    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;Antecedentes&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;1. El 21 de mayo de 2021 se formalizó entre el Consejo de Mallorca y el Ayuntamiento de Calvià la concesión del uso de la Finca Registral 9178 inscrita al Registro de la Propiedad de Calvià 2 en el Tomo 4423, Libro 223, Folio 166 y situado en el número 4 de la Plaza Pascual Miquel del Polígono Industrial Son Bugadelles de Calvià, para la construcción y explotación de una estación de inspección técnica de vehículos por parte del Consejo Insular de Mallorca (SEFYCU 2631820).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;2. Mediante resolución de adjudicación de fecha 19 de julio de 2021 el consejero&lt;span style="display:none"&gt;&amp;lt;A[consejero|conseller]&amp;gt;&lt;/span&gt; ejecutivo del departamento de movilidad e infraestructuras, actuando como órgano de contratación, resolvió adjudicar un contrato de obras consistente en la contratación conjunta de redacción del proyecto ejecutivo, de ejecución de las obras, del suministro e instalación del equipamiento y puesta en funcionamiento de la nueva estación de inspección técnica de vehículos (ITV) de Calvià, Mallorca (exp. 2020/168/OBR)&lt;strong&gt; &lt;/strong&gt;a la entidad &lt;strong&gt;GRUPO VILLAESCUSA DESARROLLO S.L.&lt;/strong&gt; y nombrar como responsable del contrato con la denominación de Director Técnico del Proyecto y Director Facultativo de la Obra al Sr. Marc Gradaille Llaneras, jefe&lt;span style="display:none"&gt;&amp;lt;A[cabeza|cabo|jefe]&amp;gt;&lt;/span&gt; de servicio de ITV y Actividades Clasificadas (SEGRA 464562).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;3. El 10 de agosto de 2021 se firmó el correspondiente contrato administrativo con la entidad &lt;strong&gt;GRUPO VILLAESCUSA DESARROLLO S.L. &lt;/strong&gt;(SEFYCU 2679935).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;4. Con número registro de entrada nº 1155/2022, el 12 de enero de 2022 la entidad adjudicataria presentó el &lt;strong&gt;proyecto básico y ejecutivo&lt;/strong&gt; &lt;strong&gt;y el estudio de seguridad y salud para la construcción de la nueva estación de inspección técnica de vehículos de Calvià.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;5. En fecha 12 de abril de 2022 el Director Técnico del Proyecto emitió informe de defectos, insuficiencias técnicas, errores materiales, omisiones e infracciones de preceptos legales o reglamentarios sobre el proyecto básico y ejecutivo presentado, proponiendo que se requiera al adjudicatario para que los enmiende (SEFYCU 2870844).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;6. El día 12 de abril de 2022 el Consejero&lt;span style="display:none"&gt;&amp;lt;A[Consejero|Conseller]&amp;gt;&lt;/span&gt; Ejecutivo del Departamento de Movilidad e Infraestructuras requirió a la entidad &lt;strong&gt;GRUPO VILLAESCUSA DESARROLLO S.L.&lt;/strong&gt; para que enmendara las deficiencias mencionadas en este informe del Director Técnico del Proyecto en el plazo de 10 días hábiles contadores desde la notificación de este requerimiento (SEGRA 511165).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Este requerimiento fue notificado a la entidad &lt;strong&gt;GRUPO VILLAESCUSA DESARROLLO S.L.&lt;/strong&gt; el 12 de abril de 2022 mediante notificación electrónica nº. 3884251.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;7. Con número registro de entrada nº. 1155/2022, el 12 de enero de 2022 la entidad &lt;strong&gt;GRUPO VILLAESCUSA DESARROLLO SL&lt;/strong&gt; presentó el proyecto básico y ejecutivo y el estudio de seguridad y salud por&lt;span style="display:none"&gt;&amp;lt;A[por|para]&amp;gt;&lt;/span&gt; la construcción de la nueva estación de inspección técnica de vehículos de Calvià.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;8. El 12 de abril de 2022 el consejero&lt;span style="display:none"&gt;&amp;lt;A[consejero|conseller]&amp;gt;&lt;/span&gt; ejecutivo de movilidad e infraestructuras, como órgano de contratación, dictó resolución para requerir al contratista para que enmendara los defectos, insuficiencias técnicas, errores materiales, omisiones e infracciones de preceptos legales o reglamentarios del proyecto básico y ejecutivo y el estudio de seguridad y salud presentado, señalados en el informe técnico emitido por el director técnico del proyecto el día 12 de abril de 2021.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;9. Con número de registro de entrada nº. 22333/2022 del 29 de abril de 2022, la entidad adjudicataria ha presentado nuevo proyecto básico y ejecutivo y el estudio de seguridad y salud en respuesta a la resolución de requerimiento de día 12 de abril de 2022. Con registro de entrada 23299/2022 de 4 de mayo de 2022 incorpora dentro del expediente, además, los archivos en formato nativos correspondientes al proyecto presentado día 29 de abril de 2022.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;10. El 6 de mayo de 2022 el consejero&lt;span style="display:none"&gt;&amp;lt;A[consejero|conseller]&amp;gt;&lt;/span&gt; ejecutivo de movilidad e infraestructuras, como órgano de contratación, dictó resolución para requerir nuevamente y por segunda vez al contratista para la enmienda de los defectos, insuficiencias técnicas, errores materiales, omisiones e infracciones de preceptos legales o reglamentarios en este nuevo proyecto básico y ejecutivo y el estudio de seguridad y salud presentado, señalados, todo ellos en el segundo informe técnico emitido por el director técnico del proyecto el día 12 de abril de 2021.