    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;span style="color:#212121"&gt;El apartado 9.3 de la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 13&amp;nbsp;de diciembre de 2019, por la cual se convocan, para el año 2019, subvenciones para inversiones en la prevención de los daños causados en los bosques por incendios forestales, desastres naturales y catástrofes, especifica que la resolución expresa se notificará a las personas interesadas mediante su publicación en el &lt;/span&gt;&lt;em&gt;&lt;span style="color:#212121"&gt;Boletín Oficial de las Illes Balears&lt;/span&gt;&lt;/em&gt;&lt;span style="color:#212121"&gt;&amp;nbsp;de acuerdo con los términos que prevé el artículo 45.2 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;span style="color:#212121"&gt;Los expedientes han sido tramitados por el Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) en cumplimiento de lo dispuesto en el artículo 43 de la Ley 30/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;span style="color:#212121"&gt;El vicepresidente&amp;nbsp;en Materia Agraria del FOGAIBA, con fecha 17&amp;nbsp;de mayo&lt;/span&gt;&lt;span style="color:#000000"&gt;&amp;nbsp;de 2022&lt;/span&gt;&lt;span style="color:#212121"&gt;, firmó la siguiente resolución:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;1.Con fecha de 17 de diciembre de 2019 se publicó, en el Boletín Oficial de las Islas Baleares núm. 169, la Resolución de la presidenta del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) por la que se convocan, para el año 2019, subvenciones para inversiones en la prevención de los daños causados en los bosques por incendios forestales, desastres naturales y catástrofes. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;2.El 3 de mayo de 2021, el vicepresidente en materia agraria del FOGAIBA dictó una Resolución de concesión de ayudas para inversiones en la prevención de los daños causados &lt;/em&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;&lt;em&gt;a los bosques por incendios forestales, desastres naturales y catástrofes (R1), que se publicó en el Boletín Oficial de las Islas Baleares número 62, de 13 de mayo de 2021, en la que figuraba una concesión, entre otros, a favor de &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;CRISTÒFOL BARCELÓ LLULL&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;, con NIF &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;431****98W&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;, con un importe de ayuda de &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;17&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;.&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;92&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;0,00 € y un plazo de 12 meses desde el día siguiente de la fecha de notificación, con número de expediente PIFO 2019_1/&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;049. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;3.Con fecha 1 de abril de 2022, el representante del beneficiario de la ayuda (Margalida Muntaner Capó) solicita un cambio de las inversiones aprobadas, reduciendo la superficie de faja aprobada pidiendo una zona de aclareo. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;4.El artículo 43 del Texto refundido de la Ley de Subvenciones, aprobado por Decreto Legislativo 2/2005, de 28 de diciembre, dispone que «Pertoca la revocación de la subvención cuando, posteriormente a la resolución de concesión válida y ajustada a derecho , el beneficiario incumple total o parcialmente las obligaciones o compromisos contraídos a los que está condicionada la eficacia del acto de concesión de la subvención. Como consecuencia de la revocación de la subvención, queda sin efecto, total o parcialmente, el acto de concesión y procede el reintegro de las cantidades indebidamente percibidas». &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;5.Por todo ello, se propone realizar la modificación de la Resolución de concesión del Vicepresidente en materia agraria del Fogaiba de 3 de mayo de 2021, por un importe de 17.920,00 €, y llevar a cabo una revocación parcial de 2.200,00 €, dado que es la cantidad que le corresponde según los módulos de la convocatoria. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;6. Con fecha 28 de abril de 2022 se publicó la propuesta provisional de modificación y revocación parcial en la web del Fogaiba. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;7.Pasados&lt;/em&gt;&amp;nbsp;&lt;em&gt;los 10 días hábiles sin haber presentado alegaciones corresponde dictar la resolución definitiva.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;3.Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;Resolución&amp;nbsp;de modificación y de revocación parcial&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;Por todo ello, se informa favorablemente y se propone al vicepresidente en materia agraria del FOGAIBA que dicte resolución en los siguientes términos: &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;1.Modificar la Resolución del vicepresidente en materia agraria del FOGAIBA de 3 de mayo de 2021 de concesión (R1), por el importe y los datos detallados en el anexo I de esta Resolución, que es del total de 1 expediente que comienza con CRISTOFÒL BARCELÓ LLULL&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;y termina con &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;CRISTOFÒL BARCELÓ LLULL&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;, relativa a la línea de ayudas &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;“&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;Subvenciones para las inversiones en la prevención de los daños causados en los bosques por incendios forestales, desastres naturales y catástrofes&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;“&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;, a &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;solicitud del beneficiario. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;2.Revocar parcialmente la resolución de ayuda antes mencionada, concedida al beneficiario por el importe y con los datos detallados en el anexo II de esta resolución, que es de un total de 1 expediente y que comienza con CRISTOFÒL BARCELÓ LLULL&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;y termina con &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;CRISTOFÒL BARCELÓ LLULL&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;, relativa a la línea de ayudas &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;“&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;Subvenciones para las inversiones en la prevención de los daños causados en los bosques por incendios forestales, desastres naturales y catástrofes&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;”. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;3.Declarar concluido el procedimiento y archivar el expediente PIFO2019_1/049.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;4.Notificar esta resolución a la persona interesada, mediante la publicación en el Boletín Oficial de la&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;s&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;&lt;em&gt;Islas Baleares.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
