&lt;span style="color:#000000"&gt; &lt;/span&gt;las Illes Balears&lt;/em&gt;, de acuerdo con el artículo 124 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas, y el artículo 57 de la Ley 3/2003, de 26 de marzo, de Régimen Jurídico de la Administración de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;También podrá interponerse directamente un recurso contencioso-administrativo ante el Juzgado de lo Contencioso-Administrativo en el plazo de dos meses a contar desde el día siguiente a su publicación, de acuerdo con el artículo 46 de la Ley 29/1998, de 13 de julio, Reguladora de la Jurisdicción Contencioso-Administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Esta convocatoria tiene por objeto la concesión de subvenciones para apoyar proyectos culturales de las artes escénicas, de la música, de las artes visuales y del mundo editorial para el año 2022.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;1.2. Los proyectos son entendidos como acciones culturales que promocionan los productos culturales, que impulsan su consumo, que ponen en valor la diversidad cultural y que contribuyen a fortalecer el tejido industrial del sector cultural. Estos proyectos culturales deben incluirse en alguna de las siguientes modalidades:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;Modalidad A: artes escénicas&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;Modalidad B: música&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;Modalidad C: artes visuales&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;Modalidad D: mundo editorial&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;1.3. No son objeto de esta convocatoria y, por tanto, quedan excluidos:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;— Los proyectos relacionados con el sector audiovisual&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;— Los proyectos culturales de naturaleza académica producidos por empresas con vinculación directa con centros de formación. A efectos de esta convocatoria, se entiende tiende por &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;vinculación directa &lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;el hecho de que la empresa gestora del centro formativo tenga una participación directa o indirecta en el capital social de la empresa productora que, de acuerdo con sus estatutos, le otorgue el derecho a designar a más de la mitad de los miembros de sus órganos de administración o dirección.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;— Las ferias y festivales, excepto aquellos en los que se trate de su primera edición.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;2. Gastos subvencionables y no subvencionables&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;2.1. De conformidad con el artículo 40 del Decreto Legislativo 2/2005, de 28 de diciembre, por el que se aprueba el Texto Refundido de la Ley de Subvenciones, se consideran gastos subvencionables los que, de forma indudable, responden al desarrollo del proyecto cultural dentro del periodo comprendido entre el 1 de enero de 2022 y el 30 de noviembre de 2022.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;Se pueden subvencionar las nóminas de trabajadores dados de alta en el régimen general de la Seguridad Social y el coste de la Seguridad Social con cargo a la empresa, hasta un importe máximo equivalente al 50&amp;nbsp;% de los gastos subvencionables&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;2.2. No son subvencionables los siguientes gastos:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;— Los relativos a agua, luz, teléfono o similares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;— Los refrigerios, &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;caterings&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt; u otros análogos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;— Las dietas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;— Los relativos a obras o compra de equipamientos o de cualquier otro bien inventariable de similar naturaleza.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;— La compra de programas informáticos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;— Las páginas web de las personas físicas y jurídicas que no resulten imprescindibles para el desarrollo del proyecto cultural presentado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;— Las nóminas de los administradores y las cuotas de autónomos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;— Los gastos de personas que no tengan contrato de servicios o laboral con el solicitante.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;— &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;Los honorarios del beneficiario de la subvención &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;o de los administradores o representantes de las personas jurídicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;— El kilometraje en los desplazamientos por carretera.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;— Los tiques de combustible, gastos de peajes y taxis.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;— Los impuestos, tasas y tributos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;— La dotación económica de premios.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;— Gastos estructurales (compra de software y hardware, compra de instrumentos, alquiler y gastos de locales de uso habitual, alquiler de servicios informáticos no específicos de la actividad).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;— Obsequios.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;— Los gastos que no se correspondan con el periodo de ejecución.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;— Cualquier otro gasto que no quede justificado de una forma clara que responde indudablemente a la realización del proyecto.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;3. Importe e imputación presupuestaria&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;3.1. El crédito asignado a esta convocatoria es de 440.000 € (cuatrocientos cuarenta mil euros), con cargo al capítulo IV de los presupuestos del ICIB de 2022.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;3.2. El importe de la convocatoria se distribuye, por modalidades, de la siguiente forma:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Modalidad A (artes escénicas), para la que están reservados 140.000,00 €.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Modalidad B (música), para la que están reservados 140.000,00 €.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Modalidad C (artes visuales), para la que están reservados 85.000,00&amp;nbsp;€.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Modalidad D (mundo editorial), para la que están reservados 75.000,00&amp;nbsp;€.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;3.3. En caso de que no se llegue a repartir la cantidad máxima asignada para cada una de las modalidades, las cantidades no utilizadas se podrán destinar a otras modalidades. El mismo criterio se aplicará en el caso de falta de propuestas o si las propuestas no cumplen los requisitos o si no alcanzan la puntuación mínima exigible en la fase de valoración.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Para repartir este remanente, se considerarán las solicitudes a las que la Comisión Evaluadora haya otorgado una puntuación más alta, independientemente de su modalidad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;3.4. Siempre que la disponibilidad presupuestaria lo permita, se podrá incrementar el importe de esta convocatoria. El importe consignado inicialmente podrá ampliarse mediante una resolución de ampliación del crédito asignado. Salvo que se establezca de otro modo, esta ampliación no implica que el plazo para presentar solicitudes se amplíe y no afecta a la tramitación ordinaria de las solicitudes presentadas y no resueltas de forma expresa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;4. Beneficiarios y requisitos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;4.1.