&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Al no haberse presentado ninguna reclamación o sugerencia durante el plazo de exposición al público, del acuerdo inicialmente adoptado por el Pleno del Ayuntamiento de Sant Joan, en la sesión ordinaria del día 30 de marzo de 2022, y que fue publicado en el BOIB núm. 46, de 5 de abril de 2022, de aprobación de la modificación del Reglamento que desarrolla los Estatutos de la Agrupación Local de Voluntarios de Protección Civil de Sant Joan, debe entenderse definitivamente aprobado sin necesidad de nuevo acuerdo expreso, de conformidad con lo establecido en los artículos 49 de la Ley 7/1985, de 2 de abril, Reguladora de las Bases del Régimen Local y 102.1.d) de la Ley 20/2006, de 15 de diciembre, municipal y de Régimen Local de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El texto íntegro de la modificación del Reglamento que desarrolla los Estatutos de la Agrupación Local de Voluntarios de Protección Civil de Sant Joan, se hace público, para su general conocimiento y en cumplimiento de lo dispuesto en el artículo 70.2 de la ley 7/1985, de 2 de abril, Reguladora de las Bases del Régimen Local, y que se transcribe a continuación:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&amp;lt;&amp;lt; ANTECEDENTES DE HECHO&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;I. &lt;/strong&gt;En fecha 27 de enero de 2009, el Pleno del Ayuntamiento de Sant Joan acordó la constitución de la Junta Local de Protección Civil y de la Agrupación de Protección Civil.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;II. &lt;/strong&gt;En fecha 31 de marzo de 2009, el Pleno del Ayuntamiento de Sant Joan aprobó el Reglamento de la Agrupación Local de Voluntarios de Protección Civil.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;III. &lt;/strong&gt;Durante los años posteriores se realizaron los trámites oportunos para continuar con la formación, organización e inscripciones de los miembros de la citada agrupación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;IV.- &lt;/strong&gt;Dada la necesidad de adaptar el Reglamento de los Estatutos de la Agrupación del Voluntariado de Protección Civil de Sant Joan a su normativa reguladora, en fecha 5 de noviembre de 2021 (2021-S-RC-507) se remitieron los borradores de Estatutos rectificados en la Dirección General de Emergencias e Interior de la Consejería de Función pública, Presidencia e Igualdad.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;V.- &lt;/strong&gt;En fecha 7 de febrero de 2022 (2022-E-RC-227) se recibió por parte de la Dirección General de Emergencias e Interior, informe-propuesta desfavorable para que se subsane una serie de errores.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;VI.- &lt;/strong&gt;En fecha 11 de febrero de 2022 (2022-S-RC-66) el Ayuntamiento remite el borrador de Estatutos con las correcciones indicadas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;VII.- &lt;/strong&gt;Por último, en fecha 21 de marzo de 2022 (2022-E-RC-600) se recibió comunicación de la Dirección General de Emergencias e Interior, por la que se remite Informe de Propuesta favorable del director general de Emergencias y Interior en relación con dicho borrador y certificado del Pleno de Emergencias y Protección Civil celebrado el día 3 de marzo de 2022, por el que se ratifica el informe favorable de la Dirección General.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;FUNDAMENTOS JURÍDICOS&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;I.- Decreto 32/2019, de 10 de mayo, por el que se aprueba el Reglamento del personal voluntario de Protección Civil de las Islas Baleares&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;II.-. CAPÍTULO III de la Ley 20/2006, de 15 de diciembre, municipal y de Régimen Local de las Islas Baleares&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;III.- Artículo 22.2 d) de la Ley 7/1985, de 2 de abril, Reguladora de las Bases del Régimen Local.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;IV -TÍTULO VI de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Por todo ello, vista toda la documentación que consta en el expediente, de acuerdo con las atribuciones de 22.2 d) de la Ley 7/1985, de 2 de abril, Reguladora de las Bases del Régimen Local, en relación con los artículo del Decreto 32/2019, de 10 de mayo, por el que se aprueba el Reglamento del personal voluntario de Protección Civil de las Illes Balears, el pleno de la Corporación adopta lo siguiente,&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;ACUERDO:&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;PRIMERO.- &lt;/strong&gt;Aprobar inicialmente la Modificación del Reglamento que desarrolla los Estatutos de la Agrupación Local de Voluntarios de Protección Civil de Sant Joan conforme al texto del &lt;strong&gt;Anexo I &lt;/strong&gt;del presente acuerdo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;SEGUNDO.- &lt;/strong&gt;Comunicar el presente acuerdo a la Dirección General de Emergencias e Interior de la Consejería de Función Pública, Presidencia e Igualdad del Gobierno de las Islas Baleares, de conformidad con los artículos 4.3 del Decreto 32/2019, de 10 de mayo, por el que se aprueba el Reglamento del personal voluntario de Protección Civil de las Islas Baleares, en relación con el artículo 111 de la Ley 20/2006, de 15 de diciembre, municipal y de Régimen Local de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;TERCERO.- &lt;/strong&gt;Someter dicho texto a información pública y audiencia de los interesados, con publicación en el Boletín Oficial de las Islas Baleares y tablón de anuncios del Ayuntamiento, por el plazo de 30 días hábiles&lt;strong&gt; &lt;/strong&gt;para que puedan presentar reclamaciones o sugerencias, que serán resueltas por la Corporación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Simultáneamente, se publicará en el portal web del Ayuntamiento &lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;(dirección https://santjoan.sedelectronica.es/info.0).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;CUARTO.