    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:125%"&gt;&lt;span style="line-height:125%"&gt;Por Acuerdo del Pleno de fecha 03/08/2022, fue aprobada la disolución de la Junta de Gobierno Local de este Ayuntamiento tras lo cual, mediante Resolución de Alcaldía de fecha 05/08/2022, se aprobó el cese de los Regidores que formaban parte de esta Junta y nombramiento de nuevo Teniente de Alcalde, lo que se publica a efectos de los artículos 46.1 y 52.4 del Reglamento de Organización, Funcionamiento y Régimen Jurídico de las Entidades Locales aprobado por Real Decreto 2568/1986, de 28 de noviembre.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;/ul&gt;

&lt;p&gt;&lt;em&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:125%"&gt;&lt;span style="line-height:125%"&gt;«Visto el Informe de Secretaría y de conformidad con lo dispuesto en los artículos 20.1.b) de la Ley 7/1985, de 2 de abril, Reguladora de las Bases del Régimen Local y 35.2.d) del Reglamento de Organización, Funcionamiento y Régimen Jurídico de las Entidades Locales aprobado por Real Decreto 2568/1986, de 28 de noviembre, el Alcalde propone al Pleno del Ayuntamiento la adopción del siguiente&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;ACUERDO&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;PRIMERO. Disolver la Junta de Gobierno Local, con efectos desde el día siguiente a la fecha de adopción del presente acuerdo, haciendo constar que las competencias delegadas mediante el acuerdo plenario de fecha 08 de julio de 2019, devuelven a este Plenario.&lt;/span&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:125%"&gt;&lt;span style="line-height:125%"&gt;SEGUNDO. Comunicar este acuerdo a todos los Regidores afectados para que tomen conocimiento y efectos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:125%"&gt;&lt;span style="line-height:125%"&gt;TERCERO. Publicar este acuerdo en el Boletín Oficial de las Islas Baleares, en cumplimiento de lo que se dispone en el artículo 46.1 del Reglamento de Organización, Funcionamiento y Régimen Jurídico de las Entidades Locales aprobado por Real Decreto 2568/1986, de 28 de noviembre.»&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;em&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:125%"&gt;&lt;span style="line-height:125%"&gt;Resolución de Alcaldía de fecha 05/08/2022:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;em&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:125%"&gt;&lt;span style="line-height:125%"&gt;«Visto que se adoptó, por Acuerdo del Pleno, la disolución de la Junta de Gobierno Local, que tendrá efecto desde el día 04 de agosto de 2022.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:125%"&gt;&lt;span style="line-height:125%"&gt;Examinada la documentación que lo acompaña, visto el informe de Secretaría, y de conformidad con aquello que se ha fijado en los artículos 23 de la Ley 7/1985, de 2 de abril, Reguladora de las Bases del Régimen Local, 43, 46 y 52 del Reglamento de Organización, Funcionamiento y Régimen Jurídico de las Entidades Locales aprobado por Real Decreto 2568/1986, de 28 de noviembre, esta Alcaldía es competente para cesar a los miembros que integran la Junta, y por eso&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;RESUELVO&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:125%"&gt;&lt;span style="line-height:125%"&gt;PRIMERO. Cesar, como miembros de la Junta de Gobierno Local, a los siguientes Regidores:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;em&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:125%"&gt;&lt;span style="line-height:125%"&gt;— Rafael Capó Cerdà.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;em&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:125%"&gt;&lt;span style="line-height:125%"&gt;— Marc Bernal Cantallops.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;em&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:125%"&gt;&lt;span style="line-height:125%"&gt;— Coloma Capó Saletas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:125%"&gt;&lt;span style="line-height:125%"&gt;SEGUNDO. Revocar las atribuciones delegadas en la Junta de Gobierno Local mediante decreto de Alcaldía n.º 305 de fecha 30 de octubre de 2019.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:125%"&gt;&lt;span style="line-height:125%"&gt;TERCERO. Nombrar como Teniente de Alcalde única a la regidora Sra. Coloma Capó Saletas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:125%"&gt;&lt;span style="line-height:125%"&gt;QUARTO. Revocar las materias delegadas en los regidores mediante decreto de Alcaldía n.º 304 de fecha 30 de octubre de 2019, y delegar las siguientes materias en la regidora Sra. Coloma Capó Saletas:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;em&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:125%"&gt;&lt;span style="line-height:125%"&gt;Servicios Sociales, Igualdad, Cultura, Asociaciones, Educación, Deportes, Juventud y Medio Ambiente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;em&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:125%"&gt;&lt;span style="line-height:125%"&gt;La gestión correspondiente en las áreas de Gobernación, Servicios Generales, Personal, Hacienda, Urbanismo, Sanidad, Comercio, Turismo, Obras Públicas y Patrimonio, serán competencia del Alcalde.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:125%"&gt;&lt;span style="line-height:125%"&gt;QUINTO. Comunicar este Acuerdo a todos los Regidores afectados para su conocimiento y efectos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:125%"&gt;&lt;span style="line-height:125%"&gt;SEXTO. Publicar este Acuerdo en el Boletín Oficial de las Islas Baleares, en cumplimiento del que se dispone por el artículo 46.1 del Reglamento de Organización, Funcionamiento y Régimen Jurídico de las Entidades Locales aprobado por Real Decreto 2568/1986, de 28 de noviembre.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:125%"&gt;&lt;span style="line-height:125%"&gt;SÉPTIMO. Dar cuenta de este Acuerdo al Pleno en la próxima sesión que este celebre.»&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:125%"&gt;&lt;span style="line-height:125%"&gt;Contra el acuerdo de Pleno y la resolución de Alcaldía, que ponen fin a la vía administrativa, puede interponer alternativamente recurso de reposición potestativo ante el Pleno y la Alcaldía, respectivamente, de este Ayuntamiento, en el plazo de un mes a contar desde el día siguiente a la presente publicación, en conformidad con los artículos 123 y 124 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas; o bien interponer directamente recurso contencioso-administrativo, ante el Juzgado del Contencioso-Administrativo correspondiente, en el plazo de dos meses, a contar desde el día siguiente a la presente publicación, de conformidad con el artículo 46 de la Ley 29/1998, de 13 de julio, de la Jurisdicción Contencioso-Administrativa. Si se optara por interponer el recurso de reposición potestativo no podrá interponer recurso contencioso-administrativo hasta que aquel sea resuelto expresamente o se haya producido su desestimación por silencio. Todo esto sin perjuicio de que pueda interponer cualquier otro recurso que pudiera estimar más conveniente a su derecho.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
