El artículo 10.1&nbsp;<em>j </em>de la Ley 14/2006, de 17 de octubre, del Deporte de las Illes Balears, establece que corresponde a la Administración de la Comunidad Autónoma de las Illes Balears, en el ejercicio de sus competencias, fomentar el deporte de alto nivel.</span></span></p> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">2. El artículo 2.1.<em>a</em> de la Orden de la consejera de Asuntos Sociales y Deportes de 12 de febrero de 2021 por la que se establecen las bases reguladoras para conceder subvenciones en materia de deportes (BOIB nº 23, de 16 de febrero), establece que es susceptible de ayudas el apoyo a los y las deportistas. Por otra parte, el artículo 5.1 de la misma orden dispone que las convocatorias que se dicten al amparo de estas bases se aprobarán por resolución del consejero competente en materia de deportes y se publicarán en el <em>Boletín Oficial de las Illes Balears</em>.</span></span></p> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">3. La Consejería de Asuntos Sociales y Deportes mediante la Dirección General de Deportes, ejerce las competencias en materia de deporte y ocio, otorgadas por el artículo 30.12 del Estatuto de Autonomía de las Illes Balears, y de acuerdo con lo dispuesto en el Decreto 11/2021, de 15 de febrero, de la presidenta de las Illes Balears, por el cual se rectifica el Decreto 21/2019, de 2 de agosto, de la presidenta de les Illes Balears, por el que se establecen las competencias y la estructura orgánica básica de las consejerías de la Administración de la Comunidad Autónoma de las Illes Balears (BOIB nº 21 de 15 de febrero), modificado por el Decreto 25/2021, de 8 de marzo (BOIB nº 33 de 9 de marzo).</span></span></p> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><strong>Fundamentos de derecho</strong></span></span></p> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">1. Beneficiarios y requisitos para la obtención de ayudas</strong></span></span></p> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">2.1 Pueden ser beneficiarios de estas ayudas los y las deportistas que cumplan los siguientes requisitos:</span></span></p> <ol style="list-style-type:lower-alpha"> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">Todos los deportistas que obtengan una puntuación igual o superior a cinco puntos, como resultado de aplicar<span style="color:#ff0000"> </span>los criterios y baremos del apartado 9. Esta puntuación se calcula sobre la base de los resultados deportivos conseguidos durante el año&nbsp;2021 o en algunos casos, cuando los títulos conseguidos en los años 2019 y 2020 continúen vigentes.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">Tener la vecindad administrativa vigente en cualquiera de los municipios de las Illes Balears con una antigüedad mínima de dos años hasta la fecha de publicación en el BOIB de esta convocatoria de subvenciones.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">Tener el domicilio fiscal en las Illes Balears.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">Los deportistas que habiendo competido en el año 2021 representando una comunidad autónoma, ésta sea la comunidad autónoma de las Illes Balears.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">Los deportistas que habiendo competido en el año 2021 con licencia federativa autonómica, sea ésta de la federación autonómica de las Illes Balears. No es necesario cumplir este requisito cuando no exista federación autonómica balear de la modalidad deportiva practicada por el deportista o en caso de que el deportista tenga licencia nacional.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">No tener vigente ninguna sanción firme grave o muy grave en materia deportiva, ni ninguna sanción firme por dopaje, ni ninguna sanción penal firme por delitos relacionados con el dopaje. En el supuesto de que los expedientes sancionadores o los procedimientos judiciales estén todavía en tramitación o la resolución sancionadora o sentencia condenatoria no sea firme, el deportista puede presentar la solicitud de ayuda, pero la concesión, si procede, queda suspendida hasta que estos procedimientos se resuelvan definitivamente.</span></span></p> </li> </ol> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">2.2 Quedan excluidos de esta convocatoria los y las deportistas que se encuentren en alguno de los siguientes casos durante las competiciones disputadas en el año 2021:</span></span></p> <ul> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">Competidores de ligas profesionales de fútbol.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">Competidores de ligas profesionales de baloncesto.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">Ciclistas profesionales que tengan contrato con un equipo de la UCI World Team.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">Tenistas profesionales ATP que hayan disputado una fase final de un máster 250 o una competición de nivel superior.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">Tenistas profesionales WTA que hayan disputado una fase final de un torneo premium o una competición de nivel superior.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">Jugadores de golf profesionales del PGA Tour y del European Tour.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">Competidores de moto GP.