- &lt;/strong&gt;De no presentarse reclamaciones o sugerencias en el citado plazo, se considerará aprobado definitivamente sin necesidad de acuerdo expreso por el Pleno y el Acuerdo de aprobación definitiva tácita del Reglamento, con el texto íntegro de éste, se publicará para su general conocimiento en el tablón de anuncios del Ayuntamiento y en el Boletín Oficial de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Asimismo, estará a disposición de los interesados en la sede electrónica de este Ayuntamiento (dirección &lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;https://santjoan.sedelectronica.es/info.0).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El objeto de estos estatutos es definir el funcionamiento y organización de la agrupación del personal Voluntario de Protección Civil de Sant Joan (AVPC Sant Joan).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;div style="page-break-after:always"&gt;&lt;span style="display:none"&gt;&amp;nbsp;&lt;/span&gt;&lt;/div&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;ARTÍCULO 2&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. La Agrupación del personal voluntario de Protección Civil de Sant Joan (AVPC Sant Joan) es una organización de carácter humanitario y altruista, que actúa de forma desinteresada y solidaria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. La AVPC de Sant Joan no ampara actividades de finalidad religiosa, política y/o sindical.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;ARTÍCULO 3&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. La Agrupación tiene como objetivo la colaboración en la previsión y prevención de situaciones de grave riesgo colectivo, catástrofe o calamidad pública que puedan plantearse en el Municipio. También en la protección y socorro de las personas y de los bienes, cuando estas situaciones se producen y en el restablecimiento de la normalidad en el área afectada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. La Agrupación llevará a cabo estas misiones en el marco del Plan Municipal ante emergencias (*PME), y Planes de actuación ante riesgos específicos (*PAE), que es de donde surgen las competencias atribuidas a la AVPC de Sant Joan.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. La AVPC de Sant Joan se integrará en la Junta de Seguridad Local.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;ARTÍCULO 4&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El Pleno del Ayuntamiento acordó la creación de la AVPC de Sant Joan en fecha 27 de enero de 2009 y corresponde al Pleno del Ayuntamiento en su caso, su disolución.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;ARTÍCULO 5&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Se establece el domicilio social y la sede de la AVPC en el edificio del Escorxador.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. El ámbito territorial operativo de la AVPC de Sant Joan se limitará al término municipal de Sant Joan. La actuación fuera de su ámbito será siempre a petición de la consejería de Hacienda y Administraciones Públicas (ahora consejería de Presidencia, Función Pública e Igualdad) al alcalde o alcaldesa de su ayuntamiento, mediante el SEIB-112, y coordinado con los servicios técnicos de emergencias en el marco del Plan Territorial de la Comunidad Autónoma (PLATERBAL) o Plan especial activado,&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;SECCIÓN SEGUNDA: ORGANIZACIÓN&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;ARTÍCULO 6&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. La organización y funcionamiento de la AVPC de Sant Joan se regirá por lo establecido en el presente Reglamento, por sus propios Estatutos aprobados por la corporación local, así como por las instrucciones y directrices que, a efectos de coordinación general, en puedan dictar las autoridades competentes en materia de emergencias y protección civil.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Para pertenecer a una Agrupación de personal voluntario de Protección Civil en las Illes Balears, los aspirantes deben cumplir las siguientes condiciones:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2.1 Ser mayor de edad.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2.2 No tener antecedentes penales por los delitos siguientes: homicidio y contra la integridad física, violencia de género, contra la libertad, contra la libertad y la identidad sexual, contra la seguridad colectiva, contra la salud pública y terrorismo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2.3 No haber perdido la condición de voluntario o voluntaria de alguna Agrupación de Protección Civil en aplicación de las sanciones establecidas en sus estatutos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2.4 Estar empadronado en un municipio de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. La estructura jerárquica de la AVPC de Sant Joan quedará de la siguiente forma:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Jefe de Agrupación&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Subjefe de Agrupación&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Jefe de Sección&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Jefe de Grupo&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Jefe de Equipo&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Voluntario / Voluntaria en prácticas Aspirante&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. Todos los cargos de la AVPC de Sant Joan a excepción de la persona en Jefe de Agrupación, son elegidos por confianza, por buen trabajo y distinción a los servicios realizados, por decisión de la persona en Jefe de Agrupación, al que recae la función de organizar al personal voluntario en equipos, grupos o secciones según sea necesario para la realización y consecución de los servicios y emergencias.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. La persona en Jefe de Agrupación puede en cualquier momento organizar grupos, equipos y secciones, así como nombrar a un voluntario o voluntaria en un cargo específico si así lo considera oportuno, así como determinar el cese del cargo si es necesario.