&lt;/span&gt;&lt;span style="color:#ce181e"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;Podrán ser beneficiarios de las subvenciones las personas físicas dadas de alta en el régimen de autónomos y las personas jurídicas de los sectores de las artes escénicas, la música, las artes visuales y el mundo del libro que puedan llevar a cabo los proyectos o las actividades que se encuentren en la situación que motiva la concesión de la subvención.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;4.2. Todas las personas o entidades que soliciten estas ayudas deberán cumplir los siguientes requisitos:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;a&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;) Estar al corriente de sus obligaciones con la Seguridad Social.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;b&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;) Estar al corriente de sus obligaciones tributarias con el Estado y con la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;c&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;) Estar establecidas en un Estado miembro de la Unión Europea o del Espacio Económico Europeo y, en el momento de solicitar la ayuda, tener un establecimiento operativo permanente en la Comunidad Autónoma de las Illes Balears, o acreditar que el 50&amp;nbsp;% de los contratos laborales o servicios contratados se ha realizado en el último año en las Illes Balears o que el proyecto cultural subvencionado (o subvencionable) tiene lugar en el territorio de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;d&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;) Estar de alta en un epígrafe del Impuesto de Actividades Económicas (IAE) vinculado, como mínimo, a uno de los siguientes sectores culturales: las artes escénicas, la música, las artes visuales o el mundo editorial.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;e&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;) Que el principal objeto social de la entidad sea el de las artes escénicas, la música, las artes visuales o el mundo del libro.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;f) &lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;Cumplir los principios del artículo 3 de la Ley 11/2016, de 28 de julio, de Igualdad de Mujeres y Hombres.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;g&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;) No haber sido sancionadas o condenadas por ejercer o tolerar prácticas laborales consideradas discriminatorias por razón de sexo o de género, por resolución administrativa firme o sentencia judicial firme. En caso de que hayan sido sancionadas o condenadas en esta situación, podrán presentarse siempre que hayan cumplido la sanción o la pena impuesta y hayan elaborado un plan de igualdad en las condiciones previstas en el artículo 11.3 de la Ley 11/2016, de 28 de julio, de Igualdad de Mujeres y Hombres.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;h)&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt; Presentar la solicitud en los términos y con los requisitos que establecidos en los apartados 6 y 7 de esta convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;i) &lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;En el caso de proyectos presentados para la modalidad D (mundo editorial), estar dadas de alta en la Base de datos de editoriales del Ministerio de Cultura y Deportes del Gobierno de España.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;4.3. No tendrán la condición de beneficiarios de esta convocatoria:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;— Las sociedades públicas y las entidades de derecho público, así como cualquier empresa u organización en la que la participación de estos entes sea mayoritaria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;— Las personas físicas o jurídicas que incurran en cualquiera de las prohibiciones establecidas en el artículo 10 del Texto Refundido de la Ley de Subvenciones de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;— Las asociaciones sin ánimo de lucro.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;— Las empresas cuya actividad principal es la referida al sector audiovisual.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;4.4. Las ayudas reguladas en esta convocatoria podrán concederse a las empresas que no se encuentren en situación de &lt;em&gt;empresa en crisis&lt;/em&gt;, de conformidad con el artículo 1.4.&lt;em&gt;c&lt;/em&gt;) del Reglamento (UE) n.º&amp;nbsp;651/2014 de la Comisión (Reglamento General de Exención por Categorías), y de acuerdo con la definición de &lt;em&gt;empresa en crisis&lt;/em&gt; que prevé el artículo 2.18 de este Reglamento.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;4.5. Estos requisitos deberán cumplirse desde el momento de la presentación de la solicitud y mantenerse hasta la finalización y la justificación de la actividad objeto de subvención.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;5. Normativa de aplicación&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Esta convocatoria se regirá por la Orden de la consejera de Educación y Cultura de 1 de julio de 2009 por la que se establecen las bases reguladoras de las subvenciones en materia de educación y cultura (BOIB n.º 100, de 11 de julio); el Decreto Legislativo 2/2005, de 28 de diciembre, por el que se aprueba el Texto Refundido de la Ley de Subvenciones (BOIB n.º 196, de 31 de diciembre); la Ley 38/2003, de 17 de noviembre, General de Subvenciones (BOE n.º 277, de 18 de noviembre), y demás normativa comunitaria, estatal o autonómica de aplicación a las subvenciones que concede la Administración de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;6. Plazo y presentación de solicitudes&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;6.1. El plazo para presentar las solicitudes, dirigidas al ICIB, se iniciará el 5 de septiembre de 2022 y se extenderá hasta el 20 de septiembre de 2022, ambos incluidos. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;6.2. Las solicitudes se formalizarán obligatoriamente tal y como se indica en el apartado 8.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;6.3. Cuando el solicitante sea una persona jurídica, deberá solicitar la ayuda por medio de su representante legal, acreditado adecuadamente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;6.4. En el caso de personas jurídicas, deberán presentar las solicitudes de forma electrónica mediante el trámite telemático que está disponible en la Sede Electrónica de la CAIB.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;En caso de presentarla de forma presencial, la Administración, conforme a lo establecido en el artículo 68.4 de la Ley 39/2015, les requerirá la formalización del modo señalado.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;En el caso de personas físicas (personas dadas de alta en el régimen especial de trabajadores autónomos), también es recomendable presentar toda la solicitud a través del trámite telemático &lt;/span&gt;&lt;span style="color:#000000"&gt;del procedimiento disponible en la Sede Electrónica de la CAIB:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&amp;lt;&lt;/span&gt;https://www.caib.es/seucaib/ca/200/persones&amp;gt;.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Sin embargo, las personas físicas también podrán presentar la documentación (solicitud, anexos y justificación) de forma presencial, a través de las oficinas de asistencia en materia de registro previstas en el artículo 16 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas. Las solicitudes entregadas en papel mediante registro deberán presentarse en hojas separadas (no encuadernadas y sin ningún tipo de unión), todas impresas a una cara o todas impresas a dos caras.