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;11. Finalmente, la entidad adjudicataria presentó nuevo proyecto básico y ejecutivo y el estudio de seguridad y salud en contestación al anterior requerimiento, el cual recibió informe favorable del director técnico del proyecto según consta en el expediente administrativo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;12. El Sr. Miguel Ángel Sagrera Clota, Coordinador de Infraestructuras del Servicio de Planificación y Proyectos del Departamento de Movilidad e Infraestructuras, &lt;strong&gt;emitió informe de supervisión del proyecto básico y ejecutivo y el estudio de seguridad y salud presentado favorable&lt;/strong&gt;, todo eso de conformidad con el artículo&lt;strong&gt; &lt;/strong&gt;235 y concordantes de la Ley 9/2017, de 8 de noviembre, de Contratos del Sector Público, por&lt;span style="display:none"&gt;&amp;lt;A[por|para]&amp;gt;&lt;/span&gt; la cual se trasladan al ordenamiento jurídico español las Directivas del Parlamento Europeo y del Consejo 2014/23/UE y 2014/24/UE, de 26 de febrero de 2014 (LCSP) y previa la resolución del consejero ejecutivo del Departamento de Movilidad e Infraestructuras que &lt;strong&gt;ordenó al&lt;/strong&gt; &lt;strong&gt;servicio de Planificación y Proyectos del Departamento de Movilidad e Infraestructuras&lt;/strong&gt; que emita este informe.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;1. De conformidad con el artículo 1 de la Ley 13/1993 de 20 de diciembre, de atribución de competencias en los consejos insulares en materia de inspección técnica de vehículos, el Consejo Insular de Mallorca tiene atribuida las competencias ejecutivas y de gestión en materia de inspección técnica de vehículos (ITV)&lt;strong&gt;.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;2. El artículo 8 e) del Decreto de la Presidenta del Consejo Insular de Mallorca, de día 9 de diciembre de 2019, por&lt;span style="display:none"&gt;&amp;lt;A[por|para]&amp;gt;&lt;/span&gt; el cual se determina la organización del Consejo Insular de Mallorca y sus sucesivas modificaciones (BOIB nº. 29 de 24 de febrero de 2022), establece que corresponde al Departamento de Movilidad e Infraestructuras la correspondiente gestión administrativa en materia de inspección técnica de vehículos (ITV).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;3. El artículo 231 de la Ley 9/2017, de 8 de noviembre, de contratos del sector público, recoge que la aprobación de los proyectos de obra corresponde al órgano de contratación, a menos que esta competencia esté específicamente atribuida a otro órgano por una norma jurídica, que en este caso es el Consejero&lt;span style="display:none"&gt;&amp;lt;A[Consejero|Conseller]&amp;gt;&lt;/span&gt; Ejecutivo de Movilidad e Infraestructuras.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;4. El artículo 149.1 de la Ley 20/2006, de 15 de diciembre, municipal y de régimen local, y el artículo 83 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, regulan el trámite de información pública al cual se tiene que someter el proyecto.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;5. El artículo 3 de la Ley 40/2015, de 1 de octubre de régimen jurídico del sector público establece que las administraciones actúan de acuerdo con el principio de coordinación, y el artículo 79 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas prevé que, a afectos de resolución del procedimiento, se soliciten aquellos informes que se juzguen necesarios para resolver.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Por todo eso, dicto la siguiente &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Resolución&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;1. &lt;strong&gt;Aprobar inicialmente el&lt;/strong&gt; &lt;strong&gt;proyecto básico y ejecutivo para la ejecución de las obras, suministro e instalación del equipamiento y puesta en funcionamiento de la nueva estación de inspección técnica de vehículos (ITV) de Calvià, Mallorca&lt;/strong&gt; (exp. 2020/168/OBR) con un presupuesto para el conocimiento de la administración &lt;strong&gt;de UN MILLÓN NOVECIENTOS OCHO MIL OCHOCIENTOS OCHENTA EUROS CON CUATRO CÉNTIMOS (1.908.880,04 €) &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;2. &lt;strong&gt;Someter el proyecto&lt;/strong&gt;, de acuerdo con lo que dispone el artículo 149.1 de la Ley 20/2006, de 15 de diciembre, municipal y de régimen local, y el artículo 83 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, &lt;strong&gt;al trámite de información pública&lt;/strong&gt; al efecto de que cualquier persona física o jurídica pueda examinar el expediente y formular las alegaciones que estime pertinentes. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;3. En consecuencia ordenar la apertura&lt;span style="display:none"&gt;&amp;lt;A[apertura|abertura]&amp;gt;&lt;/span&gt; de un plazo de información pública de &lt;strong&gt;veinte días (20 días)&lt;/strong&gt;, con la inserción previa de un anuncio en el BOIB, y en el tablón de anuncios de la sede electrónica del Consejo Insular de Mallorca, y disponer que durante este plazo el proyecto se podrá consultar en las dependencias del Departamento de Movilidad e Infraestructuras del Consejo Insular de Mallorca y en el tablón de anuncios mencionado. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;El plazo de información pública de 20 días empieza a partir del día siguiente de la última publicación de los anuncios en el BOIB o en el tablón de anuncios de la sede electrónica del Consejo Insular de Mallorca: https://cim.sedipualba.es/tablondeanuncios&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Durante el plazo mencionado, el proyecto se podrá consultar en las dependencias del Departamento de Movilidad e Infraestructuras, ubicadas en la calle del General Riera, 113, de Palma, en horario de 9 a 14 horas, del lunes al viernes (excepto festivos), y en el tablón de anuncios mencionado.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
