text/html es CAIB ![CDATA[<p><span style="font-family:Times New Roman,Times,serif; font-size:12px">La situación de emergencia sanitaria iniciada el año 2020 impactó de manera muy significativa la actividad turística. Si bien el desarrollo de las diferentes vacunas ha contribuido a mejorar la situación a lo largo de 2021, el Gobierno de las Illes Balears es consciente de que la situación en el sector turístico, que sufrió restricciones importantes, no recuperó la normalidad, sobre todo durante el primer semestre, y sufrió el efecto de la sexta ola a final de ejercicio. </span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">El artículo 14.3 del Decreto 35/2016, de 23 de junio, por el que se desarrolla la Ley del impuesto sobre estancias turísticas y de medidas de impulso del turismo sostenible, dispone que cuando circunstancias excepcionales que incidan gravemente en el sector o en una parte substancial de este, afecten al desarrollo de la actividad turística de alojamiento, la consejera de Hacienda y Administraciones Públicas (actualmente, de Hacienda y Relaciones Exteriores), puede aprobar, mediante una orden, la reducción de los signos, índices o módulos que sean procedentes, para aquellos establecimientos que opten por el régimen de estimación objetiva.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">A su vez, el artículo 34 de la Ley 2/2020, de 15 de octubre, de medidas urgentes y extraordinarias para el impulso de la actividad económica y la simplificación administrativa en el ámbito de las administraciones públicas de las Illes Balears para paliar los efectos de la crisis ocasionada por la COVID-19, ha concretado los trámites que han de llevarse a cabo para elaborar y aprobar esta peculiar orden y que son los siguientes: </span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em>a)</em> Resolución de la consejera de Hacienda y Relaciones Exteriores de inicio del procedimiento de elaboración, que tiene que ordenar la elaboración de un anteproyecto de orden a cargo de la Secretaría General de la Consejería, con la colaboración de la Dirección General de Financiación y de la Agencia Tributaria de las Illes Balears. </span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em>b)</em> Audiencia a los interesados por medio de la Confederación de Asociaciones Empresariales de Baleares (CAEB) y de la Confederación de la Pequeña y Mediana Empresa de Baleares (PIMEB), por un plazo de siete días hábiles.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em>c) </em>Audiencia a las consejerías del Gobierno de las Illes Balears, por un plazo de siete días hábiles. </span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em>d) </em>Informe de la Dirección de la Agencia Tributaria de las Illes Balears, que se tiene que pronunciar, como mínimo, sobre el impacto económico del anteproyecto.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em>e)</em> Informe de la Secretaría General de la Consejería de Hacienda y Relaciones Exteriores, que se tiene que pronunciar sobre la corrección del procedimiento seguido, tiene que valorar sucintamente las alegaciones presentadas, en coordinación con la Dirección General de Financiación y la Agencia Tributaria de las Illes Balears, y tiene que proponer a la consejera de Hacienda y Relaciones Exteriores el proyecto de orden correspondiente.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">De acuerdo con este mandato del legislador, se ha elaborado esta Orden por la que se modifican, para el ejercicio fiscal 2021, determinados signos, índices o módulos del anexo 1 del citado Decreto 35/2016. Así, por un lado, y por lo que al número previo de días de estancia anual por unidad se refiere, se reducen estos días en función del descenso de la ocupación (por categoría e isla); por otro lado, y por lo que al índice de desestacionalización se refiere, se reduce un 35 % el número de días en que un establecimiento ha de estar abierto al público para poder aplicar los correspondientes índices, con la finalidad de considerar el esfuerzo inherente al hecho de mantener los establecimientos abiertos el mayor número de días posible. </span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">El artículo 49 de la Ley 1/2019, de 31 de enero, del Gobierno de las Illes Balears, relativo a los principios de buena regulación, prevé que el preámbulo de las normas reglamentarias han de informar sobre la adecuación a los principios de buena regulación.