    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;El Pleno del Ayuntamiento en sesión de 26 de mayo de 2022 ha aprobado el siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:whitesmoke"&gt;&lt;span style="color:#333333"&gt;ACUERDO&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#333333"&gt;&lt;span style="background-color:whitesmoke"&gt;&lt;strong&gt;1.º- DESESTIMAR,&lt;/strong&gt; en conformidad con el dictamen desfavorable de la Comisión de Urbanismo y Medio Ambiente de 20 de mayo de 2022, las siguientes enmiendas:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#333333"&gt;&lt;span style="background-color:whitesmoke"&gt;1.1- Por el grupo municipal de Ciutadans, la relativa a la supresión a todo el articulado de las referencias al nivel amarillo, manteniendo los niveles naranja y rojo y la relativa a la modificación del art. 24.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#333333"&gt;&lt;span style="background-color:whitesmoke"&gt;1.2- Por el grupo municipal de Vox-Actúa Palma, la relativa a delimitar el ejercicio de la actividad a partir del nivel naranja o rojo, prestándose el servicio con el nivel verde y amarillo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#333333"&gt;&lt;span style="background-color:whitesmoke"&gt;1.3- Por el grupo municipal del Partido Popular, la relativa a la redacción del arte. 24 e) y la relativa a la no modificación del art. 37.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#333333"&gt;&lt;span style="background-color:whitesmoke"&gt;&lt;strong&gt;2.º- ESTIMAR,&lt;/strong&gt; en conformidad con el dictamen favorable de la Comisión de Urbanismo y Medio Ambiente de 20 de mayo de 2022, las siguientes enmiendas:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#333333"&gt;&lt;span style="background-color:whitesmoke"&gt;2.1.- Por el grupo municipal del&amp;nbsp;PSIB-PSOE, la relativa a la inserción del artículo 24 d) con el siguiente tenor literal: “&lt;/span&gt;&lt;/span&gt;&lt;span style="color:black"&gt;Colocar sombrero, cintas, cascabeles, campanillas, elementos publicitarios u otros complementos al animal".&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#333333"&gt;&lt;span style="background-color:whitesmoke"&gt;2.2.- Por el grupo municipal del&amp;nbsp;PSIB-PSOE, la relativa a la modificación del art. 25, segundo párrafo, queda fijada con el siguiente tenor literal: “&lt;/span&gt;&lt;/span&gt;&lt;span style="color:black"&gt;"Las guarniciones serán de tipo mallorquina o inglesa provistas de cabezada, bocado o filete de acero inoxidable, collera o pecherín, lomera, zufra y barriguera, retranca o reculera, cejadores, baticola, tirantes y riendas".&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#333333"&gt;&lt;span style="background-color:whitesmoke"&gt;&lt;strong&gt;3.º- APROBAR&lt;/strong&gt; inicialmente la modificación del Reglamento municipal del servicio de transporte urbano de viajeros con vehículos de tracción animal con conductor (galeras), en conformidad con el que dispone el artículo 49 de la Ley 7/1985 (LRBRL)&amp;nbsp;y los artículos 98 y siguientes del Reglamento orgánico del Pleno del Ayuntamiento de Palma (ROGA), de acuerdo con el que se expone seguidamente:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:whitesmoke"&gt;3.1.- Introducir la apartado letra e) en el artículo 24 de la Ordenanza con el siguiente tenor literal:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:80px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#333333"&gt;&lt;span style="background-color:whitesmoke"&gt;“e) Hacer trabajar animales cuando se declare oficialmente por parte de la Agencia Estatal de Meteorología (AEMET) alerta meteorológica por aviso amarillo, naranja o rojo de riesgo grave o muy severo de temperaturas”.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#333333"&gt;&lt;span style="background-color:whitesmoke"&gt;3.2.- Modificar la redacción del artículo 24 d) con el siguiente tenor literal:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:80px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#333333"&gt;&lt;span style="background-color:whitesmoke"&gt;“d).&lt;/span&gt;&lt;/span&gt;&lt;span style="color:black"&gt; Colocar sombrero, cintas, cascabeles, campanillas, elementos publicitarios u otros complementos al animal".&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="background-color:whitesmoke"&gt;&lt;span style="color:#333333"&gt;3.3.- Modificar la redacción del artículo 25, segundo párrafo, con el siguiente tenor literal:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:80px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;"Las guarniciones serán de tipo mallorquina o inglesa provistas de cabezada, bocado o filete de acero inoxidable, collera o pecherín, lomera, zufra y barriguera, retranca o reculera, cejadores, baticola, tirantes y riendas".&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#333333"&gt;&lt;span style="background-color:whitesmoke"&gt;3.4-. Introducir la modificación del primer párrafo del artículo 37 de la Ordenanza con el siguiente tenor literal:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:80px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#333333"&gt;&lt;span style="background-color:whitesmoke"&gt;“El conductor tiene que suspender el servicio cuando aprecie que el vehículo o la caballería no cumplen las condiciones de seguridad, higiene, comodidad o estado físico, y según aquello previsto en el artículo 24, mientras no se adopten las medidas correctoras pertinentes”.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#333333"&gt;&lt;span style="background-color:whitesmoke"&gt;3.5.- Introducir la apartado letra r) en el artículo 53 de la Ordenanza con el siguiente tenor literal:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:80px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#333333"&gt;&lt;span style="background-color:whitesmoke"&gt;“r) Incumplir las prohibiciones a que se refiere el artículo 24”.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#333333"&gt;&lt;span style="background-color:whitesmoke"&gt;&lt;strong&gt;4.º- SOMETER A INFORMACIÓN PÚBLICA &lt;/strong&gt;la modificación del Reglamento municipal del servicio de transporte urbano de viajeros con vehículos de tracción animal con conductor (galeras), por un plazo de 30 días hábiles contados a partir del día siguiente de la publicación del anuncio en el&amp;nbsp;BOIB, para que se puedan presentar las alegaciones que se estimen oportunas dentro del mencionado plazo y determinar como lugar de exposición de esta norma la Concejalía de Movilidad (Departamento de Movilidad, avda. de san Fernando, s/n, 2.º piso, edificio de la Policía Local de Palma).&lt;/span&gt;&lt;span style="display:block; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;span style="display:block; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