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;En el supuesto de concesión de la subvención, en cualquier momento se podrá requerir la documentación original para cotejarla.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;6.5. Las personas interesadas deberán presentar las solicitudes cumplimentadas debidamente, de acuerdo con los modelos que facilite el ICIB, disponibles en la Sede Electrónica de la CAIB.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;6.6. Si la solicitud no cumple los requisitos legales y los exigidos en la Orden de bases reguladoras y la convocatoria, se requerirá una sola vez a la persona interesada para que subsane las deficiencias dentro de un plazo de diez días hábiles, de acuerdo con el artículo&amp;nbsp;68 de la Ley 39/2015, con la indicación de que, si no lo hace, se considerará que desiste de su petición, previa resolución a dictar en los términos que previstos en el artículo&amp;nbsp;21 de la Ley 39/2015.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;6.7. La presentación de solicitudes para estas ayudas supone la aceptación expresa y formal de lo establecido en las bases y esta convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;7. Número de solicitudes y plazo de ejecución de las actuaciones&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;7.1. Cada solicitante podrá presentar, en esta convocatoria, un máximo de dos solicitudes, en total.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Solamente en el caso de presentar proyectos exclusivamente para la modalidad D (mundo editorial) se podrá presentar un máximo de cuatro solicitudes en esta convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;En caso de que un mismo beneficiario presente más de dos solicitudes durante el periodo que establece el apartado 6, solo se considerarán las dos primeras que se hayan registrado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;7.2. Las facturas serán emitidas y pagadas en el periodo comprendido entre el 1 de enero de 2022 y el 15 de diciembre de 2022 (ambos incluidos), que corresponde igualmente al plazo de ejecución de las actuaciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;8. Documentación de la solicitud&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;8.1. El formulario de solicitud, cumplimentado debidamente y firmado, deberá ir acompañado de la siguiente documentación:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;a) &lt;/em&gt;Documentación administrativa&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;a&lt;/em&gt;.1) Persona física:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;— La acreditación de su identidad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;— Un documento acreditativo del alta en el régimen especial de trabajadores autónomos y de la vigencia de esta alta en el momento de presentar la solicitud.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;a&lt;/em&gt;.2) Persona jurídica:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;— El NIF de la persona jurídica.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;— El DNI, pasaporte o NIE de la persona física que la representa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;— Documento acreditativo de la representación legal con la que actúa la persona física que firma la solicitud, que deberá estar vigente en el momento de presentar esta solicitud.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;— &lt;span style="color:#00000a"&gt;Documento constitutivo de la entidad y sus estatutos sociales debidamente inscritos en el registro correspondiente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;a&lt;/em&gt;.3) Personas físicas y jurídicas:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;— Un documento acreditativo de estar dado de alta en el impuesto de actividades económicas (IAE) en epígrafes vinculados a los sectores culturales de las artes escénicas, la música, las artes visuales y el mundo del libro.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;— Certificado del domicilio fiscal del solicitante.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;— Certificado de estar al corriente de sus obligaciones tributarias con el Estado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;Sin embargo, no será necesaria la aportación de estos certificados en caso de que el interesado manifieste en su solicitud el consentimiento expreso para que el ICIB lleve a cabo la consulta sobre estos datos tributarios.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;— Certificado de estar al corriente de sus obligaciones con la Seguridad Social.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;— Certificado de estar al corriente de&lt;/span&gt;&lt;span style="color:#00000a"&gt; sus obligaciones tributarias con l&lt;/span&gt;&lt;span style="color:#000000"&gt;a hacienda de la &lt;/span&gt;&lt;span style="color:#00000a"&gt;Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;Sin embargo, no será necesaria la aportación de este certificado en caso de que el interesado no se oponga a que el ICIB consulte estos datos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;En caso de oponerse, deberá aportar la documentación acreditativa de estar al corriente de sus obligaciones tributarias y con la Seguridad Social antes de que se dicte la propuesta de &lt;span style="color:#000000"&gt;resolución de concesión.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Sin embargo, en el caso de subvenciones de cuantía igual o inferior a 3.000 €, la persona o la empresa interesada podrá sustituir la presentación de estos certificados mediante la presentación de una declaración responsable.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;b&lt;/em&gt;) Documentación del proyecto&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;b&lt;/em&gt;.1) Memoria descriptiva del proyecto cultural, que tendrá que incluir, obligatoriamente, todos estos apartados:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;— Objetivos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;— Explicación detallada del proyecto y de las acciones a desarrollar.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;— Plan de trabajo. Calendarización de la gestión y ejecución del proyecto cultural.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;— Estructura organizativa y recursos humanos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;— Acciones y métodos a desarrollar para la evaluación del proyecto cultural.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;— Viabilidad y coherencia del proyecto cultural.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;— Destinatarios y cobertura del proyecto cultural.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;— Plan de comunicación, difusión y marketing.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;— Trayectoria profesional y formación de la empresa solicitante, así como de las personas, colectivos, empresas o entidades implicados.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;— Explicación referente al uso de la lengua catalana, en lo que se refiere tanto a la presentación del proyecto como a las acciones a desarrollar y su difusión.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;— Explicación de las acciones a desarrollar con el objetivo de la consecución efectiva de la igualdad de género.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;b&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;.2) Presupuesto detallado del proyecto (Anexo 2), con ingresos y gastos y con el IVA pertinente desglosado. Será necesario que el presupuesto recoja todos los gastos previstos derivados del proyecto cultural.