260 23342 CAIB 2022-06-07 ![CDATA[Modificación de las bases reguladoras de las autorizaciones de venta ambulante o no sedentaria en los mercados periódicos y temporales de verano]] 2022-06-03 316926 661634 CAIB es 2022-06-07 es text/html ![CDATA[<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Primero .-</strong> Por <strong>Decreto de Alcaldía de fecha 12/03/2020</strong> (BOIB n.º 82, de 14/05/2020), se crearon los mercados periódicos y temporales de verano del término municipal de Calvià<strong> </strong>de<strong> </strong>Santa Ponça, Peguera, Palmanova y Magaluf. Asimismo se adjuntaron los planos de emplazamiento de los puestos de venta. Las localizaciones eran, y siguen siendo, las siguientes: </span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">A.- <strong>Mercado de Santa Ponça:</strong> Calle Puig de Galatzó. Desde la Oficina municipal de información turística -OMIT- hasta el cruce con la calle Riu Sil.</span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">B.- <strong>Mercado de Peguera</strong>: Paseo Marítimo de la playa de Palmira.</span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">C.- <strong>Mercado de Palmanova:</strong> Paseo Marítimo. Desde la oficina municipal de información turística -OMIT- hasta el restaurante McDonald's.</span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">D.- </span><span style="color:#000000"><strong>Mercado de Magaluf</strong></span><span style="color:#000000">: Plaza Jacques Sasson.</span><span style="color:#000000"> </span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>Segundo.-</strong> Por<strong> Decreto de Alcadía de fecha 21/03/2021 </strong>( BOIB Nº 43 de 30/03/2021), se aprobaron las bases reguladoras de las autorizaciones de venta ambulante de actividades o no sedentaria en los mercados periódicos y temporales de verano. Asimismo se aprobaron las bases reguladoras de las autorizaciones de actividades no comerciales anexas a dichos mercados. </span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">En en punto primero del citado decreto se dispuso: </span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">“ <strong>PRIMERO.- APROBAR </strong>las bases que han de regir las autorizaciones para el ejercicio de la venta ambulante, o no sedentaria, en los mercados periódicos y temporales de verano del término municipal de Calvià. Se adjuntan como <strong>Anexo I</strong> de este Decreto.</span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">[...]”</span></span></p> <p><strong>Tercero.-</strong><span style="color:#000000; font-family:&quot;Times New Roman&quot;,Times,serif"> En el artículo 11 del anexo I del mencionado Decreto de Alcaldía, se establece lo siguiente:</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">“<strong>Artículo 11.- Productos permitidos</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1.- El <strong>artículo 17</strong> del <strong>Reglamento de Mercados</strong> establece que solo queda autorizada la venta de los siguientes productos: </span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">“[...]</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">h.- Otros productos que por su interés y atractivo puedan ser autorizados por la Alcaldía”.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">2.- Debido a la posibilidad de que la Alcaldía pueda autorizar los productos que se pueden vender en los mercados es por lo que se establecen las siguientes categorías:</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1.- PRODUCTOS ARTESANALES Y/O HECHOS A MANO. </span></p> <ul> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px">Productos artesanos con carta de artesano vigente otorgada por el Consejo Insular de Mallorca.</span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px">Productos hechos a manos sin carta de artesano otorgada por el Consejo Insular de Mallorca.</span></li> </ul> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2.- PRODUCTOS ARTÍSTICOS: </span></p> <ul> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px">Pinturas de retratos o caricaturas. Venta de retratos o caricaturas cuya realización se haga en el mismo punto de venta.</span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px">Otras pinturas. Se prohíbe la venta de aquellas obras de arte que, en todo o en parte, se hayan reproducido mecánicamente. font-size:10px"><strong>5</strong></span></p> </td> </tr> </tbody> </table> <p><span style="color:#000000; font-family:&quot;Times New Roman&quot;,Times,serif">4.- En el caso de que queden puestos vacantes en alguna categoría de producto sin posibilidad de cubrir, por estar vacía la lista de espera y la bolsa auxiliar correspondiente, el Ayuntamiento tendrá la potestad de aumentar el número de puestos de la otra categoría de productos, sin aumentar el número total de puestos.”