&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;1. Resolución del director de la Fundació Mallorca Turisme por&lt;/span&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt; la cual se aprueba la Convocatoria de un Hackathon en el marco del Foro International de Turismo Sostenible de 25 de febrero de 2022 (BOIB núm. 31, de 1 de marzo de 2022).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;2. El 8 de abril de 2022 tuvo lugar el Hackathon en el Palacio de Congresos de Palma, donde se llevó a cabo el Foro Internacional de Turismo Sostenible.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;3. Acta de las deliberaciones del Jurado de 7 de junio de 2022, donde se concreta el resultado de las valoraciones.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;4. Revisado el cumplimiento&lt;/span&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt; de los requisitos de los ganadores se comprueba que hay dos personas que no los cumplen y, por lo tanto, quedan excluidas de la convocatoria por no haberse presentado mediante solicitud en el registro electrónico de la Fundación Mallorca Turisme.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;5. De acuerdo con la convocatoria, &lt;/span&gt;&lt;em&gt;cada equipo ganador del SDS Hackathon se llevará un premio en metálico de 5.000 € a distribuir en partes iguales entre los cinco participantes del equipo.&lt;/em&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt; Después de las valoraciones del Jurado hay tres premios, uno por&lt;/span&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt; cada reto: agua, alimentación y movilidad, pero con la particularidad que el grupo no está formado por cinco miembros sino por cuatro o tres miembros por&lt;/span&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt; lo cual la parte del cuarto o quinto participante queda desierta. Los grupos no han podido estar formados por cinco miembros para no haber participantes suficientes o por no cumplir los requisitos establecidos en la convocatoria.&amp;nbsp;&amp;nbsp;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;6. Hay crédito adecuado y suficiente en el presupuesto de la Fundación de 2022 para afrontar el pago de los premios derivados de la convocatoria.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;7. El director de la Fundació Mallorca Turisme ha emitido el certificado del artículo 48.5 de la Ordenanza General de Subvenciones.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;8. De acuerdo con la Disposición Adicional Primera, punto 3, de la Ordenanza General de Subvenciones, los ganadores presentan declaración responsable de cumplimiento&lt;/span&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt; de los requisitos del artículo 8 en los escritos de solicitud de participación.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;9. Informe jurídico favorable sobre el borrador de la resolución de concesión, reconocimiento y liquidación de la obligación derivada de los premios del Hackathon.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;Fundamentos de derecho&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;1. Artículo 16 de los Estatutos de la Fundació Mallorca Turisme que dice que son atribuciones de la dirección gestionar y ejecutar los planes&lt;/span&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt; y programas que aprueba el Patronato y formalizar y aprobar toda clase de actos y contratos (BOIB núm. 24, de 23 de febrero de 2019, con modificación BOIB núm. 10, de 23 de enero de 2021).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;2. Ordenanza General de Subvenciones del Consejo Insular de Mallorca (BOIB núm. 21, de 18 de febrero de 2017), modificada por el Pleno del Consejo de Mallorca en sesión de 14 de junio (BOIB núm. 96, de 4 de agosto), en especial, la Disposición Adicional Cuarta que hace referencia a las subvenciones tramitadas por las fundaciones que dependen del Consejo y la Disposición Adicional Primera que regula la concesión de premios.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Contra la desestimación presunta, por silencio, del recurso de alzada se puede interponer un recurso contencioso administrativo ante el juzgado contencioso administrativo que corresponda en el plazo de seis meses, contados a partir del día siguiente de la desestimación presunta (tres meses desde la interposición del recurso sin que se haya notificado la resolución).&lt;/span&gt;&lt;/p&gt;