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6. La persona en Jefe de Agrupación o en su defecto la persona delegada en comunicaciones oficiales, está obligado a informar a los restantes miembros de la AVPC de Sant Joan de todos los nombramientos o ceses de cargos que se realicen, para que así la jerarquía de la AVPC de Sant Joan sea siempre clara y conocida por todos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;7. La persona en Jefe de Agrupación será elegido por votación democrática entre todos los miembros en activo de la AVPC de Sant Joan , siendo esta elección verificada por el alcalde , alcaldesa o persona delegada del Ayuntamiento.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;8. El cargo de persona en Jefe de Agrupación estará vigente durante 4 años a partir del nombramiento. Una vez finalizados estos 4 años, y en un plazo de 15 días se tendrán que convocar nuevamente elecciones para designar a una nueva persona en Jefe de Agrupación. Pueden presentarse a las elecciones por el cargo, cualquier voluntario o voluntaria en activo de la AVPC de Sant Joan.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;9. En caso de incapacidad, fallecimiento o cese en el cargo (ya sea voluntario o administrativo) de la persona en Jefe de Agrupación, automáticamente pasará a ejercer la dirección de la *AVPC de Sant Joan el personal voluntario de mayor rango ( según punto nº 3). En caso de no haber rangos especificados, lo hará el voluntario de mayor antigüedad en la AVPC de Sant Joan. En ambos casos, obligándose a, en un plazo de 15 días, convocar elecciones para renovar el cargo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;ARTÍCULO 7&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. La AVPC de Sant Joan depende directamente del alcalde o alcaldesa como responsable máximo de la Protección Civil Local, o bien en su delegado en su caso.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. A efectos de organización, los presentes Estatutos funcionarán como Reglamento de la Agrupación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;ARTÍCULO 8&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La AVPC de Sant Joan quedará encuadrada orgánica y funcionalmente en la unidad municipal de la que dependan los servicios de Protección Civil o de los servicios de Seguridad Ciudadana, sin que ello constituya vínculo laboral o funcionarial de sus componentes con el Ayuntamiento.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;ARTÍCULO 9&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La Concejalía del área correspondiente, o el Servicio Local de Protección Civil, si lo hubiere, elaborarán y formularán propuestas para la elaboración de las normas e instrucciones que sean necesarias para desarrollar, completar y aplicar los presentes Estatutos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La aprobación de estas normas corresponde al Alcalde o Alcaldesa, a propuesta del Concejal correspondiente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;ARTÍCULO 10&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Para garantizar su eficacia, se exigirá a todas las personas integrantes de la Agrupació un nivel mínimo de conocimientos sobre los distintos campos que integran la Protección Civil. Para ello se pedirá su participación en los diferentes planes formativos destinados al personal voluntario de Protección Civil y se certificarán por las administraciones u organismos acreditados que los impartan.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;ARTÍCULO 11&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La Corporación Municipal, en función de la disponibilidad económica que tenga y mediante la colaboración de la Consejería competente en la materia en su caso, dotará de los medios necesarios para que la Agrupación cuente con el material específico que garantice la adecuada intervención ante cualquiera situación de emergencia. Especialmente se dotará al ámbito del transporte, la uniformidad y las radiocomunicaciones. También se velará por que la Agrupación pueda disponer de una sede digna y adecuada a sus necesidades.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;ARTÍCULO 12&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La Corporación Municipal podrá suscribir convenios de colaboración con otras administraciones, organismos o entidades públicas o privadas, encaminadas hacia la promoción, dotación de medios y formación para el mejor funcionamiento de la AVPC de Sant Joan.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;SECCIÓN TERCERA: PERSONAL VOLUNTARIO&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;ARTÍCULO 13&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Se denomina “aspirante” a toda persona interesada en formar parte de la AVPC de Sant Joan.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Para poder formar parte de la AVPC de Sant Joan, los/las aspirantes tendrán que rellenar un formulario de solicitud de alta dirigido al ayuntamiento o departamento que dependa la AVPC de Sant Joan.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Junto con la solicitud, deben enviar un certificado de antecedentes penales y otra certificación de delitos de naturaleza sexual, o prestar su consentimiento para que estos certificados sean solicitados por la administración competente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;También se mantendrá una entrevista personal con la persona encargada del personal en la AVPC de Sant Joan, o bien con la persona en Jefe de la Agrupación. Se explicará el funcionamiento de la AVPC de Sant Joan y las condiciones, requisitos y formación necesaria para formar parte de este voluntariado según lo establecido en el Decreto 32/2019, de 10 de mayo, por el que se aprueba el Reglamento del personal voluntario de protección civil de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. La Corporación local podrá establecer pruebas psicotécnicas o de otra índole, para comprobar la idoneidad de la persona aspirante.