</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Se ha constatado que quedan sin cubrir algunos puestos disponibles para la venta ambulante, o no sedentaria, en los mercados periódicos y temporales del término municipal de Calvià, por presentarse menos solicitudes que puestos previstos para cada uno de los mercados. </span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">En cambio, se presentan muchas más solicitudes en la categoría de servicios no comerciales “ peinados étnicos tradicionales” que puestos disponibles y previstos para cada mercado de verano., reguladas en el anexo II del Decreto de Alcaldía de 24/03/21.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">Por todo lo anteriormente expuesto, y en uso de las facultades conferidas por los</span><strong> artículos 21</strong><span style="font-family:&quot;Times New Roman&quot;,Times,serif"> y </span><strong>25.2.i)</strong><span style="font-family:&quot;Times New Roman&quot;,Times,serif"> de la </span><strong>Ley 7/1985</strong><span style="font-family:&quot;Times New Roman&quot;,Times,serif">, de 2 de abril, Reguladora de las Bases de Régimen Local, el </span><strong>Reglamento de Mercados</strong><span style="font-family:&quot;Times New Roman&quot;,Times,serif"> y demás normativa aplicable.</span></p> <p style="text-align:center"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">DISPONGO</span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>PRIMERO.- MODIFICAR </strong>las bases que han de regir las autorizaciones para el ejercicio de la venta ambulante, o no sedentaria, en los mercados periódicos y temporales de verano del término municipal de Calvià, quedando redactado el artículo 11 de las bases reguladoras que han de regir las autorizaciones para el ejercicio de la venta ambulante, o no sedentaria, en los mercados periódicos y temporales de verano del término municipal de Calvià, quedando redactado de la siguiente manera: </span></p> <p><span style="font-family:Times New Roman,Times,serif; font-family:&quot;Times New Roman&quot;,Times,serif">4.- En el caso de que queden puestos vacantes en alguna categoría de producto sin posibilidad de cubrir, por estar vacía la lista de espera y la bolsa auxiliar correspondiente, el Ayuntamiento tendrá la potestad de aumentar el número de puestos de la otra categoría de productos, sin aumentar el número total de puestos.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">5.- En el caso de que queden puestos vacantes sin posibilidad de cubrir, el Ayuntamiento tendrá la potestad de aumentar los puestos previstos para las actividades no comerciales reguladas en el anexo II, como máximo un puesto más para la categoría de “ peinados étnicos tradicionales” en cada uno de los cuatro mercados de verano existentes” </span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>SEGUNDO.-</strong> <strong>CONFIRMAR</strong> todas las demás prescripciones de la parte dispositiva de la Resolución de Alcaldía de fecha 24/03/202. </span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>TERCERO .- </strong>Ordenar la publicación del presente Decreto, en el Boletín Oficial de les Illes Balears (BOIB), en el Tablón de Anuncios del Ayuntamiento y en la página web municipal.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Contra la presente Resolución, que pone fin a la vía administrativa, podrá interponerse con carácter potestativo recurso de reposición ante el Alcalde del Ajuntament de Calvià en el plazo de un (1) mes, de conformidad con lo dispuesto en los <strong>artículos 123</strong> y </span><span style="color:#000000"><strong>124</strong></span><span style="color:#000000"> de la</span><span style="color:#000000"><strong> Ley 39/2015</strong></span><span style="color:#000000">, de 1 de octubre, de Procedimiento Administrativo Común de las Administraciones Públicas, o recurso contencioso administrativo ante los Tribunales competentes en el plazo de dos (2) meses contados desde el día siguiente al de su publicación en el Boletín Oficial de las Illes Balears, conforme a lo dispuesto en los </span><span style="color:#000000"><strong>artículos 10</strong></span><span style="color:#000000"> y </span><span style="color:#000000"><strong>45</strong></span><span style="color:#000000"> y </span><span style="color:#000000"><strong>siguientes</strong></span><span style="color:#000000"> de la <strong>Ley 29/1998</strong>, de 13 de julio, Reguladora de la Jurisdicción Contencioso-Administrativa.</span></span></p> <p> </p> <p style="text-align:center"><span style="font-family:Times New Roman,Times,serif;
