La citada Resolución se modificó con fecha 17 de diciembre de 2015 (BOIB núm. 185) y con fecha 22 de junio de 2016, (BOIB núm. 81) y en fecha 26 de junio de 2018 (BOIB núm. 80).</em></em></p> <p><em style="font-family:&quot;Times New Roman&quot;,Times,serif"><em>2.Una vez analizada toda la documentación presentada, el vicepresidente del FOGAIBA resolvió favorablemente la concesión de la ayuda a favor de SON FORNÉS, SAT, entre otros,&nbsp;que figuran en el anexo de la Resolución de concesión, RES- 1 de fecha 4 de febrero de 2022, (BOIB núm. 23, de 12 de febrero de 2022) con los datos y los importes correspondientes (con un importe concedido de 89.868,44 €).</em></em></p> <p><em style="font-family:&quot;Times New Roman&quot;,Times,serif"><em>3.Dada la Resolución de concesión de la ayuda mencionada, y de acuerdo con lo que establece el apartado décimo de la convocatoria antes mencionada, el beneficiario se obliga, entre otros, a realizar las actuaciones auxiliadas dentro del plazo establecido y en justificar los gastos relacionados con la inversión para la recepción de los fondos comunitarios en el modo y plazos determinados en la convocatoria.</em></em></p> <p><em style="font-family:&quot;Times New Roman&quot;,Times,serif"><em>4.Dentro del plazo legalmente establecido para la justificación de las inversiones aprobadas, el interesado presenta la solicitud de pago, así como la documentación exigida, pero, una vez revisada ésta, se comprueba lo siguiente:</em></em></p> <p style="margin-left:40px"><em style="font-family:&quot;Times New Roman&quot;,Times,serif"><em>a)Que el cultichisel adquirido, por un importe de 12.840,00 euros (sin IVA), del proveedor «Maquinaria y servicios 201, SL», es un modelo y marca distinto al cultichisel concedido (marca GIL), por un importe de 10.530,00 euros (sin IVA), del proveedor «Ribot», del proveedor dado este cambio se emitió el Informe de moderación de costes con fecha 5 de mayo de 2022, que determina que el importe del Cultichisel 17 brazos con rodillo y grada de púas es de 11.310,00 euros, el valor de mercado del producto es inferior al importe que se ha justificado.</em></em></p> <p style="margin-left:40px"><em style="font-family:&quot;Times New Roman&quot;,Times,serif"><em>b)Por último, de acuerdo con la visita de inspección final y con la cuenta justificativa las inversiones realizadas son inferiores a las concedidas, al no justificar la bomba (6.091,17€). El solicitante declara que a pesar de la diferencia, se han logrado todos los objetivos previstos en el proyecto aprobado.</em></em></p> <p><em style="font-family:&quot;Times New Roman&quot;,Times,serif"><em>5.De acuerdo con el apartado noveno de la Resolución de convocatoria antes mencionada, en lo referente a subvenciones para inversiones en las explotaciones agrícolas en los casos en los que se produzcan desviaciones entre la inversión realizada y la aprobada, se ajustará la ayuda total concedida al importe de la inversión realizada, siempre que la finalidad de la subvención, dada su naturaleza, sea susceptible de satisfacción parcial, y siempre que se acerquen de forma significativa al cumplimiento total de los objetivos previstos y supongan al menos un 50% de ejecución de la cantidad total de inversión aprobada en la resolución de concesión inicial. Este ajuste se hará aplicando el porcentaje de subvención que corresponda a la inversión total justificada. No se reducirá el importe de la subvención concedida siempre que la inversión ejecutada sea igual o superior a la máxima auxiliable.</em></em></p> <p><em style="font-family:&quot;Times New Roman&quot;,Times,serif"><em>6.El artículo 43 del Texto refundido de la Ley de Subvenciones, aprobado por el Decreto Legislativo 2/2005, de 28 de diciembre, dispone que “Entorpe la revocación de la subvención cuando, posteriormente a la resolución de concesión válida y ajustada a derecho , el beneficiario incumple total o parcialmente las obligaciones o compromisos contraídos a los que está condicionada la eficacia del acto de concesión de la subvención. Como consecuencia de la revocación de la subvención, queda sin efecto, total o parcialmente, el acto de concesión y procede el reintegro de las cantidades percibidas indebidamente”.</em></em></p> <p><em style="font-family:&quot;Times New Roman&quot;,Times,serif"><em>7.Con fecha 9 de mayo de 2022 se notifica al beneficiario, mediante la publicación en la web del FOGAIBA, el Informe propuesta provisional de resolución de revocación parcial INEA2019_1/057 de 9 de mayo de 2022, a efectos de cumplir con el trámite de audiencia para realizar las alegaciones.
