    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;El apartado 9.3 de la Resolución del presidente del &lt;em&gt;&lt;em&gt;Fon&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;s&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;de Garant&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;i&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;a Agr&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;à&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;ria &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;i&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;Pesquera de l&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;e&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;s I&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;l&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;l&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;e&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;s Balears&lt;/em&gt;&lt;/em&gt;&amp;nbsp;(FOGAIBA) de 10 de julio de 2015 por la cual se convocan subvenciones para Inversiones a las explotaciones agrícolas, para los años 2015-2019, especifica que la resolución expresa se notificará a las personas interesadas mediante su publicación en el &lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Butlletí Oficial de les Illes Balears&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;de acuerdo con los términos que prevé el artículo 45.2 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los expedientes han sido tramitados por el&lt;em&gt;&lt;em&gt;&amp;nbsp;Fon&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;s&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;de Garant&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;i&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;a Agr&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;à&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;ria &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;i&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;Pesquera de l&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;e&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;s I&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;l&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;l&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;e&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;s Balear&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;s&lt;/em&gt;&lt;/em&gt;&amp;nbsp;(FOGAIBA), en cumplimiento del que dispone el artículo 43 de la Ley 39/2015, de 1 de octubre, del Procedimiento Común de las Administraciones Públicas.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El vicepresidente en materia agraria del FOGAIBA, con fecha de 2 de junio&amp;nbsp;de 2022, dicta lo siguiente:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Antecedentes&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;1.Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Illes Balears (FOGAIBA) de 10 de julio de 2015 por la que se convocan, para los años 2015 a 2019, subvenciones para inversiones en las explotaciones agrarias. La citada Resolución se modificó en fecha 17 de diciembre de 2015 (BOIB núm. 185) y en fecha 22 de junio de 2016, (BOIB núm. 81) y en fecha 26 de junio de 2018 (BOIB núm. 80). &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;2.Una vez analizada toda la documentación presentada, el vicepresidente del FOGAIBA resolvió favorablemente la concesión de la ayuda a favor de &lt;/em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;MARIA FLORENCIA GARAY GOÑI&lt;/em&gt;&lt;/span&gt;&lt;em&gt;, entre otras, que figuran en el anexo de la Resolución de concesión, R&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;ES1&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;de fecha 1&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;0&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;de &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;setiem&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;bre de 202&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;0&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;, (BOIB núm. 1&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;61&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;, de &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;17&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;de &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;setie&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;mbre de 202&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;0) con los datos y los importes correspondientes (con un importe concedido de 79.144,33&amp;nbsp;€). &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;3.Dada la Resolución de concesión de la ayuda mencionada, y de acuerdo con lo que establece el punto 8 del apartado duodécimo de la convocatoria antes citada, en los casos en que se produzcan desviaciones entre la inversión realizada y la aprobada se ajustará la ayuda total concedida al importe de la inversión realizada, siempre que la finalidad de la subvención, dada su naturaleza, sea susceptible de satisfacción parcial, y siempre que se acerquen de forma significativa al cumplimiento total de los objetivos previstos y supongan al menos un 50 % de ejecución de la cantidad total de inversión aprobada en la resolución de concesión inicial. