    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;ANTECEDENTES&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;1. Por resolución de 26 de enero de 2022 de la Dirección de la Oficina de Prevención y Lucha contra la Corrupción en las Islas Baleares (Oficina en adelante), se convocó concurso específico para la provisión de puestos de trabajo (convocatoria de provisión núm. CO 1/2022). La resolución mencionada se publicó en el BOIB núm. 15, de 29 de enero de 2022 y en el BOE núm. 32, de 7 de febrero de 2022.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;2. El día 28 de febrero de 2022 finalizó el plazo previsto en la anterior Resolución para presentar las solicitudes de participación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;3. En fecha 25 de marzo de 2022 se publicó en la página web https://www. oaib.es&lt;/span&gt;&lt;span style="color:#0563c1"&gt;&lt;u&gt;&lt;span style="line-height:107%"&gt;,&lt;/span&gt;&lt;/u&gt;&lt;/span&gt;&lt;span style="line-height:107%"&gt; las listas provisionales de admitidos y excluidos y se concedió un plazo de diez días hábiles a contar desde el día siguiente de la publicación, para subsanar las deficiencias detectadas y aportar los documentos preceptivos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;4. En el plazo mencionado no se ha recibido ninguna alegación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;5. En fecha 11 de abril de 2022 el Sr. Josep Mateu Sbert presentó la renuncia a la participación en la convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;FUNDAMENTOS DE DERECHO&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;1.&lt;/span&gt;&lt;/strong&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif; line-height:107%"&gt; El artículo 22.5 de la Ley 16/2016, de 9 de diciembre, de creación de la Oficina, establece que el personal al servicio de la Oficina se regirá por lo que dispone esta ley y el Reglamento de Régimen Interior de la Oficina. En todo lo no previsto, le es aplicable supletoriamente la legislación sobre función pública del personal al servicio de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;2.&lt;/span&gt;&lt;/strong&gt;&lt;span style="line-height:107%"&gt; El artículo 63 del Reglamento de Funcionamiento y Régimen Interior de la Oficina, aprobado por la Comisión de Asuntos Institucionales y Generales en sesión ordinaria de 21 de noviembre de 2018 (BOIB núm. 156, de 13 de diciembre de 2018) dispone que el personal al servicio de la Oficina se rige por lo preceptuado en la Ley 16/2016, de 9 de diciembre, de creación de la Oficina y por este Reglamento y, en lo no previsto, le será aplicable el régimen establecido a todos los efectos para el personal al servicio de la Sindicatura de Cuentas de las Illes Balears. La Ley de la función de las Islas Baleares y el Estatuto básico del empleado público se aplicarán supletoriamente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;3.&lt;/span&gt;&lt;/strong&gt;&lt;span style="line-height:107%"&gt; El artículo 66 del mismo Reglamento indica en su apartado 2 que los puestos de trabajo adscritos a personal funcionario se tienen que proveer por el sistema de concurso o libre designación, en el mismo sentido se establece en el artículo 75.1 y 2 (sistemas de provisión) de la Ley 3/2007, de 22 de febrero, de la función pública de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;4.&lt;/span&gt;&lt;/strong&gt;&lt;span style="line-height:107%"&gt; El Reglamento de provisión de puestos de trabajo y promoción profesional de los funcionarios al servicio de la Comunidad Autónoma de las Illes Balears, aprobado por el Decreto 33/1994, de 28 de marzo, dedica el capítulo II a regular el procedimiento a seguir para proveer los puestos de trabajo por el sistema de concurso de méritos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;5.&lt;/span&gt;&lt;/strong&gt;&lt;span style="line-height:107%"&gt; El artículo 22.3 de la Ley 16/2016, de 9 de diciembre, indica que corresponde a la Dirección de la Oficina establecer las bases y sistema de provisión de los puestos de trabajo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;6.&lt;/span&gt;&lt;/strong&gt;&lt;span style="line-height:107%"&gt; El apartado 6.4 de las bases establecen que una vez finalizado el plazo para la presentación de alegaciones contra la resolución provisional de admitidos y excluidos, la dirección de la Oficina debe dictar una resolución por la cual apruebe la lista definitiva de personas admitidas y excluidos del concurso o de alguna de las plazas convocadas, con expresión de las causas de exclusión. Dicha resolución debe publicarse en la página web de la Oficina (https://www. oaib.es) y en el Boletín Oficial de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;Por todo esto y de acuerdo con la base sexta de la convocatoria,&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;RESUELVO&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;1.&lt;/span&gt;&lt;/strong&gt;&lt;span style="line-height:107%"&gt; Aprobar la lista definitiva de las personas admitidas en el concurso en los términos que establece el anexo 1 de esta Resolución.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;2&lt;/span&gt;&lt;/strong&gt;&lt;span style="line-height:107%"&gt;. Aprobar la lista definitiva de personas excluidas del concurso o de algunos de los puestos convocados, en los términos que establece el anexo 2 de esta Resolución.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;3&lt;/span&gt;&lt;/strong&gt;&lt;span style="line-height:107%"&gt;. Publicar esta Resolución en la página web https://www. oaib.es&lt;/span&gt; &lt;span style="margin-bottom:8pt; margin-top:0cm"&gt;y en el Boletín Oficial de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="margin-bottom:8pt; margin-top:0cm"&gt;INTERPOSICIÓN DE RECURSOS&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;Contra esta Resolución, que agota la vía administrativa, se puede interponer un recurso potestativo de reposición ante la dirección de la Oficina en el plazo de un mes a contar desde el día siguiente de la publicación, de acuerdo con el artículo 124 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;También se puede interponer directamente un recurso contencioso administrativo ante el Juzgado de lo Contencioso Administrativo en el plazo de dos meses contadores desde el día siguiente de la publicación, de acuerdo con el artículo 46 de la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contencioso-administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
