    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;span style="color:#212121"&gt;El apartado 9.3 de la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 13&amp;nbsp;de diciembre de 2019, por la cual se convocan, para el año 2019, subvenciones para inversiones en la prevención de los daños causados en los bosques por incendios forestales, desastres naturales y catástrofes, especifica que la resolución expresa se notificará a las personas interesadas mediante su publicación en el &lt;/span&gt;&lt;em&gt;&lt;span style="color:#212121"&gt;Boletín Oficial de las Illes Balears&lt;/span&gt;&lt;/em&gt;&lt;span style="color:#212121"&gt;&amp;nbsp;de acuerdo con los términos que prevé el artículo 45.2 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;span style="color:#212121"&gt;Los expedientes han sido tramitados por el Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) en cumplimiento de lo dispuesto en el artículo 43 de la Ley 30/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;span style="color:#212121"&gt;El vicepresidente&amp;nbsp;en Materia Agraria del FOGAIBA, con fecha 16&lt;/span&gt;&lt;span style="color:#000000"&gt;&amp;nbsp;de junio&amp;nbsp;de 2022&lt;/span&gt;&lt;span style="color:#212121"&gt;, firmó la siguiente resolución:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;&lt;em&gt;1.Con fecha de 17 de diciembre de 2019 se publicó, en el Boletín Oficial de las Islas Baleares núm. 169, la Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) por la que se convocan, para el año 2019, subvenciones para inversiones en la prevención de los daños causados &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;en&amp;nbsp;los bosques por incendios forestales, desastres naturales y catástrofes.&lt;/em&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;2.De conformidad con el apartado sexto de la Resolución mencionada, el plazo para presentar las solicitudes finalizó el día 28 de febrero de 2020.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;3.Con fecha 15 de marzo de 2021 se publicó en la página web del Fogaiba, la propuesta provisional de concesión, en la que figura entre otros, el expediente PIFO 2019_1/055 a nombre de MARIA TORRES FERRER, con una ayuda concedida de 14.560 €. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;4. Con fecha 15 de marzo de 2021 se publicó en la página web del FOGAIBA la propuesta provisional de concesión y denegación PIFO 2019. En su Anexo I se establece el orden de prevalencia según la aplicación de los criterios de prioridad ( concurrencia) quedando incluida la interesada en el puesto 51 con una puntuación de 60 puntos. En el Anexo II "relación de beneficiarios con derecho de ayuda" se encuentra la interesa con un importe concedido de 14.560,00 euros. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;5. Con fecha 3 de mayo de 2021 el vicepresidente en materia agraria del FOGAIBA dictó Resolución de concesión/denegación a los beneficiarios de las ayudas, R1 de fecha 3 de mayo de 2021, publicada en el BOIB núm. 62 día 13 de mayo de 2021. El anexo I establece «los puntos obtenidos en aplicación de la concurrencia» donde encontramos a la interesada en la orden 55. El Anexo II regula los expedientes con derecho ayuda donde la interesada se encuentra incluida en la orden 55 con un importe concedido de 14.560,00 euros. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;6. Co&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;n fecha 11 de junio de 2021 Dª. MARIA TORRES FERRER con NIF &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;***&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;4785&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;**, presentó recurso de alzada contra la Resolución de concesión/denegación a los beneficiarios de las ayudas de fecha 3 de mayo de 2021 alegando que las actuaciones solicitadas fueron 2,1644 ha de faja y 0,4559 de recuperación de cultivo y que se solicita que se subsane el error y se modifique la concesión del importe de la ayuda. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;7. Con fecha 2 de marzo de 2022 el Jefe de Servicio de Gestión Forestal y Protección del Suelo emitió informe en el que quedaban reflejadas las superficies susceptibles de ayudas y se adjuntaron los planos que representaban los croquis definitivos de la actuación (faja o área de prevención de incendios 2,16 ha y recuperación de cultivo 0,456 ha). &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;8. Con fecha 2 de mayo de 2022 la Consejera de Agricultura, Pesca y Alimentación resolvió el recurso de alzada presentado Dª. MARIA TORRES FERRER, estimando las alegaciones hechas, acordando la retroacción del procedimiento en la fase de Propuesta de resolución y modificar la Resolución de concesión a los beneficiarios R1 de 3 de mayo de 2021 en lo que afecta a la ayuda concedida a la señora Maria Torres Ferrer, modificando el importe de la ayuda por la cuantía que le corresponda.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Orden del Conseller de Agricultura, Medio Ambiente y Territorio de 19 de febrero de 2015, por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco del Programa de Desarrollo Rural de las Islas Baleares desde 2014 hasta 2020.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;3. &lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;1.Modificar la subvención concedida en el expediente PIFO 2019_1/0&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;55&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;a nombre de &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;MARIA TORRES FERRER&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;con NIF ***4&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;785**, a la resolución de concesión de 3 de mayo de 2021. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;2.Que las superficies de actuación elegibles y subvencionadas, son: &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;- Faja o área de prevención de incendios: 2,16 ha. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;- Recuperación de cultivo: 0,456 ha.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;3. La ayuda finalmente concedida es de &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;15&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;.&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;296,00 euros, con cargo al presupuesto 100% CAIB y las anualidades que se reflejan en el Anexo I. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;4. Determinar que, de acuerdo con lo que establece la convocatoria de referencia, las obligaciones de los beneficiarios serán las indicadas en el Anexo II.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;5. Notificar esta resolución &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;a los interesados &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;mediante &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;su&amp;nbsp;publicación en el Boletín Oficial de las Islas Baleares.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;em&gt;&lt;em&gt;Interposición de recursos&lt;/em&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;Contra esta resolución, que no agota la vía administrativa, se puede interponer recurso de alzada ante la consellera de Agricultura, Pesca y Alimentación, en el plazo de un mes, a contar desde el día siguiente a la notificación de la resolución, de acuerdo con el artículo 58.4 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la comunidad autónoma de las Islas Baleares, y los artículos 121 y 122, de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