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;4. El 16 de diciembre de 2021, la interesada presenta la solicitud de pago, así como parte de la documentación, pero, una vez revisada ésta, se comprueba que la documentación presentada es incompleta y no presenta toda la documentación exigida, por lo que el 28 de febrero de 2022 se notifica mediante la web del FOGAIBA el requerimiento de enmiendas de deficiencias de 24 de febrero de 2022. El 28 de febrero de 2022 (RGE núm. 106484) contesta a las enmiendas de deficiencias, pero no presenta toda la documentación requerida. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;5. Una vez analizada toda la documentación presentada con la solicitud de pago y las enmiendas se ha detectado lo siguiente: &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;a) En la cuenta justificativa presentada, en el capítulo de «maquinaria» se ha declarado 42.250,00 €, cuando sólo puede declararse como máximo 28.723,20 €, que es el importe concedido por esta inversión. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;b) Para la inversión del capítulo de «bienes inmuebles» se concedió 59.599,95 €, pero no ha presentado la justificación de esta inversión, por tanto se considera no hecha (0,00 €). &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;c) Para la inversión del capítulo de instalaciones se concedió 43.584,06 €, pero sólo ha justificado 28.596,36 €. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;6. Dado el apartado anterior, resulta que, la inversión total concedida era de 131.907,21 €, pero el importe de la inversión elegible y determinada es de 57.319,56 €, y por tanto no supera el 50 % de ejecución de la cantidad total de inversión aprobada en la Resolución de concesión inicial, por lo que incumple las actuaciones exigidas por ser una actuación subvencionable. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;7. Por todo ello, en fecha 4 de abril de 2022 se notifica a la persona interesada, mediante la publicación en la web del FOGAIBA, el Informe/Propuesta provisional de resolución de revocación total de 28 de marzo de 2022, a efectos de cumplir con el trámite de audiencia para realizar las alegaciones. Dentro del plazo de alegaciones, el representante presenta escrito de alegaciones en el que adjunta 3 facturas de preparaciones de terreno que se realizaron, pero que no presentaron con la solicitud de pago ya que el pago se hizo con efectivo. Ante esto, se aceptan las alegaciones, ya que mediante las facturas presentadas se acredita que las inversiones realizadas superan el 50% del importe elegible. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;8. El 2 de mayo de 2022, se notifica a la persona interesada, mediante la publicación en la web del FOGAIBA, el requerimiento de enmiendas de deficiencias de 27 de abril de 2022, mediante el cual se requiere a la beneficiaria para que en el plazo de 10 días hábiles presente la documentación que falta, esto es: &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;1) Certificado de titularidad de la cuenta corriente núm. ES593058************3635 desde el que se ha pagado la factura núm. 021141, de 4 de junio de 2021. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;2) La inscripción en el Registro de Maquinaria Agrícola de la desbrozadora cadenas TMC. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;3) Factura 284/2020: acreditar dónde se ha realizado la instalación. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;9. El 16 de mayo de 2022, la interesada presenta escrito (RGE 275650) en el que adjunta el certificado de titularidad de la cuenta corriente y la factura rectificada, pero no presenta la inscripción en el Registro de Maquinaria Agrícola (ROMA) de la desbrozadora cadenas TCM, por lo que se da por desistido de esta petición (3.650,00 €), de acuerdo con lo que establece el artículo 68 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;10. El artículo 21.1 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, establece la obligación de la Administración a dictar resolución expresa y notificarla. En su párrafo segundo especifica que «en los casos de prescripción, renuncia del derecho, caducidad del procedimiento o desistimiento de la solicitud, así como la desaparición sobrevenida del objeto del procedimiento, la resolución consistirá en la declaración de la circunstancia que concurra en cada caso, con indicación de los hechos producidos y normas aplicables». &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;11. Por otra parte, de acuerdo con la visita de inspección final y con la cuenta justificativa, las inversiones realizadas son inferiores a las concedidas. El solicitante declara que a pesar de la diferencia, se han logrado todos los objetivos previstos en el proyecto aprobado. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;12. En consecuencia, el importe no elegible es, por un lado, 3.650,00 € de la desbrozadora por no aportar en tiempo y forma la documentación requerida, conforme al artículo 68.1 de la Ley 39/2015 , de 1 de octubre, del procedimiento administrativo común de las administraciones públicas y, por alto&lt;/em&gt;&amp;nbsp;&lt;em&gt;por un lado, 74.587,65 € de inversión no justificada, lo que hace un total de 78.237,65 € de importe no elegible, con un importe a revocar del 60 %, esto es de 46.942,59 €. