    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;El apartado&amp;nbsp;9.3. de la Resolución del&amp;nbsp;Presidente del Fondo de&amp;nbsp;Garantía Agraria&amp;nbsp;y Pesquera de&amp;nbsp;las&amp;nbsp;Islas Baleares&amp;nbsp;(FOGAIBA) de 10 de setiembre de 2015 por la&amp;nbsp;que se convocan, subvenciones&amp;nbsp;para la Creación de empresas de Jóvenes agricultores, correspondientes a los años 2015-2019, &amp;nbsp;especifica&amp;nbsp;que la resolución&amp;nbsp;expresa&amp;nbsp;se notificará&amp;nbsp;a&amp;nbsp;los interesados mediante&amp;nbsp;su publicación en el&amp;nbsp;&lt;em&gt;Boletín Oficial de las&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;Islas Baleares&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;de acuerdo con los&amp;nbsp;términos&amp;nbsp;previstos en el artículo&amp;nbsp;45.2&amp;nbsp;de la Ley&amp;nbsp;39/2015, de 1&amp;nbsp;de octubre, del&amp;nbsp;procedimiento administrativo común de&amp;nbsp;las&amp;nbsp;administraciones públicas. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;Los expedientes&amp;nbsp;han sido&amp;nbsp;tramitados&amp;nbsp;por el Fondo&amp;nbsp;de Garantía Agraria&amp;nbsp;y Pesquera de&amp;nbsp;las&amp;nbsp;Islas Baleares&amp;nbsp;(FOGAIBA) en cumplimiento de lo&amp;nbsp;dispuesto en el artículo&amp;nbsp;43&amp;nbsp;de&amp;nbsp;la Ley&amp;nbsp;39/2015, de 1 de octubre, del procedimiento administrativo común de las&amp;nbsp;administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;El vicepresidente&amp;nbsp;en materia agraria del FOGAIBA, con fecha 11&amp;nbsp;de julio&amp;nbsp;de 2022, firmó la siguiente resolución, &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;Antecedentes&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;1.Con fecha de 15 de septiembre de 2015 se publicó, en el Boletín Oficial de las Islas Baleares núm. 136, la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) por la que se convocan, para los años 2015 a 2019, subvenciones para la creación de empresas de jóvenes agricultores, modificada mediante las resoluciones de 26 de abril de 2016 y 26 de junio de 2018. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2.De conformidad con el apartado sexto de la citada Resolución, el plazo para presentar las solicitudes finalizó el día 30 de junio de 2019. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;3.Los órganos gestores del Servicio de Ayudas al Desarrollo Rural han llevado a cabo el control administrativo de las solicitudes y de la documentación aportada de acuerdo con las normas reguladoras de esta ayuda, el cumplimiento de los requisitos y documentación ha quedado reflejado en la aplicación SIFOG. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;4.El crédito final queda en 2.950.000 euros para esta línea de ayudas para la convocatoria del año 2019. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;5.Teniendo en cuenta que el crédito existente no cubrió la totalidad de las peticiones de esta convocatoria, la selección de los beneficiarios de las ayudas se ha realizado mediante el procedimiento de concurrencia competitiva, según los criterios de prioridad y la puntuación obtenida aplicando el apartado séptimo de la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 15 de septiembre de 2015, antes mencionada. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;6.En fecha 29 de diciembre de 2020 se publicó en el Boletín Oficial de la Comunidad Autónoma de las Illes Balears, la resolución de concesión, dentro de la cual había 35 expedientes que cumplían con las condiciones establecidas por la convocatoria pero que quedaban denegados provisionalmente por falta de presupuesto. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;7.En esta resolución se disponía que si alguno de los beneficiarios renuncia a la subvención en los seis meses siguientes de la notificación de su concesión, el órgano que concede la mencionada subvención deberá acordar, sin necesidad de nueva convocatoria, la concesión de la subvención al solicitante o solicitantes siguientes por orden de puntuación, siempre que con la renuncia por parte de alguno de los beneficiarios, se haya liberado crédito suficiente para poder atender como mínimo una de las solicitudes denegadas. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;8.La fecha límite de los seis meses era el 29 de junio de 2021 y, por renuncias y revocaciones, se liberó un total de 45.400,00 euros, por tanto, se pueden conceder, por el orden de puntuación que existía, los expedientes que figuran en el Anexo I. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;9.Requeridos los interesados el día 25 de mayo de 2022, CATALINA GIRART PONS presenta un desistimiento a la propuesta de concesión de la ayuda por un importe de 5.400,00 €, dado que ha pedido la ayuda a la convocatoria CEJA 2021 . &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;10.Después de este reparto queda un remanente de 5.400,00 € sin repartir.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2. Orden del Consejero de Agricultura, Medio Ambiente y Territorio de 19 de febrero de 2015, por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco del Programa de Desarrollo Rural de las Islas Baleares desde 2014 hasta 2020.