    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;El apartado 9.3. de la Convocatoria de ayudas para el desarrollo rural de la isla de Mallorca, de fecha 13 de noviembre de 2020, vinculadas a proyectos relacionados con los ámbitos agrario y/o ambiental y enmarcados en la Estrategia de Desarrollo Local Participativo 2014 a 2020 de Mallorca, para el año 2020, especifica&amp;nbsp;&amp;nbsp;que la resolución se publicará con carácter informativo a los interesados mediante su publicación en el Boletín Oficial de las Illes Balears de acuerdo con los términos previstos en el artículo 45.2 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;Los expedientes han sido tramitados por el Fondo de Garantía Agraria y Pesquera de las Illes Balears (FOGAIBA) en cumplimiento de lo dispuesto en el artículo 43 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas .&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;El vicepresidente en Materia Agraria del FOGAIBA con fecha 29&amp;nbsp;de abril&amp;nbsp;de 2022, firmó la siguiente resolución,&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;Antecedentes&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;1.Con fecha de 19 de noviembre de 2020 se publicó en el BOIB núm. 197, el anuncio de la publicación del Acuerdo de la Junta Directiva de la Asociación Mallorca Rural Grupo de Acción Local de Mallorca aprobando la Convocatoria, para el año 2020, de ayudas al desarrollo rural de la isla de Mallorca, vinculadas a proyectos relacionados con los ámbitos agrario y/o ambiental y enmarcados en la Estrategia de Desarrollo Local Participativo 2014-2020 de Mallorca.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2.De conformidad con el apartado sexto de la mencionada convocatoria, el plazo de presentación de solicitudes de treinta días naturales terminó el día &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;21/12/2020 y tuvieron entrada en el Registro del Grupo de Acción Local, Asociación Mallorca Rural un total de 69 solicitudes de ayuda.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;3.Con fecha 8 de abril de 2022&lt;/em&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;&lt;em&gt;se &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;public&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;ó&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;en la web del Fogaiba &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;dos&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;notificaciones de deficiencias donde se emplazaba a los interesados a enmendar sus expedientes en el plazo de diez días.&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;El 19 de abril de 2022 el Grup d&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;'&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;Ornitolog&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;i&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;a &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;i&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;Defensa de la Naturale&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;ss&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;a presentó un documento en el que pide el desistimiento de su solicitud.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;4.Dado todo ello, se propone el desistimiento de las ayudas a los beneficiarios que se indican en el anexo de esta resolución.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;Fundamentos de derecho&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;VI. Orden del Consell&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;er de Agricultura, Medio Ambiente y Territorio de 19 de febrero de 2015, por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco del Programa de Desarrollo Rural de las I&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;l&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;l&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;es Balears 2014-2020.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;VII. Ley 12/2014, de 16 de diciembre, agraria de las Islas Baleares.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;VIII. Decreto 65/2007, de 25 de mayo, de constitución, organización y funcionamiento del Organismo Pagador de los gastos del Fondo Europeo Agrícola de Garantía (FEAGA) y del Fondo Europeo Agrícola de Desarrollo Rural (FEADER), en la Comunidad Autónoma de las Il&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;l&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;e&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;s Balears BOIB núm. 082 de 2007; en virtud de la Orden de la Conse&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;ll&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;era de Agricultura y pesca de 23 de diciembre de 2005, por la que se dispone la asunción de la ejecución de la política de mejora y fomento de los sectores agrario y pesquero por parte del Fondo de garantía Agraria y Pesquera de las I&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;l&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;l&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;e&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;s Balears, establece en el artículo 1 que el FOGAIBA asume la ejecución de la política de la Conse&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;llería de Agricultura y Pesca referente a la aplicación de las medidas de fomento y mejora de los sectores agrario y pesquero , a partir del 1 de enero de 2006.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;IX. Ley 30/1992, de 26 de noviembre de régimen jurídico de las administraciones públicas y del procedimiento administrativo común&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;Propuesta de resolución de desistimiento&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Por todo ello, se informa favorablemente y se propone al vicepresidente en materia agraria del FOGAIBA que dicte una resolució&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;n en los siguientes t&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;érminos:&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;1.Dar por desistida&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;la solicitud presentada por los interesados relacionados en el anexo I, que son un total de &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;1&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;expediente de la l&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;í&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;nea de ayudas al &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;D&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;esarrollo rural de la isla de Mallorca, vinculadas a proyectos relacionados con los &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;á&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;mbitos agrario y/o ambiental y enmarcados en la Estrategia de Desarrollo Local Participativo 2014-2020 de Mallorca, que comienza con &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;GRUP BALEAR D'ORNITOLOGIA I DEFENSA DE LA NATURALESSA&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;&lt;em&gt;y termina con &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;GRUP BALEAR D'ORNITOLOGIA I DEFENSA DE LA NATURALESSA&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;&lt;em&gt;por los motivos descritos en el anexo&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;mencionado.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2.Declarar concluido el procedimiento y archivar los expedientes relacionados en el anexo I.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;3. Notificar esta resolució&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;n mediante la publicaci&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;ó&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;n en el Bolet&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;í&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;n Oficial de las I&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;l&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;l&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;es Balears.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Interposición de recursos&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Contra esta resolución, que no agota la vía administrativa, podrá interponerse recurso de alzada ante la consellera de Agricultura, Pesca y Alimentación en el plazo de un mes, a contar desde el día siguiente de la notificación de la resolución, de acuerdo con el artículo 58.4 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la comunidad autónoma de las Islas Baleares, y los artículos 121 y 122 de la Ley 39/2015, del 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
