&lt;p&gt;&lt;span style="line-height:1"&gt;1.&amp;nbsp;El 3 de julio de 2021 se publicó la convocatoria pública de subvenciones para actuaciones de apoyo a la movilidad eléctrica (Programa MOVES III) mediante la Resolución de consejero de Transición Energética, Sectores Productivos y Memoria Democrática de 28 de junio de 2021.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;2.&amp;nbsp;Las personas o entidades que figuran en el anexo de esta Resolución presentaron una solicitud de subvención en el marco de la convocatoria.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;3.&amp;nbsp;El técnico, Andreu Garau Rosselló, de la Dirección General de Energía y Cambio Climático examinó las solicitudes y emitió un informe favorable de los siguientes aspectos:&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;Las personas o entidades solicitantes, por su naturaleza, pueden ser beneficiarias de subvenciones.&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;Las personas o entidades han adjuntado la documentación prevista en la convocatoria.&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;Las personas o entidades solicitantes están al corriente de las obligaciones con la Seguridad Social y con la Administración tributaria, tanto la estatal como la autonómica.&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;1.&amp;nbsp;El técnico, Andreu Garau Rosselló, de la Dirección General de Energía y Cambio Climático, en aplicación del procedimiento de concesión que establece el apartado octavo de la mencionada Resolución, informó favorablemente sobre la concesión de las subvenciones descritas en el anexo, las cuales se han calculado de acuerdo con la Resolución de convocatoria de estas ayudas.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;2.&amp;nbsp;El 8 de junio de 2022, se emitió una una propuesta de resolución estimatoria del director general de Energía y Cambio Climático (BOIB nº 82, de 25 de junio de 2022) y se ha agotado el plazo de diez días hábiles que se concedía para presentar alegaciones.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;Fundamentos de derecho&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;1.&amp;nbsp;El Decreto Legislativo 2/2005, de 28 de diciembre, por el que se aprueba el texto refundido de la Ley de Subvenciones (BOIB n.º 196, de 31 de diciembre de 2005).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;2.&amp;nbsp;El Decreto 75/2004, de 27 de agosto, por el que se despliegan determinados aspectos de la Ley de Finanzas y de las leyes de presupuestos generales de la Comunidad Autónoma de las Illes Balears (BOIB n.º 122, de 2 de septiembre de 2004).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;3.&amp;nbsp;La Orden de la consejera de Comercio, Industria y Energía de 15 de mayo de 2008 por la que se establecen las bases reguladoras para la concesión de subvenciones en materia de energía (BOIB n.º 72, de 24 de mayo de 2008).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;4.&amp;nbsp;El Real Decreto 266/2021, de 13 de abril, por el que se aprueba la concesión directa de ayudas a las comunidades autónomas y a las ciudades de Ceuta y Melilla para la ejecución de programas de incentivos ligados a la movilidad eléctrica (MOVES III) en el marco del Plan de Recuperación, Transformación y Resiliencia europeo (BOE n.º 89, de 14 de abril de 2021).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;5.&amp;nbsp;La Resolución de consejero de Transición Energética, Sectores Productivos y Memoria Democrática de 28 de junio de 2021 por la que se aprueba la convocatoria pública de subvenciones para actuaciones de apoyo a la movilidad eléctrica (Programa MOVES III) en el marco del Plan de Recuperación, Transformación y Resiliencia europeo (BOIB n.º 88, de 3 de julio de 2021).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;Por todo ello, dicto la siguiente&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;RESOLUCIÓN&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;1.&amp;nbsp;Aprobar la concesión de una subvención a los beneficiarios que figuran en el anexo, de acuerdo con el concepto y el importe que figuran en el mencionado anexo.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;2.&amp;nbsp;Autorizar y disponer el gasto con cargo a la partida presupuestaria indicada en el anexo de los presupuestos de la Comunidad Autónoma de las Illes Balears. Los fondos para la concesión de la ayuda proceden del Ministerio para la Transición Ecológica y el Reto Demográfico, del Plan de Recuperación, Transformación y Resiliencia, y el Mecanismo de Recuperación y Resiliencia Fondos NextGenerationUE.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;3.&amp;nbsp;Disponer que las inversiones objeto de la solicitud se deben ejecutar, pagar y justificar desde el día de la presentación de la solicitud hasta el plazo de doce meses desde la fecha de notificación de la resolución definitiva de concesión.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;4.&amp;nbsp;Establecer que el pago y la justificación se deben hacer de acuerdo con lo que dispone el apartado undécimo de la convocatoria de subvenciones.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;5.&amp;nbsp;Establecer que los beneficiarios están obligados a cumplir lo que dispone el apartado decimocuarto de la Resolución del consejero de Transición Energética, Sectores Productivos y Memoria Democrática de 28 de junio de 2021.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;6.&amp;nbsp;Disponer que toda alteración de las condiciones establecidas para la concesión de la subvención, como también la obtención concurrente de subvenciones o ayudas otorgadas por otras administraciones públicas o entes públicos, nacionales o internacionales, da lugar a la revisión parcial o total de la subvención y, por tanto, al reintegro de la cantidad correspondiente más los intereses de demora.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;7.&amp;nbsp;Publicar esta Resolución en el Boletín Oficial de las Illes Balears.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;Interposición de recursos&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;Contra esta Resolución, que agota la vía administrativa, cabe interponer un recurso potestativo de reposición ante el consejero de Transición Energética, Sectores Productivos y Memoria Democrática en el plazo de un mes contado desde el día siguiente al de su publicación, de acuerdo con los artículos 123 y 124 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas, y el artículo 57 de la Ley 3/2003, de 26 de marzo, de Régimen Jurídico de la Administración de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;​​​​​​​&lt;/span&gt;&lt;span style="line-height:1"&gt;También cabe interponer directamente un recurso contencioso-administrativo ante la Sala de lo Contencioso del Tribunal Superior de Justicia de las Illes Balears en el plazo de dos meses contados desde el día siguiente al de la publicación de la resolución, de acuerdo con el artículo 46 de la Ley 29/1998, de 13 de julio, reguladora de la Jurisdicción Contencioso-administrativa.&lt;/span&gt;&lt;/p&gt;