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">Competidores de fórmula 1.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">Competidores del World Rally Championship.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">Modalidad de caza, salvo la especialidad de compak sporting.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">Conductor profesional de competiciones “Premium” o profesionales del trote.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">Modalidades deportivas de Colombicultura, Colombofilia y lebreros.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">Deportistas profesionales de las modalidades deportivas de boxeo, kickboxing i fisicoculturismo.</span></span></p> </li> </ul> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">2.3 En aplicación del artículo 4 de la Ley 1/1992, de 8 de abril, de protección de los animales que viven en el entorno humano, no son objeto de esta convocatoria las competiciones de tiro al palomo y la codorniz, a brazo mecánico o tubo o a jaula.</span></span></p> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">2.4 Quedan<span style="display:none">&lt;A[Restan|Quedan]&gt;</span> excluidos de la aplicación de esta convocatoria los y las deportistas con contrato profesional. Se entiende que tienen carácter profesional las competiciones que el Consejo Superior de Deportes haya calificado así, visto el artículo 46 de la Ley 10/1990, de 15 de octubre, estatal del deporte.</span></span></p> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><strong>3. Importe máximo y crédito presupuestario</strong></span></span></p> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">3.1 La Consejería de Asuntos Sociales y Deportes destina a esta convocatoria un máximo de 940.000,00 € con cargo a la partida presupuestaria 17601.461A01.48000.00 de los presupuestos generales de la Comunidad Autónoma de las Illes Balears para el año&nbsp;2022.</span></span></p> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">3.2 En el supuesto de que se quiera aumentar la dotación de la partida presupuestaria o modificar la partida a la que se imputa esta convocatoria, se realizará mediante una resolución de la consejera de Asuntos Sociales y Deportes.</span></span></p> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><strong>4. En caso de menores de edad o personas dependientes puede presentar la solicitud el representante legal del deportista. </span></span></p> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">4.4 Si se hace la presentación de la solicitud como representante, debe acreditarse esta representación bien en el momento de iniciar la solicitud o a lo largo del proceso de tramitación.</span></span></p> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">4.5 Documentación que se debe aportar:</span></span></p> <ol style="list-style-type:lower-alpha"> <li> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">Impreso de solicitud rellenado y firmado adecuadamente, en el que consten los datos del beneficiario. Podrá firmar el documento el deportista, la persona en quien delegue o su representante legal.</span></span></p> </li> <li> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">En caso de que presente la solicitud otra persona que no sea el beneficiario directo: declaración responsable de que tiene autorización para presentar la solicitud en su lugar.</span></span></p> </li> <li> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">Fotocopia del documento nacional de identidad de la persona solicitante y de la persona en quien delega la representación, en su caso.</span></span></p> </li> <li> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">Declaración responsable de la persona solicitante que acredite que no se encuentra incluida en ninguno de los supuestos de prohibición o de incompatibilidad para ser beneficiaria de la ayuda, de conformidad con la normativa aplicable (incluida en la hoja de solicitud).</span></span></p> </li> <li> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">Declaración responsable de la persona solicitante de no tener vigente ninguna sanción firme grave o muy grave en materia deportiva, ni ninguna sanción firme por dopaje, ni ninguna sanción penal firme por delitos relacionados con el dopaje.</span></span></p> </li> <li> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">Declaración responsable de la persona solicitante de no haber competido representando a otras comunidades autónomas durante el año 2021.</span></span></p> </li> <li> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">Declaración responsable de la persona solicitante de todas las ayudas y subvenciones solicitadas o concedidas por cualquier institución, públicas o privadas, nacionales o extranjeras, relacionadas con la solicitud.</span></span></p> </li> <li> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">En el supuesto de que no sean perceptores de la Comunidad Autónoma, una declaración responsable de veracidad de los datos bancarios aportados, tal como dispone el Decreto 6/2013, de 8 de febrero, de medidas de simplificación documental de los procedimientos administrativos, o un documento bancario que acredite la titularidad de la cuenta. El citado impreso normalizado se puede obtener en la sede o en la página web de la Dirección General de Deportes.