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;De acuerdo con el artículo 40.3. del Decreto Legislativo 2/2005, de 28 de diciembre, por el que se aprueba el Texto Refundido de la Ley de Subvenciones, si el importe es superior a 15.000 €, el beneficiario deberá solicitar, como mínimo, tres ofertas de diferentes proveedores, anteriores a la ejecución del compromiso, salvo que por sus especiales características no existan entidades suficientes para poder realizarlas, salvo que el gasto se haya efectuado antes de la solicitud de la subvención. Las ofertas presentadas tendrán que elegirse de conformidad con los criterios de eficacia y de economía, y deberá justificarse expresamente en caso de que la elección no recaiga en la propuesta económica más ventajosa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;8.2.Si la solicitud o la documentación presentada no cumple los requisitos legales y los exigidos en la Orden de bases reguladoras y esta convocatoria, se requerirá una sola vez a la persona interesada para que enmiende o aporte los documentos preceptivos dentro de un plazo de diez días hábiles, de acuerdo con el artículo 68 de la Ley 39/2015, con la advertencia de que, de no hacerlo, se considerará que desiste de su petición, previa resolución a dictar en los términos previstos en el artículo 21 de la misma Ley.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;8.3. El incumplimiento de los requisitos en la documentación aportada establecidos en esta convocatoria comportará que no se admita la solicitud.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;9. Criterios para seleccionar a los beneficiarios&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Los beneficiarios se seleccionarán mediante el procedimiento de concurso, separadamente para cada modalidad, de acuerdo con el siguiente procedimiento:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;a&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;) Una vez finalizado el periodo de presentación de solicitudes, la Comisión Evaluadora valorará los proyectos solicitados, separadamente para cada modalidad, de acuerdo con los criterios de valoración del apartado 27, y se ordenarán por orden de puntuación. En caso de empate, se seguirá el criterio establecido en el apartado 10.2.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;b&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;) A continuación, se calculará el importe de la subvención que correspondería a cada uno de los proyectos, con atención a las cuantías máximas establecidas en esta convocatoria, de acuerdo con los criterios del apartado 17.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;c&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;) Finalmente, las ayudas se concederán por el orden establecido en el apartado &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;a&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;) anterior y con el importe calculado en el apartado &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;b&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;), hasta que se agote el crédito presupuestario asignado a cada modalidad y, en su caso, con el crédito sobrante de otras modalidades.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;d&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;) Solo tendrán derecho a la subvención los solicitantes que hayan obtenido un mínimo de 25 puntos de acuerdo con los criterios de valoración.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;​​​​​​​&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;10. Importe de la subvención&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;10.1. Los proyectos se calificarán en función de las puntuaciones obtenidas según los criterios de valoración detallados en el apartado 27 y según lo dispuesto en los apartados 9.&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;b&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;) y 9.&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;c&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;10.2. A la hora de determinar las subvenciones correspondientes a las solicitudes que han obtenido la misma puntuación total dentro de una misma modalidad, si el crédito que queda por asignar no es suficiente para concederlas todas, se seguirá el orden de prelación en virtud de los siguientes criterios:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;— Las que han obtenido una mayor puntuación en el primer apartado del criterio de evaluación &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;a&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;). En caso de que haya más de una con la misma puntuación en este apartado y el crédito no sea suficiente para concederles las ayudas, este empate se resolverá teniendo en cuenta la puntuación obtenida en el apartado &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;b&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;). Si el crédito no fuera aún suficiente, para resolver el empate debería observarse la puntuación conseguida en el apartado &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;c&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;) y, si continuara el empate, se debería tener en cuenta la puntuación obtenida en el apartado &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;d&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;— Con todo, si como resultado de atender al orden de prelación anterior se mantuviera el empate, se resolvería a favor de la solicitud con el importe total de presupuesto subvencionable más elevado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Este sistema para resolver un posible empate entre solicitudes con una misma puntuación se aplicará siempre igual, hasta agotar todo el crédito a distribuir.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;10.3. En caso de que algún beneficiario renunciara a la subvención, el importe de la ayuda podría adjudicarse, correlativamente, a los expedientes denegados en la resolución de concesión.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;10.4. En ninguno de los casos se abonará un importe superior al justificado mediante facturas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;10.5. La suma de todos los gastos subvencionables tendrá que ser igual o superior a 2.000&amp;nbsp;€, IVA excluido.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;10.6. No se admitirán facturas justificativas inferiores a 100&amp;nbsp;€ (IVA excluido).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;11. Órganos competentes para instruir, informar y resolver el procedimiento&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;11.1. En aplicación del artículo 8 de las bases reguladoras, corresponde a la directora del ICIB y a su personal adscrito ordenar e instruir el procedimiento. De acuerdo con el artículo&amp;nbsp;20.&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;h&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;) de los Estatutos del ICIB, el órgano competente para resolverlo es la directora del ICIB.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;11.2. Corresponderá a la Comisión Evaluadora examinar las solicitudes presentadas y emitir el informe que deberá servir de base para elaborar la propuesta de resolución.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;12. Composición de la Comisión Evaluadora&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;12.1. En cuanto al régimen de constitución y funcionamiento, la Comisión Evaluadora se regirá por lo dispuesto en los artículos 15 y siguientes de la Ley 40/2015, de 1 de octubre, de Régimen Jurídico del Sector Público.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;12.2. La Comisión Evaluadora de esta convocatoria de subvenciones estará integrada por cinco miembros:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;— Presidente: la directora gerente del ICIB o la persona que ella designe (con voz, pero sin voto).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;— Vocales:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