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;3. Ley 39/2015, del&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;1 de octubre, de r&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;é&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;gimen jur&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;í&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;dico de las administraciones p&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;úblicas.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;Propuesta de resolución &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Por todo ello, se informa favorablemente y proposo al vicepresidente en materia agraria del FOGAIBA que dicte resolución en los siguientes términos: &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;1.Conceder la ayuda solicitada a los beneficiarios por los importes y con los plazos detallados en el anexo I, con los números de orden del 75 y 78 que son un total de 2 expedientes y que comienza con ALEXANDRE BLAI COSTA FERRER y termina con JAIME ARROM QUETGLAS, que suma un importe total de 40.000,00 euros, relativa a la línea de ayuda “Creación de empresas de jóvenes agricultores”. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2.Autorizar y disponer el gasto señalado a cada uno de los beneficiarios con cargo a los presupuestos y porcentajes de cofinanciación detallados en el anexo I de esta resolución. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;3.Determinar que, de acuerdo con lo que establece la convocatoria de referencia, las obligaciones de los beneficiarios son las indicadas en el anexo II de esta resolución. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;4.Notificar esta resolución a los interesados mediante la publicación en el Boletín Oficial de las Islas Baleares.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;Interposición de recursos&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Contra esta resolución -que no agota la vía administrativa- se puede interponer recurso de alzada ante la consellera de Agricultura, Pesca y Alimentación, en el plazo de un mes, a contar desde el día siguiente de la notificación de la resolución, de acuerdo con el artículo 58.4 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la comunidad autónoma de las Illes Balears, y los artículos 121 y 122, de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;-Poner en marcha el plan empresarial como máximo durante los nueve meses siguientes de la fecha de concesión de la ayuda. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;-Ejercer la actividad agraria en la explotación durante al menos cinco años desde el momento del inicio de la actividad hasta cinco años después de la concesión de la ayuda. En el caso de las SRM (Sociedad rural menorquina), el joven agricultor incorporado podrá cambiar de SRM siempre que se cumplan los mismos requisitos y previa comunicación al FOGAIBA. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;-Mantener los requisitos y condiciones exigibles en cuanto a las condiciones de la explotación durante este período. En el caso de la viabilidad económica de la explotación deberá mantenerse durante un mínimo de tres años a partir de que ésta sea alcanzada. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;-Tener la consideración de agricultor activo, de acuerdo con lo dispuesto en el Capítulo I, Título II del Real Decreto 1075/2014, de 19 de diciembre, sobre la aplicación a partir de 2015 de los pagos directos a la agricultura y en la ganadería y otros regímenes de ayuda, así como sobre la gestión y control de los pagos directos y de los pagos al desarrollo rural, durante los dieciocho meses siguientes a la fecha de instalación. -Someterse a los controles que lleve a cabo la Administración, necesarios para comprobar la correcta concesión de la ayuda y el posterior mantenimiento de los compromisos. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;- Cumplir, en su explotación, los requisitos legales de gestión, así como las buenas condiciones agrarias y medioambientales establecidas en los artículos 91, 92, 93, 94 y 95 del Reglamento (UE) núm. 1306/2013 del Parlamento Europeo y del Consejo, de 17 de diciembre de 2013. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;-Cumplir las normas de información y publicidad previstas en el anexo III del Reglamento de ejecución (UE) núm. 808/2014 de la Comisión, de 17 de julio de 2014, por el que se establecen disposiciones de aplicación del Reglamento (UE) núm.1305/2013,del&lt;/em&gt;&amp;nbsp;&lt;em&gt;Parlamento Europeo http://www.caib.es/eboibfront/pdf/ca/2016/54/948925 Nº. 54 30 de abril de 2016 Fascicle 64 - Sec. &lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;-Cumplir los compromisos adquiridos para la concesión de la ayuda. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;-Cumplir las normas mínimas en materia de medio ambiente, higiene y bienestar de los animales, de conformidad con la normativa comunitaria y nacional, en un plazo máximo de 24 meses desde la instalación del joven. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Se informa a los beneficiarios de que sus expedientes se encuentran a su disposición y consulta en el Servicio de Ayudas al Desarrollo Rural del FOGAIBA (calle de Reina Constanza, núm. 4, de Palma). &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