</span></span></p> </li> <li> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">Certificado de estar al corriente de las obligaciones tributarias con la Comunidad Autónoma de las Illes Balears. El órgano instructor debe adjuntar de oficio este certificado.</span></span></p> </li> <li> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">Certificados de estar al corriente de las obligaciones tributarias con la Hacienda del Estado y con la Seguridad Social (para autorizar la consulta ver punto 4.7).</span></span></p> </li> <li> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">Certificado federativo de la licencia deportiva balear o nacional del 2022 o copia de la licencia original.</span></span></p> </li> <li> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">Certificado de empadronamiento que demuestre que se cumple el requisito b) del apartado 2.1.</span></span></p> </li> <li> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">Clasificación final oficial de cada uno de los resultados presentados o bien un certificado federativo de los resultados. La clasificación o certificado debe incluir el nombre de la competición, la fecha y localidad, la lista o el número de participantes, y la posición obtenida. Además, en los resultados de competiciones internacionales debe aparecer la lista o número de países de los deportistas o equipos participantes.</span></span></p> </li> <li> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">En el supuesto de que haya sido lesionado durante las competiciones más importantes de 2021, debe presentarse un certificado de la lesión deportiva que acredite el tiempo de baja y relación de las competiciones que no se han podido hacer como consecuencia de la lesión. </span></span></p> </li> <li> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">Declaración responsable de no haber sido sancionadas o condenadas en los últimos tres años por haber ejercido o tolerado prácticas laborales consideradas discriminatorias por razón de sexo o de género, sancionadas por resolución administrativa firme o condenadas por sentencia judicial firme.</span></span></p> </li> <li> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">Formulario online de resultados deportivos, que ha de completar en la dirección de internet <span style="color:null">https://forms.office.com/r/Ezza5QMvgJ,</span> i que ha de incluir las siguientes declaraciones:</span></span></p> </li> </ol> <ul style="margin-left:40px"> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">Declaración responsable con los datos de cada resultado presentado. Podrán presentarse un máximo de tres resultados obtenidos entre el 1 de enero y el 31 de diciembre de 2021 (ambos incluidos) o de los resultados todavía vigentes de los años 2019 y 2020 de campeonatos que no se hayan realizado durante el 2021, de de acuerdo con el modelo de declaración responsable de resultados. </span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">En caso de presentar un resultado internacional, declaración responsable de que el solicitante ha participado en un campeonato de España, de Europa o del Mundo de categoría absoluta, o hasta dos categorías por debajo de la absoluta, entre en 2018 y 2021, o bien, declaración responsable de que el solicitante tiene la condición vigente de deportista de Alto Nivel Balear o de Alto Nivel Nacional.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">En el supuesto de haber estado en concentración permanente (como interno o externo) durante un mínimo de tres meses del año 2021 en un CAR o CEAR reconocido por el CSD, declaración responsable (incluida en la hoja de solicitud) de que se cumple esta condición, indicando el nombre del centro, nombre del programa y fecha de incorporación y salida del mismo, si se da el caso. No tendrá ningún beneficio tener esta condición si no se puede presentar conjuntamente con el punto siguiente.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">En caso de cumplir la condición del punto anterior, se debe presentar una declaración responsable de que el solicitante ha conseguido hacer pódium en un Campeonato de España o ha participado en un campeonato de Europa o del Mundo entre los años 2018 y 2021, de categoría absoluta, o de segunda categoría de edad, o bien, declaración responsable de que el solicitante tiene la condición vigente de deportista de Alto Nivel Nacional.</span></span></p> </li> </ul> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">4.6 Con la presentación del formulario de resultados deportivos anterior, se entenderán como manifestadas y confirmadas las declaraciones responsables del solicitante que aparecen incluidas en el mismo.</span></span></p> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">4.7 En relación con la documentación requerida en el apartado <em>j)</em> y de acuerdo con el Decreto 6/2013, de 8 de febrero, de medidas de simplificación documental de los procedimientos administrativos, el solicitante puede autorizar a la Consejería de Asuntos Sociales y Deportes para que efectúe las consultas telemáticas para la verificación de los datos.</span></span></p> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">En el modelo normalizado de solicitud de la ayuda que se pone a disposición de los interesados se prevé la autorización al órgano gestor de las ayudas para que lleve a cabo las actuaciones necesarias para la comprobación de los datos relativos al cumplimiento de las obligaciones tributarias con el Estado y con la Seguridad Social.