&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;Los expedientes&amp;nbsp;han sido&amp;nbsp;tramitados&amp;nbsp;por el Fondo&amp;nbsp;de Garantía Agraria&amp;nbsp;y Pesquera de&amp;nbsp;las&amp;nbsp;Islas Baleares&amp;nbsp;(FOGAIBA) en cumplimiento de lo&amp;nbsp;dispuesto en el artículo&amp;nbsp;43&amp;nbsp;de&amp;nbsp;la Ley&amp;nbsp;39/2015, de 1&amp;nbsp;de octubre, del&amp;nbsp;procedimiento administrativo común de&amp;nbsp;las&amp;nbsp;administraciones públicas &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;El vicepresidente&amp;nbsp;en Materia Agraria del FOGAIBA, con fecha 22 de julio&amp;nbsp;de 2022, firmó la siguiente resolución, &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Antecedentes &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;1.Con fecha 25/10/2018 tuvo entrada en el Registro del GOVERN DE LES ILLES BALEARS, número registro 23259, la solicitud de ayuda presentada por MARIA ADROVER SANSÓ con NIF ***1504**, para la convocatoria 2018_1 de la línea de Proyectos piloto y desarrollo de nuevos productos, prácticas, procesos y tecnologías. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;2. Con fecha 03/12/2020 el vicepresidente del FOGAIBA dictó Resolución de concesión de la ayuda, a favor del interesado, por importe de 44.592,55€, financiado 100% por el ITS 2018. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;3. Dada la mencionada Resolución de concesión de la ayuda, y de acuerdo con lo que establece el apartado décimo de la convocatoria antes mencionada, el beneficiario se obliga, entre otros, a realizar las actuaciones auxiliadas dentro del plazo establecido . El apartado undécimo de la convocatoria determina cómo deben justificarse los gastos relacionados con la inversión para la recepción de los fondos comunitarios, y la obligación de justificar al menos un 50% de ejecución de la cantidad total aprobada. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;4. Con fecha 15/01/2021 y nº registro L95E641 el interesado presenta una solicitud de pago parcial, junto con documentación complementaria. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;5.Analizada la solicitud y la documentación presentada, con fecha 19/02/2021 se le comunican las deficiencias de la solicitud, dándole un plazo de 10 días para presentar la documentación que carece o subsanar los errores detectados. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;6. Con fecha 03/03/2021 y nº registro L95E24403, el interesado presenta una contestación al requerimiento notificado. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;7.Analizada la documentación presentada, se considera que no ha subsanado las deficiencias notificadas. Faltan facturas válidas, recibos de autónomo y detalle de trabajos por meses. La factura de Construcciones Toni Binimelis se considera no admisible porque su objeto social no tiene la actividad agraria, aparte de no detallar los días concretos de trabajos. La factura es de día 22/11/2018 y especifica trabajos anteriores a la visita previa por tanto no subvencionables (embaldosado&amp;nbsp;y alicatado ya estaban realizadas, tal y como se vio en el acta de visita previa de 14/11/2018) . Por tanto, eliminando esta factura, junto con otra analíticas que tiene fecha anterior a la solicitud de ayuda, la justificación presentada admisible no llega ni al 14% del proyecto concedido. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;8. El 10/06/2021 se le requirió, por correo electrónico, que presentara alguna otra factura correctamente justificada del resto de actuaciones aprobadas (estufa laboratorio, molino, honorarios expertos, Ainia, Patent). &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;9. El día 10/06/2021 el interesado comunica, mediante correo electrónico, que no hará más gastos en este proyecto y que desiste de la ayuda por este Proyecto Piloto. Ante todo esto, se propone hacer la revocación total por los siguientes motivos: por el incumplimiento de obligaciones por parte del interesado, por no realizar ni justificar las inversiones concedidas en la forma y los plazos determinados en la convocatoria, por no demostrar que se ha acercado de forma significativa al cumplimiento total de los objetivos previstos, por no justificar al menos un 50% de la cantidad total de inversión aprobada, y por haber comunicado la renuncia a la ayuda.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;2.Ley 38/2003, de 17 de noviembre, general de subvenciones. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;3.Real decreto 887/2006, de 21 de julio, por el que se aprueba el Reglamento de la Ley 38/2003, de 17 de noviembre, general de subvenciones. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;4.Decreto legislativo 2/2005, de 28 de diciembre, por el que se aprueba el Texto refundido de la Ley de subvenciones. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;5.Programa de Desarrollo Rural de las Islas Baleares 2014-2020. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;6.Orden del conseller de Agricultura, Medio Ambiente y Territorio de 19 de febrero de 2015, por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco del Programa de Desarrollo Rural de las Illes Balears 2014-2020 . &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;7.Ley 39/2015, de régimen jurídico de las administraciones públicas. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Propuesta de resolución &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Por todo ello, se informa favorablemente de la revocación por el incumplimiento de obligaciones y la no justificación correcta de los gastos solicitados, y por renuncia del interesado. Por tanto, se propone al vicepresidente del FOGAIBA que dicte una resolución en los siguientes términos: &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;1.Proceder a la revocación total de la resolución de ayuda concedida a MARIA ADROVER SANSÓ con NIF ***1504**, mediante Resolución de concesión del vicepresidente del FOGAIBA de día 03/12/2020, la cual concedía al interesado una ayuda por importe de 44.592,55€. El motivo de la revocación es por no haber justificado el pago de la inversión aprobada de acuerdo con los términos y plazos establecidos en la convocatoria, y por haber comunicado la renuncia a la ayuda. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;2.Revocar la ayuda concedida en la resolución del vicepresidente del FOGAIBA de 03/12/2020, correspondiente al expediente COPPI 2018_1/006 por el importe indicado en el anexo de esta resolución, financiado 100% por la CAIB (ITS 2018). &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;3.En consecuencia, dejar sin efecto la mencionada resolución de concesión de la ayuda y proceder al archivo del expediente COPPI 2018_1/006.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;4.Notificar esta resolución a las personas interesadas mediante la publicación en el Boletín Oficial de las Islas Baleares. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Contra esta resolución -que no agota la vía administrativa- se puede interponer recurso de alzada ante la consellera de Agricultura, Pesca y Alimentación, en el plazo de un mes, a contar desde el día siguiente de la notificación de la resolución, de acuerdo con el artículo 58.4 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la comunidad autónoma de las Illes Balears, y los artículos 121 y 122, de la Ley 39/2015 del Procedimiento Administrativo Común de las Administraciones Públicas.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