El procedimiento se instruirá de acuerdo con el artículo 16 del Decreto Legislativo autonómico 2/2005, de 28 de diciembre, por el que se aprueba el Texto Refundido de la Ley de Subvenciones, y el artículo 8 de la Orden de la consejera de Educación y Cultura de 1 de julio de 2009 por la que se establecen las bases reguladoras de las subvenciones en materia de educación y cultura.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;13.2. De acuerdo con el informe de la Comisión Evaluadora, la directora gerente del ICIB formulará una propuesta de resolución de concesión en la que se repartirá la dotación &lt;/span&gt;&lt;span style="color:#333333"&gt;presupuestaria entre las solicitudes concurrentes, se determinará cuantía individual de cada ayuda y se expresará, como mínimo, el beneficiario o la lista ordenada de beneficiarios a los que se propone conceder la subvención y la cuantía de esta subvención.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;La propuesta se publicará en la Sede Electrónica de la CAIB a fin de que las personas interesadas puedan formular alegaciones en un plazo de diez días hábiles.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Como aviso, y sin efectos de notificación, el ICIB informará por vía telemática, al correo electrónico señalado en la solicitud, de que se ha publicado la propuesta de resolución en el web del ICIB, e indicará su fecha de publicación y su enlace.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;13.3. La directora gerente del ICIB resolverá el procedimiento mediante una resolución motivada, en la que se fijará, con carácter definitivo, la cuantía de la subvención concedida. Asimismo, la resolución especificará los siguientes aspectos: beneficiario, descripción, importe de la actividad que se subvenciona, importe de la subvención y recursos administrativos pertinentes. La resolución se publicará en el BOIB.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;13.4. La resolución de la directora gerente del ICIB que conceda o deniegue la subvención solicitada no agota la vía administrativa y, en contra, podrá interponer un recurso de alzada ante el presidente del ICIB, en el plazo de un mes a contar desde el día siguiente a la publicación de la resolución de concesión en el BOIB.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;13.5. El plazo máximo para dictar y notificar la resolución será de seis meses a partir de la publicación de esta convocatoria. El vencimiento del plazo máximo sin haberse notificado la resolución legitima a la entidad interesada a entender desestimada por silencio administrativo su solicitud de concesión de la subvención.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;14. Modificación del proyecto&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;14.1. La entidad beneficiaria podrá solicitar por escrito a la directora del ICIB la modificación del proyecto, cuando concurran circunstancias debidamente justificadas y siempre que la modificación no altere el objeto y la finalidad de la subvención.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;14.2. La solicitud de modificación deberá ir acompañada de una memoria en la que se expongan los motivos del cambio, la justificación de la imposibilidad de cumplir las condiciones de la concesión, y que el proyecto sigue cumpliendo las condiciones establecidas en esta convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;14.3. La directora del ICIB tendrá que autorizar la modificación mediante una resolución expresa, que notificará al beneficiario.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;15. Subcontratación&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;La persona o entidad beneficiaria podrá subcontratar hasta un 80&amp;nbsp;% de la ejecución de la actividad subvencionada, siempre que ello implique un valor añadido al contenido de la actividad. En todo caso, deberán respetarse los límites y las condiciones establecidos en los apartados del 3 al 7 del artículo 38 del Texto Refundido de la Ley de Subvenciones de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;De acuerdo con el artículo 38.7 de la citada Ley, en relación con el artículo 29.7.&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;d&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;) de la Ley&amp;nbsp;38/2003, de 17 de noviembre, el beneficiario no podrá concertar la ejecución total o parcial de las actividades subvencionadas con:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;a&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;) Personas o entidades sometidas a alguna de las prohibiciones del artículo 10 de la citada Ley.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;b&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;) Personas o entidades que hayan percibido otras subvenciones per realizar la actividad objeto de contratación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;c&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;) Intermediarios o asesores en los que los pagos se definan como un porcentaje del coste total de la operación, salvo que el pago esté justificado en referencia al valor de mercado del trabajo efectuado o de los servicios prestados.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;d&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;) Personas o entidades vinculadas con el beneficiario, salvo que la contratación se efectúe de acuerdo con las condiciones normales de mercado y se obtenga la autorización previa expresa del órgano que concede la subvención.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;e&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;) Personas o entidades solicitantes de ayuda o subvención en la misma convocatoria y en el mismo programa que no hayan obtenido la subvención por no cumplir los requisitos o no lograr la valoración suficiente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Para la determinación de las personas vinculadas se aplicará, supletoriamente, el artículo&amp;nbsp;68.2 del Reglamento de Subvenciones, aprobado por Real Decreto 887/2006, de 21 de julio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;16. Comprobación de valores de mercado&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;En ningún caso el importe de los gastos subvencionables podrá ser superior al valor de mercado. El ICIB podrá comprobar el valor de mercado de los gastos subvencionados, de acuerdo con el artículo 41 del Texto Refundido de la Ley de Subvenciones de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;17. Importes máximos de las ayudas&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;17.1. El importe máximo de la ayuda que podrá percibir cada proyecto beneficiario no podrá superar nunca el 60&amp;nbsp;% del presupuesto total del proyecto cultural.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;17.2. El importe máximo de la ayuda que podrá percibir cada proyecto beneficiario es de 25.000 € (veinticinco mil euros) para las modalidades A, B y C.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;En caso de presentar proyectos para la modalidad D (mundo editorial), el importe máximo de la ayuda que podrá percibir cada proyecto beneficiario es de 10.000 € (diez mil euros).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;17.3. El importe máximo que podrá percibir un mismo beneficiario es de 50.000&amp;nbsp;€ (cincuenta mil euros).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;17.4. Para máximos acumulados con otras ayudas, véase el punto 20.1.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;17.5. En caso de que algún beneficiario renunciara a la subvención, o en caso de que se produjera una minoración en el importe final justificado, el importe de la ayuda se podría adjudicar a otros expedientes siguiendo el mismo criterio que establece el apartado&amp;nbsp;9.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;16.5. Esta subvención es compatible con otras subvenciones concedidas a los beneficiarios para la misma finalidad, aun cuando el importe derivado de la suma de todas las subvenciones no pueda ser de una cantidad que supere el coste del proyecto subvencionado.