</span></span></p> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">En caso de que la persona solicitante deniegue de manera expresa dicha autorización, deberá presentar, junto con la solicitud, una declaración responsable de estar al corriente de las obligaciones tributarias con el Estado y con la Seguridad Social, o bien los correspondientes certificados acreditativos de estas circunstancias.</span></span></p> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">4.8 En el supuesto de que la Dirección General de Deportes, por causas ajenas a su voluntad, no pueda conseguir los citados documentos, requerirá a la persona o entidad solicitante que los aporte en el plazo de diez días hábiles y siempre con anterioridad a la propuesta de resolución.</span></span></p> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">4.9 La Dirección General de Deportes, en cualquier momento, puede solicitar a los interesados la documentación y la información complementaria que considere necesaria para resolver el expediente.</span></span></p> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">4.10 Si la documentación aportada no cumple los requisitos exigidos, se requerirá a la persona interesada que, en el plazo de diez días hábiles, subsane la deficiencia o adjunte los documentos preceptivos, con la advertencia de que, en caso que no lo haga, se considerará que desiste de su solicitud y se archivará el expediente sin más trámite, con la correspondiente resolución previa que se dictará en los términos previstos en el artículo 21.1 de la Ley 39/2015, de 1 de octubre.</span></span></p> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">La inexactitud, falsedad u omisión, de carácter esencial, de cualquier dato o información que se incorpore a una declaración responsable, o la no presentación ante la Conserjería de Asuntos Sociales y Deportes de la declaración responsable, la documentación que sea en su caso requerida para acreditar el cumplimiento de lo declarado, determinará la imposibilidad de continuar con el ejercicio del derecho de solicitud de la subvención desde el momento en que se tenga constancia de tales hechos, sin perjuicio de las responsabilidades penales, civiles o administrativas a que hubiera lugar.</span></span></p> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">4.11 El incumplimiento de los requisitos o del plazo de presentación de solicitudes establecidos en esta convocatoria implica no tener que admitir la solicitud.</span></span></p> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><strong>5. Plazo para presentar las solicitudes</strong></span></span></p> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">El último día para presentar las solicitudes es día 31 de mayo de 2022.</span></span></p> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><strong>6. Competencia y resolución</strong></span></span></p> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">6.1 La Dirección General de Deportes es el órgano competente para instruir el procedimiento, tramitar los expedientes y debe realizar de oficio todas las actuaciones que considere necesarias para determinar, conocer y comprobar los datos en virtud de los cuales se tiene que pronunciar la Comisión Evaluadora. Ésta debe emitir un informe que sirva de base para elaborar la propuesta de resolución. En este informe, la Comisión Evaluadora establecerá la lista ordenada por puntuación de los posibles deportistas beneficiarios.</span></span></p> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">6.2 El órgano instructor puede pedir al solicitante la modificación o mejora voluntarias de los términos de la solicitud. En este caso se levantará acta sucinta, que se incorporará al procedimiento.</span></span></p> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">En todo caso, el órgano instructor puede proponer la mejora de la solicitud y, en particular, la modificación del presupuesto presentado por la persona solicitante o las condiciones y la forma de realización de la actividad propuesta por él, siempre que ello no perjudique terceras personas. En estos casos, se debe pedir la conformidad del solicitante, lo se entenderá otorgada si la propuesta formulada por el órgano instructor explicita claramente las modificaciones correspondientes y la persona solicitante no manifiesta oposición, por escrito, en un plazo de quince días. En cualquier otro caso, la solicitud se mantendrá en los términos expresados ​​por la persona solicitante en su escrito inicial, sin perjuicio de las correcciones que, en su caso, se desprendan del escrito de oposición que presente.</span></span></p> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">6.3 Sin perjuicio de lo que prevé el apartado anterior, la persona solicitante también puede modificar por sí misma la solicitud en los casos y bajo las condiciones que establece el artículo 16.3 del Texto refundido de la Ley de subvenciones. </span></span></p> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">6.4 Si el procedimiento de concesión se paraliza por causa imputable al solicitante de la subvención, por la falta de cumplimiento de algún trámite preceptivo en el plazo otorgado al efecto, se le podrá declarar decaído en su derecho al trámite correspondiente, y la Dirección General de Deportes propondrá a la consejera de Asuntos Sociales y Deportes la resolución del procedimiento; no obstante, siempre que no afecte a terceros, se admitirá la actuación del interesado y producirá sus efectos legales, si se produjera antes o dentro del día en que se notifique la resolución en la que se tenga por transcurrido el plazo.