    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;span style="color:#212121"&gt;El apartado 9.3 de la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 13&amp;nbsp;de diciembre de 2019, por la cual se convocan, para el año 2019, subvenciones para inversiones en la prevención de los daños causados en los bosques por incendios forestales, desastres naturales y catástrofes, especifica que la resolución expresa se notificará a las personas interesadas mediante su publicación en el &lt;/span&gt;&lt;em&gt;&lt;span style="color:#212121"&gt;Boletín Oficial de las Illes Balears&lt;/span&gt;&lt;/em&gt;&lt;span style="color:#212121"&gt;&amp;nbsp;de acuerdo con los términos que prevé el artículo 45.2 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;span style="color:#212121"&gt;Los expedientes han sido tramitados por el Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) en cumplimiento de lo dispuesto en el artículo 43 de la Ley 30/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;span style="color:#212121"&gt;El vicepresidente&amp;nbsp;en Materia Agraria del FOGAIBA, con fecha 16&lt;/span&gt;&lt;span style="color:#000000"&gt;&amp;nbsp;de julio&amp;nbsp;de 2022&lt;/span&gt;&lt;span style="color:#212121"&gt;, firmó la siguiente resolución:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;strong&gt;&lt;span style="color:#000000"&gt;“PROPUESTA DE &lt;/span&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;RESOLUCIÓN&amp;nbsp;DE MODIFICACIÓN DE LA RESOLUCIÓN DE CONCESIÓN&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Antecedentes&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;1.Con fecha de 17 de diciembre de 2019 se publicó, en el Boletín Oficial de las Islas Baleares núm. 169, la Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) por la que se convocan, para el año 2019, subvenciones para inversiones en la prevención de los daños causados &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;en&amp;nbsp;los bosques por incendios forestales, desastres naturales y catástrofes.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;2.Con fecha 3 de mayo de 2021, el vicepresidente en materia agraria del Fogaiba dictó una resolución de concesión a los beneficiarios de las ayudas R1, que se publicó en el BOIB núm. 62 de 13 de mayo de 2021. Entre los beneficiarios figura una subvención a favor de FINCAS OLIVIA SL por importe de 5.780,00 €. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;3.En la solicitud de ayuda se contemplaban las siguientes inversiones: faja de prevención de incendios forestales en una superficie de 0,29 hectáreas (Ha) y recuperación de cultivo en zonas abancaladas a una superficie de 1,12 Ha. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;4.En el acta de control previo se reflejaron una superficie de 0,99 Ha de faja de prevención de incendios forestales y 1,12 Ha de recuperación de cultivo en zonas abancaladas a una superficie de 1,12 Ha. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;5.La subvención concedida fue en base a las siguientes actuaciones: faja de prevención de incendios forestales en una superficie de 0,29 Ha y recuperación de cultivo en zonas abancaladas a una superficie de 1,12 Ha. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;6.En la concesión hubo un error en las superficie de faja de prevención de incendios forestales, se concedieron 0,29 Ha cuando realmente le correspondían 0,99 Ha. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;7.Teniendo en cuenta que con el crédito existente es posible resolver este expediente sin afectar a lo dispuesto en los apartados séptimo y octavo de la convocatoria. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;8.El citado expediente ha sido objeto de una revisión sistemática por parte de un superior, de acuerdo con lo que establece el artículo 3.2 de la Circular de Coordinación 18/2019, por la campaña 2019, se han detectado los errores descritos en el punto 6.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;FUNDAMENTOS DE DERECHO&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;1.Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) por la que se convocan, para el año 2018, subvenciones para inversiones en la prevención de los daños causados en los bosques por incendios forestales, desastres naturales y catástrofes.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;2. Orden del Conseller de Agricultura, Medio Ambiente y Territorio de 19 de febrero de 2015, por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco del Programa de Desarrollo Rural de las Islas Baleares desde 2014 hasta 2020.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;3. Ley 39/2015 de 1 de octubre del procedimiento administrativo común&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;de las &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;A&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;dministraciones &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;P&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;úblicas.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;PROPUESTA DE RESOLUCIÓN &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;Por todo ello, se informa favorablemente y propongo al vicepresidente del FOGAIBA que dicte una resolución en los siguientes términos:&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;1.Modificar la Resolución del vicepresidente en materia agraria de 3 de mayo de 2021 de concesión (R1), por el importe y los datos detallados en el anexo 1 de esta resolución, que es un total de 1 expediente que comienza con FINCAS OLIVIA SL y termina con FINCAS OLIVIA SL, por un importe total de 10.540,00, relativa a la línea de ayuda «para inversiones en la prevención de los daños causados a los bosques por incendios forestales, desastres naturales y catástrofes» a consecuencia de la revisión sistemática. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;2. Ampliar el importe de concesión de la Resolución de ayuda concedida antes mencionada concedida al beneficiario por el importe y con los datos detallados en el anexo 1 de esta resolución, que es un total de 1 expediente y que comienza con FINCAS OLIVIA SL y termina con FINCAS OLIVIA SL, por importe de 10.540,00 €, relativa a la línea de ayuda «para inversiones en la prevención de los daños causados a los bosques por incendios forestales, desastres naturales y catástrofes». &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;3. Notificar esta resolución a la persona interesada, mediante la publicación en el Boletín Oficial de las Islas Baleares. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;4. Notificar esta propuesta provisional de resolución a la persona interesada mediante la publicación en la web del FOGAIBA e informarle que dispone de un plazo máximo de 10 días hábiles, a contar desde el día siguiente a la publicación de esta propuesta, por presentar alegaciones. En el caso de no hacer uso de su derecho para alegar, en el plazo indicado, o si manifiesta su decisión de no efectuar alegaciones ni aportar nuevos documentos o justificaciones, esta propuesta tendrá carácter definitivo, elevando al vicepresidente en materia agraria del FOGAIBA para que dicte la Resolución de modificación de la resolución de concesión 3 de mayo de 2021.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