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. Una vez rellenado este formulario positivamente y estando informado el aspirante del funcionamiento de la AVPC de Sant Joan, se remitirá a la *DGEI la solicitud de alta, así como la solicitud para la realización del Curso Básico de Protección Civil (si no lo ha realizado previamente).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. Una vez confirmada el alta por la *DGEI, y mientras no haya realizado el Curso Básico de Protección Civil impartido por la *Escuela Balear de Administración Pública (EBAP), o formación equivalente convalidada, el aspirante únicamente podrá realizar actividades auxiliares y formativas Estos únicamente pueden realizar actividades auxiliares y formativas en el seno de la organización, y no pueden participar activamente en emergencias ni simulacros, ni en situaciones que puedan suponer un riesgo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6. Cuando el aspirante haya finalizado positivamente el Curso Básico de Protección Civil impartido por la EBAP o formación equivalente convalidada, el aspirante se convertirá en “personal voluntario en prácticas”. Esta situación supone para el aspirante pasar a una fase de prueba, pudiendo comprobar cómo se desarrollan las tareas organizativas así como las intervenciones en los diferentes operativos donde pueda participar la Agrupación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;7. El “personal voluntario en prácticas”, del momento que ha sido dado de alta en la *AVPC de Sant Joan y durante 6 meses y/o ha realizado 50 horas de servicios, sin que haya tenido ningún informe negativo, automáticamente pasará a obtener la condición de “voluntario”.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;8. Un "voluntario" y un "voluntario en prácticas" tienen los mismos deberes y derechos indicados en los estatutos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;ARTÍCULO 14&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Para que se pueda realizar la baja de un miembro de la AVPC en Sant Joan, deberá concurrir alguna de estas condiciones:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Voluntariamente podrá solicitar su baja mediante escrito.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Si el personal voluntario no participa en ningún servicio durante 12 meses.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Por incumplimientos de estos estatutos (artículos 35-38).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. Por muerte o por la concurrencia de alguna circunstancia que la imposibilite para ejercer sus funciones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Si las condiciones concurridas son la 2, 3 o 4, deberá notificarse por escrito al personal voluntario su baja de la AVPC de Sant Joan, así como el motivo de la misma.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Independientemente del motivo de la baja, en el momento que se haga efectiva, y se informe debidamente a la persona interesada, el personal voluntario deberá entregar en un plazo máximo de 10 días, toda la uniformidad, herramientas y equipamiento que le haya sido suministrado por el desarrollo de sus tareas en la agrupación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;SECCIÓN CUARTA: SISTEMAS INFORMÁTICOS Y REDES SOCIALES&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;ARTÍCULO 15&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Debido a que la *AVPC de Sant Joan, publica periódicamente en redes sociales los eventos que realiza, tanto preventivos, emergencias, mantenimiento, etc., dispone de usuarios en las redes sociales más conocidas. Mediante estos “usuarios” se realizan las publicaciones relacionadas con la *AVPC de Sant Joan o bien por la persona jefe de la Agrupación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Todos los “usuarios” que se utilicen en relación a la *AVPC de Sant Joan, deben ser necesariamente vinculados a la cuenta de correo electrónico de la Agrupación: protecciocivilsantjoan @gmail.com, ya sea en exclusiva, o al menos como administrador con todos los derechos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Todas las cuentas a redes sociales relacionadas con la *AVPC de Sant Joan son propiedad de la *AVPC de Sant Joan, en ningún caso serán propiedad de ningún voluntario en concreto, ya sea con cargo o no.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Sólo podrá publicarse en cuentas de redes sociales vinculadas a la *AVPC de Sant Joan: información relevante, noticias, comentarios o fotografías relacionadas con la Agrupación, con Protección Civil o con alguna emergencia o aviso importante y relevante hacia la ciudadanía.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;ARTÍCULO 16&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. La cuenta de correo electrónico de la *AVPC de Sant Joan es:&lt;/span&gt;&lt;/span&gt; protecciocivilsantjoan@gmail.com&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. A nivel técnico, esta cuenta es gestionada por el Ayuntamiento de Sant Joan.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Es responsabilidad de la AVPC de Sant Joan y en concreto la persona en Jefe de la Agrupación (y persona o personas delegadas) la preservación y mantenimiento del correo electrónico contenido en su buzón, no haciendo mal uso en ningún momento de esta cuenta de correo, ni eliminando o destruyendo información de la misma por motivos ajenos a la *AVPC de Sant Joan.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;ARTÍCULO 17&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Todo el personal voluntario de la *AVPC de Sant Joan, cumpliendo con el reglamento general sobre Protección Civil (Artículo 18. Apartado 1. Punto o), no podrán publicar ni transmitir información ni fotografías en actos de servicio, relativas a eventos o servicios realizados por la *AVPC de Sant Joan, ya sea en redes sociales, grupos de difusión, whatsapp , ni ningún otro medio digital, sin la autorización previa de la persona en Jefe de Agrupación o de la persona delegada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;ARTÍCULO 18&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Se hace constar que existe un fichero informatizado en el que están almacenados los datos de cada voluntario de la *AVPC de Sant Joan, incluido datos médicos de relevancia en una emergencia, suministrados por cada persona al ingreso en la *AVPC de Sant Joan.