</span></span></p> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">6.5 El director general de Deportes emitirá las propuestas de resolución de concesión o denegación de las ayudas, las cuales deben contener la relación de los beneficiarios propuestos por la Comisión Evaluadora para otorgar la subvención, así como las solicitudes excluidas con el motivo de la exclusión. La propuesta de resolución del Director General de Deportes contendrá todos los aspectos previstos en el artículo 16.4 del Decreto Legislativo 2/2005, de 28 de diciembre, por el que se aprueba el texto refundido de la Ley de Subvenciones y en el artículo 14 de la Orden de la consejera de Asuntos Sociales y Deportes de 12 de febrero de 2021por la que se establecen las bases reguladoras para conceder subvenciones en materia de deportes (BOIB nº 23, de 16 de febrero de 2021).</span></span></p> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">6.6 De acuerdo con el artículo 45.1.&nbsp;<em>b</em> de la Ley 39/2015, los actos a que se refiere el punto 2 anterior se notificarán a las personas interesadas mediante la publicación, durante el periodo en que esta convocatoria sea vigente, en la página web de la Dirección General de Deportes y la difusión en el tablón de anuncios de la Consejería de Asuntos Sociales y Deportes, para que, en el plazo de diez días hábiles, puedan alegar lo que consideren oportuno. En todo caso, se considera que la persona beneficiaria desiste de la propuesta de resolución si no manifiesta la aceptación en el plazo otorgado.</span></span></p> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">6.7 La resolución expresa de la consejera de Asuntos Sociales y Deportes pone fin al procedimiento de concesión de la subvención. Esta resolución contendrá los aspectos previsto en el artículo 14 de la Orden de la consejera de Asuntos Sociales y Deportes de 12 de febrero de 2021 por la que se establecen las bases reguladoras para conceder subvenciones en materia de deportes (BOIB nº 23, de 16 de febrero de 2021).</span></span></p> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">6.8 El plazo máximo para resolver el procedimiento y notificar las resoluciones es de 6 meses desde la finalización del período de presentación de las solicitudes.</span></span></p> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><strong>7. Comisión Evaluadora</strong></span></span></p> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">7.1 De conformidad con el artículo 12 de la Orden de la consejera de Asuntos Sociales y Deportes de 12 de febrero de 2021, se constituye la Comisión Evaluadora, compuesta por:</span></span></p> <ul> <li> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">Presidente: el jefe del Servicio de Planificación y Formación de la Dirección General de Deportes.</span></span></p> </li> <li> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">Secretaria: la jefa de la Sección VI de la Dirección General de Deportes.</span></span></p> </li> <li> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">Vocales: </span></span></p> <ul> <li><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">los jefes de Sección II e V de la Dirección General de Deportes.</span></span></li> <li><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">Una funcionaria técnica superior de la Dirección General de Deportes designada por el director General de Deportes.</span></span></li> </ul> </li> </ul> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">7.2 Las funciones de la Comisión Evaluadora son:</span></span></p> <ul> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">Examinar las solicitudes presentadas.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">Emitir el informe que debe servir de base para elaborar la propuesta de resolución que tiene que formular la Dirección General de Deportes.</span></span></p> </li> </ul> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">Las decisiones de esta Comisión se toman por mayoría simple y en caso de empate el presidente tiene voto de calidad.</span></span></p> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><strong>7.3 Comisión Técnica</strong></span></span></p> <p style="margin-left:40px"><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">7.3.1 Por criterios deportivos y técnicos, y de conformidad con el artículo 12.3 de la Orden de la consejera de Asuntos Sociales y Deportes de 12 de febrero de 2021, se constituye la Comisión Técnica, compuesta por tres técnicos de la Fundación para el Deporte Balear designados por el director General de Deportes a propuesta de la Gerencia de la mencionada Fundación.</span></span></p> <p style="margin-left:40px"><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">7.3.2 Las funciones de la Comisión Técnica son:</span></span></p> <ul style="margin-left:40px"> <li><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">Comprobación y control de las declaraciones responsables presentadas por los solicitantes.