&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="color:#000000"&gt;Hechos&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="color:#000000"&gt;1. En fecha 14 de junio de 2018, la consejera de Hacienda y Administraciones Públicas autorizó, mediante resolución, la cesión de uso de tres obras de arte a favor de la Fundación Es Baluard Museo de Arte Contemporáneo de Palma.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="color:#000000"&gt;Las obras de arte tienen las siguientes características:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="color:#000000"&gt;a) Rafael Juan, La Sagrada fábrica II, 1992, Técnica mixta sobre lienzo, 89 x 116 cm.&amp;nbsp;Núm. Inventario: 10000000844.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="color:#000000"&gt;b) Rafael Tur Costa, Sin título, 1967, Oleo sobre madera, 97 x 130 cm, Núm. Inventario: 10000000570.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="color:#000000"&gt;c) Andreu Terrades Moragues, Mujer, árbol y luna, Técnica mixta sobre lienzo, 140 x160 cm.&amp;nbsp;Núm. Inventario: 10000000852.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="color:#000000"&gt;2. La cesión de uso gratuita y temporal se autorizó por un periodo de cuatro años, a contar a partir del día siguiente de la firma del acta de entrega, que se llevó a cabo el 20 de junio de 2018, por lo que el vencimiento del plazo se producirá el próximo 21 de junio de 2022.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="color:#000000"&gt;3. La directora de la Fundación Es Baluard Museo de Arte Contemporáneo de Palma ha remitido un escrito, con fecha 19 de mayo de 2022, mediante el cual solicita la renovación de la cesión de uso temporal de las tres obras de arte mencionadas con el objeto de reforzar el conocimiento de los creadores vinculados a las Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="color:#000000"&gt;4. La directora general de Cultura de la Consejería de Fondos Europeos, Universidad e Investigación ha presentado un escrito, con fecha 13 de junio de 2022, por el cual solicita la prórroga de la cesión temporal de las tres obras mencionadas con el objeto que continúen dentro del proyecto artístico del museo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="color:#000000"&gt;5. &lt;span style="color:#000000"&gt;En fecha 17 de junio de 2022, la directora general del Tesoro, Pol&lt;/span&gt;&lt;span style="color:#000000"&gt;ítica Financiera y Patrimonio dictó resolución de inicio del expediente de referencia&lt;/span&gt;&lt;span style="color:#000000"&gt; (CSV: https://csv.caib.es/concsv/view.xhtml?hash=1655455666734-451839050-74481839008208440).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;6. En fecha 20 de junio de 2022, el Servicio de Patrimonio emitió un informe favorable sobre el expediente de referencia (CSV: &lt;/span&gt;&lt;span style="color:#0000ff"&gt;&lt;span style="color:#000000"&gt;https://csv.caib.es/concsv/view.xhtml?hash=1655710805309-452367545-7578262684079336724).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="color:#000000"&gt;Fundamentos de derecho&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="color:#000000"&gt;1. La resolución de la consejera de Hacienda y Administraciones Públicas, de 14 de junio de 2018, por la cual se autoriza la cesión de uso gratuita y temporal de tres obras de arte al Museo Es Baluard. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="color:#000000"&gt;2. El artículo 3.1 de la Ley 6/2001, de 11 de abril, del patrimonio de la Comunidad Autónoma de las Illes Balears (BOIB núm. 49, de 24 de abril), y el resto de disposiciones aplicables concordantes. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="color:#000000"&gt;3. La Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Illes Balears (BOIB núm. 44, de 3 de abril).&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="color:#000000"&gt;4. Los artículos 63 y 64, en relación con los artículos 87.g), y 88.f), incluidos en la Ley 6/2001, de 11 de abril, de patrimonio de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="color:#000000"&gt;5. Los artículos 128, 129 y 130, por remisión del artículo 142, incluidos en el Decreto 127/2005, de 16 de diciembre, por el cual se aprueba el Reglamento de desarrollo de la Ley 6/2001, de 11 de abril, de patrimonio de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="color:#000000"&gt;6. El Decreto 8/2021, de 13 de febrero, de modificación del Decreto 9/2019, de 2 de julio, de la presidenta de las Islas Baleares, por el cual se determina la composición del Gobierno y se establece la estructura de la Administración de la Comunidad Autónoma de las Illes Balears (BOIB núm. 20, de 14 de febrero).&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="color:#000000"&gt;7. El Decreto 25/2021, de 8 de marzo, por el cual se modifica el Decreto 11/2021, de 15 de febrero, de la presidenta de las Illes Balears, por el cual se establecen las competencias y la estructura orgánica básica de las consejerías de la Administración de la Comunidad Autónoma de las Illes Balears (BOIB núm. 33, de 9 de marzo).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="color:#000000"&gt;8. El Decreto 14/2021, de 15 de marzo, por el cual se dispone el cese y el nombramiento de un alto cargo de la Consejería de Hacienda y Relaciones Exteriores (BOIB núm. 36, de 16 de marzo).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="color:#000000"&gt;Propuesta de resolución&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Propongo a la consejera de Hacienda y Relaciones Exteriores que dicte resolución en los términos siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;1. Autorizar la prórroga de la cesión de uso gratuita y temporal de las obras de arte siguientes a favor de la Fundación Es Baluard Museo de Arte Contemporáneo de Palma:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;2. Establecer la cesión de uso se prorroga por un periodo de cuatro años, a contar a partir del 21 de junio de 2022.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;3. Determinar que las dos partes pueden, en cualquier momento, dar por acabada la cesión de uso gratuita y temporal, siempre que lo hayan notificado a la parte contraria con un mínimo de tres meses de antelación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;4. Disponer que la eficacia de esta autorización se condiciona al hecho que el gasto por el seguro se produzca a cargo de la Fundación Es Baluard, cuya copia ha de ser entregada al Servicio de Patrimonio para adjuntar al expediente de cesión.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;5. Notificar esta Resolución a las partes interesadas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;6. Anotar las características de la cesión de uso en el Inventario General de Bienes y Derechos de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;7. Publicar esta Resolución en &lt;em&gt;el Boletín Oficial de las Islas Baleares&lt;/em&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Por todo esto, dicto la siguiente&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;RESOLUCIÓN&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Manifestar la conformidad con la propuesta de resolución y dictar resolución en los mismos términos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Interposición de recursos&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="color:#000000"&gt;Contra esta Resolución —que agota la vía administrativa— se puede interponer recurso potestativo de reposición ante la consejera de Hacienda y Relaciones Exteriores en el plazo de un mes a contar desde el día siguiente de haberse notificado y publicado en &lt;em&gt;el Boletín Oficial de las Islas Baleares&lt;/em&gt;, de acuerdo con el artículo 124 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de les administraciones públicas, y el artículo 57 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="color:#000000"&gt;También se puede interponer directamente recurso contencioso administrativo ante la Sala de lo contencioso administrativo del Tribunal Superior de Justicia de las Illes Balears en el plazo de dos meses a contar a partir del día siguiente de haberse notificado y publicado la Resolución, de acuerdo con el artículo 46 de la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contenciosa administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