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;18. Pago&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;18.1. Las ayudas se abonarán en un único pago, que se realizará una vez acreditado el cumplimiento de la finalidad para la que se ha otorgado la subvención y justificada la realización de la actividad subvencionada en los términos de esta convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;18.2. La subvención se pagará mediante una transferencia bancaria en el número de cuenta bancaria indicada &lt;/span&gt;en el formulario de solicitud&lt;span style="color:#000000"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;​​​​​​​&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;19. Justificación&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;19.1. El plazo para justificar los gastos subvencionables objeto de la ayuda terminará en veinte días hábiles a contar desde el día siguiente a la publicación de la resolución de concesión, si el proyecto ya ha finalizado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;En caso de que el proyecto no esté finalizado, el plazo para presentar la documentación justificativa terminará el 20 de diciembre de 2022.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;En caso de que no se hubiera presentado, el órgano administrativo competente requeriría al beneficiario para presentar la justificación en un plazo improrrogable de quince días hábiles, tal y como establece el artículo 20.3.&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;c&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;) de la Orden de la consejera de Educación y Cultura de 1 de julio de 2019 por la que se establecen las bases reguladoras de subvenciones en materia de educación y cultura. El hecho de presentar la justificación en el plazo adicional que establece este apartado no eximirá al beneficiario de las sanciones que correspondan de conformidad con la Ley General de Subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;19.2. No tendrán la consideración de justificantes de la inversión subvencionada las facturas emitidas o los extractos bancarios realizados con anterioridad al 1 de enero de 2022 ni con posterioridad al 15 de diciembre de 2022, salvo que se trate de un pago a cuenta para realizar los pedidos relacionados directamente con la actividad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;19.3. La actividad subvencionada deberá justificarse con la presentación de la cuenta justificativa, a través del modelo normalizado (Anexo 4), con la siguiente documentación:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;a) &lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;Una memoria de actuación justificativa del cumplimiento de las condiciones impuestas para la concesión de la subvención, con indicación de todas las acciones llevadas a cabo y de los resultados obtenidos. Asimismo, deberá contener toda la información necesaria para interpretar y comprender correctamente la justificación de gastos presentada y su imputación al proyecto. Si no se ha ejecutado la totalidad del proyecto por causas ajenas o de fuerza mayor, la memoria expondrá sus causas y explicará las modificaciones aplicadas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;b&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;) En caso de que el proyecto implique realizar actividades en espacios físicos, dos fotografías para cada una de las actividades llevadas a cabo, que deberán permitir confirmar que se han hecho.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;c) &lt;/em&gt;Una memoria económica justificativa del coste de las acciones llevadas a cabo o&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;de los gastos objeto de la subvención, que deberá contener:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;— E&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;xplicación detallada de los gastos realizados en relación con el proyecto cultural. En su caso, se indicarán las desviaciones que se produzcan en el presupuesto inicial. Solo se tendrán en cuenta los conceptos imputados al presupuesto presentado con la solicitud.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;— Indicación, si procede, de los criterios de reparto de los costes generales e indirectos incorporados a la relación clasificada de dichos gastos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;— Relación detallada de otros ingresos o subvenciones, si procede, que hayan financiado la actividad subvencionada, con indicación de su importe y procedencia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;— &lt;/span&gt;&lt;span style="color:#000000"&gt;Hoja de cálculo (Anexo 4) que incluya una relación clasificada de los gastos, cumplimentada correctamente y firmada, &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;con la identificación del acreedor, el importe, la fecha de emisión y la fecha de pago.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;— Si procede, y de acuerdo con el artículo 40.3. del Decreto Legislativo 2/2005, de 28 de diciembre, por el que se aprueba el Texto Refundido de la Ley de Subvenciones, cuando el importe del gasto subvencionable supere las cuantías que establece la legislación estatal en materia de contratos del sector público para los contratos menores, el beneficiario, cuando sea una persona física o jurídica privada, con o sin ánimo de lucro, deberá presentar, como mínimo, tres ofertas de diferentes proveedores, anteriores a la ejecución del compromiso, salvo que, por sus características especiales, no existan entidades suficientes para poder realizarlas, excepto que el gasto se haya realizado antes de solicitar la subvención. Las ofertas presentadas deberán elegirse de conformidad con los criterios de eficacia y de economía, y deberá justificarse expresamente en caso de que la elección no recaiga en la propuesta económica más ventajosa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="background-color:#ffffff"&gt;En los supuestos en que a las solicitudes deba adjuntarse una memoria económica, los compromisos que se plasmen podrán flexibilizarse en el sentido de que se permitan compensaciones entre los conceptos presupuestados, siempre que se cumpla la finalidad de la subvención.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;d) &lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;Las facturas, ya sean completas o simplificadas, deberán cumplir los requisitos establecidos en el Reglamento por el que se regulan las obligaciones de facturación, aprobado por Real Decreto 1619/2012, de 30 de noviembre. La descripción de la operación tendrá que aportar información suficiente sobre el concepto y el periodo objeto de facturación, para que se pueda verificar la relación del gasto con el desplazamiento objeto de la ayuda. Si el concepto de la factura no es suficientemente explicativo, deberán adjuntarse los albaranes de entrega correspondientes u otra documentación justificativa. En todo caso se tendrá que poder verificar el precio unitario de la operación. En caso de que en algunas de las facturas solicitadas no conste el IVA, es obligatorio hacer referencia a la disposición normativa en virtud de la cual es de aplicación la exención, de acuerdo con el artículo 6.1.&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;j&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;) del Reglamento por el que se regulan las obligaciones de facturación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;No se admitirán facturas que no desglosen con detalle los servicios contratados.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;No se aceptarán tiques como documentos contables justificativos de gastos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;e&lt;/em&gt;) Los documentos acreditativos del pago (extracto bancario y/o justificante bancario) deberán cumplir los siguientes requisitos:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;— La identificación de la persona beneficiaria y del ordenante del pago, que tendrán que coincidir con el beneficiario y con el emisor de la factura, respectivamente. El ordenante deberá hacer constar su NIF y la denominación social.