</span></span></li> <li><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">Evaluar las solicitudes presentadas, de acuerdo con los criterios de evaluación establecidos en el punto 8.</span></span></li> <li><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">Emitir el informe técnico que debe servir de base a la Comisión Evaluadora para el informe que servirá de base para elaborar la propuesta de resolución que formulará la Dirección General de Deportes.</span></span></li> </ul> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">7.4 Una vez examinadas las solicitudes, la Comisión Técnica confeccionará una lista provisional de deportistas admitidos y excluidos.</span></span></p> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><strong>8. Criterios y baremos para evaluar las solicitudes</strong></span></span></p> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">8.1 El procedimiento para conceder estas ayudas será el de distribuir o prorratear el importe global máximo destinado a la convocatoria entre los solicitantes que cumplan los requisitos para ser beneficiarios, de acuerdo con los criterios de valoración que fijan los apartados siguientes.</span></span></p> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">8.2 Los requisitos que deben cumplir los resultados presentados son los que se indican a continuación:</span></span></p> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><strong>Fecha de consecución de los resultados, número de resultados valorados </strong></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">a)&nbsp;Los resultados se deben haber conseguido en competiciones celebradas entre el 1 de enero y el 31 de diciembre de 2021, ambos incluidos. </span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">b)&nbsp;Excepcionalmente, pueden presentarse resultados vigentes de campeonatos del mundo, campeonatos de Europa, juegos olímpicos o paralímpicos, juegos del Mediterráneo o Universiada, celebrados entre el 1 de enero de 2019 y el 31 de diciembre de 2020, ambos incluidos.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">c)&nbsp;Los y les deportistas que presenten un certificado acreditando una lesión deportiva que les haya impedido participar en competiciones importantes durante el año 2021, pueden presentar los resultados deportivos no vigentes obtenidos entre el 1 de enero y el 31 de diciembre de 2020, que se evaluarán como resultados vigentes, teniendo en cuenta el coeficiente corrector en función del año en que se han conseguido. Al igual que el resto de deportistas, también podrán presentar otros resultados vigentes obtenidos desde el 1 de enero de 2019 </span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; Valor punto:</span></span></p> <p style="margin-left:40px"><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">Se utilizará un método repetitivo de aproximaciones sucesivas a la solución del valor punto, considerando las siguientes restricciones:</span></span></p> <ul style="margin-left:40px"> <li><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">El sumatorio de todas las ayudas no podrá superar el crédito disponible.</span></span></li> <li><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">El importe del valor punto se obtiene de dividir el importe de la convocatoria entre la suma total de los puntos obtenidos por todos los beneficiarios y no podrá superar los 200,00 euros.</span></span></li> <li><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">El importe de la ayuda será el resultado de multiplicar los puntos obtenidos por el valor del punto, redondeado el importe al centenamás cercano.</span></span></li> <li><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">En el caso de que el importe supere los 20.000,00€, la ayuda tendrá un máximo de 20.000,00€.</span></span></li> </ul> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><strong>9. Justificación de las actividades y pago de la subvención</strong></span></span></p> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">9.1 El pago de la ayuda se hará efectivo en una única entrega a partir de la fecha de la resolución de la consejera de Asuntos Sociales y Deportes que incluye la lista definitiva de los y las deportistas beneficiarios y los importes asignados a cada uno de ellos.</span></span></p> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">9.2 En estos pagos, la aplicación de las retenciones del IRPF se hará de acuerdo con lo dispuesto en la Ley y el Reglamento de impuesto sobre la renta de las personas físicas u otras normas que regulen esta materia.</span></span></p> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">9.3 La ayuda se justifica en el momento en que se cumplen los requisitos para ser beneficiario de ésta.</span></span></p> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><strong>10. Obligaciones de los beneficiarios</strong></span></span></p> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">Son obligaciones de los beneficiarios de las ayudas:</span></span></p> <ul> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">Comunicar, mediante un escrito dirigido a la consejera de Asuntos Sociales y Deportes, la aceptación o renuncia de la propuesta de resolución de la ayuda. En cualquier caso, la aceptación se entiende producida automáticamente si en el plazo de cinco días naturales desde que se notifique la propuesta de resolución no se hace constar lo contrario.