&lt;p&gt;&lt;strong&gt;Antecedentes&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;1. En fecha 10 de marzo de 2020 y con el registro de entrada en la Subdirección de Presupuestos y Control del Gasto número 1583, se recibe la documentación con objeto de tramitar la cesión de uso de Biosensors Iberia, SL, a favor del Servicio de Salud de las Islas Baleares y destino al Hospital Universitario Son Espases, de un generador Shockwave IVLGCC y cable de conexión para el uso con catéteres C2 IVL (30864), valorados en 10.000&amp;nbsp;€.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;La documentación remitida y que consta en el expediente es la siguiente:&lt;/span&gt;&lt;/p&gt;

&lt;ol class="lower-alpha" start="1"&gt;
	&lt;li style="list-style-type:none"&gt;&amp;nbsp;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Solicitud de efectuación de trámites para la cesión de uso instada por el director gerente del Hospital Universitario Son Espases en fecha2 de marzo de 2020.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&amp;nbsp;Informe de necesidad de un generador Shockwave IVLGCC y cable de conexión para el uso con catéteres C2 IVL (30864) firmado por el jefe del Servicio de Cardiología en fecha 28 de enero de 2020.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&amp;nbsp;Escrito de ofrecimiento del bien de fecha 11 de enero de 2020, firmado por el representante de Biosensors Iberia, SL.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&amp;nbsp;Documentos acreditativos de la personalidad y representación de la cedente.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&amp;nbsp;Certificación de la propiedad del generador por parte de Biosensors Iberia, SL.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ol&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;2. El 27 de septiembre de 2021, se reiteran las solicitudes de informe a la CITEC/CVIT de petición de informe para valoración de las tecnologías. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;3. En fecha 25 de noviembre de 2022 el director general del Servicio de Salud de las Islas Baleares firma la resolución de inicio para aceptar la cesión de uso de Biosensors Iberia, SL, a favor del Servicio de Salud de las Islas Baleares y destino al Hospital Universitario Son Espases, de un generador Shockwave IVLGCC y cable de conexión para el uso con catéteres C2 IVL (30864), valorados en 10.000 €.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;4. El 24 de mayo de 2022, el subdirector de Compras y Logística considera PROCEDENTE CON FUNGIBLE la cesión. Si bien, la CITEC aprueba la cesión con las condiciones siguientes [texto original]:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#201f1e"&gt;«Recomendación:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#201f1e"&gt;La recomendación final es de incorporación con condicionantes hasta una evaluación preestablecida. (2C) en el contexto clínico de paciente con lesión coronaria &lt;em&gt;ex novo&lt;/em&gt; con calcificación moderada a severa de un solo vaso (2A).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;
	&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#201f1e"&gt;Condición de autorización:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
&lt;/ul&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#201f1e"&gt;- Autorización de uso durante un año.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#201f1e"&gt;- Renovación condicionada a informe de valoración de resultados en diciembre 2022»&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#201f1e"&gt;5. &lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:normal"&gt;En fecha 27 de mayo de 2022, el subdirector de Presupuestos y Control del Gasto emite un informe favorable a la autorización del uso durante un año y la renovación condicionada a informe de valoración de resultados a fecha de diciembre de 2022 y siguiendo la recomendación de la CITEC.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;Fundamentos jurídicos&lt;/strong&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;El Código civil aprobado por el Real decreto de 24 de julio de 1889.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;La Ley 6/2001, de 11 de abril, de patrimonio de la Comunidad Autónoma de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;La Ley 5/2003, de 4 de abril, de salud de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;La Ley 33/2003, de 3 de noviembre, de patrimonio de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;La Ley 7/2010, de 21 de julio, del sector público instrumental de la Comunidad Autónoma de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;El Real decreto 1373/2009, de 28 de agosto, por el que se aprueba el Reglamento general de la Ley 33/2003, de 3 de noviembre.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;El Decreto 127/2005, de 16 de diciembre, por el que se aprueba el Reglamento de desarrollo de la Ley 6/2001.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;

	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;La Ley 40/2015, de 1 de octubre, del régimen jurídico del sector público.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;El Decreto 39/2006, de 21 de abril, por el que se aprueban los estatutos del ente público Servicio de Salud de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;La Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;El Decreto 63/2019, de 2 de agosto, por el que se establece la estructura orgánica básica del Servicio de Salud de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;El Decreto 9/2019, de 2 de julio, de la presidenta de las Islas Baleares, por el que se determina la composición del Gobierno y se establece la estructura de la Administración de la Comunidad Autónoma de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;El Decreto 12/2019, de 2 de julio, de la presidenta de las Islas Baleares, por el que se establecen las competencias y la estructura orgánica básica de las consejerías de la Administración de la Comunidad Autónoma de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;El resto de disposiciones de aplicación legal.&lt;span style="display:none"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;strong&gt;Propuesta de resolución&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Propongo al director general del Servicio de Salud de las Islas Baleares dictar una resolución en los términos siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ol&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Aceptar la cesión de uso de Biosensors Iberia, SL, a favor del Servicio de Salud de las Islas Baleares y destino al Hospital Universitario Son Espases, de un generador Shockwave IVLGCC y cable de conexión para el uso con catéteres C2 IVL (30864), valorados en 10.000&amp;nbsp;€.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;La cesión está condicionada a la autorización del uso durante un año y la renovación condicionada a informe de valoración de resultados a fecha de diciembre de 2022 y siguiendo la recomendación de la CITEC.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Publicar la resolución en el&lt;em&gt; Boletín Oficial de las Islas Baleares&lt;/em&gt;, de acuerdo con el artículo 72 de la Ley 6/2001, de 11 de abril, de patrimonio de la Comunidad Autónoma de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ol&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Por todo esto dicto la siguiente&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;RESOLUCIÓN&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Manifestar la conformidad con la propuesta de resolución y dictar resolución en los mismos términos.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;Interposición de recursos&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Contra esta resolución —que agota la vía administrativa— se puede interponer un recurso contencioso-administrativo, previo requerimiento en los términos expuestos en el artículo 44 de la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contencioso-administrativa, ante los juzgados de lo contencioso-administrativo de Palma en el plazo de dos meses a contar desde el día siguiente a la fecha de publicación de esta resolución, en conformidad con los artículos 8 y 46 de la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contencioso-administrativa.&lt;/span&gt;&lt;/p&gt;