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;— El concepto en el que se ordena el pago y remisión al número o números de factura a los que corresponde. Si el documento de pago no hace referencia a las facturas, irá acompañado de la documentación complementaria que permita verificar la correspondencia entre gasto y pago.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;En el caso de pago mediante cheque nominativo, pagaré, letras de cambio o similares, la entidad tendrá que aportar una copia del documento y una copia del extracto bancario que acredita el cargo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;— No se aceptará ningún documento acreditativo del pago que sea en efectivo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;— No se aceptará ninguna justificación de pago por compensación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;f) &lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;Si procede, una copia de los materiales gráficos editados con motivo de la actividad subvencionada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;g&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;) Cualquier otra documentación que le sea requerida a efectos de comprobar la realización del proyecto cultural subvencionado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;19.4. En caso de que la cuenta justificativa no contenga la documentación necesaria para comprobar que se ha justificado y aplicado la ayuda, el órgano competente deberá solicitar al beneficiario que subsane los defectos de la justificación dentro de los&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt; &lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;diez días hábiles siguientes, a contar a partir del día siguiente a haber recibido el requerimiento de enmienda.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;19.5. En caso de que no se justifique totalmente la actividad objeto de la ayuda, pero se haya cumplido parcialmente la finalidad para la que se concedió esta ayuda, se revisará y minorará proporcionalmente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;19.6. Cualquier alteración de las condiciones que se hayan tenido en cuenta para conceder la ayuda y, en todo caso, la obtención concurrente de subvenciones o ayudas concedidas por otras administraciones o entidades, públicas o privadas, nacionales o internacionales, podrá dar lugar a la modificación de la resolución de la concesión.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;19.7. La falta de justificación en los términos y plazos que establezca la resolución de concesión de la ayuda, así como los demás incumplimientos previstos en la normativa aplicable, podrán determinar la revocación de la ayuda. El órgano gestor será el encargado de dirimirla.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;19.8. En el marco de un control financiero, la Intervención de la Comunidad Autónoma podrá solicitar copia de los extractos de movimientos bancarios, información a los emisores de las facturas, control material de las inversiones y otras comprobaciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;20. Concurrencia de ayudas o subvenciones&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;20.1. E&lt;/span&gt;l importe de las ayudas establecido en esta convocatoria no podrá ser, en ningún caso, de una cuantía que, aisladamente o en concurrencia con subvenciones o ayudas de otras administraciones públicas, o de otras entidades públicas o privadas, nacionales o internacionales, supere el 100&amp;nbsp;% del coste de la actividad objeto de la ayuda.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;De conformidad con el artículo 11.&lt;em&gt;e&lt;/em&gt;) del Decreto Legislativo&amp;nbsp;2/2005, el beneficiario deberá comunicar al órgano que la concede, la solicitud o la obtención de otras subvenciones para la misma finalidad. Esta comunicación se tendrá que realizar dentro del plazo de tres días hábiles desde la solicitud o la obtención de la subvención concurrente y, en todo caso, antes de justificar la aplicación que se haya dado a los fondos percibidos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;20.2. Los beneficiarios no podrán obtener ayudas por los mismos conceptos que se deriven de otras convocatorias de ayudas de la Consejería de Fondos Europeos, Universidad y Cultura; del propio ICIB&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;; del Instituto de Estudios Baleáricos (IEB), o del Instituto Ramon Llull.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;20.3. En los casos no previstos en el punto anterior, esta subvención será compatible con otras subvenciones concedidas a los beneficiarios para la misma finalidad, con las siguientes condiciones:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;a) &lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;El importe derivado de la suma de todas las subvenciones no podrá ser de una cantidad que supere el coste de la actividad subvencionada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;em&gt;b&lt;/em&gt;) Las facturas y los justificantes de gasto que se hayan presentado a otras convocatorias de subvenciones deberán incluirse en la cuenta justificativa de esta convocatoria. En este caso, dichas facturas y justificantes de gasto se presentarán estampillados por la otra administración y, además, indicarán el porcentaje que haya imputado dicha administración a su convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;En caso de que no sea posible presentar la documentación estampillada, se deberá presentar una relación, firmada debidamente, de las facturas y justificantes de gasto. Esta relación tendrá que incluir una descripción clara de la otra convocatoria, el porcentaje que se ha imputado a ella y la autorización expresa para que el ICIB, si procede, verifique los datos con la otra administración.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;21. Obligaciones de los beneficiarios&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Son obligaciones de los beneficiarios de las ayudas las establecidas en el artículo 11 del Texto Refundido de la Ley de Subvenciones. Además de las obligaciones que se establecen en este artículo, los beneficiarios deberán cumplir las siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;a)&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt; Comunicar al órgano que ha emitido la propuesta de resolución que la aceptan o que renuncian a ella, en los términos establecidos en esta convocatoria. En cualquier caso, se entenderá que queda aceptada automáticamente si en el plazo de diez días hábiles desde que se notifica la propuesta no se hace constar lo contrario.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;b)&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt; Acreditar ante el órgano que les ha concedido la ayuda el efectivo cumplimiento de los requisitos y condiciones que se exigen para la concesión de las ayudas y, si procede, el mantenimiento de la actividad subvencionada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;c)&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt; Someterse a las actuaciones de comprobación y control que procedan por parte de las administraciones autonómica, estatal y comunitaria; de la Sindicatura de Cuentas, o de otros órganos de control externo, así como facilitar toda la información que les requieran en relación con las ayudas concedidas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;em&gt;d)&lt;/em&gt;&lt;span style="color:#000000"&gt; Acreditar, en la forma que se establezca reglamentariamente y antes de dictar la propuesta de resolución de concesión, que se encuentran al corriente de sus obligaciones tributarias y con la Seguridad Social ante la Administración del Estado y de sus obligaciones tributarias ante la hacienda autonómica.