    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;Se publica el convenio que sigue, formalizado el 25 de abril de 2022, de conformidad con aquello que dispone el artículo 11.3 b) de la ley 40/2015, de 1 de octubre, de régimen jurídico del sector público:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;Convenio que regula la encomienda de gestión del Consejo Insular de Mallorca a la Cámara de Comercio, Industria, Servicios y Navegación de Mallorca para asistir a la feria internacional de vinos Prowein Düsseldorf 2022.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;PARTES&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;El Sr. Jaume Alzamora Riera, consejero ejecutivo de Promoción Económica y Desarrollo Local del Consejo de Mallorca, con domicilio en la calle General Riera, nº. 111, Palma, CP 07010, en virtud de las competencias atribuidas por el artículo 1 letra d) del vigente Decreto de organización del Consejo de Mallorca, de día 9 de diciembre de 2019.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;Y de la otra, el Sr. Antoni Mercant Morató, presidente de la Cámara de Comercio, Industria, Servicios y Navegación de Mallorca, de ahora en adelante la Cámara, con domicilio en la calle Estudio General nº. 7, Palma, CP 07001, que actúa en representación de esta institución, de conformidad con el nombramiento otorgado por el Plenario, en sesión de fecha 25 de junio de 2018, según el artículo 12 de la Ley 4/2014, Básica de las Cámaras Oficiales de Comercio, Industria, Servicios y Navegación y el artículo 15 de la Ley 1/2017, de las Cámaras Oficiales de Comercio, Industria, Servicios y Navegación de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;ANTECEDENTES&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;1. El día 6 de abril de 2022, el director insular de Promoción Económica y Producto de Mallorca emitió informe justificativo sobre la necesidad y la idoneidad de aprobar una encomienda de gestión a la Cámara de Comercio, Industria, Servicios y Navegación de Mallorca que se regulará mediante un convenio para asistir a la Feria internacional de vinos Prowein Dusseldorf 2022, en el ejercicio de un interés público conjunto de promover el sector vinícola de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;2.La Dirección Insular de Promoción Económica y Producto de Mallorca, de acuerdo en lo previsto en el artículo 7.4 de la Ley 7/1985, de 2 de abril, reguladora de las Bases del Régimen Local, que establece que las entidades locales únicamente podrán ejercer competencias distintas de las propias y de las atribuidas por delegación cuando no se pongan en riesgo la sostenibilidad financiera del conjunto de la hacienda municipal, de acuerdo con los requerimientos de la legislación de estabilidad presupuestaria y sostenibilidad financiera y no se incurra en un supuesto de ejecución simultánea del mismo servicio público con otra administración pública. A estos efectos, serán necesarios y vinculantes los informes previos de la Administración competente por razón de materia, en el que se determine la inexistencia de duplicidades, y de la Administración que tenga atribuida la tutela financiera sobre la sostenibilidad financiera de las nuevas competencias. Por este motivo, se solicitaron los informes mencionados.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;De acuerdo con el precepto anterior, se han emitido los informes favorables vinculantes y previos de la administración competente en razón de la materia que establece la inexistencia de duplicidades y el de la Administración que tiene atribuida la tutela financiera sobre la sostenibilidad financiera de la nueva competencia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;3. La Cámara es una corporación de derecho público que se configura, como órgano consultivo y de colaboración con las administraciones públicas y tiene, entre otras, las funciones públicas administrativas siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;-Asistir a las administraciones públicas de las Illes Balears en el desarrollo de programas de mejora de la competitividad empresarial de las islas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;-Colaborar con las administraciones públicas en la representación de los intereses económicos generales de las Islas Baleares en el exterior, así como en la acción exterior comercial.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;-Promover y cooperar en la organización de ferias y exposiciones&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;-Cualquier otra función que el ordenamiento jurídico les pueda atribuir, así como también, aquellas que pueda asumir mediante los instrumentos previstos en el ordenamiento mencionado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;3. El Departamento de Promoción Económica y Desarrollo Local no dispone de los medios técnicos y personales suficientes para poder asistir a la Feria Prowein Düsseldorf 2022.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;4. La Cámara tiene una amplia experiencia en la organización y asistencia a ferias internacionales. Desde hace más de 30 años, la Cámara acompaña las empresas a las ferias más destacadas de los sectores productivos más representativos del tejido mallorquín, como por ejemplo: calzado, turismo, alimentación (vinos), diseño, entre otros, circunstancia que ha permitido a la Cámara convertirse en una entidad de referencia en internacionalización.