&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;1.&amp;nbsp; &lt;span style="line-height:normal"&gt;En el registro de garantías de la Depositaría constan fianzas a nombre del Consejo General Interinsular de Baleares y de la Diputación de Baleares, instituciones extinguidas con la entrada en vigor de la Ley Orgánica 2/1983, de 25 de febrero, de Estatuto de Autonomía para las Illes Balears, y la consecuente creación de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;2. Estas fianzas se depositaron en la delegación territorial en Balears de la Caja General de Depósitos, de la Administración General del Estado, con sede en Palma, por la carencia de un órgano equivalente de ámbito autonómico. Por eso, sólo están custodiados en la Depositaría los resguardos de los registros aportados por la Caja General de Depósitos, con un número de registro igual al de cualquier garantía, y no los documentos originales de aval.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;3. Las garantías depositadas en la Caja General de Depósitos de la Administración General del Estado, con su valor original en pesetas, se detallan en la siguiente tabla:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;(*) Manuel Latartegui Pérez aparece como: "Recaudador de tributos del Estado de la zona de Ibiza-Consell General Interinsular de Baleares"&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;4. En fecha 15 de octubre de 2021, la Depositaría requirió información a la Delegación de Economía y Hacienda de Illes Balears, de la que depende la delegación balear de la Caja General de Depósitos, sobre el estado de estas fianzas, mediante escrito de registro SIR GOIBS221696/2021. La respuesta se recibió por el registro SIR GOIBE503586/2021.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;5. La delegación en las Illes Balears de la Caja General de Depósitos ha informado que los dos avales de Manuel Latartegui, con número de registro CAIB 14/1980 y 24/1981, fueron devueltos a las entidades bancarias el 28 de octubre de 1997 y el de Mª Cristina Aceves, con número de registro CAIB 4/1982, fue cancelado de oficio según la normativa vigente, por el Real decreto 161/1997, de 7 de febrero, por el que se aprueba el Reglamento de la Caja General de Depósitos. Además, ha aportado los certificados de cancelación de los tres.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;6. En cuanto a la fianza en metálico con número de registro CAIB 14/1978, indica que fue declarada prescrita, de acuerdo con el citado Real Decreto 161/1997, cuyo importe fue ingresado en el Tesoro Público. Igualmente se aporta certificado. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;7. Por todo ello, los registros correspondientes a estas garantías pueden cancelarse en el sistema económico financiero de la Comunidad Autónoma, dado que las garantías e importes anotados por carecer de vigencia.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Fundamentos de derecho&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&amp;nbsp;1. &lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;Ley Orgánica 2/1983, de 25 de febrero, del Estatuto de Autonomía para las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;2. Decreto 13/2019, de 7 de marzo, por el que se regula el régimen jurídico de las garantías y de los depósitos custodiados por la Depositaría de la Comunidad Autónoma de las &lt;span style="color:black"&gt;Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3.Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Por todo lo expuesto, dicto la siguiente&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Resolución&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&amp;nbsp;1. &lt;span style="line-height:normal"&gt;Autorizar la cancelación de los registros en el sistema económico financiero de la Comunidad Autónoma de las Illes Balears de las fianzas 14/1978, 14/1980, 24/1981 y 4/1982, detallados en el punto 4 de los hechos, dado que corresponden a fianzas ya devueltas o prescritas y no depositadas en la Depositaría de la Dirección General del Tesoro, Política Financiera y Patrimonio de la Comunidad Autónoma.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;2. Dada la excepcionalidad del expediente, no se considera necesario notificar la resolución particularmente ni expedir los certificados de cancelación de fianzas. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;3. Publicar esta resolución en el Boletín Oficial de les Illes Balears. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Interposición de recursos&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Contra esta Resolución, que no agota la vía administrativa, se puede interponer recurso de alzada ante la Consejera de Hacienda y Relaciones Exteriores en el plazo de un mes a contar desde el día siguiente de la publicación de esta Resolución en el Boletín Oficial de las Illes Balears, de acuerdo con los artículos 121 y 122 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/p&gt;