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;e)&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt; Llevar a cabo la acción o acciones o la inversión que fundamenta la concesión de la subvención en la forma y el plazo establecidos en esta convocatoria. Cualquier cambio en el proyecto o en el calendario deberá comunicarse antes de que acabe el plazo de ejecución al órgano gestor, el cual podrá aceptar o no la modificación solicitada. Los cambios que no se hayan comunicado podrán dar lugar a la revocación total o parcial de la subvención.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;f)&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt; Destinar el importe de la subvención a financiar la actuación para la que se ha solicitado, y mantener la afectación de las inversiones a la actividad subvencionada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;g)&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt; Declarar toda alteración de las condiciones tenidas en cuenta para su concesión. En cualquier caso, la obtención concurrente de subvenciones otorgadas por cualquier entidad pública o privada, nacional o internacional, podrá dar lugar a la modificación de la subvención concedida.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;h) &lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;Comunicar al ICIB, con una antelación mínima de diez días hábiles, la celebración de cualquier acto público relacionado con la actividad subvencionada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;i&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;) Difundir que el proyecto ha sido objeto de subvención por parte del ICIB e incluir su logotipo en cualquier acción de difusión y publicidad que se lleve a cabo. &lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;22. Interpretación y ejecución&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;El presidente del ICIB podrá dictar las resoluciones, circulares e instrucciones que resulten necesarias para interpretar y ejecutar esta convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;23. Revocación&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;23.1. De acuerdo con el artículo 43 del Decreto Legislativo 2/2005, de 28 de diciembre, procederá revocar la subvención cuando, posteriormente a la resolución de concesión válida y ajustada al Derecho, el beneficiario incumpla total o parcialmente las obligaciones o compromisos contraídos a los que está condicionada la eficacia del acto de concesión de la subvención.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;23.2. Como consecuencia de la revocación de la subvención, el acto de concesión quedará sin efecto, total o parcialmente, y procederá el reintegro de las cantidades indebidamente percibidas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;24. Reintegro&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;24.1. Procederá reintegrar, total o parcialmente, las cantidades recibidas y exigir el interés de demora desde el momento del pago de la subvención hasta la fecha de la resolución por la que se aprueba el reintegro en los supuestos previstos en el artículo 44.1 del Decreto Legislativo 2/2005.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Además, cuando la resolución de concesión de subvención haya sido declarada inválida por cualquiera de las causas de nulidad de pleno derecho o de anulabilidad establecidas en el ordenamiento jurídico aplicable, el órgano competente debe iniciar, si procede, el procedimiento de reintegro de las cantidades abonadas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;24.2. Las cantidades reintegrables tendrán la consideración de ingresos de derecho público y podrán ser exigidas por la vía de apremio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;24.3. En caso de incumplimiento parcial o de justificación parcial, deberá reintegrarse la cantidad recibida mediante la aplicación de un porcentaje de minoración y según la naturaleza del incumplimiento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;25. Régimen de infracciones y sanciones&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Constituyen infracciones administrativas en materia de subvenciones las acciones u omisiones de los beneficiarios previstas en los artículos 51, 52 y 53 del Decreto Legislativo&amp;nbsp;2/2005, cuando intervenga dolo, culpa o simple negligencia, y será de aplicación el título V de dicha norma.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;26. Criterios de valoración (máximo de 50 puntos)&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;a&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;) Calidad e interés (máximo de 30 puntos):&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;— Objetivos (máximo: 3 puntos).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;— Explicación detallada del proyecto y de las acciones a desarrollar (máximo: 10 puntos).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;— Plan de trabajo. Calendarización de la gestión y ejecución del proyecto cultural (máximo: 3 puntos).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;— Estructura organizativa y recursos humanos (máximo: 3 puntos).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;— Acciones y métodos a desarrollar para evaluar el proyecto cultural (máximo: 3 puntos).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;— Viabilidad y coherencia del proyecto cultural (máximo: 4 puntos).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;— Presupuesto, con ingresos y gastos (máximo: 4 puntos).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;b&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;) Destinatarios y cobertura del proyecto cultural (máximo de 5 puntos):&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;— Definición del perfil de destinatarios a los que se dirige el proyecto cultural (máximo: 1&amp;nbsp;punto).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;— Acciones para el desarrollo de nuevos públicos y que favorecen la inclusión social (máximo: 3 puntos).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;— Definición de la ubicación y/o cobertura del proyecto cultural (máximo: 1 punto).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;c&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;) Plan de comunicación, difusión y marketing (máximo de 5 puntos).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;d&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;) Trayectoria profesional y formación de la empresa solicitante, así como de las personas, colectivos, empresas o entidades implicados (máximo de 5 puntos).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;e&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;) Uso de la lengua catalana, en cuanto tanto a la presentación del proyecto como a las acciones a desarrollar y su difusión (máximo de 2 puntos).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;f&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;) Acciones desarrolladas con el objetivo de la consecución efectiva de la igualdad de género (máximo de 3 puntos).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;La puntuación mínima para obtener subvención será de 25 puntos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;27. Protección de datos personales&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Los tratamientos de datos de carácter personal de las personas físicas se harán con estricta sujeción a lo dispuesto en el Reglamento (UE) 2016/679 del Parlamento Europeo y del Consejo, de 27 de abril de 2016, relativo a la protección de las personas físicas lo que respecta al tratamiento de datos personales y a la libre circulación de estos datos y por el que se deroga la Directiva 95/46/CE (Reglamento General de Protección de Datos); la Ley Orgánica&amp;nbsp;3/2018, de 5 de diciembre, de Protección de Datos Personales y Garantía de los Derechos Digitales, y demás normativa sobre protección de datos personales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