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los datos que se almacenan son:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;• Datos de contacto: teléfonos, dirección postal, *correo electrónico.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;• Datos académicos: formación, nivel académico, cursos y titulaciones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;• Datos personales: edad, fecha de nacimiento, permiso conducción, etc.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;• Datos médicos: patologías que puedan afectar al desarrollo de un servicio o que pueda suponer un riesgo para la persona y que sea relevante tener esta información, grupo sanguíneo, alergias e intolerancias, etc.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;ARTÍCULO 19&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Todos los datos mencionados en el artículo anterior están protegidos por la Ley orgánica 3/2018, de 5 de diciembre, de Protección de Datos Personales y garantía de los derechos digitales (LOPD-GDD), siendo el responsable del tratamiento de estos datos y el encargado del tratamiento, el Ayuntamiento de Sant Joan. Éste mediante la persona en Jefe de la Agrupación y/o personas encargadas de la gestión administrativa de la AVPC de Sant Joan, serán quienes gestionarán, tramitarán y almacenarán los datos estrictamente necesarios para el cumplimiento de los servicios y obligaciones de la *AVPC de Sant Joan. Al respecto y en cuanto a las altas y bajas del personal voluntario de la Agrupación se mantendrá una fluida y periódica comunicación con la *DGEI por el mantenimiento y actualización del registro del personal. También en cuanto a entidades o asociaciones que sea necesarias para el funcionamiento de la AVPC de Sant Joan y la contratación de seguros y las gestiones que sean necesarias. La *AVPC se compromete a no realizar mal uso de los mismos ni facilitarlos a terceros no relacionados con la actividad de la *AVPC de Sant Joan.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;ARTÍCULO 20&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Cuando el personal voluntario pasa a formar parte de la AVPC de Sant Joan, éste cederá el uso de su imagen exclusivamente a los servicios, preventivos, emergencias y uso de sistemas informáticos, tanto en la AVPC de Sant Joan, como en la DGEI. Por ejemplo:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;• Publicación de un servicio realizado por la AVPC de Sant Joan, en una red social (*facebook , *twiter , etc.) donde aparecen fotografías del personal voluntario durante un servicio.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;• Uso del sistema informático de Control de Participación (datos y fotografía). Siendo el uso única y exclusivamente estando de servicio el personal voluntario, con la uniformidad correcta y en horario de prestación de servicio de voluntariado de Protección Civil, no pudiéndose usar por otro caso o función, sin el consentimiento explícito del voluntario o voluntaria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;ARTÍCULO 21&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Es derecho de todo el personal voluntario el poder solicitar en el momento que lo consideren oportuno:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;• (previa solicitud de baja como voluntario) La eliminación de todos los datos almacenados sobre su persona, en cualquier soporte digital o impreso de la *AVPC de Sant Joan o el Ayuntamiento de Sant Joan.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;• La eliminación de parte de sus datos (datos médicos, formativos o personales que no influyan en la comunicación con el personal voluntario y que no sean imprescindibles para la realización de un servicio)&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;• La negativa al uso de su fotografía en redes sociales u otras plataformas de comunicación, la cual deberá comunicarse por escrito a la AVPC de Sant Joan.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;SECCIÓN QUINTA: FUNCIONES&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;ARTÍCULO 22&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La actuación de la AVPC de Sant Joan se centrará, de forma permanente y regularizada, en el campo preventivo y operativo de la gestión de emergencias, catástrofes y/o calamidades públicas, de acuerdo con lo previsto en los Planes Territoriales Municipales y en los Planes de actuación frente a riesgos específicos o PLATERBAL.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La actuación de la agrupación, en sus ámbitos territoriales, en situaciones de emergencia en las que no han llegado los servicios profesionales se efectuará bajo la responsabilidad del alcalde o alcaldesa, y esta intervención únicamente puede efectuarse si el personal voluntario cuenta con la adecuada formación en el ámbito de la emergencia, los correspondientes equipos de protección individual, y conforman una unidad mínima de actuación (dos voluntarios). En estos casos la primera actuación de la agrupación debe ser la de informar al SEIB112 de la existencia del siniestro y comunicar su actuación, pasando a desempeñar tareas de apoyo una vez los servicios profesionales hagan acto de presencia, y actuando bajo su dirección a partir de entonces.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Tendrán la consideración de servicios de emergencia profesionales, además de los habituales, los bomberos forestales, los bomberos voluntarios y las brigadas de auxilio rápido de la Comunidad Autónoma, es decir, la Unidad Operativa de la DGEI.