    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;El apartado 9.3 de la Resolución del presidente del &lt;em&gt;&lt;em&gt;Fon&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;s&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;de Garant&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;i&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;a Agr&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;à&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;ria &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;i&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;Pesquera de l&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;e&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;s I&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;l&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;l&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;e&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;s Balears&lt;/em&gt;&lt;/em&gt;&amp;nbsp;(FOGAIBA) de 10 de julio de 2015 por la cual se convocan subvenciones para Inversiones a las explotaciones agrícolas, para los años 2015-2019, especifica que la resolución expresa se notificará a las personas interesadas mediante su publicación en el &lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Butlletí Oficial de les Illes Balears&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;de acuerdo con los términos que prevé el artículo 45.2 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los expedientes han sido tramitados por el&lt;em&gt;&lt;em&gt;&amp;nbsp;Fon&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;s&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;de Garant&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;i&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;a Agr&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;à&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;ria &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;i&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;Pesquera de l&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;e&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;s I&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;l&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;l&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;e&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;s Balear&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;s&lt;/em&gt;&lt;/em&gt;&amp;nbsp;(FOGAIBA), en cumplimiento del que dispone el artículo 43 de la Ley 39/2015, de 1 de octubre, del Procedimiento Común de las Administraciones Públicas.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El vicepresidente en materia agraria del FOGAIBA, con fecha de 17 de mayo&amp;nbsp;de 2022, dicta lo siguiente:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Antecedentes&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;1.Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Illes Balears (FOGAIBA) de 10 de julio de 2015 por la que se convocan, para los años 2015 a 2019, subvenciones para inversiones en las explotaciones agrarias. La citada Resolución se modificó en fecha 17 de diciembre de 2015 (BOIB núm. 185) y en fecha 22 de junio de 2016, (BOIB núm. 81) y en fecha 26 de junio de 2018 (BOIB núm. 80). &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;2.Una vez analizada toda la documentación presentada, el vicepresidente del FOGAIBA resolvió favorablemente la concesión de la ayuda a favor de SON VIDAL DE GRANADA, S&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;RM&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;, entre otras, que figuran en el anexo de la Resolución de concesión, R1 de fecha 10 de septiembre de 2020, (BOIB núm. 161, de 17 de septiembre de 2020) con los datos y los importes correspondientes (con un importe concedido de &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;37&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;.&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;988,35€). &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;3.Dada la Resolución de concesión de la ayuda mencionada, y de acuerdo con lo que establece el apartado décimo de la convocatoria antes mencionada, el beneficiario se obliga, entre otros, a realizar las actuaciones auxiliadas dentro del plazo establecido y en justificar los gastos relacionados con la inversión para la recepción de los fondos comunitarios en el modo y plazos determinados en la convocatoria. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;4.Dentro del plazo legalmente establecido para la justificación de las inversiones aprobadas, el interesado presenta la solicitud de pago así como la documentación exigida, pero, una vez revisada ésta, se comprueba que: &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;a) El tractor adquirido es un tractor marca LANDINI, mod. TREKKER 105M, por importe de 49.500,00 € (sin IVA), pero el tractor concedido era marca JOHN DEERE 5115M, por un importe también de 49.500,00 € (sin IVA), dado este cambio se ha emitido el Informe de moderación de costes de 7 de abril de 2022 que determina que el precio del tractor adquirido es de 32.500,00 €, por tanto, el valor del mercado del producto es inferior al importe que se ha justificado. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;5. Por último, de acuerdo con la visita de inspección final y con la cuenta justificativa no se ha justificado la inversión de bienes inmuebles y los honorarios del proyecto. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;El solicitante declara que a pesar de la diferencia, se han logrado todos los objetivos previstos en el proyecto aprobado. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;6. De acuerdo con el apartado noveno de la Resolución de convocatoria antes mencionada, en lo referente a subvenciones para inversiones en las explotaciones agrícolas en los casos en los que se produzcan desviaciones entre la inversión realizada y la aprobada, se ajustará la ayuda total concedida al importe de la inversión realizada, siempre que la finalidad de la subvención, dada su naturaleza, sea susceptible de satisfacción parcial, y siempre que se acerquen de forma significativa al cumplimiento total de los objetivos previstos y supongan al menos un 50% de ejecución de la cantidad total de inversión aprobada en la resolución de concesión inicial. Este ajuste se hará aplicando el porcentaje de subvención que corresponda a la inversión total justificada. No se reducirá el importe de la subvención concedida siempre que la inversión ejecutada sea igual o superior a la máxima auxiliable. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;7. El artículo 43 del Texto refundido de la Ley de Subvenciones, aprobado por el Decreto Legislativo 2/2005, de 28 de diciembre, dispone que “Entorpe la revocación de la subvención cuando, posteriormente a la resolución de concesión válida y ajustada a derecho , el beneficiario incumple total o parcialmente las obligaciones o compromisos contraídos a los que está condicionada la eficacia del acto de concesión de la subvención. Como consecuencia de la revocación de la subvención, queda sin efecto, total o parcialmente, el acto de concesión y procede el reintegro de las cantidades percibidas indebidamente”. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;8. Con fecha 19 de abril de 2022, se notifica al beneficiario, mediante la publicación en la web del FOGAIBA, el Informe propuesta provisional de resolución de revocación parcial de 12 de abril de 2022, a efectos de cumplir con el trámite de audiencia para realizar las alegaciones. El 13 de mayo de 2022 (RGE 275044), el beneficiario presenta escrito en el que manifiesta estar de acuerdo con el Informe propuesta provisional de resolución de revocación parcial antes mencionado, y por tanto esta propuesta tiene carácter definitiva. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;9. Se ha considerado el Informe propuesta provisional de resolución de revocación parcial de 12 de abril de 2022, de la ayuda concedida a SON VIDAL DE GRANADA, SRM, con NIF J07715634.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Fundamentos de derecho&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;1.Resolución del Presidente del Fondo de Garant&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;ía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 10 de julio de 2015 por la que se convocan, para los años 2015 a 2019, subvenciones para inversiones en las explotaciones agrarias.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;2. Orden del Conseller de Agricultura, Medio Ambiente y Territorio de 19 de febrero de 2015, por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco del Programa de Desarrollo Rural de las Islas Baleares 2014 a 2.020 .&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;3. Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Por todo ello, dicto la siguiente&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Resolución &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;1. Revocar parcialmente la resolución de ayuda concedida al beneficiario,&amp;nbsp;mediante la Resolución del vicepresidente en materia agraria del FOGAIBA de 10 de septiembre de 2020, por el importe y con los datos detallados en el anexo de esta resolución, que es un total de 1 expediente y que comienza con SON VIDAL DE GRANADA, SRM y termina con SON VIDAL DE GRANADA, SRM , que suma un importe total de 21.738,35 euros, relativa a la línea de ayuda “Inversiones en las explotaciones agrarias”, puesto que el importe elegible del gasto es inferior a la aprobada.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;2.Notificar esta resolución a la persona beneficiaria mediante la publicación en el Boletín Oficial de las Islas Baleares.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;em&gt;Interposición de recursos&lt;/em&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Contra esta resolución -que no agota la vía administrativa- se podrá interponer recurso de alzada ante la consellera de Agricultura, Pesca y Alimentación, en el plazo de un mes, a contar desde el día siguiente a la notificación de la resolución, de acuerdo con el artículo 58.4 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la comunidad autónoma de las Islas Baleares, y los artículos 121 y 122, de la Ley 39/2015 del procedimiento Administrativo Común de las Administraciones Públicas.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