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;13. De acuerdo con el apartado noveno de la Resolución de convocatoria antes mencionada, en lo referente a subvenciones para inversiones en las explotaciones agrícolas en los casos en los que se produzcan desviaciones entre la inversión realizada y la aprobada, se ajustará la ayuda total concedida al importe de la inversión realizada, siempre que la finalidad de la subvención, dada su naturaleza, sea susceptible de satisfacción parcial, y siempre que se acerquen de forma significativa al cumplimiento total de los objetivos previstos y supongan al menos un 50% de ejecución de la cantidad total de inversión aprobada en la resolución de concesión inicial. Este ajuste se hará aplicando el porcentaje de subvención que corresponda a la inversión total justificada. No se reducirá el importe de la subvención concedida siempre que la inversión ejecutada sea igual o superior a la máxima auxiliable. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;14. El artículo 43 del Texto refundido de la Ley de Subvenciones, aprobado por el Decreto Legislativo 2/2005, de 28 de diciembre, dispone que “Entorpe la revocación de la subvención cuando, posteriormente a la resolución de concesión válida y ajustada a derecho , el beneficiario incumple total o parcialmente las obligaciones o compromisos contraídos a los que está condicionada la eficacia del acto de concesión de la subvención. Como consecuencia de la revocación de la subvención, queda sin efecto, total o parcialmente, el acto de concesión y procede el reintegro de las cantidades percibidas indebidamente”. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;15. Ante todo esto, se propone hacer la revocación parcial por no aportar en tiempo y forma la documentación requerida, conforme al artículo 68.1 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, y por otra parte, las inversiones realizadas son inferiores a las concedidas.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;1.Resolución del Presidente del Fondo de Garant&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;ía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 10 de julio de 2015 por la que se convocan, para los años 2015 a 2019, subvenciones para inversiones en las explotaciones agrarias.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;2. Orden del Conseller de Agricultura, Medio Ambiente y Territorio de 19 de febrero de 2015, por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco del Programa de Desarrollo Rural de las Islas Baleares 2014 a 2.020 .&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;3. Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Propuesta de Resolución&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Por todo ello, se informa favorablemente y proposo al vicepresidente en materia agraria del FOGAIBA que dicte resolución en los siguientes términos:&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;1.Aceptar las alegaciones presentadas en el Informe propuesta provisional de resolución de revocación total de 28 de marzo de 2022, del expediente INEA2018_1/208, correspondiente a MARIA FLORENCIA GARAY GOÑI, con NIF ***8137** y tramitar su pago. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;2. Dar por desistido de la petición de pago de la ayuda por la desbrozadora concedida a MARIA FLORENCIA GARAY GOÑI, por la Resolución del vicepresidente en materia agraria del FOGAIBA de 10 de septiembre de 2020, expediente núm. INEA2018_1/208, por no aportar en tiempo y forma la documentación requerida, de acuerdo con el artículo 68.1 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;3.Revocar parcialmente la ayuda concedida a la beneficiaria, mediante la Resolución del vicepresidente en materia agraria del FOGAIBA de 10 de septiembre de 2020, por el importe y con los datos detallados en el anexo de esta resolución, que es un total de 1 expediente y que comienza con MARÍA FLORENCIA GARAY GOÑI y termina con MARÍA FLORENCIA GARAY GOÑI , que suma un importe total de 46.942,59 euros, relativa a la línea de ayuda “Inversiones en las explotaciones agrarias”, conforme se detalla en el apartado 12 de este informe. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;4.Declarar concluido el procedimiento y archivar el expediente INEA2018_1/208. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;5. Notificar esta resolución a la persona beneficiaria mediante la publicación en el Boletín Oficial de las Islas Baleares.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Interposición de recursos&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Contra esta resolución -que no agota la vía administrativa- se podrá interponer recurso de alzada ante la consellera de Agricultura, Pesca y Alimentación, en el plazo de un mes, a contar desde el día siguiente a la notificación de la resolución, de acuerdo con el artículo 58.4 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la comunidad autónoma de las Islas Baleares, y los artículos 121 y 122, de la Ley 39/2015 del procedimiento Administrativo Común de las Administraciones Públicas.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