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;Por todo lo que se ha expuesto y de acuerdo con el citado informe justificativo, el Consejo Insular de Mallorca, mediante el Departamento de Promoción Económica y Desarrollo Local quiere establecer una línea de actuación conjunta para cumplir un interés general de promover el sector vinícola de Mallorca en el exterior, mediante la encomienda de gestión a la Cámara que se regulará con el presente Convenio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;Ambas partes se reconocen mutuamente la capacidad legal necesaria para formalizar este convenio, de acuerdo con las siguientes&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;CLÁUSULAS&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;PRIMERA. OBJETO&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;El objeto de este convenio es establecer y regular el contenido de la encomienda de gestión para asistir a la Feria Prowein, del 15 al 17 de mayo de 2022 en Dusseldorf, en cumplimiento de un interés general conjunto para la promoción del sector vinícola de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;SEGUNDA. RESPONSABLE DEL ENCOMIENDA DE GESTIÓN.&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;El responsable de la encomienda de gestión es el director insular de Promoción Económica y Producto de Mallorca, el señor Joan Font Massot.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;Como responsable, adoptará las decisiones y dará las instrucciones necesarias con el objetivo de asegurar la correcta realización de las prestaciones pactadas, también le corresponde aprobar la justificación de la encomienda de gestión.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;TERCERA. OBLIGACIONES DE LA CÁMARA&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;Son obligaciones de la Cámara:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;a) Ejecutar la encomienda de gestión en los términos que prevé este Convenio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;b) Adecuar la superficie asignada por la organización de la Feria de vinos Prowein Düsseldorf 2022 para el correcto desarrollo de la actividad, con el mobiliario y material adecuado y suficiente, así como, coordinar la ubicación de los representantes de las entidades colaboradoras/participativas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;c) Gestionar la contratación de los servicios y suministros, de acuerdo con las normas y condiciones de los organizadores de la Feria Prowein y en los términos establecidos por la Dirección Insular de Promoción Económica y Producto de Mallorca, en el presente convenio:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:80px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;-Alquiler de:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul style="margin-left:80px"&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;Almacén adjunto&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;Mobiliario siguiente: 6 expositores, 1 mesa redonda para reuniones, 9 sillas, 1 colgador de abrigos y 1 estantería de interior.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;Material siguiente: 1 nevera, copas de vino (mínimo 15 por empresa), cubiteras (1 por empresa) y escupideras (1 por empresa).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;Servicio de limpieza.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;-Impresión y colocación de imagen del stand.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;-Compra de suplementos necesarios para el servicio: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul style="margin-left:80px"&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;Hielo, servilletas&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;Pases extras expositores.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p style="margin-left:80px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;-Servicios técnicos: aumento potencia eléctrica del stand.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;d) Gestionar y asumir todos los pagos derivados de esta encomienda, que incluye los días 15,16 y 17 de mayo y las actividades anteriores y posteriores que se realicen.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;e) Cumplir con las Condiciones de participación establecidas en el siguiente enlace:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;g) Gestionar el envío y la recepción de las mercancías.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;h) Reuniones de seguimiento con el Consejo Insular de Mallorca y las empresas participantes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;i) Apoyo en el montaje del stand y responsabilizarse del desmontaje, así como, supervisar que se cumplen todos los requerimientos y condiciones de los organizadores de la Feria de vinos Prowein Düsseldorf 2022.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;j) Gestionar la agenda de los representantes del Consejo de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;k) Presentar, una vez realizada la Feria, una memoria explicativa de la Feria, adjuntando fotografías, entre otra documentación que se considere adecuada, con el contenido mínimo detallado en la cláusula novena del presente convenio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;CUARTA. OBLIGACIONES DEL CONSEJO DE MALLORCA&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;Son obligaciones del Consejo de Mallorca:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;a) Facilitar las instrucciones y criterios para el desarrollo de las actuaciones objeto de esta encomienda de gestión.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;b) Destinar personal propio y/o directivo y coordinar la tarea de estas personas con el personal de la Cámara.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;c) Poner a disposición de la Cámara la red de contactos con las bodegas participantes para facilitar la tarea de coordinación y comunicación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;d) Poner a disposición del proyecto los recursos en materia de logotipos institucionales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;e) Poner a disposición del proyecto la red de contactos con las entidades públicas y privadas que tengan que participar en la gestión, la coordinación y la ejecución del proyecto.