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Pues bien, en cumplimiento de esta norma, lo cierto es que la necesidad de esta Orden viene determinada por la grave situación sufrida por el sector turístico, que comenzó en año 2020 y que se prolonga a lo largo del 2021 como consecuencia de la COVID-19, lo que obliga a la Administración a aprobar, también para el ejercicio 2021, mecanismos para paliar los efectos negativos de esta pandemia en relación con la tributación mediante el régimen de estimación objetiva en el impuesto sobre las estancias turísticas en las Illes Balears, y por el mismo Decreto 35/2016 antes citado, cuyo artículo 14.3 prevé expresamente como ya se ha dicho la reducción de los signos, índices o módulos por razón de la eventual concurrencia de circunstancias excepcionales en la actividad de comercialización de establecimientos turísticos mediante la aprobación de una orden específica de la consejera de Hacienda y Relaciones Exteriores. Asimismo, la reducción de los signos, índices o módulos propios del régimen de estimación objetiva de este impuesto supone una respuesta proporcional, eficaz y eficiente a la reducción de la actividad empresarial en este sector, ya que tiene en cuenta la realidad económica y social del ejercicio 2021, en el que se advertía ya una recuperación del sector. Por su parte, la adecuación a los principios de seguridad jurídica y de transparencia se justifican en el procedimiento tramitado para la aprobación de la Orden, que prevé la audiencia a los sectores afectados y los informes de los órganos competentes. Finalmente, esta orden se adecúa también a los principios de calidad y de simplificación, en la medida que modifica únicamente los elementos imprescindibles para adaptar la tributación del régimen de estimación objetiva de este impuesto a las circunstancias excepcionales provocadas por la crisis de la COVID-19.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Por todo ello, y en uso de las atribuciones que me confiere el artículo 46.2 de la Ley 1/2019, dicto la siguiente</span></p> <p style="text-align:center"> </p> <p style="text-align:center"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>ORDEN</strong></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Artículo 1</strong></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Objeto </strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Esta Orden tiene por objeto la reducción, para el ejercicio fiscal 2021, de determinados signos, índices o módulos aplicables en el régimen de estimación objetiva del impuesto sobre estancias turísticas en las Illes Balears, de acuerdo con el artículo 34 de la Ley 2/2020, de 15 de octubre, de medidas urgentes y extraordinarias para el impulso de la actividad económica y la simplificación administrativa en el ámbito de las administraciones públicas de las Illes Balears para paliar los efectos de la crisis ocasionada por la COVID-19, y del artículo 14.3 del Decreto 35/2016, de 23 de junio, por el que se desarrolla la Ley del impuesto sobre estancias turísticas y de medidas de impulso del turismo sostenible.</span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Artículo 2</strong></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Reducción, para el ejercicio 2021, de determinados signos, índices o módulos del anexo 1 del Decreto 35/2016, de 23 de junio, por el que se desarrolla la Ley del impuesto sobre estancias turísticas y de medidas de impulso del turismo sostenible</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1<strong>. </strong>El índice de desestacionalización de la letra <em>b)</em> de la regla 2ª del punto 1 del anexo 1 del Decreto 35/2016, de 23 de junio, por el que se desarrolla la Ley del impuesto sobre estancias turísticas y de medidas de impulso del turismo sostenible, aplicable en el ejercicio fiscal de 2021, es el siguiente: &nbsp;</span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em>b)</em> Índice de desestacionalización</span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Sobre el resultado de aplicar el índice de temporada que proceda en cada caso se aplicará un índice de desestacionalización del 0,9 cuando el número de días en los que se desarrolle la actividad, continuos o alternos, supere durante el ejercicio fiscal los siguientes umbrales para cada una de las islas: </span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1º. Establecimientos ubicados en la isla de Mallorca: más de 179 días.</span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2º. Establecimientos ubicados en la isla de Ibiza: más de 120 días.</span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3º. Establecimientos ubicados en la isla de Formentera: más de 99 días</span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">4º. Establecimientos ubicados en la isla de Menorca: más de 79 días.</span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Se aplicará un índice de desestacionalización del 0,8 cuando el número de días en los que se desarrolle la actividad, continuos o alternos, supere durante el ejercicio fiscal los siguientes umbrales para cada una de las islas:</span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1º. Establecimientos ubicados en la isla de Mallorca: más de 198 días.</span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2º. Establecimientos ubicados en la isla de Ibiza: más de 139 días.</span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3º. Establecimientos ubicados en la isla de Formentera: más de 119 días</span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">4º.