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">Someterse a las actuaciones de comprobación y control que correspondan de las administraciones autonómica, estatal y comunitaria, la Sindicatura de Cuentas y otros órganos de control externo, y también facilitar toda la información que éstos les requieran con relación a las ayudas concedidas.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">Estar al corriente de las obligaciones tributarias o de cualquier naturaleza con el Estado, con la Seguridad Social y con la Comunidad Autónoma de las Illes Balears.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">Durante un periodo de un año que se contará desde la concesión de la ayuda, prestar su imagen y colaborar con la Consejería de Asuntos Sociales y Deportes para actuaciones oficiales y protocolarias así como para proyectos de promoción de la práctica deportiva, salud, prevención de drogodependencias e igualdad de género siempre que no interrumpa su asistencia a competiciones oficiales.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">Durante un periodo de un año que se contará desde la concesión de la ayuda, incorporar el logotipo de la marca “Esports IB Govern de les Illes Balears” o “Direcció General d'Esports” en la indumentaria de competición, siempre que la normativa específica del campeonato, club o selección con que participa lo permita.</span></span></p> </li> </ul> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><strong>11. Revocación</strong></span></span></p> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">Se revocará la concesión de la ayuda si, posteriormente a la concesión válida y ajustada a derecho, el beneficiario incumple totalmente o parcialmente las obligaciones o los compromisos contraídos a los que está condicionada la eficacia del acto de concesión.</span></span></p> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><strong>12. Reintegro</strong></span></span></p> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">12.1 Como consecuencia de la revocación se reintegrará total o parcialmente el importe de la ayuda obtenida y, si procede, la exigencia del interés de demora, en los casos siguientes:</span></span></p> <ol style="list-style-type:lower-alpha"> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">El incumplimiento de la finalidad para la que se concedió la ayuda.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">La obtención de la ayuda sin que se cumplan las condiciones requeridas para eso o la alteración de las condiciones tenidas en cuenta para concederlo, siempre que sea por causas imputables al deportista beneficiario.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">La negativa a someterse a las actuaciones de comprobación y control previstas legalmente o la obstrucción injustificada de estas actuaciones.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">Haber recibido sanción firme grave o muy grave en materia deportiva, sanción firme por dopaje o sanción penal firme por delitos relacionados con el dopaje, durante el año 2020.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">Otros supuestos establecidos en las bases reguladoras.</span></span></p> </li> </ol> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">12.2 Para el reintegro, se aplicará el procedimiento que determina a este efecto el artículo 44 del Decreto Legislativo 2/2005, de 28 de diciembre, por el que se aprueba el texto refundido de la Ley de Subvenciones.</span></span></p> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">12.3 Las cantidades reintegrables tienen la consideración de ingresos de derecho público y pueden ser exigidas por la vía de apremio.</span></span></p> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><strong>13. Régimen de infracciones y sanciones</strong></span></span></p> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">El incumplimiento de los requisitos que determina esta resolución da lugar a la aplicación del régimen de infracciones y sanciones establecidas legalmente.</span></span></p> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><strong>14. Inspección</strong></span></span></p> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">De acuerdo con lo dispuesto en esta convocatoria, las ayudas que concede la Consejería de Asuntos Sociales y Deportes se someterán a la inspección correspondiente según la normativa legal vigente que es aplicable.</span></span></p> <p><strong><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><span style="color:#000000">15.</span><span style="color:#000000"> </span><span style="color:#000000">Protección de datos.</span></span></span></strong></p> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">En caso de que el objeto de la subvención incluya el tratamiento de datos de carácter personal, los beneficiarios deben cumplir con la normativa correspondiente, adoptando e implementando las medidas de seguridad previstas por la Ley Orgánica 3/2018, de 5 de diciembre, de protección de datos personales y garantía de los derechos digitales.</span></span></p> <p>&nbsp;&nbsp;</p> <p style="margin-bottom:0px;