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;f) Coordinar las relaciones entre todas las administraciones implicadas, la Cámara y las entidades participantes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;g) Hacer el seguimiento y evaluación de esta encomienda de gestión.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;h) Satisfacer el importe económico previa justificación con un máximo de 30.000,00€, IVA incluido.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;El Consejo de Mallorca y la Cámara se comprometen a colaborar en todo momento de acuerdo con los principios de buena fe y eficacia en la ejecución de esta encomienda de gestión en los términos acordados.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;QUINTA. ABONO DE LOS COSTES Y FINANCIACIÓN&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;El Consejo de Mallorca abonará a la Cámara en concepto de cobertura de los costes para las actividades realizadas un total máximo de 30.000,00€, IVA incluido.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;Este gasto se financiará con cargo a la aplicación presupuestaria 65.43110.22706 Estudios y Trabajos Técnicos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;El pago de esta compensación se hará una vez realizadas las tareas descritas objeto de la encomienda mediante una única factura.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;SEXTA. CONFIDENCIALIDAD Y PROTECCIÓN DE DATOS&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;En la ejecución del presente Convenio se respetará la normativa vigente en materia de protección de datos de carácter personal. En particular, se respetarán las obligaciones de la Ley orgánica 3/2018, de 5 de diciembre, de protección de datos personales y garantizaba de los derechos digitales, relativas al consentimiento para el tratamiento y la cesión de los citados datos en las partes implicadas. Asimismo, se respetará lo que se dispone en el Real decreto 1720/2007, de 21 de diciembre, por el cual se aprueba el Reglamento de desarrollo de la mencionada Ley orgánica.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;SÉPTIMA. MODIFICACIÓN&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;La alteración o modificación del presente convenio o de la encomienda objeto del convenio requerirá el acuerdo expreso de las partes firmantes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;OCTAVA. VIGENCIA, PRÓRROGAS Y CAUSAS DE RESOLUCIÓN&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;Este Convenio entra en vigor al día siguiente de la publicación en el BOIB y tiene una duración de dos meses desde la fecha de finalización de la feria que es el 17 de mayo de 2022.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;Se podrá prorrogar en la forma y términos previstos en el artículo 49 de la Ley 40/2015 de 1 de octubre, de Régimen Jurídico del Sector Público.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;El convenio se extinguirá al finalizar su vigencia y se podrá resolver por mutuo acuerdo de las partes, que se deberá de formalizar por escrito. Son causas de resolución las previstas en el artículo 51 de la Ley 40/2015, de 1 de octubre, de régimen jurídico del sector público.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;NOVENA. MECANISMOS DE SEGUIMIENTO Y DE EVALUACIÓN&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;Las partes, una vez finalizada la feria, celebrarán una reunión con los representantes del Consejo de Mallorca, representantes de la Cámara, y con los representantes de las cinco bodegas, con la siguiente finalidad:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;1. Evaluar la memoria realizada y redactada por la Cámara, que tendrá, como mínimo el siguiente contenido:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;- Memoria descriptiva de las actuaciones y actividades que se han desarrollado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;- Descripción de la agenda que se ha llevado a cabo, adjuntando fotografías...&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;- Objetivos alcanzados.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;- Calendario de ejecución.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;- Impacto de la Feria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;2. Velar para que se haya desarrollado y ejecutado correctamente esta encomienda de gestión, en los términos acordados.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;DÉCIMA. RÉGIMEN JURÍDICO.&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;Este Convenio tiene naturaleza administrativa y queda excluido de la Ley 9/2017, de 8 de noviembre, de Contratos del Sector Público, conforme a lo previsto en su artículo 6. Este Convenio se rige por sus cláusulas; por la Ley 40/2015, de Régimen Jurídico del Sector Público; por la normativa sectorial correspondiente; así como por las normas generales de derecho administrativo, los principios de buena administración y el ordenamiento jurídico en general.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;Esta encomienda de gestión no comporta la alteración de la titularidad de la competencia ni de los elementos sustantivos de su ejercicio, atribuida en todo caso a la entidad excomandante que tiene que dictar los actos o las resoluciones de carácter jurídico que den apoyo a la encomienda de gestión y a las actuaciones que se derivan.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;Las partes se comprometen a resolver de forma amistosa en un primer momento mediante las reuniones del equipo de trabajo las posibles controversias que se puedan originar en la interpretación o la aplicación de este Convenio. Si esto no es posible, atendiendo a la naturaleza jurídico administrativa de las cuestiones litigiosas que se puedan plantear, éstas quedarán sometidas al orden jurisdiccional contencioso administrativo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
