&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;Los expedientes&amp;nbsp;han sido&amp;nbsp;tramitados&amp;nbsp;por el Fondo&amp;nbsp;de Garantía Agraria&amp;nbsp;y Pesquera de&amp;nbsp;las&amp;nbsp;Islas Baleares&amp;nbsp;(FOGAIBA) en cumplimiento de lo&amp;nbsp;dispuesto en el artículo&amp;nbsp;43&amp;nbsp;de&amp;nbsp;la Ley&amp;nbsp;39/2015, de 1 de octubre, del procedimiento administrativo común de las&amp;nbsp;administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;El vicepresidente&amp;nbsp;en Materia Agraria&amp;nbsp;del FOGAIBA, con fecha 7&amp;nbsp;de abril&amp;nbsp;de 2022, firmó la siguiente resolución, &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;em&gt;Antecedentes&lt;/em&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;1.Resolución de&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;&lt;em&gt;l&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;a&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;President&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;a&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) por la que se convocan, para &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;e&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;l año 20&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;21, subvenciones para inversiones en la transformación y comercialización de productos agrícolas.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2. De conformidad con el apartado sexto de la citada Resolución, el plazo de presentación de solicitudes terminó el dí&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;a &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;15/&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;0&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;7&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;/20&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;2&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;1, y tuvieron entrada en el Registro del Fondo de Garantía Agraria y Pesquera de las Islas Baleares un total de &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;54&amp;nbsp;solicitudes de ayuda.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;3. Los órganos gestores del Servicio de Ayudas al Desarrollo Rural han llevado a cabo el control administrativo de las solicitudes y de la documentación aportada de acuerdo con las normas reguladoras de esta ayuda.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;4. Una vez evaluadas las solicitudes de ayuda por los órganos gestores, y de acuerdo con los criterios de elegibilidad establecidos, los interesados señalados en el Anexo I adjunto no cumplen con alguno de los requisitos previstos en la convocatoria para poder ser beneficiarios de la ayuda, por los motivos indicados en el citado anexo. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;5. En fecha 16 de junio de 2020 el Servicio de Ayudas al Desarrollo Rural ha emitido informe desfavorable y propuesta provisional de denegación de la ayuda a los interesados relacionados en el Anexo I. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;6. En fecha 21 de febrero de 2022 se notifica, mediante publicación en la página web http://www.caib.es, la citada propuesta provisional a los interesados, concediéndoles un plazo de 10 días para presentar las alegaciones oportunos. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;7. Los interesados relacionados en el Anexo I adjunto no han presentado alegaciones o se han desestimado, tal y como se detalla en el Anexo I.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;3.Real decreto 887/2006, de 21 de julio, por el que se aprueba el Reglamento de la Ley 38/2003, de 17 de noviembre, general de subvenciones. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;4.Decreto legislativo 2/2005, de 28 de diciembre, por el que se aprueba el texto refundido de la Ley de Subvenciones. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;5.Programa de Desarrollo Rural de las Islas Baleares 2014-2020.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;6..Ley 39/2015, de 1 de octubre del procedimiento administrativo común de las administracione&lt;/em&gt;s públicas.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;Propuesta de resolución de desistimiento&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;Por todo ello, se informa desfavorablemente y propongo al vicepresidente del FOGAIBA que dicte una resolución en los siguientes términos:&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;1.&lt;em&gt;Denegar la ayuda solicitada por los interesados que figuran en el Anexo I, que son un total de 3 expedientes y que comienza con BINIGARBA QUESOS SL y termina con ALCAIDUS SL, relativa a la línea de ayudas “Transformación y comercialización de productos agrícolas 2021 ” , por no cumplir con alguno de los requisitos que se establecen en la convocatoria y que se especifican en el mencionado anexo.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;2.Declarar concluido el procedimiento y proceder al archivo de los expedientes relacionados en el &lt;/em&gt;&lt;em&gt;Anexo I.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;3.Notificar la resolución a cada uno de los &lt;/em&gt;&lt;em&gt;interesados del Anexo I.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;Interposición de recursos&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;Contra esta resolución, que no agota la vía administrativa, podrá interponerse recurso de alzada ante el consell&lt;/em&gt;&lt;em&gt;er&amp;nbsp;de Medio Ambiente, Agricultura y Pesca, en el plazo de un mes, a contar desde el día siguiente de la notificación de la resolución, de acuerdo con el artículo 58.4 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la comunidad autónoma de las Islas Baleares, y los artículos 121 y 122 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

En el presente caso, en fecha 15/07/2021 el interesado presentó la solicitud de ayuda en el registro, y el plazo de presentación finalizaba ese mismo día, por tanto, y tal y como establece el artículo, la solicitud de ayuda se hubiera presentado fuera del plazo estipulado en la convocatoria, puesto que «se considerará como fecha de presentación de la solicitud aquella en la que haya sido realizada la enmienda». Este extremo también regulado en el artículo 14.1 del Real Decreto 203/2021 antes citado. &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

			&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:10px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;(El artículo 68.4 de la ley no establece en la administración un plazo para llevar a cabo el requerimiento para la subsanación de la deficiencia. De todos modos, en este caso, la presentación de la solicitud por vía telemática habría sido extemporáneo).&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
