es ![CDATA[<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Hechos</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. <span style="color:black">El 11 de septiembre de 2021 se publicó la convocatoria pública de subvenciones para </span>la realización de instalaciones de autoconsumo con fuentes de energía renovable<strong> </strong><span style="color:black">mediante la Resolución del consejero de Transición Energética, Sectores Productivos y Memoria Democrática de 6 de septiembre de 2021</span>.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Las personas o entidades que figuran en el anexo de esta Resolución presentaron una solicitud de subvención en el marco de la convocatoria.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Los técnicos de la Dirección General de Energía y Cambio Climático han examinado las solicitudes y han emitido un informe favorable de los siguientes aspectos:</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. Las personas o entidades solicitantes, por su naturaleza, pueden ser beneficiarias de subvenciones.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Las personas o entidades han adjuntado la documentación prevista en la convocatoria.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Las personas o entidades solicitantes están al corriente de las obligaciones con la Seguridad Social y con la Administración tributaria, tanto la estatal como la autonómica.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. Los técnicos de la Dirección General de Energía y Cambio Climático, en aplicación del procedimiento de concesión que establece el apartado undécimo de la mencionada Resolución, han informado favorablemente sobre la concesión de las subvenciones descritas en el anexo, las cuales se han calculado de acuerdo con la Resolución de convocatoria de estas ayudas.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. El 4 de mayo de 2022, se emitió una propuesta de resolución estimatoria del director general de Energía y Cambio Climático (BOIB núm. 62, de 12 de mayo de 2022) y se ha agotado el plazo de diez días hábiles que se concedía para presentar alegaciones.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Fundamentos de derecho</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. La Ley&nbsp;38/2003, de 17 de noviembre, General de Subvenciones.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. El Real Decreto&nbsp;887/2006, de 21 de julio, por el que se aprueba el Reglamento de la Ley&nbsp;38/2003, de 17 de noviembre, General de Subvenciones.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. El Decreto Legislativo&nbsp;2/2005, de 28 de diciembre, por el que se aprueba el texto refundido de la Ley de Subvenciones (BOIB núm.&nbsp;196, de 31 de diciembre de 2005).</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. El Decreto&nbsp;75/2004, de 27 de agosto, por el que se desarrollan determinados aspectos de la Ley de Finanzas y de las leyes de presupuestos generales de la Comunidad Autónoma de las Illes Balears (BOIB núm.&nbsp;122, de 2 de septiembre de 2004).</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. El Real Decreto&nbsp;477/2021, de 29 de junio, por el que se aprueba la concesión directa a las comunidades autónomas y a las ciudades de Ceuta y Melilla de ayudas para la ejecución de diversos programas de incentivos ligados al autoconsumo y al almacenamiento, con fuentes de energía renovable, así como a la implantación de sistemas térmicos renovables en el sector residencial, en el marco del Plan de Recuperación, Transformación y Resiliencia europeo.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">6. La Resolución de consejero de Transición Energética, Sectores Productivos y Memoria Democrática de 6 de septiembre de 2021 por la que se aprueba la convocatoria pública de subvenciones para la realización de instalaciones de autoconsumo con fuentes de energía renovable, con o sin almacenamiento, en el sector servicios y otros sectores productivos de la economía; y para la incorporación de almacenamiento en instalaciones de autoconsumo, con fuentes de energía renovable, ya existentes en el sector servicios y otros sectores productivos, en el marco del Plan de Recuperación, Transformación y Resiliencia europeo (BOIB n.º&nbsp;125, de 11 de septiembre de 2021).</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Por todo ello, dicto la siguiente</span></p> <p style="text-align:center"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Resolución</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. Aprobar la concesión de una subvención a los beneficiarios que figuran en el anexo, de acuerdo con el concepto y el importe que también figuran en el anexo.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Autorizar y disponer el gasto con cargo a la partida presupuestaria indicada en el anexo de los presupuestos de la Comunidad Autónoma de las Illes Balears. Los fondos para la concesión de la ayuda proceden del Ministerio para la Transición Ecológica y el Reto Demográfico, del Plan de Recuperación, Transformación y Resiliencia, y el Mecanismo de Recuperación y Resiliencia Fondos NextGenerationEU.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Disponer que las inversiones objeto de la solicitud se deben realizar desde el 30 de junio de 2021 hasta el 15 noviembre de 2022 para las solicitudes con anualidad de justificación 2022 y, para el resto, hasta un máximo de dieciocho meses desde la fecha de notificación de la resolución definitiva de concesión.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. Establecer que el pago y la justificación se deben realizar de acuerdo con lo dispuesto en el apartado decimotercero de la convocatoria de subvenciones.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. Establecer que los beneficiarios están obligados a cumplir lo que dispone el apartado decimoséptimo de la Resolución de consejero de Transición Energética, Sectores Productivos y Memoria Democrática de 6 de septiembre de 2021.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">6. Disponer que toda alteración de las condiciones establecidas para la concesión de la subvención, así como la obtención concurrente de subvenciones o ayudas otorgadas por otras administraciones públicas o entes públicos, nacionales o internacionales, da lugar a la revisión parcial o total de la subvención y, por lo tanto, al reintegro de la cantidad correspondiente más los intereses de demora.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">7. Publicar esta Resolución en el <em>Boletín Oficial de las Illes Balears</em>.</span></p> <div style="page-break-after:always"><span style="display:none">&nbsp;</span></div> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Interposición de recursos</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Contra esta resolución, que agota la vía administrativa, se puede interponer un recurso potestativo de reposición ante el consejero de Transición Energética, Sectores Productivos y Memoria Democrática en el plazo de un mes a contar desde el día siguiente de su publicación, de acuerdo con los artículos 123 y 124 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas, y el artículo 57 de la Ley 3/2003, de 26 de marzo, de Régimen Jurídico de la Administración de la Comunidad Autónoma de las Illes Balears.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">También se puede interponer directamente un recurso contencioso‑administrativo ante la Sala de lo Contencioso-Administrativo del Tribunal Superior de Justicia de las Illes Balears en el plazo de dos meses a contar desde el día siguiente de la publicación de la Resolución, de acuerdo con el artículo 46 de la Ley 29/1998, de 13 de julio, reguladora de la Jurisdicción Contencioso-Administrativa.</span></p> <p style="text-align:center"><span style="font-family:Times New Roman,Times,serif;