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;ARTÍCULO 23&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El Plan Territorial Municipal y los Planes de actuación frente a riesgos específicos o PLATERBAL son la verdadera fuente de donde salen las competencias de la AVPC de Sant Joan, pudiendo variar la cantidad y calidad de las mismas en función de la capacidad de la Agrupación para asumirlas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En coherencia con su finalidad y organización, algunas de las funciones que podría desarrollar la Agrupació son:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En el marco de la prevención:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Estudios de riesgos de la localidad, preferentemente orientados a edificios, locales, y establecimientos de pública concurrencia.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Colaboración y soporte en la confección y divulgación de los Planes de Autoprotección de edificios y locales.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Colaboración en la elaboración y mantenimiento de los Planes Municipales de Emergencias (PME) y Planes de Actuación (PAE) frente a riesgos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. Confección y realización de campañas de información y divulgación para colectivos afectados por los distintos riesgos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. Actuación en dispositivos operativos de carácter preventivo (en grandes concentraciones humanas, vigilancia forestal,etc.)&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En el marco de la INTERVENCIÓN:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6. Apoyo a los servicios operativos de emergencia.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;7. Atención a los afectados de una emergencia.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;8. Colaboración en el desarrollo del Plan Sectorial de Comunicaciones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;9. En general, ejecución de las misiones encomendadas por el PME y los PAE.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;ARTÍCULO 24&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La colaboración voluntaria podrá realizarse incorporándose a la Agrupación como “colaborador”. Son “colaboradores” aquellas personas que poseen una determinada cualificación profesional y participan eventualmente con la *AVPC de Sant Joan realizando informes, asesoramiento técnico y contribuyendo a la formación del personal voluntario. Los presentes Estatutos no serán de aplicación a los colaboradores.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;SECCIÓN SEXTA: DERECHOS DEL PERSONAL VOLUNTARIO.&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;ARTÍCULO 25&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El voluntariado tiene derecho a ser reintegrado de los gastos de manutención, transporte y alojamiento, previamente autorizados por el alcalde o alcaldesa, sufridos en la prestación del servicio, debiendo hacer frente a estos gastos la Administración Pública de quien dependa la planificación y organización de los dispositivos establecidos. En cualquier caso, esta compensación de los gastos no tendrá carácter de remuneración o salario.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;ARTÍCULO 26&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El voluntario tiene derecho a adoptar todas las medidas necesarias para evitar situaciones que comporten peligros innecesarios para él o terceros. En cualquier caso, el voluntario tiene derecho a estar asegurado contra los posibles riesgos derivados de su actuación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Igualmente, quedan aseguradas las indemnizaciones correspondientes en los casos en que, a consecuencia del accidente, sobrevengan invalidez permanente o fallecimiento.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;ARTÍCULO 27&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Los daños y perjuicios que, a consecuencia del trabajo voluntario, puede sufrir el beneficiario del mismo, así como terceros, quedarán cubiertos por un seguro de responsabilidad civil.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Se establecerán mediante convenio entre la Administración de la Comunidad Autónoma de las Islas Baleares y el Ayuntamiento la modalidad de las correspondientes pólizas de seguros y coste de las indemnizaciones. La Administración de la Comunidad Autónoma de las Islas Baleares pagará las primas de los seguros, siempre que exista dotación presupuestaria suficiente al efecto, mediante la firma de convenio de colaboración con el Ayuntamiento de Sant Joan. En caso contrario, las primas de los seguros serán fijadas por el Pleno Municipal, a propuesta del Concejal Delegado, responsabilizándose al Ayuntamiento de sufragar las cuotas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. El personal voluntario en prácticas tiene derecho a sus correspondientes seguros en igualdad de condiciones que los voluntarios.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. Los costes de los seguros se actualizarán anualmente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. El Ayuntamiento será responsable civil subsidiario, de acuerdo con la legislación vigente, en virtud de su potestad de dirección sobre la *AVPC de Sant Joan. Sin embargo, cuando la actuación exceda del ámbito del término municipal y se hayan coordinado diferentes Agrupaciones supramunicipales será responsable civil subsidiario el Gobierno de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;ARTÍCULO 28&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. El personal voluntario de Protección Civil tiene derecho a obtener el soporte material de la Agrupación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Del mismo modo, tendrá derecho a participar en la estructura de la Agrupación y opinar sobre el trabajo desarrollado.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. El voluntario podrá efectuar las peticiones, sugerencias y reclamaciones que considere necesarias, dirigidas a la persona Jefe de la Agrupación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. En todo caso, si pasados 20 días desde la entrada en el registro, el escrito no fuera contestado, se podrá elevar directamente al alcalde, alcaldesa o a su delegado.