    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;El Consejo General del Agencia Tributaria de las Illes Balears, a propuesta del administrador tributario (por vacante de la Dirección de la ATIB, art. 5.3 de la Orden de la consejera de Hacienda y Administraciones Públicas de 22/12/2016. BOIB núm. 163, de 29/12/2016), en la sesión de 17 de mayo de 2022, adoptó, sin perjuicio de la ulterior aprobación del acto, entre otros, el Acuerdo siguiente que, transcrito literalmente, dice:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;«&lt;strong&gt;Primero&lt;/strong&gt;. Aprobar la oferta pública de estabilización para el año 2022 correspondiente al personal funcionario interino de la Agencia Tributaria de las Illes Balears, que supone un total de 39 plazas correspondientes a estabilización, con la distribución indicada en el anexo que se adjunta y en los términos establecidos en este Acuerdo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;Segundo&lt;/strong&gt;. Ofrecer por el turno correspondiente a la oferta pública de estabilización las plazas siguientes, de acuerdo con el desglose siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;a) 5 plazas vacantes de personal funcionario, correspondientes a las plazas de naturaleza estructural, dotadas presupuestariamente, que han sido ocupadas de manera temporal e ininterrumpida al menos en los tres años anteriores al 31 de diciembre de 2020, de acuerdo con el que prevé la Ley 20/2021, de 28 de diciembre, de medidas urgentes para la reducción de la temporalidad en la ocupación pública.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;b) 33 plazas vacantes de personal funcionario, correspondientes a las plazas de naturaleza estructural, dotadas presupuestariamente, que han sido ocupadas de manera temporal e ininterrumpida con anterioridad al 1 de enero de 2016, de acuerdo con el que prevé la Ley&amp;nbsp;20/2021, mencionada en el párrafo anterior.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;c) 1 plaza vacante de personal funcionario, correspondiente a una plaza de naturaleza estructural, dotada presupuestariamente, que ha sido ocupada de manera temporal e ininterrumpida con anterioridad al 1 de enero de 2016, de acuerdo con el que prevé la Ley&amp;nbsp;20/2021, mencionada en el párrafo anterior.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;Tercero&lt;/strong&gt;. Reservar, si procede, una cuota mínima de un 7% del total de las vacantes objeto de la oferta, al amparo del artículo 2.1 de la Ley 20/2021, para que las cubran personas con un grado de discapacidad igual o superior al 33 %, de acuerdo con el que dispone el artículo 59.1 del Texto refundido de la Ley del Estatuto básico del empleado público, aprobado por el Real decreto legislativo 5/2015, de 30 de octubre, y el resto de normativa aplicable. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;Quarto&lt;/strong&gt;. Disponer que las convocatorias correspondientes a los procesos selectivos de las plazas de la oferta pública de estabilización se tienen que publicar antes del 31 de diciembre de 2022 y la resolución tendrá que finalizar antes del 31 de diciembre de 2024. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;Quinto&lt;/strong&gt;. Publicar este Acuerdo en el &lt;em&gt;Boletín Oficial de las Illes Balears&lt;/em&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;Sexto&lt;/strong&gt;. Contra este Acuerdo, que agota la vía administrativa, se puede interponer un recurso potestativo de reposición ante el Consejo General en el plazo de un mes contador desde el día siguiente de la publicación, de acuerdo con el artículo 57, de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Illes Balears, y el artículo 123 de la Ley&amp;nbsp;39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;También se puede interponer un recurso contencioso-administrativo ante la Sala de lo Contencioso-Administrativo del Tribunal Superior de Justicia de las Illes Balears en el plazo de dos meses contadores desde el día siguiente de la publicación, de acuerdo con los artículos 8.2, 10.1 y 46 de la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contencioso-administrativa, sin perjuicio que la persona interesada&amp;nbsp; pueda interponer cualquier otro que considere procedente.»&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Por todo esto, dicto la siguiente&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;Resolución&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Publicar en el &lt;em&gt;Boletín Oficial de las Illes Balears&lt;/em&gt; la oferta pública de estabilización para el año 2022 correspondiente al personal funcionario interino de la Agencia Tributaria de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
