font-size:12px">El 1 de octubre de 2020 se publicó la convocatoria pública de subvenciones para actuaciones de apoyo en la movilidad eficiente y sostenible (Programa MOVES II) mediante resolución del consejero de Transición Energética y Sectores Productivos de 25 de septiembre de 2020.</span></p> </li> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">La Dirección General de Energía y Cambio Climático concedió una subvención a las personas o entidades que figuran en el anexo de esta Propuesta en el marco de la convocatoria para actuaciones de apoyo a la movilidad eléctrica.</span></p> </li> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Las personas o entidades que figuran en el anexo han aportado la documentación requerida para la justificación de la realización de las actuaciones subvencionadas.</span></p> </li> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">El técnico de la Dirección General de Energía y Cambio Climático ha examinado la documentación aportada y ha emitido un informe desfavorable a la justificación de los expedientes descritos en el anexo con la motivación que figura en este anexo.</span></p> </li> </ol> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Fundamentos de derecho</strong></span></p> <ol> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">El consejero de Transición Energética, Sectores Productivos y Memoria Democrática es el órgano competente para resolver este procedimiento de acuerdo con la estructura orgánica del Gobierno de las Islas Baleares y de acuerdo con la Orden de la consejera de Comercio, Industria y Energía de 15 de mayo de 2008 por la cual se establecen las bases reguladoras para la concesión de subvenciones en materia de energía.</span></p> </li> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">El Decreto Legislativo 2/2005, de 28 de diciembre, por el cual se aprueba el Texto refundido de la Ley de subvenciones (BOIB nº 196, de 31 de diciembre de 2005).</span></p> </li> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">La Orden de la consejera de Comercio, Industria y Energía de 15 de mayo de 2008 por la cual se establecen las bases reguladoras para la concesión de subvenciones en materia de energía (BOIB nº 72, de 24 de mayo de 2008).</span></p> </li> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">La Resolución del vicepresidente y consejero de Transición Energética y Sectores Productivos de 25 de septiembre de 2020 por la cual se aprueba la convocatoria pública de subvenciones para actuaciones de apoyo a la movilidad eficiente y sostenible (Programa MOVES II), (BOIB nº 169, de 1 de octubre de 2020).</span></p> </li> </ol> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Propuesta de resolución</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Propongo al consejero de Transición Energética, Sectores Productivos y Memoria Democrática que dicte una resolución en los términos siguientes:</span></p> <ol> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Revocar la subvención a los beneficiarios que figuran en el anexo.</span></p> </li> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Declarar concluido el procedimiento y, por lo tanto, archivar los expedientes indicados en el anexo.</span></p> </li> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Publicar esta Propuesta en el <em>Boletín Oficial de las Islas Baleares.</em></span></p> </li> </ol> <div style="page-break-after:always"><span style="display:none">&nbsp;</span></div> <p><span style="font-family:Times New Roman,Times,serif;