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;SECCIÓN SÉPTIMA: DEBERES DE LOS VOLUNTARIOS&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;ARTÍCULO 29&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Todo el personal voluntario debe respetar la estructura jerárquica y funcional de la Agrupación, y colaborar por la mayor eficacia y mejor funcionamiento de la Agrupación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Los voluntarios tendrán que acatar la dirección de otros organismos competentes, en determinadas actuaciones contempladas en el Plan Municipal de Emergencias o Planes de Actuación Municipal Específica, como en el caso de extinción de incendios forestales.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3.A Desarrollar la tarea con la máxima diligencia, esfuerzo e interés.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;4.Poner en conocimiento de los responsables de la organización o de las autoridades la existencia de hechos que puedan suponer riesgos para las personas, para los bienes o para el medio ambiente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5.Guardar secreto profesional sobre la información a la que tengan acceso por razón del desarrollo de sus actividades, en el marco de la legislación general en materia de protección de datos personales.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6.Participar en las actividades de formación que se organicen, con el fin de capacitarles para un mejor desempeño de sus tareas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;7.En ningún caso, el voluntario o colaborador de Protección Civil actuarán como miembros de la Agrupación fuera de los actos de servicio. Sin embargo, podrá intervenir con carácter estrictamente personal, y sin vinculación con la Agrupación, en aquellos supuestos relacionados con su deber como ciudadano, usando los conocimientos y experiencias derivadas de su actividad voluntaria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;ARTÍCULO 30&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El personal voluntario de Protección Civil deberá realizar un número mínimo de horas anuales, comprometidas mutuo acuerdo con la Agrupación, y que no podrá ser inferior a 60 horas anuales, contabilizando la suma de horas de formación e intervención.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;ARTÍCULO 31&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. El voluntario tiene el deber de conservar y mantener en perfectas condiciones de uso el material y el equipo que se les haya confiado.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Los perjuicios causados a los mismos a consecuencia del trato incorrecto o falta de mención serán responsabilidad del personal voluntario.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. En cualquier caso, todo el material que disponga el personal voluntario, será devuelto a la Agrupación si se modifican las circunstancias que aconsejaron o habilitaron este depósito.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. No consumir ni estar bajo los efectos de drogas ni bebidas alcohólicas estando de servicio.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. No utilizar la organización para realizar actividades o tareas que no estén relacionadas con las labores propias de protección civil.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6. Actuar con absoluto respeto hacia la ciudadanía.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;7. Abstenerse de efectuar apología o propaganda de tipo político o religioso cuando actúe como personal voluntario de protección civil.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;SECCIÓN OCTAVA: RECOMPENSAS Y SANCIONES&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;ARTÍCULO 32&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La actividad altruista, solidaria y no lucrativa excluye toda remuneración, pero no impide el reconocimiento de los méritos del personal voluntario y, por tanto, la constatación de los mismos a efectos honoríficos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Con esta distinción de conductas meritorias, también serán estudiadas las posibles faltas cometidas por el personal voluntario que llevarán aparejadas las correspondientes sanciones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Tanto los méritos y honores concedidos, como las faltas y sus sanciones serán anotadas en el expediente personal del interesado.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;ARTÍCULO 33&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La valoración de las conductas meritorias que puedan merecer una recompensa, siempre de carácter no material, corresponde al alcalde o alcaldesa . La iniciativa de este reconocimiento meritorio corresponde a la persona jefe del Jefe del Servicio Local de Protección Civil o, en su defecto, a la persona jefe de la Agrupación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;ARTÍCULO 34&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La valoración de las conductas meritorias se realizará mediante reconocimiento público, diplomas o medallas, además de otras distinciones que puedan concederse el Ayuntamiento u otras Administraciones Públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;ARTÍCULO 35&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. La sanción será consecuencia de la comisión de una infracción, que se dispone en los presentes Estatutos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Las infracciones podrán ser consideradas leves, graves o muy graves.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. El voluntario tendrá derecho a un proceso justo y ecuánime que garantice al máximo la defensa en caso de sanciones reglamentadas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;ARTÍCULO 36&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Se consideran faltas leves:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. El descuido en la conservación y mantenimiento del equipo material con cargo al personal voluntario.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. El descuido o negligencia en el ejercicio de sus funciones, siempre que no suponga falta más grave&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. La incorrección con el público o con los miembros de la Agrupación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. El incumplimiento de los deberes y obligaciones del personal voluntario, siempre que no deban ser calificadas como faltas más graves.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. La desobediencia a las personas en Ninguno de los diferentes servicios, cuando no suponga maltrato de palabra u obra y no afecte al servicio que deba cumplirse.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6. Las faltas leves podrán sancionarse con la suspensión de la condición de personal voluntario, de 30 a 180 días.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;7. Las faltas leves prescribirán a los 6 meses de la fecha de su comisión.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;ARTÍCULO 37&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Se consideran faltas graves:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. El no seguir las normas orgánicas y funcionales de la Agrupación, de forma manifiesta y no justificada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. La notoria desconsideración hacia ciudadanos o miembros de la Agrupación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. La negligencia que cause daños de consideración en los locales, material o documentos de la Agrupación, así como del equipo o material a su cargo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. La grave perturbación de la actividad de la Agrupación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. La utilización injustificada, fuera de los actos propios de servicio, del equipo, material o distintivos de la AVPC de Sant Joan.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6. La acumulación de tres faltas leves.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;7. Las faltas graves podrán sancio- narse con la suspensión de la condición de personal voluntario, de 180 días a un año.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;8. Las faltas graves prescribirán a los 2 años de la fecha de su comisión.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;ARTÍCULO 38&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Se consideran faltas muy graves:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Dejar de cumplir, sin causa justificada las exigencias del servicio.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. La notoria falta de rendimiento que comporte inhibición en el cumplimiento de las tareas encomendadas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Utilizar o exhibir indebidamente las identificaciones del servicio.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. La agresión a cualquier miembro de la Agrupación y la desobediencia que pueda afectar al desarrollo de las tareas encomendadas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. El negarse a cumplir las sanciones de suspensión que sean impuestas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6. Consumo de drogas y alcohol en actas de servicio.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;7. Haber sido sancionado por la comisión de dos faltas graves en un período de dos años.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;8. Dos faltas muy graves se sancionarán con suspensión de 180 días, dos años o con la expulsión definitiva de la AVPC de Sant Joan.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;9. Las faltas muy graves prescribirán a los 3 años de la fecha de su comisión.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;DISPOSICIONES FINALES&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Para que entren en vigor los presentes Estatutos deberá ser aprobado por el Pleno Municipal, previo informe de la Comisión de Emergencias y Protección Civil respecto a la adecuación de estos .&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. La Dirección General de Emergencias e Interior, en el desarrollo de sus competencias sobre el personal voluntario de Protección Civil, colaborará con los Ayuntamientos de las siguientes formas:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;• Normalización y homologación de equipos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;• Elaboración de normativa y directrices.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;• Constitución del Registro del personal voluntario de la Agrupación, que mantendrán actualizado conjuntamente mediante una fluida y periódica comunicación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Estos estatutos establecen el régimen disciplinario aplicable al personal voluntario, sin perjuicio del régimen sancionador previsto en la legislación en materia de emergencias.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Sucesivamente se irán adjuntando Anexos a los presentes Estatutos, quienes podrán sufrir modificaciones, una vez aprobado los presentes Estatutos, sin que sea necesaria la revisión íntegra de éstos, ni su nueva aprobación por el Pleno Municipal, no siendo así cuando se proponga la alteración del articulado.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. Los diferentes Anexos serán aprobados por la Alcaldía, e incluirán las directrices necesarias para el desarrollo y aplicación de los presentes Estatutos (Uniformidad &lt;span style="color:black"&gt;según lo establecido en el Anexo 1 del Decreto 32/2019, de 10 de mayo, &lt;/span&gt;instrucciones de funcionamiento, designación de responsables) &lt;strong&gt;&amp;gt;&amp;gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Contra el presente Acuerdo definitivo se podrá interponer recurso contencioso-administrativo, ante la Sala de lo Contencioso-Administrativo del Tribunal Superior de Justicia de las Islas Baleares con sede en Palma, en el plazo de dos meses a contar desde el día siguiente a la publicación del presente anuncio, de conformidad con el artículo 46 de la Ley 29/1998, de 13 de julio, de la Jurisdicción Contencioso-Administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
